The Effect Of Statutory Rape Laws On Teen Birth Rates, Michael D. Frakes, Matthew C. Harding Jan 2015

The Effect Of Statutory Rape Laws On Teen Birth Rates, Michael D. Frakes, Matthew C. Harding

Faculty Scholarship

Policymakers have often been explicit in expanding statutory rape laws to reduce teenage pregnancies and live births by teenage mothers, often with the goal of reducing associated welfare outlays. In this paper, we explore whether expansions in such laws are indeed associated with reductions in teen birth rates. In order to codify statutory-rape-law expansions, we use a national micro-level sample of sexual encounters to simulate the degree to which such encounters generally implicate the relevant laws. By codifying statutory-rape laws in terms of their potential reach into sexual encounters, as opposed to using crude binary treatment variables, this simulation approach …

Habermas, The Public Sphere, And The Creation Of A Racial Counterpublic, Guy-Uriel Charles, Luis Fuentes-Rohwer Jan 2015

Habermas, The Public Sphere, And The Creation Of A Racial Counterpublic, Guy-Uriel Charles, Luis Fuentes-Rohwer

Faculty Scholarship

In The Structural Transformation of the Public Sphere, Jürgen Habermas documented the historical emergence and fall of what he called the bourgeois public sphere, which he defined as “[a] sphere of private people come together as a public . . . to engage [public authorities] in a debate over the general rules governing relations in the basically privatized but publicly relevant sphere of commodity exchange and social labor.” This was a space where individuals gathered to discuss with each other, and sometimes with public officials, matters of shared concern. The aim of these gatherings was not simply discourse; these gatherings …

The Promises And Pitfalls Of State Eyewitness Identification Reforms, Nicholas A. Kahn-Fogel Jan 2015

The Promises And Pitfalls Of State Eyewitness Identification Reforms, Nicholas A. Kahn-Fogel

Faculty Scholarly Works

This article provides a comprehensive analysis of state-based eyewitness identification reforms, including legislative directives, evidentiary rules, and judicial interpretations of state constitutions as providing greater protection against the use of unreliable eyewitness evidence than the United State Supreme Court offered in its 1977 decision in Manson v. Brathwaite. While previous scholarship has included thorough consideration of a single state's eyewitness law, state-by-state analysis of a sub-issue in eyewitness law, and brief general surveys of state approaches to eyewitness reform, this article adds to the current body of scholarship with an in-depth evaluation of eyewitness identification law in states that have …

Artificial Amplification Of Warming Trends Across The Mountains Of The Western United States, Jared Wesley Oyler, Solomon Z. Dobrowski, Ashley P. Ballantyne, Anna E. Klene, Steven W. Running Jan 2015

Artificial Amplification Of Warming Trends Across The Mountains Of The Western United States, Jared Wesley Oyler, Solomon Z. Dobrowski, Ashley P. Ballantyne, Anna E. Klene, Steven W. Running

Numerical Terradynamic Simulation Group Publications

Observations from the main mountain climate station network in the western United States (U.S.) suggest that higher elevations are warming faster than lower elevations. This has led to the assumption that elevation-dependent warming is prevalent throughout the region with impacts to water resources and ecosystem services. Here we critically evaluate this network's temperature observations and show that extreme warming observed at higher elevations is the result of systematic artifacts and not climatic conditions. With artifacts removed, the network's 1991–2012 minimum temperature trend decreases from +1.16°C decade−1 to +0.106°C decade−1 and is statistically indistinguishable from lower elevation trends. Moreover, …

Labor Law 2.0: The Impact Of New Information Technology On The Employment Relationship And The Relevance Of The Nlra, Kenneth G. Dau-Schmidt Jan 2015

Labor Law 2.0: The Impact Of New Information Technology On The Employment Relationship And The Relevance Of The Nlra, Kenneth G. Dau-Schmidt

