The Impact Of Climate Change On Human Health, Mary Snow, Richard Snow Jan 2015

The Impact Of Climate Change On Human Health, Mary Snow, Richard Snow

Publications

Climate change is impacting human health. An obvious effect of a warmer environment is more frequent and severe heat waves. During the European heat wave of 2003, there were an estimated 35,000 more deaths than normal in the first two weeks of August. Many of the deaths resulted from cardiovascular complications among the elderly. As heat waves become more commonplace in the future, so will the number of heat strokes and the onset of other cardiovascular problems. Higher summertime temperatures also increase tropospheric ozone concentrations which in turn affects people with asthma and causes lung and heart damage. Increases in …

Reflections On Freedom And Criminal Responsibility In Late Twentieth Century American Legal Thought, Thomas A. Green, Merrill Catharine Hodnefield Jan 2015

Reflections On Freedom And Criminal Responsibility In Late Twentieth Century American Legal Thought, Thomas A. Green, Merrill Catharine Hodnefield

Articles

It is now a commonplace among historians that American criminal jurisprudence underwent a dramatic change something like two-thirds to three-quarters into the last century. Roughly, this development is understood as a shift (or drift) from a more-or-less pure consequentialism to a "mixed theory" wherein retributivism played a major-at times, dominant-role. As the new paradigm remains intact, now approaching a half-century, the development qualifies as a significant historical fact. The fact applies not only to the history of justification for punishment but also to conceptions of the underlying principle of (basis for) responsibility. The two are rightly distinguished: for many scholars …

No Reason To Blame Liberals (Or, The Unbearable Lightness Of Perversity Arguments), Margo Schlanger Jan 2015

No Reason To Blame Liberals (Or, The Unbearable Lightness Of Perversity Arguments), Margo Schlanger

Reviews

In addition to the current extraordinary number of people behind American bars, the other key feature of our current carceral state is the very high concentration of non-whites in that population. That concentration of non-whites has grown significantly since the 1960s, when whites constituted nearly two thirds of American prison population; today, they are only a bit over one-third. Since 72% of Americans are white, the distinction in terms of incarceration rate is far more stark: among white men, the current imprisonment rate (counting only sentenced prisoners) is 4.7/1000; among Latino men it is two-and-a-half times that (11.3/1000); and among …

Intellectual Property And The Presumption Of Innocence, Irina D. Manta Jan 2015

Intellectual Property And The Presumption Of Innocence, Irina D. Manta

Hofstra Law Faculty Scholarship

Our current methods of imposing criminal convictions on defendants for copyright and trademark infringement are constitutionally defective. Previous works have argued that due process under the Sixth Amendment requires prosecutors to prove every element of a crime beyond a reasonable doubt, including the jurisdictional element. Applying this theory to criminal trademark counterfeiting results in the conclusion that prosecutors should have to demonstrate that an infringing mark needs to have traveled in or affected interstate commerce, which currently is not mandated. Parallel to this construction of the Commerce Clause, criminal prosecutors would also have to prove that Congress has the power …

Moving Forward, Looking Back: A Retrospective On Sexual Harassment Law, Joanna L. Grossman Jan 2015

Moving Forward, Looking Back: A Retrospective On Sexual Harassment Law, Joanna L. Grossman

Hofstra Law Faculty Scholarship

The history of sexual harassment law─which I have occasion to consider as part of this symposium on the fiftieth anniversary of Title VII─can be divided, if not neatly, into three eras. The 1970s was home to the emergence of consciousness about the frequency and harm of sexually harassing behaviors in the workplace─and a name to describe them. The 1980s and 1990s saw the development and embrace of a theoretical understanding of sexual harassment as a form of discrimination, outlined in Catharine MacKinnon's path-breaking 1979 book, The Sexual Harassment of Working Women, and the development of a comprehensive set of …

The New York Llc Act At Twenty: Is Piercing Still 'Enveloped In The Midst Of Metaphor'?, Miriam R. Albert Jan 2015

The New York Llc Act At Twenty: Is Piercing Still 'Enveloped In The Midst Of Metaphor'?, Miriam R. Albert

Hofstra Law Faculty Scholarship

Twenty years ago, the New York Limited Liability Company Law was enacted, including § 609(a), which explicitly disclaims liability of members, managers, and agents for the debts and obligations of the LLC. However, New York courts have held that this limitation on liability is not absolute, and certain conduct on the part of the owners can erode the liability shield. The statute provides that the members will not have personal liability for LLC debts solely because of their role as owners in the LLC. The statute does not say that members will never have liability, just that any liability will …

Trotting Out The White Horse: How The S.E.C. Can Handle Bitcoin’S Threat To American Investors, J. Scott Colesanti

Hofstra Law Faculty Scholarship

Bitcoin has entered the kingdom to stay, yet few are willing to shield its most likely victims.

