Defining "Navigability": Balancing State-Court Flexibility And Private Rights In Waterways, Maureen E. Brady Apr 2015

Defining "Navigability": Balancing State-Court Flexibility And Private Rights In Waterways, Maureen E. Brady

Cardozo Law Review

Over the course of American history, state courts have eliminated property rights in waterways through a quirk of public trust law: declaring the water in question to be "navigable" makes it public property, while declaring it "non-navigable" leaves the water subject to private control. The historical record is flooded with examples of these declarations by state courts. While some navigability rulings have protected public rights in waters against irrational private claims, others have abused this peculiarity to seize private property to placate irate, and even violent, interest groups.

The scope of this authority to craft navigability doctrine - especially whether …

Rural Health Care Information Access And The Use Of The Internet: Opportunity For University Extension, Biswa R. Dias, John C. Leatherman, Bonnie M. Bressers Apr 2015

Rural Health Care Information Access And The Use Of The Internet: Opportunity For University Extension, Biswa R. Dias, John C. Leatherman, Bonnie M. Bressers

Journal of Extension

The Internet has potential for improving health information delivery and strengthening connections between rural populations and local health service providers. An exploratory case study six rural health care markets in Kansas showed that about 70% of adults use the Internet, with substantial use for accessing health information. While there are statistical differences for general Internet use based on socio-economic characteristics, these "digital divides" are not so apparent in relation to Internet usage for health-related information. The study opens opportunities for Extension to include Internet usage as an added dimension to programs to aid in community and economic development.

Farmer Responses To Resistance Issues In Corn Rootworm To Bt Corn: Qualitative Analysis Of Focus Groups, Erin W. Hodgson, Robert Wright, Michael Gray, Tom Hunt

Journal of Extension

Western corn rootworm is an important corn pest in the U.S. Some farmers noted unexpected corn rootworm injury of transgenic hybrids as early as 2008; however, the full extent of product performance is still not fully understood. We conducted telephone focus groups with farmers in 2013 to gain their perspective of current and future issues for corn rootworm. Respondents were surprised how quickly corn rootworm injury escalated in their fields and were disappointed with incorrect diagnoses from consultants and seed companies. Most participating farmers saw university Extension as an unbiased source of information.

The Teachers' Perspective Of Critical Thinking Skills Development In Middle School Gifted Students In The Social Studies Classroom Through The Use Of Primary Sources, Lara Elizabeth Henry

Doctoral Dissertations and Projects

Gifted education, although having been a part of the United States educational fabric since the early 1900s, has various definitions and programs throughout the nation. Many gifted students are being placed in regular education programs without consideration of their needs. In 1991 Wineburg began researching and proposing using primary sources for analyzing and research skills in social studies classrooms as a possible way to meet the needs of gifted students while teaching problem solving and critical thinking skills. The purpose of this phenomenological study was to discover two connected concepts: The perception middle school social studies teachers' have toward critical …

Innovation And Leadership: When Does Cmo Leadership Improve Performance From Innovation?, Adam J. Bock, Andreas B. Eisengenrich, Dmitry Sharapov, Gerard George

Research Collection Lee Kong Chian School Of Business

Ensuring that organizational innovation generates value increasingly requires effective marketing management. Prior studies, however, report conflicting effects of chief marketing officer (CMO) leadership on how well the firm exploits innovation. These inconsistencies may be associated with firm-level innovation effort, customer focus, and industry type. We analyze archival data from 587 interviews with global CEOs to explain the effect of CMO leadership on outcomes of organizational innovation. CMO leadership of the firm's primary innovation mode is positively associated with product-market innovation effort but not marginal revenue from innovation. CMO leadership also moderates the relationship between customer focus and innovation revenue. Predictive …

“My Brain Database Doesn’T See Skin Color” Color-Blind Racism In The Technology Industry And In Theorizing The Web, Jessie Daniels Mar 2015

“My Brain Database Doesn’T See Skin Color” Color-Blind Racism In The Technology Industry And In Theorizing The Web, Jessie Daniels

Publications and Research

In this article, I examine three interconnected notions about color-blind racism and the Internet. The first is the fantasy that the Internet as a technology is color-blind with regard to race; the second is the reality that color-blind racism operates in the tech industry. The third notion is the way color-blind racism shapes Internet studies of race and racism, in which race is contained as a “variable” or as an “identity” that inhere exclusively in people of color, but that leaves the way race is embedded in structures, industry, and the very idea of the Internet unexamined. To explore these …

Next Generation Tanf: Reconceptualizing Public Assistance As A Vehicle For Financial Inclusion, Aleta Sprague Mar 2015

Next Generation Tanf: Reconceptualizing Public Assistance As A Vehicle For Financial Inclusion, Aleta Sprague

