In undertaking historical inquiry in the field of federal courts, one must be careful about assigning certain data points from the Founding period determinative weight, rather than treating them as part of a larger conversation about the role of the judicial power in our constitutional framework. This is because in studying the early years following ratification of the Constitution, one tends to find both examples of major principles that remained the subject of disagreement as well as examples of early legislation and practices that today we would reject as plainly inconsistent with the constitutional separation of powers. Gender, power, and identity formed a critical intersection in sixteenth century Ireland as Tudor England sought to bring this neighboring island more fully under Crown control. This dissertation examines how England imposed gender on both the Irish landscape and the Irish people, creating an illusion of weakness, a lack of power, and a means of controlling a society and a nation. Metabolomics Of Transformed Mda-Mb-231 Cell Lines Expressing Different Levels Of Human Arylamine N-Acetyltransferase 1 (Nat1)., Samantha Marie Carlisle

Human arylamine N-acetyltransferase 1 (NAT1) is a phase II xenobiotic metabolizing enzyme that is found in almost all tissues of the body. Expression of NAT1 is commonly elevated in several cancers including breast cancer. However, the exact mechanism by which NAT1 expression affects cancer risk and progression remains unclear. Three MDA-MB-231 breast adenocarcinoma cell lines that stably express wild-type, increased, and decreased levels of human NAT1 have been constructed and characterized for NAT1 mRNA, NAT1 acetylation activity, cell doubling rates, and endogenous acetyl-CoA levels. Reactive Oxygen Species (ROS) are vital to the normal functioning of the immune system in the human body. However, when a foreign material enters the system the highly regulated balance between pro- and anti-oxidants can be disrupted, especially if the material itself can generate ROS. One way a material can generate ROS is through Fenton chemistry. The hypothesis that Fenton chemistry is an important factor in many exposure related diseases is experimentally tested using an array of complementary acellular and cellular in vitro techniques. It is hard to imagine a more iconic representation of Peru than the Inca archeological complex of Machu Picchu located in the Cusco region. However, when US explorer, Hiram Bingham, announced that he had discovered the " lost city" in 1911, few would have predicted Machu Picchu's rise to fame during the twentieth century. My dissertation traces the unlikely transformation of Machu Picchu into its present-day role as a modern tourism destination and a representation of Peruvian national identity. Gone with the Wind (1939), a Hollywood prestige picture, was translated into Chinese as A Beauty at a Turbulent Time in 1946 and became a box-office hit at Shanghai. Its startling success, however, was soon overwhelmed in every aspect by a domestic film, The Spring River Flows East. This second blockbuster indicates the revitalization of Chinese cinemas in terms of aesthetics, genre, and industry in the aftermath of the Japanese occupation. High-frequency traders automate stock trading, placing thousands of orders over fractions of a second. Their algorithmic strategies are all too often mere rule manipulation or methods of using brute speed to gain advantages over rivals. Normative evaluation of finance's algorithms must take into account the sector's social function: to spur efficient, fair, and sustainable investment practices. The complex modeling deployed in high-frequency trading does not reliably contribute to these goals. Therefore, rather than straining to accommodate high-frequency trading strategies, regulators should eliminate many of them.

Models of historiography often drive the theological understanding of persons and periods in Christian history. This article evaluates eight different models of the early church period and then suggests a model that is appropriate for use in a Seventh-day Adventist Seminary. The first three models evaluated are general views of the early church by Irenaeus of Lyon, Walter Bauer and Martin Luther. Models four through eight are views found within Seventh-day Adventism, though some of them are not unique to Adventism. This work analyzes a distinctive characteristic of the globalizing Brazilian legal profession. Namely, intellectual property (IP) lawyers who once were leaders in opening the Brazilian economy and were key players in cross-border transactions are now losing ground to their peers with an expertise in international trade. The thesis of this article is that the manner in which Brazilian lawyers are being educated is in shambles. Generally speaking, Brazilian legal education has, overall, become degraded and provincial. Yet, Brazilian international trade lawyers, unlike Brazilian IP-lawyers, have overcome their deficient legal training by seeking legal education abroad. By traveling overseas, especially to …

This thesis explores the issues surrounding testamentary manumission, the ability of
masters to manumit slaves via their will in Virginia during the first half of the nineteenth
century. Using 37 cases in which the will was challenged and appealed up to the Supreme
Court of Virginia, I argue that in addition to the complexities of adjudicating a contested
will, the arguments and opinions offered by lawyers and judges in these cases show the
evolving discourse surrounding in slavery in Virginia during this period.