The cryptocurrency is a mysterious amalgam of technology, transparency, and secrecy. Despite its initial mission of bypassing commercial fees, the currency alternative, presently valued at over $400 a coin, is a more likely candidate for hoarding and speculation. Surprisingly, while its brazen use to facilitate money laundering and drug purchases have been met with prosecution and headlines, Bitcoin’s everyday rapidly growing appeal to investors has been left largely unaddressed.

As an investment, Bitcoin’s chief marketing tool appears to be conversion mechanisms declaring themselves …

Lgbtq Relationships, Barbara J. Stark Jan 2015

Lgbtq Relationships, Barbara J. Stark

Hofstra Law Faculty Scholarship

Perhaps nowhere in family law is this evolution more dramatic than in the burgeoning recognition of rights of lesbian, gay, bisexual, transgendered, and questioning (LGBTQ) couples. Within the past twenty- five years courts, legislatures, and international bodies have addressed the extent to which rights and obligations formerly reserved to heterosexual married spouses should be conferred on other partners.

Most western democracies now recognize same- sex unions, assuring the partners in such unions a range of rights and benefits, similar to but distinct from the rights and benefits enjoyed by married couples. Part A of this Chapter describes the legal mechanisms …

The Relationship Between Illness Representations, Avoidant Coping, And Health Outcomes In People With Ongoing Symptoms Of Chronic Illness, Emily A. Bell Jan 2015

The Relationship Between Illness Representations, Avoidant Coping, And Health Outcomes In People With Ongoing Symptoms Of Chronic Illness, Emily A. Bell

UNF Graduate Theses and Dissertations

Illness representations play an important role in the way people with chronic illness manage symptoms and view their overall health. Those suffering from functional somatic syndromes as well as conventional diagnoses seek information and meaning about their health threats in order to make appraisals concerning health outcomes. The primary interest of this study was to determine whether illness representations predict coping strategies which in turn influence general health outcomes. Data was collected from a series of four online surveys that measured an individual’s illness representations (IPQ-R), coping responses (Brief COPE), and health outcomes (RAND-36). The sample included 204 participants (169 …

Tapping Into The Social Capital Of African American Alumni Of Urban High Schools, Adrian Derrick Johnson Jan 2015

Tapping Into The Social Capital Of African American Alumni Of Urban High Schools, Adrian Derrick Johnson

UNF Graduate Theses and Dissertations

The purpose of this study was to identify and understand how African American alumni of urban high schools perceived that they could best contribute to their former schools. Despite numerous improvement efforts for several decades, the academic performance of urban high school students has failed to keep pace with that of their suburban counterparts. This research was framed around the premise that the rich legacies and diverse cultural experiences of African American alumni of urban high schools could mitigate the outside factors that negatively impact student performance at urban schools. These funds of knowledge, as Moll and Amanti (2005) described …

Role Tension In The Academy: A Philosophical Inquiry Into Faculty Teaching And Research, Nicolas Michaud Jan 2015

Role Tension In The Academy: A Philosophical Inquiry Into Faculty Teaching And Research, Nicolas Michaud

UNF Graduate Theses and Dissertations

This dissertation seeks to understand the conjunction of faculty roles as teachers and as researchers. This understanding is pursued through philosophical analysis. Discourse ethics, in particular, is used as a framework by which to best understand the roles played by faculty and if the roles of teacher and researcher are, in fact, commensurable. The purpose of the work is two-fold: 1) to develop a construct that may be used by future researchers to better understand the roles played by faculty, and 2) to suggest a best-construct that enables future researchers to propose how actual lived roles should be instantiated in …

The Studies Of Satisfaction Understood As An Attribute Of E-Service Systems Quality, Karol Łopaciński, Leszek A. Maciaszek

European Management Studies

Due to the growing demand for different types of e-services there are more and more systems that allow for e-services provision and management on the market. The quality of such solutions should be improved in cooperation with customers on the basis of information about the level of their satisfaction with the usage. This can be possible owing to regular user satisfaction research. The article presents the concept of estimating satisfaction with e-service software which is based on the achievements of marketing research and software quality studies.