Emory Law Journal

The NLRA system of collective bargaining was born during the industrial age of the early twentieth century. As a result, key terms in the statute such as ¿employee,¿ ¿employer,¿ and ¿appropriate bargaining unit¿ were first interpreted in the context of long-term employment and large vertically integrated firms that dominated this era. Beginning in the late 1970s, the new information technology wrought a revolution in the organization of production increasing short-term contingent employment and the organization of firms horizontally in trading and subcontracting relationships across the globe. To maintain the relevance of collective bargaining to the modern workplace, the interpretation of …

Being Japanese In English: The Social And Functional Role Of English Loanwords In Japanese, Shalina Omar Jan 2015

Being Japanese In English: The Social And Functional Role Of English Loanwords In Japanese, Shalina Omar

Scripps Senior Theses

This thesis investigates native speaker attitudes towards English loanwords in Japanese and the ways in which these loanwords are used. The imperialism and hegemony of English can often cause anger or worry for the preservation of the cultural identity of the borrowing language. However, the results from a 9-page sociolinguistic questionnaire suggest that English loanwords are overwhelmingly seen as useful and necessary and are generally associated with positive attitudes. Additionally, many native Japanese speakers feel that loanwords provide more options for expression, both functionally and as a possible pragmatic tool for performing Japaneseness. On the other hand, overuse of loanwords—especially …

Untold Narratives: Refugee Experiences From Laos To Richmond, California, Laiseng Saechao Jan 2015

Untold Narratives: Refugee Experiences From Laos To Richmond, California, Laiseng Saechao

Scripps Senior Theses

Untold Narratives: A Refugee Experience from Laos to Richmond, California is focused on the Mien refugee experience from Laos to Richmond, California. This thesis highlights the ways Cold War politics, the Secret War, and heavy industrialization have impacted Mien communities who have been displaced from their homelands into refugee camps, and again through sponsorship into the United States. This thesis looks at political theories that discuss inequalities that exist, particularly through environmental degradation and negative health impacts that Mien refugees are experiencing in their resettlement into Richmond, California. Due to the limited scholarly articles and documented narratives that are available …

On The Uncertainty Of Sea-Ice Isostasy, Cathleen Geiger, Peter Wadhams, Hans-Reinhard Müller, Jacqueline Richter-Menge Jan 2015

On The Uncertainty Of Sea-Ice Isostasy, Cathleen Geiger, Peter Wadhams, Hans-Reinhard Müller, Jacqueline Richter-Menge

Dartmouth Scholarship

During late winter 2007, coincident measurements of sea ice were collected using various sensors at an ice camp in the Beaufort Sea, Canadian Arctic. Analysis of the archived data provides new insight into sea-ice isostasy and its related R-factor through case studies at three scales using different combinations of snow and ice thickness components. At the smallest scale (<1 m; point scale), isostasy is not expected, so we calculate a residual and define this as (‘zjey’) to describe vertical displacement due to deformation. From 1 to 10 m length scales, we explore traditional isostasy and identify a specific sequence of thickness calculations which minimize freeboard and elevation uncertainty. An effective solution exists when the R-factor is allowed to vary: ranging from 2 to 12, with mean of 5.17, mode of 5.88 and skewed distribution. At regional scales, underwater, airborne and spaceborne platforms are always missing thickness variables from either above or below sea level. For such situations, realistic agreement is found by applying small-scale skewed ranges for the R-factor. These findings encourage a broader isostasy solution as a function of potential energy and length scale. Overall, results add insight to data collection strategies and metadata characteristics of different thickness products.

Global Governance And The Reduction Of Poverty And Inequality In The Post-Mdg Era: How Can The Asean-Japan Partnership Contribute?, Fernando T. Aldaba, Rafaelita M. Aldaba

Economics Department Faculty Publications

In 2000, the ASEAN member countries signed the UN Millennium Declaration to eradicate extreme poverty in the world by 2015 through the achievement of the Millennium Development Goals (MDGs). The MDGs represented the global vision of reducing poverty in its various dimensions, and they were mainstreamed in the process of building the ASEAN Socio-cultural Community, which had a similar target date of 2015.1 The new Sustainable Development Goals (SDGs) framework approved in 2015 goes beyond the MDG agenda, which focused solely on poverty, to also include inequality. In recent years, inequality has been worsening amidst rapid economic growth and falling …

