The Policy And Targets Of Criminal Enforcement Of Intellectual Property Rights In China And The United States, Haiyan Liu
Washington International Law Journal
This comparative study analyzes the targets, consequences, and influence factors of the criminal enforcement of intellectual property rights in the United States and China. The analysis reveals unexpected consequences when transplanting Western intellectual property law in Chinese contexts. Similarities in criminal enforcement between the two countries indicate that economic factors that are determinant forces in both the United States and China. These factors include such business practices as: (1) vehement business lobbying and the capture of enforcement agencies by top trademark corporations; (2) the size and market concentration level of top firms in an industry; and (3) trade association lobbying …

An Examination Of The Relationship Among Iraqi High School Students' Science Achievement And Perceptions Of The Value Of Education, Parent Support, And Peer Support In The United States, Samir F. Al-Mandwee
Wayne State University Dissertations
The objective of this dissertation was to quantitatively study Iraqi students (N=90) who arrived in the U.S.A. in the last 20 years. A non-experimental, descriptive research design was used for this study, which took place in one of three high schools in a large Midwestern suburban school district, during the 2013-2014 academic year. Three factors, including the students' perception of the value of education, the parental support, and the peer support, were examined using the Facilitating Conditions Questionnaire. The three subscales were part of a larger self-administered questionnaire used by McInerney (1997). In addition to the FCQ survey, a student …
Rules Are Meant To Be Broken: The Organ Procurement And Transplantation Network Should Allow Pediatric Transplantation Of Adult Lungs, Ciera Parish
Journal of Law and Health
This note analyzes the "Under 12 Rule" and advocates for its abolishment by examining the consequences and discrimination faced by children under the age of twelve since its enactment in 2005 as well as the benefits stemming from the allowance of using adult lungs for pediatric transplantation. Part II discusses the history of organ transplantation law and the current organ transplantation laws as they stand. Part III provides statistical data demonstrating the disparity between pediatric lung transplant candidates and adult lung transplant candidates. Part IV discusses the reasons for the implementation of the "Under 12 Rule" and analyzes the emerging …

Parasitism Revealed: On The Absence Of Concession, Ann G. Winfield
Parasitism Revealed: On The Absence Of Concession, Ann G. Winfield
Education Faculty Publications
An examination of the role of ideologies from the past in shaping educational thought, action, policy and practice in the present. Takes the position that inequality is an expression of a fundamentally parasitic relationship forged during the 17th century colonial push and cemented institutionally in the early 20th century by a progressive version of social Darwinist thought known as eugenic ideology. Considered are the roles of historical disciplinary limitations, memory, and the co-optation of the language of social justice in perpetuating a racist, classist, hierarchy in education that has been bearing fruit for nearly two centuries. Warns against uncritical use …
Mapping The Gothic Urban Imaginary In Juan Martínez Villergas’S Los Misterios De Madrid, Cristina Delano
Mapping The Gothic Urban Imaginary In Juan Martínez Villergas’S Los Misterios De Madrid, Cristina Delano
Decimonónica
The nineteenth-century mystery novel was among the first narrative genres to capture the modern urban experience. The foundational text of this genre, Eugène Sue’s Les Mystères de Paris (1841-1843), portrayed Paris’s criminal underworld to the titillation of middle class readers.1 Sue wrote his novel at a moment of intense urban growth and change, and his novel served to “shape the popular imagination as to what the city was and might become” (Harvey 25). Sue’s novel sparked a “manía misterial” (Milá de la Roca iii) throughout Europe and the Americas.2 In Spain alone there were misterios about Madrid, Barcelona, …

Eduarda Mansilla’S Mestizo Argentina: Orphanhood, Transnationalism, And Race In Lucía Miranda (1860), Sarah Moody
Decimonónica
The first known writing of the Lucía Miranda legend, a story of Argentine national origins, dates to 1612 with a work by Spanish soldier Ruy Díaz de Guzmán. Though apparently fictional, the episode appears as a chapter in an otherwise fact-based account of early European activity in the River Plate region known as La Argentina manuscrita.1 Later writers reworked the legend in their own ways, adapting it to the circumstances of their own historical moment, but the consistent points of the storyline focus on irremediable interethnic conflict: Lucía was a young, virtuous Spanish woman who accompanied her husband …

