The Role Of Cognitve Distortions In Adaptation To Disability And Perceived Quality Of Life In Spinal Cord Injury Survivors, Kerri M. Garruba Jan 2015

The Role Of Cognitve Distortions In Adaptation To Disability And Perceived Quality Of Life In Spinal Cord Injury Survivors, Kerri M. Garruba

PCOM Psychology Dissertations

Traumatic spinal cord injury (SCI) is a sudden, dramatic insult to the central nervous system that results in instant loss of sensory and/or motor function. In addition to physiological changes, survivors also endure both cognitive and emotional changes that increase susceptibility to depression, anxiety, and suicidality, all of which have been associated with cognitive distortions. This study sought to investigate the influence of cognitive distortions in relation to the ability to adapt to disability and establish a high quality of life among spinal cord injury survivors. Participants were 116 men and women living with spinal cord injury recruited via the …

Retirement Values: What Explains Career Transition And Well-Being, Gregg Lunceford Jan 2015

Retirement Values: What Explains Career Transition And Well-Being, Gregg Lunceford

Student Scholarship

In 2011, individuals in America's baby boomer cohort began reaching their full retirement age of 65. It is estimated that approximately 10,000 baby boomers will turn age 65 each day until 2031. Retirement is being discussed more frequently as a greater number of people try to figure out if and how they would like to transition from their primary careers. Our research focused on successful professionals between the ages of 50 and 75 to understand what factors contribute to the decision to make a transition toward retirement. From the study, we learned that retirement is a difficult decision and may …

Bridging Executive Succession Gaps: Organizational Factors That Most Accelerate Executive Readiness, Carolynn Cameron Jan 2015

Bridging Executive Succession Gaps: Organizational Factors That Most Accelerate Executive Readiness, Carolynn Cameron

Student Scholarship

Much has been written on the topic of leadership development however little on the development of top executives, and virtually nothing on the most efficient ways of developing executives. With succession pipelines to executive jobs weak across S&P 500 firms, executive succession weakness poses a real financial, continuity and governance risk to systems globally. To address this phenomenological gap, the authors conducted a qualitative inquiry involving semi-structured interviews with managers in a single S&P 50 global firm that operates across three industries. By probing into the "lived worlds" of these executive successors and high performing non-successors, new insight has been …

Droughts, Floods, And Wildfires: Paleo Perspectives On Disaster Law In The Anthropocene, Ryan Stoa Jan 2015

Droughts, Floods, And Wildfires: Paleo Perspectives On Disaster Law In The Anthropocene, Ryan Stoa

Faculty Publications

Humanity’s impact on the earth has become so pronounced that momentum is building toward adopting a new term for the modern geological age — the “Anthropocene.” The term signifies that human activity has reached a scale that it is now a planetary force capable of shaping ecosystems and natural processes. And yet, anthropocentric natural resources management and environmental lawmaking in the United States reveals a lack of control in managing natural systems and fostering resilience to extreme events. These systems do not easily conform to the whims of reactionary environmental policies. Droughts, floods, and wildfires, in particular, are often conceptualized …

Extralegal Supreme Court Policy Making, Joelle A. Moreno Jan 2015

Extralegal Supreme Court Policy Making, Joelle A. Moreno

Faculty Publications

The Colbert Report aired its final episode on December 18, 2014. Nine years earlier, on the first episode, Stephen Colbert coined the word “truthiness.” Truthiness satirized contemporary disinterest in empirical information in a country increasingly "divided between those who think with their head and those who know with their heart.” Truthiness was not just the Merriam-Webster word of the year. Over the past decade, it has been the unspoken mantra of reporters who give equal time to climate science denialists, faith healers, and vaccine refusers. When Justices of the Supreme Court decide questions of scientific or empirical fact — such …

