The Impact Of External Contexts On Alliance Governance In Biotech–Pharmaceutical Firm Alliances, Joanne L. Scillitoe, Shanthi Gopalakrishnan, Michael D. Santaro
Organization Management Journal
The interest in strategic alliances has increased over the years, especially in high tech global industries such as biotechnology, as firms seek to gain access to needed resources, expertise, and knowledge for developing and commercializing new products and technologies. The governance structure of these alliances, which is an important consideration in understanding alliance formation and performance, is influenced by both external and internal contexts of the alliance partners. However, evidence from prior research has been inconclusive regarding the impact of external contexts on alliance governance selection. To better understand this impact, we simultaneously examine three key partner external contexts - …

La Balouta Exhumed Karst: A Roman Gold-Mine-Derived Landscape Within The Las Médulas Unesco World Heritage Site (Spain), José M. Redondo-Vega, Eduardo Alonso-Herrero, Javier Santos-González, Rosa B. González-Gutiérrez, Amelia Gómez-Villar
International Journal of Speleology
The La Balouta Valley, located in the extreme SW region of the Las Médulas Natural Monument and UNESCO World Heritage Site (León, Spain), is one of the largest gold-mining sites developed by the Romans more than 2,000 years ago when excavating a thick series of red Miocene sediments in the area. The main determining feature of the La Balouta Valley, especially if we compare it with the Sil River Valley of which it is a tributary, is its status of a non-functional valley. It is a dry paleo-valley with a flat bottom and is characterized by limited surface water runoff …

Environmental tolerance of a species has been shown to correlate positively with its geographical range. On the Ordos Plateau, three Caragana species are distributed sequentially along the precipitation gradient. We hypothesized that this geographical distribution pattern is related to environmental tolerances of the three Caragana species during seed germination and seedling emergence stages. To test this hypothesis, we examined seed germination under different temperature, light and water potentials, and monitored seedling emergence for seeds buried at eight sand depths and given different amounts of water. Seeds of C. korshinskii germinated to high percentages at 5 : 15 to 25 : …
Hyperlegality And Heightened Surveillance: The Case Of Threatened Species Lists, Irus Braverman
Hyperlegality And Heightened Surveillance: The Case Of Threatened Species Lists, Irus Braverman
Journal Articles
My contribution to the Debate "Thinking about Law and Surveillance" focuses on the project of governing nonhuman species through care, briefly pointing to how law and surveillance are interwoven in this context and to how conservation's biopolitical regimes are increasingly becoming more abstract, standardized, calculable, and algorithmic in scope. I argue that conservation’s focus on governing through care lends itself to heightened modes of surveillance and to hyperlegality - namely, to the intensified inspection and regulation of both governed and governing actors. I start with some preliminary explanations about my atypical use of the terms surveillance, law, and biopolitics.
Judicial Notice And The Law's "Scientific" Search For Truth, Christopher Onstott
Judicial Notice And The Law's "Scientific" Search For Truth, Christopher Onstott
Akron Law Review
Part I of this Article begins by introducing the concept of judicial notice followed by a short background defining the scope of scientific and technical principles. Part II addresses the problems created by the current judicial notice standard. The standard’s text is problematic, and courts’ diverse interpretations of the standard have also created problems. Part III analyzes whether scientific and technical principles merit a different judicial notice standard specifically for them. This Part concludes that the inherent inconsistency of science and technical knowledge with the current standard and the judicial shortcomings in scientific/technical competence justify different legal treatment. Finally, Part …
Thomas Jefferson And The Establishment Clause, Mark J. Chadsey
Thomas Jefferson And The Establishment Clause, Mark J. Chadsey
Akron Law Review
The purpose of this paper is to ask whether the historical record actually supports either of these assumptions. A note about my mode of analysis is necessary at this juncture. When inquiring about Jefferson’s influence on the Establishment Clause, it is important to focus on the entire process by which it was adopted rather than its mere introduction by Madison in the House of Representatives. Its adoption, after all, required the assent of two-thirds of both chambers of Congress, three-fourths of the state legislatures, and the support of a majority of the American public. Without the requisite support of all …