Speaking In Wild Tongues: The Borderlands Of Eudora Welty And Alice Walker, Sara Gabler Thomas Jan 2015

Speaking In Wild Tongues: The Borderlands Of Eudora Welty And Alice Walker, Sara Gabler Thomas

Electronic Theses and Dissertations

In Borderlands/La Frontera Gloria Anzaldúa describes her experience undergoing a dental procedure as a battle between her wild tongue and the dentist. Beginning with a discussion of Anzaldúa’s concept of the wild tongue, this project asks how writers across the US South depict unruly tongues and infelicitous speech. Methodologically, this thesis inverts the comreading model in literary studies of reading Third World writers through First World theorists. Instead, beginning with Anzaldúa, I propose to reverse this process and assert a new reading methodology of reading First World writers through Third World theorists. The trope of the wild tongue will mobilize …

The Dead Rise The Dead And Walk Among The Living: An Examination Of The Haunting South, Queerness, And Grotesqueries In Truman Capote's "Other Voices, Other Rooms" And "Local Color", Jordan Alexis Savage Jan 2015

The Dead Rise The Dead And Walk Among The Living: An Examination Of The Haunting South, Queerness, And Grotesqueries In Truman Capote's "Other Voices, Other Rooms" And "Local Color", Jordan Alexis Savage

Electronic Theses and Dissertations

This project is conceptualized through a multitude of intersecting and overlapping theories that work together to allow an examination of circulations and intersections of queerness, grotesqueries, and the haunting South. Throughout this reading of Truman Capote’s Other Voices, Other Rooms and Local Color I want to think through the ways in which images and moments in the text can be queer and grotesque while also lending themselves to the images and eruptions that make up the haunting South. My reading of grotesqueries and the haunting South purposefully moves away from the Southern Gothic, rooting itself instead in a space that …

Policy Analysis Of Kentucky Senate Bill 192, Sierra Nicole Dantzler Jan 2015

Policy Analysis Of Kentucky Senate Bill 192, Sierra Nicole Dantzler

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Needle sharing has become an important factor in the prevalence of HIV and viral hepatitis rates as injection drug use of illicit substances, such as heroin and prescription opioids, has increased across the United States. Kentucky, much like the rest of the nation, has also been devastated by the recent surge of injection drug use. In 2010, drug overdose rates ranked Kentucky as the third highest state in the nation. Hepatitis B (HBV) and Hepatitis C (HCV) rates within Kentucky have been consistently higher than the national rate since 2007 and 2003, respectively. Hospital discharge costs related to HCV infections …

Two Ways To Rewrite The Constitution, Richard Kay Jan 2015

Two Ways To Rewrite The Constitution, Richard Kay

Faculty Articles and Papers

The proposition that the Constitution needs to be rewritten begs a critical question-namely what the Constitution is. If we posit that by Constitution we mean the rules drafted by the Philadelphia Convention of 1787 as amended in accordance with Article V of those rules, the argument that many of those rules are out of date and need to be replaced is a powerful one. This inadequacy appears in the powers they grant, the powers they do not grant, some of the limitations they impose on public decisions, and some limitations they ought to impose but do not. No matter how …

Structure Matters: How Organizational Characteristics Affect Military Efforts, Michael A. Morgan Jan 2015

Structure Matters: How Organizational Characteristics Affect Military Efforts, Michael A. Morgan

Theses and Dissertations--Political Science

Military organizations develop a unique set of practices and procedures in response to their particular political, economic, and social circumstances. The characteristics of these organizations shape standardized behaviors, methods of training personnel, and the degree of stratification within their bureaucratic hierarchies. This study examines how organizational characteristics influence battlefield effectiveness, patterns of alliance formation, and the security of United Nations peacekeepers.