University of the District of Columbia Law Review

Fifty years into the War on Poverty, the ability to fully participate in American economic life is predicated on access to basic financial services and mechanisms; yet, public programs designed to support the economic advancement of people in poverty often explicitly excludeinte nded beneficiaries from meaningful engagement with financial institutions. To promote economic opportunity for families accessing public assistance, we need policy reforms that both remove access barriers and create entry points to the financial mainstream. Safe and affordable financial products are foundational to financial inclusion. Unbanked and "underbanked" households-the vast majority of which are low-income---often rely on high-cost credit, …

Understanding Philanthropy Consulting: A Tool To Identify The Roles And Capabilities Needed From External Support, Brian Leslie, Kelsey Noonan, Clint Nohavec Mar 2015

Understanding Philanthropy Consulting: A Tool To Identify The Roles And Capabilities Needed From External Support, Brian Leslie, Kelsey Noonan, Clint Nohavec

The Foundation Review

This article categorizes the distinct roles played by philanthropy consultants and presents a tool and framework for charitable foundations to identify and evaluate the roles and capabilities they need from those consultants.

The article categorizes seven capability areas, from strategy setting to talent development, that are core to all foundations. Then, it identifies trigger points within these capability areas that lead foundations to undertake projects that may require outside support. Third, the article maps the capabilities that foundations consider in determining whether and how to engage philanthropy consultants.

The resulting tool is scalable and broadly applicable, providing foundation staff and …

The Family Foundation Life Cycle And The Role Of Consultants, Melissa L. Nemon, Claudia J. Jacobs, Mary Phillips, Judy Sneath Mar 2015

The Family Foundation Life Cycle And The Role Of Consultants, Melissa L. Nemon, Claudia J. Jacobs, Mary Phillips, Judy Sneath

The Foundation Review

The dynamics unique to family foundations, including a dedication to preserving a legacy and to sharing decision-making among family members, are often a significant influence on a foundation’s governance and operations and may extend to how their experiences with consultants differ from those of other foundations or nonprofits.

This article, which draws on a survey and interviews with family foundations asking why, when, and how they hire consultants, looks at common experiences that lead family foundations to seek external help and how these foundations can learn from the experiences of their peers.

This article introduces the Family Foundation Life Cycle …

Balancing Content And Process Expertise In The Practice Of Foundation Consulting, Chris Cardona Mar 2015

Balancing Content And Process Expertise In The Practice Of Foundation Consulting, Chris Cardona

The Foundation Review

Despite foundations’ frequent recourse to consultants, little, if anything, has been written on the expertise required of foundation consultants and how they cultivate it. This article looks at the types of expertise that these consultants bring to their work and for which their clients hire them.

This expertise falls into three categories: process expertise, or what the consultant does with the client; content expertise, or what the grantmaker does; and hybrid expertise, consultant processes that are their own subject areas.

This article also offers examples of how content, process, and/or hybrid expertise might combine to address particular foundation needs, and …

The Friendship Journey: Developing Global Understanding In The Middle Grades, Kevin D. Besnoy, Ellen Maddin, Emily Steele, Sara Eisenhardt

Journal of Catholic Education

The goals of developing a global perspective are consistent with the faith-based values of Catholicism. The primary goal is to prepare students academically, morally, and socially to participate in a globalized world that constantly faces new problems. A key component of this is the understanding that other people, who may appear on the surface to be very different from themselves, have differences which have value and similarities which unite us. The purpose of this article is to present one Catholic school’s attempts to prepare its students to meet the challenges of citizenry in an international community and to describe the …

Mansfield Park Comes To Life: Teaching And Staging Elizabeth Inchbald’S Lovers’ Vows In An Austen Course, Misty Krueger Mar 2015

Mansfield Park Comes To Life: Teaching And Staging Elizabeth Inchbald’S Lovers’ Vows In An Austen Course, Misty Krueger

ABO: Interactive Journal for Women in the Arts, 1640–1830

This essay discusses how I incorporated readers theatre into a senior seminar on Jane Austen and her contemporaries. The article recounts how my students read Elizabeth Inchbald’s 1798 drama, Lovers’ Vows, and Austen’s 1814 novel, Mansfield Park, and then were inspired at the end of the seminar to take part in a readers theatre production of the play. In order to set up this pedagogical example, the essay addresses the theatrical episode of Mansfield Park, the controversies surrounding Lovers’ Vows, and the ways in which I edited the play and prepared students to create a “little …

“The Preservation Of Indigenous Knowledge In Contemporary Mexico In El Cultivo Del Maíz En Yojovi By Javier Castellanos Martínez.”, Ida Day Mar 2015