In this thesis I explore the place of the actualized utopian American alternative community of higher learning within a philosophy of human culture. I carry out such a study in order to articulate a unifying description of movement; to find the “target” that orients the activity of actualized utopia, as opposed to a classificatory rule to define a mechanically determined utopian-object. Although these communities have varied in practice since the first generation of them were created in the mid-nineteenth century, I argue that they have played, and continue to play, a particular role in America. In the nineteenth and early twentieth centuries, numerous new religious and irreligious groups arose throughout the United States. These groups were often radical in their assertions of religious authority, their interpretations of scripture, their predictions about Christ’s second coming, their practice of supernatural gifts, their rejection of traditional Christian doctrines, or their rejection of Christianity altogether. American Catholics watched and commented as these groups multiplied and gained momentum. Catholics believed that the growth of radical religious and irreligious groups was the fault of mainstream Protestantism. The current study explores the association between perceived stress and health risk factors (heart disease, high blood pressure, high cholesterol, obesity, high blood glucose/diabetes, tobacco use, problematic alcohol use, physical inactivity, poor nutrition, and depressive symptoms) among a sample of working adults. The moderating effect of work meaning on the relationship between perceived stress and health risk factors was examined. It was hypothesized that greater levels of perceived stress would be significantly associated with a higher number of total health risks and that the relationship between perceived stress and total health risks would be buffered by work meaning. OBJECTIVE: Despite evidence that preoperative aspirin improves outcomes in cardiac surgery, recommendations for aspirin use are inconsistent due to aspirin's anti-platelet effect and concern for bleeding. The purpose of this study was to investigate preoperative aspirin use and its effect on bleeding and transfusion in cardiac surgery.
METHODS: This retrospective study involved consecutive patients (n=1571) who underwent CABG, valve, or combined CABG and valve surgery at a single center between March 2007 and July 2012. Of all patients, 728 met the inclusion criteria and were divided into two groups: those using (n=603) or not using (n=125) aspirin within 5 days …

The essential purpose of this paper is to provide a conceptual framework for case studies aimed at outlining the main stages in the process of negotiations; indicating some of the main factors affecting the relative bargaining position of the parties to negotiations with multinational corporations; and providing indices for evaluating the resulting structure of the distribution of gains from the projects contemplated by such negotiations. The paper thus combines elements from the second, third and fourth categories of studies on negotiations.

In Women’s Tanci Fiction in Late Imperial and Early Modern China, Li Guo presents the first book-length study in English of women’s tanci fiction, the distinctive Chinese form of narrative written in rhymed lines during the late imperial to early modern period (related to, but different from, the orally performed version also called tanci) She explores the tradition through a comparative analysis of five seminal texts. Guo argues that Chinese women writers of the period position the personal within the diegesis in order to reconfigure their moral commitments and personal desires. Agricultural Conservation Practice Effectiveness: Impacts Measured In The Outlet Larkin Creek Watershed In Northeastern Arkansas, Sarah Katherine Vogt

In an effort to control nonpoint source pollution, conservation practices are used by farmers. Outlet Larkin Creek Watershed was used to determine the effectiveness of agricultural conservation practices by measuring water quality parameters and comparing the percent reduction by the BMP tool (Merriman et al. 2009). The watershed is located in northeastern Arkansas as a subwatershed to the L’Anguille River Watershed. Weekly water samples were taken for water quality analysis prior to (2010) and after (2012-2014) conservation practices were implemented. Analyses were conducted with water quality parameters as well as aquatic and sediment toxicity bioassays. Overall, results of this study …

My essay was intended as a critique of originalism from the perspective of intellectual history. I pointed out that originalism lacked a rigorous empirical method for analyzing what texts meant in the past. I suppose in some sense it is flattering that Solum has devoted much of his recent article to an attack on my earlier essay. Of course, flattery aside, it would have been more useful if Solum had stated my thesis correctly. An increasing quantity of medicines, including medicines of different healing systems, have become available since the nineteen fifties to the mainly Sherpa inhabitants of the Mt. Everest region of Nepal. Considerable change and economic development has occurred in which this mountainous and remote area has become one of Nepal’s principal tourist destinations and people have gained access to education, health services, and modern means of communication. Many Sherpa travel regularly in Nepal and overseas, especially for work, education, or pilgrimage, or have migrated permanently. Teaching Transparency: A One-State Case Study Of Sunshine Laws And The Journalism Curriculum, Melony Shemberger

This case study on journalism instruction in Tennessee seeks to gain insight on the instruction of sunshine laws in the journalism curriculum. Such laws are necessary tools for journalists, who gather public information to write their stories, either by attending open public meetings or by filing open records requests. Journalists generally learn more about sunshine laws in the professional newsroom. Research from this one-state case study identifies two issues, curriculum complications and faculty experiences, as reasons why these laws might not be covered rigorously. The results could reflect similar barriers in other journalism programs throughout the United States.

This article brings together trade records left by Dutch and English East India Company merchants, chronicles in Arabic, and a published French travel narrative to shed light on an overlooked phenomenon, that of early modern medical diplomacy to Qasimi Yemen during the early eighteenth century. In this era, foreign merchants flocked to the southern Arabian Peninsula, many with the interest of procuring coffee, a commodity that was then still difficult to purchase elsewhere. Along with them came doctors and ships’ surgeons, who were called upon to treat Yemen’s imam al-Mahdi Muhammad (d. 1718), who suffered from many ailments in the …
