Rethinking Affirmative Consent In Canadian Sexual Assault Law: Neoliberal Sexual Subjects And Risky Women, Lise Gotell Jun 2015

Rethinking Affirmative Consent In Canadian Sexual Assault Law: Neoliberal Sexual Subjects And Risky Women, Lise Gotell

Akron Law Review

While the struggle for affirmative consent is typically framed as a feminist law reform project, I contend that we need to understand the legal elaboration of a positive and explicit consent standard in relation to wider shifts in governance. The second section of this article explores how the legal elaboration of affirmative consent in Canadian law might be seen as a specific expression of neoliberal governmentality, forging new normative sexual subjects who interact within a transactional sexual economy. In section three, I demonstrate how discourses of responsibilization and risk management inform recent Canadian sexual assault decisions, constituting the ideal victim …

Rationalizing The Constitution: The Military Commissions Act And The Duboius Legacy Of Ex Parte Quirin, Chad Deveaux Jun 2015

Rationalizing The Constitution: The Military Commissions Act And The Duboius Legacy Of Ex Parte Quirin, Chad Deveaux

Akron Law Review

Alexander Hamilton famously characterized the Judiciary as the “least dangerous” branch. It “has no influence over either the sword or the purse” and thus “must ultimately depend upon the aid of the executive arm even for the efficacy of its judgments.” But this perceived safeguard has sometimes proven to be the institution’s undoing. Faced with the prospect of appearing impotent, the Supreme Court has, on occasion, played the role of doctrinal apologist. The Court has bent seemingly immutable constitutional prerogatives to sanction Executive action when a contrary ruling would likely go unheeded.

Recipes For Success: Comparing Ala-Accredited Mlis Programs, Mandi Goodsett Jun 2015

Recipes For Success: Comparing Ala-Accredited Mlis Programs, Mandi Goodsett

Michael Schwartz Library Publications

Discussion about the MLIS degree and what could be done to produce well-prepared new librarians for the workforce abounds in the current literature. As the ALA Committee on Accreditation re-evaluates its standards, and frustrated librarians continue to add to the over 150 comments on the Library Journal editorial "Can We Talk about the MLS?" by Michael Kelley, the time to re-evaluate the MLIS degree has arrived. In order to effectively move forward, however, a gap in the literature must be addressed: an overview of the MLIS as it currently stands is needed. This dataset presents information about the current requirements, …

Book Repair, Letters, And Pamphlets... Oh My!, Avery N. Fox

Blogging the Library

A lot has been going on in Special Collections since my last blog post, so I’ll get you up to speed. As mentioned in my first post, I and the other interns created our own book. It was an awesome project and I learned to appreciate books as physical masterpieces and not just the words inside. I made my book with a black cover, and the end pages were made from homemade paper. [excerpt]

Divine Poetics: Representation Of Genre In Ovid's Metamorphoses 6.70-128, Hong Yoong Jun 2015

Divine Poetics: Representation Of Genre In Ovid's Metamorphoses 6.70-128, Hong Yoong

Foreign Languages & Literatures ETDs

In my thesis, I explore the generic allusion of two ekphrases in the textile competition between Minerva and Arachne. While various scholars have approached the story of Arachne based on Ovids critique of the Augustan regime, I focus more on the poetic representation of the two ekphrases in the context of their intertextual relationship with other Greek and Roman literary traditions. Minerva's tapestry is the embodiment of the heroic epic tradition similar to Homeric and Vergilian narrative, and Arachne's tapestry represents the archetype of the Hellenistic poetic tradition. While Ovid perceives the heroic epic tradition as the embodiment of Minerva's …

Santa Fe, New Mexico's Living Wage Ordinance And Its Effects On The Employment And Wages Of Workers In Low-Wage Occupations', Justin B. Hollis Jun 2015

Santa Fe, New Mexico's Living Wage Ordinance And Its Effects On The Employment And Wages Of Workers In Low-Wage Occupations', Justin B. Hollis