The Law And Politics Of The Charles Taylor Case, Charles Chernor Jalloh

Faculty Publications

This article discusses a rare successful prosecution of a head of state by a modern international criminal court. The case involved former Liberian president Charles Taylor. Taylor, who was charged and tried by the United Nations-backed Special Court for Sierra Leone (“SCSL”), was convicted in April 2013 for planning and aiding and abetting war crimes, crimes against humanity, and other serious international humanitarian law violations. He was sentenced to 50 years imprisonment. The SCSL Appeals Chamber upheld the historic conviction and sentence in September 2013. Taylor is currently serving his sentence in Great Britain. This article, from an insider who …

Faculty Publications

Using primary sources from the East Florida Papers, this article explores colonial legality in St. Augustine and the Province of East Florida during the second Spanish period from 1783 to 1821. In addition to discussing the promulgation of the Constitution of Cádiz and its effects, the article reaches into legal records dealing with civil and testamentary cases to explore and to describe aspects of private law in this North American Spanish colony. Economic and social relations are revealed in the sources that are rich in legal information concerning slavery, family, religion, trade, and landholding. The article concludes that the sources …

Rights, Remedies, And The Quantum And Burden Of Proof, Joelle A. Moreno Jan 2015

Rights, Remedies, And The Quantum And Burden Of Proof, Joelle A. Moreno

Faculty Publications

It is tempting to commemorate the 2014 centenary of the exclusionary rule by celebrating our historically progressive role in constitutional rights protection, but those familiar with the facts know that Fourth Amendment violations persist unabated. As New Yorkers consider Judge Scheindlin’s damning assessment of police stop-and-frisk practices, and the country erupts in protests following fatal police encounters, are legal scholars who continue to pontificate on constitutional bona fides addressing “real” Fourth Amendment questions?

Traditional academic abstraction and artificial doctrinal divides obscure the fact that rights and remedies are defined by their operation. Constitutional rights have no value if, after they …

The Liminal Workplace, Michael O'Hare Jan 2015

The Liminal Workplace, Michael O'Hare

Student Scholarship

This study investigates how managers, executives and professionals (MEP) working 50 or more hours per week and using Information Communication Technology (ICT) to stay connected with their work 24/7 manage their energy and thrive at work. Based on interviews with these subjects, we learn that they have adapted ICT to help them achieve the goals of their "protean careers" and meet the challenges of the transitional or liminal workplace. We also discovered that they function in an autopoietic fashion to rejuvenate themselves in the work domain by physical exercise, managing relationships, and through introspective reflection. We were surprised that for …

Salvaging The North Carolina Teacher-Cyberbullying Statute, James L. Seay Iii Jan 2015

Salvaging The North Carolina Teacher-Cyberbullying Statute, James L. Seay Iii

Campbell Law Review

In 2012, the North Carolina General Assembly criminalized student Internet activity intended to “torment” school employees. This Comment contends that the legislation violates the First and Fourteenth Amendments. It violates the First Amendment because it creates both subject matter and viewpoint limitations on speech. It violates the Fourteenth Amendment because the requirement that the student must intend to “torment” a school employee creates an impermissibly vague standard. This Comment suggests that the North Carolina General Assembly could correct the constitutional deficiencies in the legislation through revisions that limit punishment to “true threats.” Such revisions would reign in the broad coverage …

Restructure And Reform: Products-Liability Law In North Carolina, J. Stanley Mcquade, Olivia L. Weeks

Campbell Law Review

This Article suggests that, although previous revisions to the North Carolina Products Liability Act brought progress, more revisions are needed, and these revisions will be best accomplished by incorporating additional measures into the act, especially those that have gained wide acceptance elsewhere. Part I of this Article provides a brief introduction to the early development of products liability law. Part I.A discusses tort-law influences in products liability, and Part I.B focuses on contributions from contract law. Parts II.A and II.B briefly describe MUPLA and the Restatement (Third) of Torts: Products Liability, respectively. Part III discusses the current state of products-liability …

Divested Of Jurisdiction? The Effect Of Filing A Notice Of Appeal While A Posttrial Tolling Motion Is Pending Before The Trial Court, Katie Greene Jan 2015

