Back To The Future: What Previous Hea Reauthorizations Might Say About The Next One, Dan Madzelan

Journal of Student Financial Aid

For 50 years, the Higher Education Act has been the primary vehicle for advancing federal higher education policy. Many policymakers and interested observers expect its upcoming reauthorization to address three overarching topic areas: college affordability, institutional quality, and student safety. Indeed, previous reauthorizations have addressed specific issues within each of these areas—expanded financial aid availability and process simplification, third-party (accreditors and states) oversight of institutions, and assurances that students have safe learning environments. Yet we cannot say that these are settled issues. This article describes previously implemented policies in the hope that a better understanding of the past might help …

Mobility For Whom? Local Mobility Structures And The Stratified Impact On Earnings And Poverty, D. Matthew Ray Nov 2015

Mobility For Whom? Local Mobility Structures And The Stratified Impact On Earnings And Poverty, D. Matthew Ray

Master's Theses

A dynamic class structure that fosters social mobility is the foundation of the American Dream, and is believed to be beneficial to all society. But are the benefits of mobility evenly distributed? Although the importance of mobility to the surrounding community is an intuitive idea, it has been difficult to test empirically with data until recently. Drawing from innovative mobility data provided by Chetty et al. (2014a) for Metropolitan Statistical Areas (MSAs), I study the social consequences of intergenerational income mobility occurring across the local class structure. I use ordinary least squares (OLS) regression to investigate the impact of local …

QUESTIONS PRESENTED McDonnell Douglas Corp. v. Green established a common method of analyzing evidence of an unlawful discriminatory motive. If a plaintiff establishes a prima facie case of discrimination, the defendant must articulate a legitimate, non-discriminatory purpose for the disputed action; where the defendant has done so, the plaintiff has the burden of demonstrating that the proffered purpose was a pretext for discrimination. This Court has repeatedly explained that the burden of establishing a prima facie case is “not onerous.” United States Postal Service Board of Governors v. Aikens held, in the context of a case which had gone to …

Rising To China's Challenge In The Pacific Rim: Reforming The Foreign Corrupt Practices Act To Further The Trans-Pacific Partnership, Michael B. Runnels Nov 2015

Rising To China's Challenge In The Pacific Rim: Reforming The Foreign Corrupt Practices Act To Further The Trans-Pacific Partnership, Michael B. Runnels

Seattle University Law Review

It is a commonly held myth that the rise of U.S. global economic hegemony rests upon a free trade philosophy. On the contrary, protectionist trade policies were central to galvanizing American industrialization. This misconception lies at the heart of why the trade liberalization policies enforced under the U.S.-led Bretton Woods institutions, the World Bank and the International Monetary Fund (IMF), brought ruinous results to many poor countries. The subsequent decline in credibility of these institutions challenges their continued relevance and opens a space for powerful nations to fashion alternative rules of trade. China is a member of the IMF but …

Atrazine Exposure And Reproductive Dysfunction Through The Hypothalamus-Pituitary-Gonadal (Hpg) Axis, Sara Wirbisky, Jennifer L. Freeman Nov 2015

Atrazine Exposure And Reproductive Dysfunction Through The Hypothalamus-Pituitary-Gonadal (Hpg) Axis, Sara Wirbisky, Jennifer L. Freeman

School of Health Sciences Faculty Publications

Endocrine disrupting chemicals (EDC) are exogenous agents that alter endogenous hormone signaling pathways. These chemicals target the neuroendocrine system which is composed of organs throughout the body that work alongside the central nervous system to regulate biological processes. Of primary importance is the hypothalamic-pituitary-gonadal (HPG) axis which is vital for maintaining proper reproductive function. Atrazine (2-chloro-4-ethylamino-6-isopropylamino-1,3,5-triazine) is a pre-emergent herbicide used to prevent the growth of weeds on various crops. This herbicide is reported to widely contaminate potable water supplies everywhere it is applied. As such, the European Union banned the use of atrazine in 2004. Currently the United States …

Content Analysis Of Pre- And Post-Jones Federal Appellate Cases: Implications Of Jones For Fourth Amendment Search Law, James A. Purdon

Master of Science in Criminal Justice Theses & (Pre-2016) Policy Research Projects