Economics ETDs

In June of 2004 the City of Santa Fe enacted a living wage ordinance requiring an $8.50 minimum wage, the largest increase of a universal coverage municipal wage floor over its previous prevailing minimum of any municipal living wage law preceding it. Using occupational employment and wage estimates from the U.S. Bureau of Labor Statistics Occupational Employment Statistics program, this paper analyzes the impact of Santa Fe's living wage on workers in low-wage occupations. Our estimates compare labor market outcomes for low-wage workers in Santa Fe and Albuquerque and show low-wage workers in Santa Fe experienced substantial hourly wage increases, …

Gregório De Matos Guerra’S Poetic Corpus As An Analogy For The Duality Of Colonial Brazil, Viviane Ferreira De Faria Jun 2015

Gregório De Matos Guerra’S Poetic Corpus As An Analogy For The Duality Of Colonial Brazil, Viviane Ferreira De Faria

Spanish and Portuguese ETDs

In this thesis I propose a model of analysis for Gregório de Matos Guerras poetry based on the scholarly understanding of his Satirical poetry as a representation of Colonial Brazil as a body in decay. The comparison between the Colony and Matos Guerra's poetry allows for the dramatization of the tension in the Colony's life: on one hand, the new land is seen as a virtuous paradise; and, on the other, as a place where its people and resources are exploited and corrupted. The first view of the Colony is depicted by Matos Guerra Lyrical poetry, thus, in the first …

Developing Utah Juniper Into A Useful Species For Dendrochronology, Calli Nielsen, Dr. Matthew F. Bekker Jun 2015

Developing Utah Juniper Into A Useful Species For Dendrochronology, Calli Nielsen, Dr. Matthew F. Bekker

Journal of Undergraduate Research

Utah juniper is rarely used by dendrochronologists in tree-ring applications. In the global species database, Utah juniper has a score of 1, which means that it typically only crossdates within its own site, and is therefore not useful in tree-ring research. This mentored research project was conducted to demonstrate that it is a potentially very valuable species. Our preliminary research showed a very high correlation among other juniper sites in Utah, making us confident that if we moved forward, our further results would prove the usefulness of this species. In northern Utah, traditionally used species aren’t available because we are …

The "Free Road": Indigenous Travel And Rights Of Passage On The Missouri River, Christopher Steinke Jun 2015

The "Free Road": Indigenous Travel And Rights Of Passage On The Missouri River, Christopher Steinke

History ETDs

Well before Lewis and Clark, Native Americans traveled on the Missouri River, crossing it to visit friends and family members, shipping supplies downriver, and conducting visitors toward their villages. Their mobility on the upper Missouri River, an imposing and dangerous continental divide, granted them the power to define rights of passage across the midcontinent. Following the collapse of New Cahokia, Arikara and Mandan settlers pressed up the river valley and established expansive transportation and communication networks that stretched across the Missouri watershed. By 1650 their villages were influential centers of Native North America and places where river crossings held not …

A Case Study In Toponymy: Sampling And Classifying A Tri-Lingual Place Name Inventory Found In The North-Central State Of New Mexico, Roberto H. Valdez Jun 2015

A Case Study In Toponymy: Sampling And Classifying A Tri-Lingual Place Name Inventory Found In The North-Central State Of New Mexico, Roberto H. Valdez

Geography ETDs

The north-central portion of the State of New Mexico has an extensive distribution of geographic names applied to landscape features from documented sources and from living oral tradition. Many of these geographic names originated from three distinct socio-linguistic groups, among which are names in three languages applied to single features. The three primary languages involved are Tewa, Spanish and English. Names that apply to topographical features and a selection of man-build features on the landscape were collected, mapped, and useful approaches to analyze them were developed from literature on toponymy, the study of place names. This study offers an analysis …

Regulating Electronic Legal Support Across State And National Boundaries, Cassandra Burke Robertson Jun 2015

Regulating Electronic Legal Support Across State And National Boundaries, Cassandra Burke Robertson