This dissertation comprises a series of studies conducted on modifiable risk factors as they contribute to cardiovascular health and disease and their associated health service expenditures and utilization. Specific topics in this compilation include (1) exploring the role of dietary sodium and potassium intake in cardiovascular health and disease; (2) examination of direct health expenditures in the Medicare-linked REasons for Geographic And Racial Differences in Stroke (REGARDS) cohort as associated with Life’s Simple 7 (LS7), a composite measure of cardiovascular health defined by the American Heart Association (AHA) that is based on seven modifiable risk factors (blood pressure, blood cholesterol, …

The Regulation Of Vitamin A Metabolism, Mark Adams Jan 2015

The Regulation Of Vitamin A Metabolism, Mark Adams

All ETDs from UAB

Bioactive vitamin A takes form as several molecules, among them all-trans-retinoic acid (RA) is the major form and influences a wide range of biological processes. RA must be synthesized through a two-step mechanism, where all-trans-retinol is first oxidized to all-trans-retinaldehyde by retinol dehydrogenases (RDHs) and retinaldehyde is further oxidized to RA by retinaldehyde dehydrogenases (RALDHs). The first step, retinol to retinaldehyde conversion is the rate limiting step and therefore a likely target of mechanisms that modulate RA synthesis. Despite this, many of the enzymes that are involved in retinol and retinaldehyde interconversion have yet to be identified and thus many …

Competition From New Neurons Drives Circuit Refinement In The Adult Dentate Gyrus, Elena W. Adlaf Jan 2015

Competition From New Neurons Drives Circuit Refinement In The Adult Dentate Gyrus, Elena W. Adlaf

All ETDs from UAB

The hippocampus encodes sensory information into memories. The dentate gyrus (DG) region is viewed as the entry point into the hippocampus, receiving sensory and spatial signals from perforant path axons of the entorhinal cortex (EC). Ever since researchers discovered a neurogenic niche in the subgranular zone (SGZ) of the DG in adult animals and humans, many studies have been aimed at discovering how these continually proliferating granule cells (GCs) contribute to the network. Immature GCs have dendrites that project densely into the molecular layer alongside mature GCs and there is morphological evidence that immature excitatory spines preferentially synapse onto existing …

Evaluation Of The Productive Efficiency Of Nurse Practitioners In A Nurse Managed Center In A Highly Restrictive Scope-Of-Practice State, Faraz Ahmed Jan 2015

Evaluation Of The Productive Efficiency Of Nurse Practitioners In A Nurse Managed Center In A Highly Restrictive Scope-Of-Practice State, Faraz Ahmed

All ETDs from UAB

The purpose of this study is to determine the productive efficiency of Nurse Practitioners (NP) in a Nurse Managed Center (NMC) in a highly restrictive Scope-of-Practice (SOP) state. NPs are skilled, cost effective and quality health care providers and are considered a highly competitive option for increasing access while reducing health care costs. However, it is not clearly known if NPs are the most productively efficient at delivering this reduced cost of health care. The theories of Complex Adaptive Systems (CAS) and Resource Based View (RBV) were used as a framework to develop the hypotheses that examined the productive efficiency …

Pathophysiology And Metabolic Dysfunction Following Polytrauma, Robert Mackay Akscyn Jan 2015

Pathophysiology And Metabolic Dysfunction Following Polytrauma, Robert Mackay Akscyn

All ETDs from UAB

Polytrauma, a combination of injuries to more than one body part or organ system, is common in modern warfare and in automobile and industrial accidents. The combination of injuries can include burn, fracture, hemorrhage, trauma to the extremities, and trauma to specific organ systems. These injuries are highly survivable when occurring singly. However, when they occur in combination the prognosis is worsened. To investigate the effects of combined injuries, we have developed a new and highly reproducible model of polytrauma. This model combines burn injury with soft tissue and gastrointestinal (GI) tract trauma. Male Sprague Dawley rats were subjected to …

Association Between Physical Activity And Learning, Pain Coping Strategies, Perceived Stress, And Depression Among Adults With Diabetes And Chronic Pain, Susan J. Andreae Jan 2015

Association Between Physical Activity And Learning, Pain Coping Strategies, Perceived Stress, And Depression Among Adults With Diabetes And Chronic Pain, Susan J. Andreae

All ETDs from UAB

In addition to the role of physical activity (PA) in the prevention of chronic disease and premature death, PA may have psychosocial benefits. We examined the association between four different domains of PA and three outcomes that may contribute to the emotional and mental well being of individuals. This is a secondary analysis of community dwelling adults with diabetes and chronic pain in which we examined the association between four domains of PA and learning (measured using diabetes knowledge, self efficacy in diabetes and pain management), pain coping strategies, perceived stress, and depression. Regression models were used to model changes …