Divested Of Jurisdiction? The Effect Of Filing A Notice Of Appeal While A Posttrial Tolling Motion Is Pending Before The Trial Court, Katie Greene

Campbell Law Review

What happens when there is a tolling motion under Rule 3 of the North Carolina Rules of Appellate Procedure pending before a trial court and a subsequent notice of appeal is filed? As the case law currently stands, depending on which of three tolling motions is pending, the trial court may be divested of jurisdiction to rule on the motion - a divestiture that could lead the appellate court to dismiss the appeal as untimely. This Article argues that the North Carolina courts have drawn arbitrary distinctions between the different tolling motions to determine whether a trial court is divested …

A Narrative Study Of Emotions Associated With Negative Childhood Experiences Reported In The Adult Attachment Interview, Lynne Hartman Jan 2015

A Narrative Study Of Emotions Associated With Negative Childhood Experiences Reported In The Adult Attachment Interview, Lynne Hartman

Antioch University Dissertations & Theses

Attachment patterns, which tend to be stable over time, are passed from one generation to the next. Secure attachment has been linked to adaptive social functioning and has been identified as a protective factor against mental illness. The parents’ state of mind with regard to attachment—as measured with the Adult Attachment Interview (AAI) (Main, Goldwyn, & Hesse, 2002)—predicts the attachment classification for the infant in Ainsworth’s Strange Situation Procedure (Ainsworth, Blehar, Waters, & Wall, 1978). Earned-secure individuals have overcome negative childhood experiences to achieve a secure state of mind in adulthood. Earned security, like continuous security, strongly predicts infant security …

Data were collected through participant interviews with primary caregivers (n=10) who responded to recruitment notices posted on (1) listservs by organizations directly affiliated with early intervention and child care services; (2) local Internet classified sites; and (3) through word of mouth. The research demonstrated that caregivers who learned of their child’s disability in a prenatal diagnosis or prior to an adoption identified with having a greater sense of choice and control over their …

Impact Assessment Of Facial Recognition Algorithms' Performance When Modifying Nose Dimensions, Jacob Wolen Jan 2015

Impact Assessment Of Facial Recognition Algorithms' Performance When Modifying Nose Dimensions, Jacob Wolen

Graduate Theses, Dissertations, and Problem Reports (ETD)

This work quantitatively measures the impact of modifying the nasal width and length dimensions, in a simulated plastic surgery, on the Facial Recognition algorithms, Principal Component Analysis (PCA), Linear Discrimination Analysis (LDA), and Local Binary Patterns Histogram (LBPH). This was integrated through the use of OpenCV. It was found that as the nose width increases beyond 40% its original width, there is an average decrease in facial recognition performance of up to 14%. It was also found that as the nose was modified vertically, there was less than a 3% decrease in performance for the facial recognition algorithms. These rates …

Effects Of Input Modality On Capturing Notes, Chaya Bijani Jan 2015

Effects Of Input Modality On Capturing Notes, Chaya Bijani

Master's Theses

The features of the smartphone make it an indispensible commodity of Western urban lifestyles. However, the most common problems of using a mobile device for work-related activities are limited screen space and poor input techniques. People in the workforce whose daily job entails being in a mobile environment generally prefer to carry light, mobile devices along with a pen and a notepad. The purpose of this study was to investigate optimal input modality for taking notes. The three modes of input evaluated were spoken notes, typing on the phone, and writing by hand using a pen and paper. The variables …

Comparing Taxi Clearance Input Layouts For Advancements In Flight Deck Automation For Surface Operations, Lara W.S. Cheng Jan 2015

Comparing Taxi Clearance Input Layouts For Advancements In Flight Deck Automation For Surface Operations, Lara W.S. Cheng

Master's Theses

Airport moving maps (AMMs) have been shown to decrease navigation errors, increase taxiing speed, and reduce workload when they depict airport layout, current aircraft position, and the cleared taxi route. However, current technologies are limited in their ability to depict the cleared taxi route due to the unavailability of datacomm or other means of electronically transmitting clearances from ATC to the flight deck. This study examined methods by which pilots can input ATC-issued taxi clearances to support taxi route depictions on the AMM. Sixteen general aviation (GA) pilots used a touchscreen monitor to input taxi clearances using two input layouts, …