Akron Law Review

Given the combination of digital communications, porous state and national borders, and a growing need for affordable legal services, it is likely that practices now at the margins of legal practice will quickly grow in scope. Technological changes and increasing globalization allow foreign lawyers to compete in the U.S. market for legal service. The downward price movement from this increased competition allows middle-class individuals who would otherwise have represented themselves to hire legal counsel — albeit, in some cases, counsel from individuals not licensed to practice in the client’s jurisdiction, or even in the client’s home country. Regulators, used to …

Replacing Sustainability, Robin Kundis Craig, Melinda Harm Benson Jun 2015

Replacing Sustainability, Robin Kundis Craig, Melinda Harm Benson

Akron Law Review

This Article argues that, from a policy perspective, we must face the impossibility of even defining—let alone pursuing—a goal of “sustainability” in a world characterized by such extreme complexity, radical uncertainty, and discomfiting loss of stationarity. Instead, we need new policy directions and orientations that provide the necessary capacity to deal with these “wicked problems” in a meaningful and equitable way. The realities of current and emerging SES dynamics warrant a new set of tools and approaches to governance of those systems. Part II of this Article provides a brief history of sustainability and sustainable development, including corollary emphases on …

The Inquisitorial Advantage In Removal Proceedings, Won Kidane Jun 2015

The Inquisitorial Advantage In Removal Proceedings, Won Kidane

Akron Law Review

A thoughtful student once asked an immigration judge during an informal exchange: “If the respondent in your court who has just been found deportable appears to qualify for cancellation of removal but has failed to fill out the form properly, what would you do?” The judge responded matter-of-factly, “I am not his attorney. If the application is not completed properly, I don’t have an application to consider.” It goes without saying that the judge would then order the respondent deported for not submitting a properly completed application for relief. The judge’s response might have seemed harsh or even insensitive to …

The Daily Relationship Between Food Insecurity And Medication Adherence Among People Living With Hiv, Jennifer A. Pellowski Jun 2015

The Daily Relationship Between Food Insecurity And Medication Adherence Among People Living With Hiv, Jennifer A. Pellowski

Doctoral Dissertations

Limited access to resources based on social position can significantly impact health behaviors. Previous research on food insecurity and HIV has focused on establishing the relationship between food insecurity and antiretroviral (ARV) medication non-adherence in a variety of social contexts (i.e. resource poor and resource rich environments). However, one main caveat of these studies is the level of analysis. Previous studies have used cross-sectional and longitudinal studies that concentrate on the individual level of analysis. However, these study designs do not allow for a true test of whether ARV medication non-adherence occurs on days with limited access to food.

The …

We Subdued The Body But Not The Courage': Popular Literature, Sovereign Authority, And Ceremonial Rites Of Power During The Dutch Revolt, 1550-1598', Breanna Griego-Schmitt Jun 2015

We Subdued The Body But Not The Courage': Popular Literature, Sovereign Authority, And Ceremonial Rites Of Power During The Dutch Revolt, 1550-1598', Breanna Griego-Schmitt

History ETDs

By engaging with the vast body of pamphlet literature, rarely seen engravings and images, personal and official correspondence between leading figures, edicts and proclamations, visual renderings and written accounts of public ceremonials, and songs, poems, and placards published between 1550 and 1598, this dissertation creates a comprehensive analysis of the religio-political relations and social change in the Low Countries. My work draws upon the premises that appeared most consistently in the literature and images circulated during the Dutch Revolt: strategy and communication, sovereignty and constitutionalism, freedom of conscience, political theory in the Low Countries, rites of power, and the creation …

Ethnic Differences In Medicinal Plant Use Among University Students: A Cross-Sectional Survey Of Self-Reported Medicinal Plant Use At Two Midwest Universities, Rachel Craft, Katrina C. Mcclure, Steven Corbett, Maria Pontes Ferreira, Ashley M. Stiffarm, Kelly Kindscher Jun 2015

Ethnic Differences In Medicinal Plant Use Among University Students: A Cross-Sectional Survey Of Self-Reported Medicinal Plant Use At Two Midwest Universities, Rachel Craft, Katrina C. Mcclure, Steven Corbett, Maria Pontes Ferreira, Ashley M. Stiffarm, Kelly Kindscher

Wayne State University Associated BioMed Central Scholarship

Background: Numerous surveys of medicinal plant use among college students abound, but none compare use between students enrolled in two different Universities with significantly different ethnic compositions. The objective of this study is to compare medicinal plant use between two different ethnic college populations and explore differences between student medicinal plant users and non-users for comparison with previous research.