A series of chiral cyclometalated platinum(II) complexes, [Pt((−)-L1)(Dmpi)]Cl ((−)-1), [Pt((+)-L1)(Dmpi)]Cl ((+)-1), [Pt((−)-L2)(Dmpi)]Cl ((−)-2), [Pt((+)-L2)(Dmpi)]Cl ((+)-2), [Pt3((−)-L2)2(Dmpi)4](ClO4)4 ((−)-3), and [Pt3((+)-L2)2(Dmpi)4](ClO4)4 ((+)-3) [(−)-L1 = (−)-4,5-pinene-6′-phenyl-2,2′-bipyridine, (+)-L1 = (+)-4,5-pinene-6′-phenyl-2,2′-bipyridine), (−)-L2 = (−)-1,3-bis(2-(4,5-pinene)pyridyl)benzene, (+)-L2 = (+)-1,3-bis(2-(4,5-pinene)pyridyl)benzene, Dmpi = 2,6-dimethylphenyl isocyanide], have been designed and synthesized. In aqueous solutions, (−)-1 and (+)-1 aggregate into one-dimensional helical chain structures through Pt···Pt, π–π, and hydrophobic–hydrophobic interactions. (−)-3 and (+)-3 represent a novel helical structure with Pt–Pt bonds. The formation of helical structures results in enhanced and distinct chiroptical properties as evidenced by circular dichroism spectra. Circularly polarized luminescence (CPL) was observed from the aggregates of (−)-1 and …

Economic Freedom Studies At The State Level: A Survey, Joshua C. Hall, Dean B. Stansel, Danko Tarabar Jan 2015

Economic Freedom Studies At The State Level: A Survey, Joshua C. Hall, Dean B. Stansel, Danko Tarabar

Economics Faculty Working Papers Series

This chapter synthesizes and elaborates on much of the existing research using the Economic Freedom of North America (EFNA) index. Our consensus after reading this literature is that the EFNA index, similarly to the Economic Freedom of the World (EFW) index, is largely positively related with “good” outcomes, and negatively related with “bad” ones, although there are a few exceptions. The literature using the EFNA is growing rapidly and can provide a useful guide towards future policy changes and economic outcomes.

Production Of Wind Energy And Agricultural Land Values: Evidence From Pennsylvania, Chris Schultz, Joshua C. Hall, Michael P. Strager Jan 2015

Production Of Wind Energy And Agricultural Land Values: Evidence From Pennsylvania, Chris Schultz, Joshua C. Hall, Michael P. Strager

Economics Faculty Working Papers Series

Given the push toward renewable and alternative energy, a new energy mix is emerging. Wind is the fastest growing source of renewable electricity in the United States. The siting of wind turbines has proven controversial with multiple operations facing local resistance. Opponents cite issues such as noise, bird deaths, and aesthetics. Given that farmer portfolios are heavily comprised of land assets, the possibility that surrounding wind energy operations may reduce agricultural land value is of concern. This study examines that possibility using a hedonic regression analysis comparing per acre land value to a series of land characteristics and distance variables …

The Political Economy Of The Essential Air Service Program, Joshua Hall, Amanda Ross, Christopher Yencha Jan 2015

The Political Economy Of The Essential Air Service Program, Joshua Hall, Amanda Ross, Christopher Yencha

Economics Faculty Working Papers Series

We find that congressional influences affect the amount of airport subsidies that a congressional district receives from the Essential Air Service (EAS) program. The EAS program was passed with the goal of helping to continue commercial air service to rural communities following the deregulation of the airline industry. Using subsidy data from 1998-2014, we find strong evidence that subsidies are higher in districts having congressional representation on the House Transportation Committee. Representation on the House Appropriations Committee is also associated with higher subsidies. Our empirical results, combined with news reports, are consistent with the EAS serving private as well as …

Numerical Study On Scaling Effects And Decoupled Network-Based Simulation Of Gaseous Explosion, Liang Wang Jan 2015

Numerical Study On Scaling Effects And Decoupled Network-Based Simulation Of Gaseous Explosion, Liang Wang

Doctoral Dissertations

"This research seeks to improve the prediction efficiency of gaseous explosions realized by numerical simulations in a full-scale underground network using a decoupled method. To provide quick predictions of overpressure distribution of methane explosions in underground airway networks, a two-section theory is employed. The explosion space is divided into a driver section and a blast-wave section. Governing equations including conservation of mass, momentum, and energy, together with chemical reaction and turbulence models are solved for the driver and the blast-wave sections using computational fluid dynamics (CFD) solver ANSYS Fluent (3D-based) and Flowmaster (1D-based) respectively. The three dimensional (3D) and one …
