Sustainability And Infrastructure Investment: National Development Banks In Africa, Daniel D. Bradlow, Christopher Strong Humphrey
Sustainability And Infrastructure Investment: National Development Banks In Africa, Daniel D. Bradlow, Christopher Strong Humphrey
Scholarly Articles in Law Reviews & Journals
The need for infrastructure finance in Africa is tremendous. A 2009 report by the World Bank suggests that the continent faces needs of US$93 billion per year. More recent studies, pointing to economic and population growth trends and using more sophisticated methods of assessing needs, indicate that infrastructure needs are actually much higher. Existing financing sources have not been able to keep pace.
In this context, the role of national development banks (NDBs) in the continent merits attention. As will be shown below, many African countries have NDBs, although the vast majority are quite small, with limited access to finance …
A Technical Barriers To Trade Agreement For Services?, Bernard Hoekman, Petros C. Mavroidis
A Technical Barriers To Trade Agreement For Services?, Bernard Hoekman, Petros C. Mavroidis
Faculty Scholarship
Services are regulated for a variety of reasons. Regulation is typically influenced by political economy forces and may thus at times reflect protectionist motivations. Similar considerations arise for goods, but the potential for protectionist capture may be greater in services as many sectors are self-regulated by domestic industry. There are specific disciplines on regulation of goods (product standards) in the WTO Agreement on Technical Barriers to Trade (TBT). This encourages the use of international standards and requires that norms restrict trade only to the extent necessary to achieve the regulatory objective. WTO disciplines on domestic regulation of services are weaker …

Helping Law Students Get The Help They Need: An Analysis Of Data Regarding Law Students' Reluctance To Seek Help And Policy Recommendations For A Variety Of Stakeholders, David Jaffe, Jerome M. Organ, Katherine Bender
Scholarly Articles in Law Reviews & Journals
This article summarizes some specific results from the Survey of Law Student Well-Being, which the authors administered as a voluntary and confidential web-based survey at 15 diverse law schools in the United States from February 2014 to May 2014.
This is the first survey to assess alcohol and drug use among law students since 1991 and is the first ever to assess prescription drug use/misuse, mental health issues, and help-seeking attitudes. The primary goals of collecting and analyzing the responses from the Survey of Law Student Well-Being were to better understand:
1) alcohol and drug use among law students,
2) …
Teaching Economics To Built Environment Students, Thomas Power
Teaching Economics To Built Environment Students, Thomas Power
Conference papers
Teaching economics to construction economists is paradigmatically different to teaching economics to ‘pure’ economists. While the principles of economics don’t change, the philosophical aim and the methodology of teaching the subject do change. Understanding and executing this philosophical variant enhances the students’ learning experience.
Teaching economics and finance can open students’ eyes to a new way of thinking about the world. The study of economics looks at the world in a unique way because economics is a truly social science and it makes advances in finding solutions to the challenges that society faces. However, it approaches these solutions with the …
First Year Biomass Production Following Application Of Various Size Strip Thinnings In A Young Hardwood Stand In West Virginia., Ashlee Martin
First Year Biomass Production Following Application Of Various Size Strip Thinnings In A Young Hardwood Stand In West Virginia., Ashlee Martin
Graduate Theses, Dissertations, and Problem Reports (ETD)
Strip thinning can reduce stand density to promote better growth of residual trees and has potential to create a woody bioenergy feedstock in addition to enhancing and maintaining early successional habitat for wildlife. However, little research has been conducted on strip thinning within young hardwood stands to determine if these are viable attributes of strip thinning. The goal of this study was to assess the first year biomass production after strip thinning among three different cut strip widths (8 ft, 12 ft, and 16 ft) in a 22-year-old mixed mesophytic hardwood stand. Woody biomass production from stump sprouts and true …

Ethical Diversity In Strategic Communications: The Hiring, Training, And Mentoring Of Millennial Minorities, Rashidah C. R. Mccoy
Graduate Theses, Dissertations, and Problem Reports (ETD)
The purpose of this research is to examine the challenges and opportunities diversity has for Strategic Communications practitioners and scholars. Its primary aim is to more fully understand this growing phenomenon in the industry, without undervaluing its complexity and abundance and to move towards a more inclusive and truly committed investor approach. This study used triangulated research methods to explore these factors. An online survey of people who have experience with Millennial minorities and reverse mentoring in the Strategic Communications industry was conducted. A series of in-depth interviews was conducted with individuals who have unique experiences with cultural diversity. The …
A Study Of Self Consolidating Concrete For Cast In Place Applications: Current Practices, Rapid Wcm Determination, And Stability Effects Of Pumping, Jared Hershberger
A Study Of Self Consolidating Concrete For Cast In Place Applications: Current Practices, Rapid Wcm Determination, And Stability Effects Of Pumping, Jared Hershberger
Graduate Theses, Dissertations, and Problem Reports (ETD)
Self-Consolidating Concrete (SCC) is a relatively new type of concrete mixture that does not require external compaction during placement. Compared to traditional vibrated concrete (TVC), SCC is much more fluid, which gives it the ability to flow and fill formwork without the need for any external compaction efforts. Although the increased cement content and chemical admixtures found in SCC typically results in a higher material cost, the potential for cost savings in reduced construction time and labor are significant. The potential of this relatively new type of concrete have yet to be realized due to a lack of regulation and …