Methods: Students (n = 721) at a large research university (n = 498) and a Pan-Tribal University for Native Americans (n = 233) completed surveys in October 2011 to assess past year medicinal plant use. The Mann-Whitney U test, Chi Square …

A Comprehensive Method For Coordinating Distributed Energy Resources In A Power Distribution System, Shahin Abdollahy Jun 2015

A Comprehensive Method For Coordinating Distributed Energy Resources In A Power Distribution System, Shahin Abdollahy

Electrical and Computer Engineering ETDs

Utilities, faced with increasingly limited resources, strive to maintain high levels of reliability in energy delivery by adopting improved methodologies in planning, operation, construction and maintenance. On the other hand, driven by steady research and development and increase in sales volume, the cost of deploying PV systems has been in constant decline since their first introduction to the market. The increased level of penetration of distributed energy resources in power distribution infrastructure presents various benefits such as loss reduction, resilience against cascading failures and access to more diversified resources. However, serious challenges and risks must be addressed to ensure continuity …

Oral Health Care Access In New Hampshire, Eleanor M. Jaffee, Joan Widmer, Lisa Speropolous Jun 2015

Oral Health Care Access In New Hampshire, Eleanor M. Jaffee, Joan Widmer, Lisa Speropolous

Carsey Publications

In this brief, authors Eleanor M. Jaffee, Joan Widmer, and Lisa I. Speropolous provide an overview of the current state of oral health care in New Hampshire. They report that although New Hampshire is rated above the national average on most measures of pediatric oral health, performance varies substantially by county and by region. Access to adequate oral health care for both children and adults is particularly challenging for low-income families in the sparsely populated northern region of the state. Programs that address oral health care access issues by bringing services to those with the greatest need, such as school-based …

Virtual Capstone Design Teams: Preparing For Global Innovation, Jay Goldberg, Susannah Howe Jun 2015

Virtual Capstone Design Teams: Preparing For Global Innovation, Jay Goldberg, Susannah Howe

Engineering: Faculty Publications

Global innovation requires collaboration between groups of people located in different parts of the world, and is a growing trend in industry. Virtual teams are often used to manage new product development projects. These teams are similar to traditional teams but are geographically separated and rely heavily on virtual methods of communication (email, Skype, teleconferencing, etc.) instead of regular face-to-face meetings. Experience working as a member of a virtual capstone design team can help prepare students for this growing trend. To begin preparing students for work on virtual teams in industry, we co-advised two virtual capstone design projects with students …

The Challenge Of Involvement And Detachment In Participant Observation, Enock Takyi Jun 2015

The Challenge Of Involvement And Detachment In Participant Observation, Enock Takyi

The Qualitative Report

The technique of participant observation, and the roles involved, have been widely discussed in the literature across a range of settings and topics. However, researchers rarely argue for a particular role that a participant observer should adopt. In this paper, I attempt to argue for the participant-as-observer role. I do so by reviewing existing literature on the topic. I argue that the complete observer and the complete participant roles are not applicable in today's research environment because, aside from their practical problems, they violate the ethical requirement of informed consent. I argued further that the observer-as-participant role, with its limited …

Short Report: Raising Children Bilingually, Henriette Langdon

Faculty Publications

The purpose of this article is to describe the process of becoming bilingual by sharing my own experience being raised in a four-language environment and how it influenced the upbringing of my daughter in two, and subsequently three languages. The other purpose is to dispel the myth that children with language, developmental and/or intellectual impairments or those diagnosed as being on the autism spectrum cannot or should not be exposed to two languages because it is confusing, or because they simply cannot handle two languages due to their disability. As a bilingual speech and language pathologist (SLP) who has practiced …
