In prisoner litigation, straightforward victory is rare. Win or lose, prisoners most often remain in the custody of officials who continue to wield substantial power over them. And even where claims succeed, courts may design legal tests in ways that are deferential over time to the claims and preferences of prison authorities. Prisoners prevailed in two recent Supreme Court of Canada cases that involved, first, post-sentencing legislative changes to parole entitlements and, second, a decision to transfer a prisoner to a higher security setting. In Canada (Attorney General) v. Whaling, the Court protected prisoner expectations at sentencing regarding the length …

Penelitian ini bertujuan menghasilkan model-model permainan Aktivitas Luar kelas (ALK) yang layak digunakan sebagai materi pembelajaran penjas, serta efektif untuk mengembangkan ranah kognitif, afektif, dan psikomotorik siswa SMA. Penelitian ini bertujuan menghasilkan model pembelajaran gerak multilateral yang dibentuk melalui permainan bola besar, serta dikembangkan menjadi panduan guru olahraga dan pembelajaran dengan konsep permainan. Penelitian ini dikembangkan dengan mengadaptasi penelitian dan pengembangan pendidikan model Gall, Gall, & Borg. Uji coba dengan skala kecil dilakukan terhadap 24 orang siswa di SD Mutiara Singaraja dan 85 orang siswa pada skala besar di SDN 1 dan SDN 3 Singaraja. The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This article offers a review of recent Supreme Court of Canada search and seizure cases to demonstrate the challenges facing courts, lawyers and law enforcement in applying existing Charter jurisprudence to new technological landscapes. R. v. Vu; R. v. TELUS Communications Co.; R. v. Spencer; and R. v. Fearon highlight the difficulties in drawing boundaries of privacy in computers, mobile devices, “intercepts” and online activity. Our changing social understanding of privacy impacts the sphere of activity and information encompassed by section 8 of the Charter, but easy public and remote access to digital data make drawing lines impractical. All The World's A Page: Towards A Definition Of 'Writer' In An Age Of Opportunity, Sue Norton

This article considers the status of the writer at a time when publication is no longer elusive, given the immediacy of online dissemination. For those who identify as writers, it looks at the implications of blogging, social media, entrepreneurial self-publishing, and scholarly open access journals, including so-called ‘predatory’ ones. It argues for a distinction between day-to-day writing and composition, and seeks to establish a category for the writer that takes account of deliberation, craft, and readership. It juxtaposes the creative activity of Jack Kerouac, Virginia Woolf, Truman Capote, and Mother Goose against the linguist John McWhorter’s convincing dismissal of the …

This article examines the complex nature of literacy through a variety of lenses. The linguistic lens focuses on literacy as a language and multimodal process. The cognitive reveals the mental processes and strategies readers and writers employ to construct meanings through the linguistic and multimodal dimension. Not just a linguistic and cognitive process, the sociocultural lens examines literacy use within social and cultural contexts. Finally, the developmental lens explores the very active nature of literacy learners and their mediators.

Privacy law, to the extent that it regulates state information practices, wears two “public” hats. The first hat is constitutional law. For example, the Canadian Charter protects privacy through protecting individuals against unreasonable searches and seizures. The second hat is public sector data protection law modelled on what are known as Fair Information Practices (FIPs). For example, in Canada the federal Privacy Act regulates the collection, use and disclosure of personal information held by government institutions and provides individuals with a right of access to that information. This article was written for Osgoode Hall Law School’s annual Consti- tutional Cases conference, and provides the keynote overview of the McLachlin Court’s 2014 constitutional jurisprudence. The Court’s 2014 constitutional decisions (Appointment and Senate References; Tsilhqot’in Nation; Trial Lawyers) and restrictions on Mr. Big operations (Hart), in combination with a tsunami of Charter decisions early in 2015 (the 2015 Labour Trilogy; Carter v. In Canada, recent decisions have reaffirmed the almost unfettered discretionary power of prosecutors, and in Anderson the Supreme Court has also decided that prosecutors, unlike judges, do not have a constitutional obligation to consider the principle of proportionality, including Aboriginal status, when making decisions that trigger mandatory minimums and reduce the sentencing options available for judges. The Court found that the role of prosecutors is substantially different than the role of judges, highlighting that the prosecutorial function does not include sentencing, and that prosecutorial discretion should generally be protected from judicial oversight. The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This article analyzes the Supreme Court’s 2014 decision in R. v. Conception which considered the treatment order provisions of the Criminal Code, finding that a court may not make a forthwith treatment order without the consent of the hospital except in rare cases where a delay would breach the accused’s rights under the Canadian Charter of Rights and Freedoms (Charter). This article argues that the case represents a departure from three decades of legal developments in the sphere of civil and forensic mental health law unified by the principles of restraint and oversight. In Loyola High School, et al. v. Attorney General of Quebec, the Supreme Court of Canada held that the government of Quebec could not require a Catholic high school to teach Catholic religion and ethics from a non-Catholic perspective. The government could, however, require the school to teach other religions from a “neutral” perspective. This article takes Loyola as an opportunity to examine two ways that courts have justified limits on religious freedom. First, I interrogate an under-examined aspect of the law of religious freedom: the requirement that claimants prove the interference with their religious freedom is “more than trivial …

In November 2013, the Parti Québécois introduced the Charter affirming the values of State secularism and religious neutrality and of equality between women and men, and providing a framework for accommodation requests (also known as Bill 60). This proposed piece of legislation would substantially alter how public services are offered and received in Québec. This article argues that this legislative project was much more than a simple law, and rather, as discussed, about reconfiguring the constitutional relationship that Quebecers entertain with the rest of Canada. As such, it engages with the constitutional “misadventures”, as experienced in Quebec in 2013-2014. Drawing …

In 2015, the Supreme Court of Canada returned once more to section 2(d) of the Charter (freedom of association). In recognizing a right to strike in Saskatchewan v. Saskatchewan Federation of Labour and striking down the labour relations regime applicable to RCMP officers in Mounted Police Association of Ontario v. Canada, the Court appeared to broaden the scope of the protected right. At the same time, however, the Court in Meredith v. Canada upheld wage restraint legislation as not infringing section 2(d). This article explores these cases and their antecedents, and argues that the Court’s section 2(d) jurisprudence lacks coherence, …

In the modern era, environmental degradation is one of the most significant threats to human well-being and therefore to human rights. Biologically, the right to a viable environment supersedes all other human rights, including the right to life itself. It is not surprising, then, that the vast majority of nations with modern bills of rights have incorporated some form of environmental right or obligation into their constitutions. Respect for the environment is a fundamental value in Canada yet our constitution is silent on environmental rights and obligations. Over the past five years, the Supreme Court of Canada has released a series of decisions meant to bring section 8 of the Canadian Charter of Rights and Freedoms into the Digital Age. These decisions acknowledged the unique privacy interests that people have in the information stored on their digital devices and the potential for modern technology to eviscerate privacy if the law of search and seizure does not keep pace with technological development. There is a danger, however, that recent victories for privacy in the courts will be illusory unless the courts develop additional manner of search limits on …

The article focuses on the novelties introduced by the Damages Directive in the field of consensual settlements of disputes concerning private enforcement. The Damages Directive obliges Member States to ensure that the limitation period for bringing an action for damages is suspended for the duration of any consensual dispute resolution process. The Directive also establishes the main principles that govern the effect of consensual settlements on subsequent actions for damages. Since the EU framework for consensual dispute resolution of private enforcement disputes is quite new, many issues must still be solved in Member States’ practice.