Dressing Up: Religion And Ethnicity In Israeli National Dolls, Maya Balakirsky Katz
Dressing Up: Religion And Ethnicity In Israeli National Dolls, Maya Balakirsky Katz
Graduate School of Jewish Studies Publications and Research
This article considers Israel’s national image both at home and abroad through the framework of Israeli costume dolls, looking specifically at the way that gender played a role in Israel’s national image as it travelled from domestic production to international reception. Initially, predominantly female doll makers produced three main types of Israeli dolls, but over time the religious Eastern European male doll triumphed in the pantheon of national types. Produced for retail sale to non-Hebrew speaking tourists by immigrant woman, the Eastern European religious male doll came to represent Israel abroad while the market pushed representations of the Middle Eastern …

A Defense Of Source Rules In International Taxation, Mitchell A. Kane
A Defense Of Source Rules In International Taxation, Mitchell A. Kane
Faculty Articles
The concept of "source" is central to the functioning of the current international tax system. To the extent the "source" ofincome is meant to reflect the spatial location of income; however, many academic commentators have come to regard the concept as completely incoherent. Further, that incoherence is viewed as a partial explanation of the perceived artificiality and frailties of current instantiations of source rules. In this Paper I make three basic claims. First, it is in fact coherent to conceive ofthe source concept in terms ofthe spatial location of income. Second, most of the problems with current instantiations of source …

Disproportionate Contact: Youth Of Color In Maine's Juvenile Justice System, Robyn Dumont, Erica King Msw, George Shaler Mph
Justice Policy
Research staff at the USM Muskie School work in partnership with Maine’s Juvenile Justice Advisory Group (JJAG) in support of the goal of producing information to enhance Maine’s understanding of disproportionate minority contact (DMC) in the state. This research documents the rate of disproportionate minority contact (DMC) for youth involved in Maine’s juvenile justice system, differences in pathways to detention for youth of color, and the experiences of youth and families of color who have had contact with Maine’s juvenile justice system. It uses a relative rate index (RRI) to demonstrate how youth of color are treated in comparison to …

This article presents the scientific rationale for an ambitious ICDP drilling project to continuously sample Late Cretaceous to modern sediment in four different sedimentary basins that transect the equatorial Amazon of Brazil, from the Andean foreland to the Atlantic Ocean. The goals of this project are to document the evolution of plant biodiversity in the Amazon forests and to relate biotic diversification to changes in the physical environment, including climate, tectonism, and the surface landscape. These goals require long sedimentary records from each of the major sedimentary basins across the heart of the Brazilian Amazon, which can only be obtained …

In the long term, precipitation in the Central U.S. decreases by 25% during the seasonal transition from June to July. This precipitation decrease has intensified since 1979 and such intensification could have enhanced spring drought occurrences in the Central U.S., in which conditions quickly evolve from being abnormally dry to exceptionally dry. Various atmospheric and land reanalysis data sets were analyzed to examine the trend in the June-July seasonal transition. The intensified deficit in precipitation is accompanied by increased downward shortwave radiation flux, tropospheric subsidence, enhanced evaporative fraction, and elevated planetary boundary layer height, all of which can lead to …

Coral islands around the world are threatened by changing climates. Rising seas, drought, and increased tropical storms are already impacting island ecosystems. We aim to better understand lichen community ecology of coral island forests. We used an epiphytic lichen community survey to gauge Pisonia (Pisonia grandis R.BR.), which dominates forest conditions on Heron Island, Australia. Nine survey plots were sampled for lichen species presence and abundance, all tree diameters and species, GPS location, distance to forest-beach edge, and dominant forest type. Results found only six unique lichens and two lichen associates. A Multi-Response Permutation Procedures (MRPP) test found statistically distinct …

