Liberte, Egalite, Fraternite: The United Nations Declaration Of The Rights Of Indigenous Peoples Fails To Protect Hopi Katsinam From The Auction Block In France, Samantha K. Nikic Jan 2015

Liberte, Egalite, Fraternite: The United Nations Declaration Of The Rights Of Indigenous Peoples Fails To Protect Hopi Katsinam From The Auction Block In France, Samantha K. Nikic

Brooklyn Journal of International Law

The United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) compels member states to take action in order to protect the rights of the world’s 370 million indigenous peoples, including the right to their cultural property. Notwithstanding the UNDRIP’s robust set of protections, its status as a nonbinding piece of international law remains its ultimate and most fatal flaw. France was an enthusiastic supporter of the UNDRIP at ratification, but has effectively abandoned their position. French auction houses and courts have allowed for sales of Native American sacred property to proceed despite the objections of the Hopi Tribe. In …

The Problem With Frand: How The Licensing Commitments Of Standard-Setting Organizations Result In The Misvaluing Of Patents, David Arsego Jan 2015

The Problem With Frand: How The Licensing Commitments Of Standard-Setting Organizations Result In The Misvaluing Of Patents, David Arsego

Brooklyn Journal of International Law

Standard-setting organizations (SSOs) are bodies that oversee the development of technical standards. Technical standards are common technological designs that are used across a variety of platforms, for instance LTE, which is utilized throughout the mobile phone industry. Members of SSOs contribute different pieces of technology to an ultimate design, and if a patent covers the technology, it is called a standard-essential patent (SEP). SSOs require their members to license these patents to each other on fair, reasonable, and nondiscriminatory (FRAND) terms. This Note analyzes the FRAND requirement and the different ways that courts and private parties interpret it. The ambiguity …

The Dilemma Of Private Justice Systems: Big Data Sources, The Cloud And Predictive Analytics, Anjanette H. Raymond

Northwestern Journal of International Law & Business

Abstract: In the age of big data, demanding customer expectations, and increasingly limited access to justice for small claims arising from online sales, business organizations are moving to enhanced online customer complaint platforms and insisting upon increased online justice resolution systems. At the same time, online businesses, even websites you fail to think of as a business, are moving from traditional analytics that provide a snapshot of the past, to solutions that provide an accurate picture of the present and a prediction of future trends. For many, predictive analytics is the wave of the future.

In many ways, the use …

The analysis reveals unexpected consequences when transplanting Western intellectual property law in Chinese contexts. Similarities in criminal enforcement between the two countries indicate that economic factors that are determinant forces in both the United States and China. Building Connections Through Contextualized Learning In An Undergraduate Course On Scientific And Mathematical Literacy, Melanie K. Rathburn Jan 2015

Building Connections Through Contextualized Learning In An Undergraduate Course On Scientific And Mathematical Literacy, Melanie K. Rathburn

International Journal for the Scholarship of Teaching & Learning

With increasing demands for universities to create graduates that are numerically and scientifically literate, it is important to determine effective ways to engage students so that they can acquire these literacies. Using an undergraduate, interdisciplinary course that focused on scientific and mathematical literacy, I examined how contextualization influenced students’ abilities to build connections between their learning and their lives. In their written reflections, students connected course concepts with their social lives, academic pursuits and global or societal issues without specific prompting. I suggest that contextualization combined with reflection allows students to illustrate their understanding and apply this knowledge to novel …

Understanding The Intention To Use Pc Asset Management Tools Among Technology Leaders Using The Technology Acceptance Model, Michael G. Carper Jan 2015

Understanding The Intention To Use Pc Asset Management Tools Among Technology Leaders Using The Technology Acceptance Model, Michael G. Carper

All-Inclusive List of Electronic Theses and Dissertations

Technology vendors have developed personal computer (PC) asset management tools for managing the security and facilitating cyclical replacement lifecycle of PC hardware and software. Despite their commercial availability, PC asset management tools are sparsely implemented. Failure to adopt these tools drives up the cost, time, and disruption for managing the life-cycle of PC assets in a distributed computing environment. What affects the intention to use PC asset management tools among technology leaders is not understood. The purpose of this study was to investigate the perceptions that impact the acceptance of PC asset management tools among technology leaders in the retail …

Mining And Hiv/Aids Transmission Among Marampa Mining Communities In Lunsar, Sierra Leone, Alphajoh Cham Jan 2015

Mining And Hiv/Aids Transmission Among Marampa Mining Communities In Lunsar, Sierra Leone, Alphajoh Cham

Walden Dissertations and Doctoral Studies

Since the human immunodeficiency virus/acquired immune deficiency syndrome (HIV/AIDS) was first reported in Sierra Leone in 1987, its prevalence rate has stabilized at 1.5% in the nation's general population. However, concerns exist regarding the potential increase in high-risk populations, particularly among mineworkers and commercial sex workers. The potential spread of HIV/AIDS as a result of labor migration may threaten the mining sector, which has been identified as a critical driver of recent economic growth and development. A gap remains in the literature regarding the contextual factors in mining communities that lead to high rates of HIV/AIDS. Therefore, the purpose of …