Chapter 2 evaluates how differences in personnel sophistication and bureaucratic stratification influence battlefield efficacy. A military may devote substantial resources to develop war plans and procure advanced technology, but these assets are of limited consequence in the absence of …

Le Jeune Dreams Of Moose: Altered States Among The Montagnais In The Jesuit Relations Of 1634, Drew Lopenzina Jan 2015

Le Jeune Dreams Of Moose: Altered States Among The Montagnais In The Jesuit Relations Of 1634, Drew Lopenzina

English Faculty Publications

This article explores ruptures of colonial representation in the 1634 contribution of Paul Le Jeune to the Jesuit Relations, particularly in regard to Le Jeune’s intense antipathy to the faith Native Americans placed in dreams and dream interpretation. Native peoples had highly ritualized frameworks for interpreting dreams that stood in stark opposition to the expressed evangelical agendas of the Jesuits. The Montagnais, with whom Le Jeune wintered in 1633–34, used dreams to speak to manitous, who would assist them in finding game and other endeavors. Dreaming itself, with its claims to prophetic vision, was a phenomenon that threatened to override …

Queer Provisionality: Mapping The Generative Failures Of The Transborder Immigrant Tool, Alison R. Reed Jan 2015

Queer Provisionality: Mapping The Generative Failures Of The Transborder Immigrant Tool, Alison R. Reed

English Faculty Publications

Alison Reed investigates the border- and boundary-crossing performance of Electronic Disturbance Theater 2.0’sTransBorder Immigrant Tool (TBT), an incomplete cell phone program that offers GPS, guidance, and poetry to those attempting to cross into the United States across the Mexico/US border. Reed suggests a provocation-based performance of “queer provisionality,” revealing the aesthetics of oppressive power structures by juxtaposing them to social utopias. Interrogating the national neoliberal project of both US liberalism and US conservatism, Reed’s essay is also a transcription of the performances launched around TBT, the social and political machinery set into motion by Electronic Disturbance Theater’s failed utopian project.

Realm Of The Coin: Bitcoin And Civil Procedure, Max I. Raskin Jan 2015

Realm Of The Coin: Bitcoin And Civil Procedure, Max I. Raskin

Fordham Journal of Corporate & Financial Law

Bitcoin is a private currency issued and governed by a global network of computers. Thus far, the majority of legal cases involving bitcoin have been criminal prosecutions or disputes between bitcoin companies. If bitcoin or some iteration continues to grow, courts will need to craft rules of civil jurisdiction. This paper is the first attempt to apply existing rules of civil procedure to bitcoin. Bitcoins ought be treated as tangible property for the purposes of jurisdiction. Although they have an incorporeal form, as a practical matter, courts are able to site bitcoins to a single location and thus should do …

Decentralization In Violent Conflict Zones: Views From The Periphery, Emmi Bevensee Jan 2015

Decentralization In Violent Conflict Zones: Views From The Periphery, Emmi Bevensee

Capstone Collection

This thesis looks at the question of, “How can nations on the periphery of global capitalism sustainably negotiate with nations in the center of global capitalist power in the process of governance decentralization in violent conflict zones?” Decentralization here describes the process of power transfer of fiscal, political, and administrative duties from higher and more centralized entities to lower and more localized divisions. The process of decentralization is employed to cultivate participatory democratization, minority advocacy, peacebuilding, and development. Because of the nature of these needs decentralization is often accompanied by international intervention that uses the justification of “failed statehood.” This …

An Investigation Of The Impacts Of Face-To-Face And Virtual Laboratories In An Introductory Biology Course On Students' Motivation To Learn Biology., Amber Reece

Electronic Theses and Dissertations

The objective of this study was to evaluate and compare the effects of face-to-face and virtual laboratories in a large-enrollment introductory biology course on students* motivation to learn biology. The laboratory component of post-secondary science courses is where students have opportunities for frequent interactions with instructors and their peers (Seymour & Hewitt, 1997; Seymour, Melton, Wiese, & Pederson-Gallegos, 2005) and is often relied upon for promoting interest and motivation in science learning (Hofstein & Lunetta, 2003; Lunetta, Hofstein, & Clough, 2007). However, laboratory courses can be resource intensive (Jenkins, 2007), leading post-secondary science educators to seek alternative means of laboratory …