Seeing Success: Biographies Of Low-Income Students, Julia M. Morrice Jan 2015

Seeing Success: Biographies Of Low-Income Students, Julia M. Morrice

Master's Theses

The purpose of this narrative ethnographic study was to explore the success stories and lived experiences of six low-income students, utilizing an asset-based approach and attention to cultural wealth. Low-income students are less likely to attend college, and those that do are less likely to complete a degree. There is presently a lack of asset-based research that explores the successes of low-income students. A semi-structured interview protocol yielded biographical narratives of low-income students, which included discussions about identity and provided insight into the cultural wealth possessed by low-income students. In an effort to better understand the use of visual methodologies …

Tales Of Archaeological Places: Visualizing Mayan Pre-Colonial Settlement Patterns, Angela Ivanov Jan 2015

Tales Of Archaeological Places: Visualizing Mayan Pre-Colonial Settlement Patterns, Angela Ivanov

Master's Theses

In order to visualize ancient Mayan settlement patterns and demography through time, data derived from 26 published archaeological sites were collected and plotted onto three discrete map media. These data were subdivided into six time periods ranging from Pre-Classic to Post-Classic, and were simulated for each map medium. Specific attention was given during the selection of geographical locations, natural landscape features, map annotation, layers and coordinates. Tabulated information were site names, coordinates, site founding dates, site decline/abandonment dates, and estimated population. Combined with existing country base map layers downloaded from online geographical sources and time series animation (an animated map), …

Efficient Message Propagation In Dense Linear Ad-Hoc Networks, Shiva Moballegh Jan 2015

Efficient Message Propagation In Dense Linear Ad-Hoc Networks, Shiva Moballegh

Master's Theses

In this thesis, the dynamics of the cooperative broadcast in high density 1-dimensional (1D) networks is studied using multiple levels of relays. The benefits of the cooperative broadcast in terms of transmission range and power efficiency are evaluated by approximating the network as a continuum of nodes. Two transmission protocols are studied, the single-shot transmission and the continuous source transmission. In the single-shot transmission, the source node transmits a single message, whereas in the continuous source transmission, it transmits independent messages periodically adding signal interference into the picture. For each case, the analytical expressions for successful broadcasting are presented as …

Measuring Tsunami Exposure And Pedestrian Evacuation Potential For The City Of Alameda, California, Evacuation Playbook Phases, Jeffrey Peters

Master's Theses

A maximum tsunami inundation zone modeled by the California Geological Survey (CGS) is currently the basis for all tsunami evacuations in California, although CGS is developing Evacuation Playbooks of specific event-based evacuation phases. This report estimates population exposure for the Alameda, CA, Evacuation Playbook Phases since past U.S. Geological scientific reports estimated a large difference in numbers of Alameda residents in the maximum inundation zone when compared to an event-based inundation zone. A pedestrian evacuation analysis using an anisotropic, path distance model was also conducted to understand the time it would take for populations to reach high ground by foot. …

Paying For Your Crime: The Pay-To-Stay Jail Program In California, Carla Sue Schultz Jan 2015

Paying For Your Crime: The Pay-To-Stay Jail Program In California, Carla Sue Schultz

Master's Theses

Many California cities have recently implemented pay-to-stay jail programs at the local level. Pay-to-stay programs provide a safe and private incarceration experience for those who can afford the nightly fee. This study provides a theoretical analysis of the pay-to-stay jail program in relation to mass incarceration and the ever-expanding prison economy. It examines pay-to-stay programs as a new method of stratified punishment, reproducing race and class oppression within the U.S. penal regime. A case study of the Fremont pay-to-stay program offers insight into the implementation, operation, and application process for inmates seeking segregation from general county jail populations. This study …