Clarence Cameron White: Classical Violin Performance And Pedagogy In The African American Community, Alexandra Kori Hill
Graduate Theses, Dissertations, and Problem Reports (ETD)
This thesis focuses on the performing and teaching career of the African American classical violinist, Clarence Cameron White. Discussions of recital programming, reviews, pedagogical articles and musical essays written by White will provide a look into African Americans' presence and involvement within classical violin performance and instruction. The racial and cultural signifiers that are tightly woven with many styles and genres in American music have also been applied to Western art music and classical violin, requiring a discussion of racial and cultural stereotypes in American society.
Development Of An Erosion Control Seed Mixture That Includes Native Species, George A. Hilvers
Development Of An Erosion Control Seed Mixture That Includes Native Species, George A. Hilvers
Graduate Theses, Dissertations, and Problem Reports (ETD)
The West Virginia Divisions of Highways (WVDOH) utilizes the establishment of grass cover as a temporary and permanent management practice to mediate the effects of erosion on highway construction sites. Current West Virginia regulations include five seed mixtures for permanent applications that include combinations of nine species. Six of these species are identified as invasive, and all nine species are considered introduced or both native and introduced. This research developed alternative seed mixtures that included low threat or native species. The alternative seed mixtures were then evaluated in a field test. The research also examined seedbed preparation techniques, the performance …
Glandular Trichome Evaluation Through Scanning Electron Microscopy And The Modified Enzymic Browning Assay, Adriana Virginia Rodríguez García
Glandular Trichome Evaluation Through Scanning Electron Microscopy And The Modified Enzymic Browning Assay, Adriana Virginia Rodríguez García
Plant Sciences
Potato (Solanum tuberosum L.) ranks fifth in the USA in comparison with other countries regarding potato production. Colorado potato beetle (Leptinotarsa decemlineata Say) is a devastating insect pest affecting potato in Canada and USA. Several researchers demonstrated that glandular trichomes on potato leaves provided CPB resistance. The experimental approach consisted of using Scanning Electron Microscope to assess the presence of glandular trichomes, the Modified Enzymic Browning Assay to screen leaves for the presence of glandular trichomes, and a two-year field trial to evaluate CPB defoliation effects on potato genotypes. The SEM provided a closer look at the morphology and quantity …

One of the most controversial social policy issues that remains dramatically underdiscussed in scholarly literature is the sexual autonomy of persons with psychosocial and intellectual disabilities, especially those who are institutionalized. This population – always marginalized and stigmatized – has traditionally faced a double set of conflicting prejudices: on one hand, people with disabilities are infantilized (as not being capable of having the same range of sexual desires, needs and expectations as persons without disabilities), and on the other, this population is demonized (as being hypersexual, unable to control base or primitive urges). Although attitudes about the abilities and capabilities …

In this article, I discuss my historical involvement with therapeutic jurisprudence (TJ), how I use it in my classes (both in the free-standing TJ class and in all the others that I teach), its role in my written scholarship, and its role in conferences that I regularly attend. Although this is all positive and supportive of all efforts to widen the appeal of TJ as well as its applicability in the classroom, in scholarship and in “real life,” I also share some information that is far from optimistic with regard to the way that TJ is being reacted to by …

Ever since the Supreme Court's 2003 decision in Sell v. United States, 539 U.S. 166 (2003), there has been a cottage industry of commentary on the question of whether the state can medicate an incompetent defendant for the purpose of making him or her competent to stand trial. Moreover, there have been multiple cases interpreting Sell broadly and narrowly, both in the context of medication issues and in the context of other treatments. Because of the vagueness of certain terminology, questions such as what a "serious" crime is, what "substantially" meant to the Court in Sell, and how the least …
Administrating Patent Litigation, Jacob S. Sherkow
Administrating Patent Litigation, Jacob S. Sherkow
Articles & Chapters
Recent patent litigation reform efforts have focused on every branch of govemment-Congress, the President, and the federal courts-save the fourth: administrative agencies. Agencies, however, possess a variety of functions in patent litigation: they serve as "gatekeepers" to litigation in federal court; they provide scientific and technical expertise to patent disputes; they review patent litigation to fulfill their own mandates; and they serve, in several instances, as entirely alternative fora to federal litigation.
Understanding administrative agencies' functions in managing or directing, i.e., "administrating," patent litigation sheds both descriptive and normative insight on several aspects of patent reform. These include several problems …
Privacy As Trust: Sharing Personal Information In A Networked World, Ari Ezra Waldman
Privacy As Trust: Sharing Personal Information In A Networked World, Ari Ezra Waldman
Articles & Chapters
This Article is the first in a series on the legal and sociological aspects of privacy, arguing that private contexts are defined by relationships of trust among individuals. The argument reorients privacy scholarship from an individual right to social relationships of disclosure. This has implications for a wide variety of vexing problems of modern privacy law, from limited disclosures to “revenge porn.”
The common everyday understanding is that privacy is about choice, autonomy, and individual freedom. It encompasses the individual’s right to determine what he will keep hidden and what, how, and when he will disclose to the public. Privacy …