Current rates of global environmental and climate change pose potential challenges for migratory species that must cope with or adapt to new conditions and different rates of change across broad spatial scales throughout their annual life cycle. North American migratory hummingbirds may be especially sensitive to changes in environment and climate due to their extremely small body size, high metabolic rates, and dependence on nectar as a main resource. We used occurrence information from the eBird citizen-science database to track migratory movements of five North American hummingbird species (Archilochus alexandri, A. colubris, Selasphorus calliope, S. platycercus, and S. rufus) across …
Nurse Educators' Perspectives Of Supplemental Computer-Assisted Formative Assessment In An Associate Degree Nursing Program, Jennifer Buehler Sugg
Nurse Educators' Perspectives Of Supplemental Computer-Assisted Formative Assessment In An Associate Degree Nursing Program, Jennifer Buehler Sugg
Walden Dissertations and Doctoral Studies
Despite the implementation of various strategies to improve outcomes, the pass rates for the National Council Licensure Exam for Registered Nurses (NCLEX-RN) for an associate degree nursing (ADN) program continue to decrease. This study examined the use of a supplemental computer-assisted formative assessment (SCAFA) as a strategy for NCLEX-RN success. A qualitative case study with a theoretical framework based on constructivism was designed to investigate nurse educators' perspectives of this particular strategy for successful outcomes. To explore these perspectives, data were collected from face-to-face interviews with nurse educators and from program documents from 1 ADN program in the southeastern United …

Locating Universities Within The Phases Of Escalation Of Commitment To Intercollegiate Athletics, Calvin Nite, Michael Hutchinson, E. Nicole Melton, Adrien Bouchet
Journal of Applied Sport Management
Escalation of commitment has been studied extensively within management and has been found to be particularly prevalent within intercollegiate athletics. The purpose of this study was to broaden the scope of traditional escalation of com-mitment research by developing effective means for locating sport organizations within Staw and Ross's (1987) temporal model. In doing so, we moved beyond the typical qualitative case study approach and sought to provide more general-ized findings, both within the context of intercollegiate athletics and within the broader sport industry. Through identifying relevant factors within our data and combining those with other descriptive variables, we were able …

To predict regional-scale winter wheat yield, we developed a crop model and data assimilation framework that assimilated leaf area index (LAI) derived from Landsat TM and MODIS data into the WOFOST crop growth model. We measured LAI during seven phenological phases in two agricultural cities in China’s Hebei Province. To reduce cloud contamination, we applied Savitzky–Golay (S–G) filtering to the MODIS LAI products to obtain a filtered LAI. We then regressed field-measured LAI on Landsat TM vegetation indices to derive multi-temporal TM LAIs. We developed a nonlinear method to adjust LAI by accounting for the scale mismatch between the remotely …

The Aca, Provider Mergers And Hospital Pricing: Experimenting With Smart, Lower-Cost Health Insurance Options, Susan A. Channick
Faculty Scholarship
This paper addresses the issue of whether the recent significant uptick in provider mergers and the implementation of the Affordable Care Act have a particularly adverse effect on provider pricing in the commercial insurance market. Uncompetitive provider markets exacerbate already existing high cost issues such as lack of transparency in provider pricing, patient behavior that conflates reputation and quality, and payers’ inability, or at least reluctance, to exclude high-price providers from their networks. The ACA’s incentives for providers to coordinate patient care and hospitals’ revenue losses from reductions in Medicare reimbursement create further rationales for consolidation. The burden of finding …

The Ct20 Peptide As An Agent For Cancer Treatment, Rania Bassiouni
Electronic Theses and Dissertations
Due to cancer recurrence and the development of drug resistance, metastatic breast cancer is a leading cause of death in women. In the search for a new therapeutic to treat metastatic disease, we discovered CT20p, an amphipathic peptide based on the C-terminus of Bax. Due to inherent properties of its sequence and similarity to antimicrobial peptides, CT20p is a promising cytotoxic agent whose activity is distinct from the parent protein (e.g. does not cause apoptosis). CT20p is not membrane permeable but can be introduced to cells using polymeric nanoparticles, a method that promotes efficient delivery of the peptide into the …

Between Warrior And Helplessness In The Valley Of Azawa - The Struggle Of The Kel Tamashek In The War Of The Sahel, Patrick James Christian
Department of Conflict Resolution Studies Theses and Dissertations
This dissertation is an Investigation into the Tuareg involvement in violent conflict in the Sahara and the Sahel of North Africa from a sociological psychological perspective of unmet human needs. The research begins by establishing the structure and texture of the sociological, psychological, and emotional life patterns of their existence when not involved in violent conflict. This is followed by an examination of the pathology of Tuareg social structures that are engaged in intra and inter communal violence as perpetrators, victims, and bystanders. The first part of the research establishes normal conditions of the sociological life cycle and highlights natural …