“The Preservation Of Indigenous Knowledge In Contemporary Mexico In El Cultivo Del Maíz En Yojovi By Javier Castellanos Martínez.”, Ida Day

Modern Languages Faculty Research

The author applies an ecocritical perspective to the study of Javier Castellanos' 1988 monograph of Yojovi corn farmers' testimonies, El cultivo del maíz en Yojovi. The author's ecocritical lens establishes Yojovi rights to determine food sustainability practices and to determine land resource use. In particular, the author examines the conflicts between Yojovi knowledge of corn varieties and their cultivation and the pressure to alter their practices to adhere to genetically modified corn crop production. She also reveals the conflicts between Yojovi narratives that situate humans within their natural habitats and the Western scientific paradigm's narratives that tend to separate humans …

Corruption And Entrepreneurship: Evidence From A Random Audit Program, Jamie Bologna, Amanda Ross Mar 2015

Corruption And Entrepreneurship: Evidence From A Random Audit Program, Jamie Bologna, Amanda Ross

Economics Faculty Working Papers Series

In this paper, we examine the effect of corruption on business activity in Brazilian municipalities. Previous research that has examined the impact of corruption has relied primarily on survey or conviction data, which may be problematic as these measures likely to be biased. We use a new measure of corruption that draws upon random audit data of municipal governments’ finances in Brazil. We find that higher levels of corruption cause reductions in the number of businesses operating in an area. Furthermore, we find that these effects become larger over time, suggesting that corruption is more detrimental to long-run economic activity. …

The News Media, Education, And The Subversion Of The Neoliberal Social Imaginary, Derek R. Ford Mar 2015

The News Media, Education, And The Subversion Of The Neoliberal Social Imaginary, Derek R. Ford

Education Studies Faculty publications

In this introductory essay, the special issue editors examine the relationship between the media and the neoliberal privatization of education in the U.S. They first take up an examination of news media journalism in late modernity and highlight how neoliberal politics under the guise of democratization of the news media have resulted in both the gutting of professional education journalism and the intensification of the representation of the interests of the economic elite. They next turn to the task of establishing a common and critical understanding of the term neoliberalism, locating it as an extension of Marx’s concept of primary …

Western North American Naturalist

Fringed myotis (Myotis thysanodes) is considered a bat species of conservation concern in Colorado and in western North America. The purpose of our research was to describe the geographic and elevational distribution of fringed myotis in Colorado and consider the potential influence of the Southern Rocky Mountains on the distribution of this species. We documented, mapped, and analyzed 729 Colorado capture and occurrence records for this species, and used 546 records in a 2-way ANOVA comparing elevational distribution among sex and reproductive classes. Mean elevation of occurrence was significantly different among reproductive classes (F = 7.03, P …

Lighting The Fuse: Building Regional Identity Through Public Library Services In Rural Central Appalachia, Laura C. Mcpherson

ASA Annual Conference

This presentation will relate survey and interview data that explore the perceptions and beliefs of librarians concerning the role of public libraries in fostering regional identity with a focus on libraries in rural Central Appalachia. As public libraries across the nation work to strengthen their connections to the communities they serve, the role of the library is being refined and redefined in relation to local needs and interests. During the past decade, the archival branch of librarianship has come to terms with the notion that by denying the inherently subjective nature of core archival duties such as acquisition, description, and …

Miners And Mentors: Memory And Experiences In Coal Camp Schools In Appalachia, Harley D. Walden Mar 2015

Miners And Mentors: Memory And Experiences In Coal Camp Schools In Appalachia, Harley D. Walden

ASA Annual Conference

Appalachian educational history is as diverse as its mountains and music. As the number of the living students and teachers who taught and learned in coal camp schools dwindle over the years, their memories and experiences will also fade with them, if not preserved for future generations. I interviewed my grandmother, who taught in a small, rural two-room schoolhouse during the 1947-1948 school year in order to acquire the perspective from a former teacher who taught in a learning environment similar to that of a coal camp school. I also interviewed Dr. Stan Maynard, who attended two coal camp schools …

Leveraging Oa, The Ir, And Crossdepartment Collaboration For Sustainability: Ensuring Library Centrality In The Scholarly Communication Discourse On Campus, Steve Brantley, Todd Bruns, Kirstin Duffin

Faculty & Staff Research & Creative Activity

More than halfway into the second decade of the 21st century, academic libraries are becoming more integrated in the scholarly life of their faculties than ever before. Important trends in scholarly communication, such as transitioning from subscription journals to open access journals, increasing amounts of “born digital” data and creative works, the growing importance of protecting one’s intellectual property rights, and keeping digital scholarship organized, managed, and preserved, are all areas where academic scholars and researchers require support services and assistance. Librarians are natural partners to provide these services.