How Teaching About Therapeutic Jurisprudence Can Be A Tool Of Social Justice, And Lead Law Students To Personally And Socially Rewarding Careers: Sexuality And Disability As A Case Example, Michael L. Perlin, Alison Lynch
Articles & Chapters
Therapeutic jurisprudence (TJ) asks us to look at law as it actually impacts people’s lives and focuses on the law’s influence on emotional life and psychological well-being. It suggests that law should value psychological health, should strive to avoid imposing anti-therapeutic consequences whenever possible, and — when consistent with other values served by law — should attempt to bring about healing and wellness. The ultimate aim of TJ is to determine whether legal rules and procedures or lawyer roles can or should be reshaped to enhance their therapeutic potential while not subordinating due process principles. An inquiry into therapeutic outcomes …
Discussing Advocacy Skills In Traditional Doctrinal Courses, Stephen A. Newman
Discussing Advocacy Skills In Traditional Doctrinal Courses, Stephen A. Newman
Articles & Chapters
Can teaching students in doctrinal courses, using traditional case-oriented materials, convey some of the skills lawyers need to practice law effectively? While the recent interest in and debate over training practice-ready lawyers makes this a timely question, my thinking about this harks back to the mid-1990s, when Harry Wellington, then dean of New York Law School, suggested that faculty members consider teaching law from the lawyer’s perspective rather than from the perspective of either the judge or the legal scholar.
In traditional doctrinal courses in law school, like my own in family law, coverage is broad and time is short. …

Under Containment: Preempting State Ebola Quarantine Regulations, Eang Ngov
Faculty Articles
The outbreak of Ebola in Africa and its recent emergence in America has brought to light that the ambit of state sovereignty in the face of federal policy is unsettled in the public health field. Quarantine laws have historically been recognized as an exercise of state police powers and, absent discriminatory uses, courts have afforded much deference to states when the federal government is dormant. This article explores federalism implications when federal and state sovereigns contest the purview of regulating Ebola, other epidemics, and quarantine. This article examines how the federal government can assert supremacy to regulate treatment of epidemics …

Digital badges originated in the gaming world as incentives built into video games to acknowledge gamers’ achievements. They have only recently been identified by course designers and instructors in formal and corporate education as a way to support competency-based learning and acknowledge achievement of specialized knowledge and skills. The faculty of an undergraduate Educational Technology specialization are implementing badges in 6 fully online courses through a three-phase study. Students who excel in specific skills through their coursework would become eligible to earn digital badges in the specific EdTech areas. The purpose of the proposed study is to determine if digital …

Tort As Democracy: Lessons From The Food Wars, Melissa Mortazavi
Faculty Articles
This Article develops alternative emerging theories regarding the function of tort in American civil society. Often, scholars and policymakers evaluate the tort system in terms of compensation, loss allocation, and risk management. This focus overlooks an important modern function of tort; in the context of the modern administrative state, tort is a vital player in the democratic deliberative process. Tort suits bring forth new ideas, force fact-finding, and increase communication amongst public and private institutional actors to develop sound and legitimate law and policy. Perhaps nowhere is this more obvious today than with the current boom of food litigation. Lawsuits …

Current instructional reforms in undergraduate science, technology, engineering, and mathematics (STEM) courses have focused on enhancing adoption of evidence-based instructional practices among STEM faculty members. These practices have been empirically demonstrated to enhance student learning and attitudes. However, research indicates that instructors often adapt rather than adopt practices, unknowingly compromising their effectiveness. Thus, there is a need to raise awareness of the research-based implementation of these practices, develop fidelity of implementation protocols to understand adaptations being made, and ultimately characterize the true impact of reform efforts based on these practices. Peer instruction (PI) is an example of an evidence-based instructional …

Even though quartic force fields (QFFs) and highly accurate coupled cluster computations describe the OCHCO+ cation at equilibrium as a complex between carbon monoxide and the formyl cation, two notable and typical interstellar and atmospheric molecules, the prediction from the present study is that the equilibrium C∞v structure is less relevant to observables than the saddle-point D∞h structure. This is the conclusion from diffusion Monte Carlo and vibrational self-consistent field/virtual state configuration interaction calculations utilizing a semi-global potential energy surface. These calculations demonstrate that the proton “rattle” motion (ν6) has centrosymmetric delocalization of the …

Titanium trisulfide (TiS3) is a promising layered semiconductor material. Several-mm-long TiS3 whiskers can be conveniently grown by the direct reaction of titanium and sulfur. In this study, we exfoliated these whiskers using the adhesive tape approach and fabricated few-layer TiS3 field-effect transistors (FETs). The TiS3 FETs showed an n-type electronic transport with roomtemperature field-effect mobilities of 18-24 cm2V-1s-1 and ON/OFF ratios up to 300. We demonstrate that TiS3 is compatible with the conventional atomic layer deposition (ALD) procedure for Al2O3. ALD of alumina on TiS3 …