This study examines the state of Fourth Amendment search law in relationship to the decision in the recent, landmark case of United States v. Jones. This study focused on the effects of the Jones decision, trespass doctrine, relative to the former precedent of Katz v. United States, reasonable expectation of privacy doctrine, and the rates of searches being found under these two tests (or a combination of both). This study used a qualitative content analysis of federal appellate cases which cited Jones and/or Katz to answer the following questions: Which tests were being used in federal appellate cases …

Optic Flow Improves Adaptability Of Spatiotemporal Characteristics During Split-Belt Locomotor Adaptation With Tactile Stimulation, Diderik Jan Anthony Eikema, Jung Chien, Nicholas Stergiou, Sara Myers, Melissa Scott-Pandorf, Jacob J. Bloomberg, Mukul Mukherjee Nov 2015

Optic Flow Improves Adaptability Of Spatiotemporal Characteristics During Split-Belt Locomotor Adaptation With Tactile Stimulation, Diderik Jan Anthony Eikema, Jung Chien, Nicholas Stergiou, Sara Myers, Melissa Scott-Pandorf, Jacob J. Bloomberg, Mukul Mukherjee

Journal Articles

Human locomotor adaptation requires feedback and feed-forward control processes to maintain an appropriate walking pattern. Adaptation may require the use of visual and proprioceptive input to decode altered movement dynamics and generate an appropriate response. After a person transfers from an extreme sensory environment and back, as astronauts do when they return from spaceflight, the prolonged period required for re-adaptation can pose a significant burden. In our previous paper, we showed that plantar tactile vibration during a split-belt adaptation task did not interfere with the treadmill adaptation however, larger overground transfer effects with a slower decay resulted. Such effects, in …

Evading Miller, Robert S. Chang, David A. Perez, Luke M. Rona, Christopher M. Schafbuch

Seattle University Law Review

Miller v. Alabama appeared to strengthen constitutional protections for juvenile sentencing that the United States Supreme Court recognized in Roper v. Simmons and Graham v. Florida. In Roper, the Court held that executing a person for a crime committed as a juvenile is unconstitutional under the Eighth Amendment. In Graham, the Court held that sentencing a person to life without parole for a nonhomicide offense committed as a juvenile is unconstitutional under the Eighth Amendment. In Miller, the Court held that a mandatory sentence of life without parole for a homicide offense committed by a juvenile is also unconstitutional under …

Between A Bed And A Hard Place: How Washington Can Keep Psychiatric Patients In Treatment And Off The Streets, Spencer Babbitt Nov 2015

Between A Bed And A Hard Place: How Washington Can Keep Psychiatric Patients In Treatment And Off The Streets, Spencer Babbitt

Seattle University Law Review

On February 27, 2013, ten psychiatric patients were being involuntarily detained in hospital emergency departments located in Pierce County under Washington State’s Involuntary Treatment Act (ITA). Despite the name of the law that authorized their detainment, these individuals were not receiving any psychiatric treatment during their confinement. Nor were they there as the result of a criminal conviction. The only thing these ten detainees were guilty of was being mentally ill. Under what is now considered to have been a misinterpretation of the ITA, counties across Washington had for years been confining mentally ill patients in hospitals not certified to …

The Role Of Financial Aid In Promoting College Access And Success: Research Evidence And Proposals For Reform, Judith Scott-Clayton Nov 2015

The Role Of Financial Aid In Promoting College Access And Success: Research Evidence And Proposals For Reform, Judith Scott-Clayton

Journal of Student Financial Aid

Since the passage of the Higher Education Act of 1965, great progress has been made in increasing college enrollment rates for qualified students. But gaps in enrollment and completion by family income have persisted and even widened over time. These gaps are both troubling, given the high returns gained by attending college, and puzzling, given the growing availability of financial aid. This essay discusses key lessons that have emerged from decades of research on the impacts of student aid, suggests high-priority directions for federal policy reform, and examines implications for financial aid administrators.

Borrowing And Repaying Student Loans, Nicholas W. Hillman Nov 2015

Borrowing And Repaying Student Loans, Nicholas W. Hillman

Journal of Student Financial Aid

This essay synthesizes the most recent and rigorous research on student loan debt. It focuses on basic questions about who borrows, how much, and whether debt affects behaviors. Answers to these questions are necessary for informing federal student loan policymaking, yet the research findings are surprisingly mixed because of poor data quality, research design challenges, and the growing heterogeneity of borrowers. This ambiguity makes federal policymaking difficult when questions about the benefits and burdens of student loan debt are left unanswered. By synthesizing the current research, this essay helps answer some of these questions while calling attention to others.