Agrarian Future(S) Of Rural Nepal: Revitalizing Peasant Agriculture?, Ramesh K. Sunam, Keshab R. Goutam
HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies
Discourses on peasant agriculture have heightened in the context of recurrent food crisis and persistent poverty in Nepal as in many parts of the global South. Although an industrialized model of agriculture has been promoted as a pathway to a food-secure future, it has been heavily criticized for being environmentally destructive and socially unbearable. In this broader context, we examine peasant farming to explore enabling factors and barriers for its revitalization in Nepal, where the vast majority of rural people depends on farming for their livelihoods. This research draws on case studies of two agrarian villages characterized mainly by the …

"As Our Ancestors Once Lived": Representation, Performance, And Constructing A National Culture Amongst The Nagas Of India., Arkotong Longkumer
HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies
This paper focuses on how a national culture emerges by examining the Nagas of India. To appreciate this process, the confluence of British colonialism, the postcolonial situation, and contemporary performance of Naga identity (visible in the Hornbill Festival) must be analyzed. I will argue that the colonial era representation of ‘primitivism’ of the Nagas continues into postcolonial narratives of ‘imperialist nostalgia’ disseminated primarily through travel, popular media and museum exhibitions. I will argue that the Nagas are not simply passive onlookers, but active participants in this enterprise through the strategic articulation of a distinct Naga national image. I will demonstrate …

Biological Evaluations: Blood, Genes, And Family, Janet L. Dolgin
Akron Law Review
The next Part of the Article (Part II) provides a brief overview of the ideology in terms of which society understood the family during the nineteenth, and most of the twentieth, century. Part III then summarizes the increasing readiness of society and of lawmakers since the 1960s, openly to premise delimitations of family on values once associated with the marketplace, but not the home. Parts II and III provide background to Part IV. Part IV, the heart of the Article, focuses on contemporary understandings of family that preserve a central role for the biological correlates of domestic relationships. The Part …

Global Borderlands: A Case Study Of Subic Bay Freeport Zone, Philippines, Victoria Reyes
Global Borderlands: A Case Study Of Subic Bay Freeport Zone, Philippines, Victoria Reyes
Growth and Structure of Cities Faculty Research and Scholarship
By developing the concept of “global borderlands”–semi-autonomous, foreign-controlled geographic locations geared toward international exchange–this article shifts the focus of globalization literature from elite global cities and cities on national borders to within-country sites owned and/or operated by foreigners and defined by significant social, cultural, and economic exchange. I analyze three shared features of these sites: semi-autonomy, symbolic and geographic boundaries, and unequal relations. The multi-method analyses reveal how the concept of global borderlands can help us better understand the interactions that occur in the contemporary era of globalization across people of different nationalities, classes, and races/ethnicities as well as the …

Urban Hum: Memory Theater Of The City, Sandra Uskokovic, Boris Bakal
Journal of Urban Culture Research
The Urban Hum platform consists of hybrid theatrical, anthropological, urban and social presentations of deliberately chosen urban, public spaces that are presented as a performative game-structure containing the elements of theatre, dance, musical, stand - up and lecture. Urban Hum emphasizes historically rooted continuities (or discontinuities) of specifi locations, by creating a tool for artists, architects, urban planners, politicians and historians, in their rethinking and reconceptualization of the city as a vibrant, dynamic, and sustainable habitat, while aiming to serve the citizens in proposing and implementing their solutions. Urban Hum is looking for those type of creative solutions that will …

Preparing For Humanitarian Demining In Post-Conflict Colombia, Carl Case
Preparing For Humanitarian Demining In Post-Conflict Colombia, Carl Case
The Journal of Conventional Weapons Destruction
Nearly a decade after launching an effort to build national capacity to clear landmines from its territory, the Colombian government still faces significant challenges in addressing the country’s mine problem, which has claimed more than 11,000 victims since 1991.1 Although the overall number of new landmine victims significantly decreased over the past eight years, survey and clearance work has been limited to more secure zones of the countryside because of the threat from nonstate armed groups to deminers and people living in conflict areas. Meanwhile, the risk to civilians living in parts of the country where demining activities have …
