Human Rights Thinking And The Laws Of War, David Luban Jan 2015

Human Rights Thinking And The Laws Of War, David Luban

Georgetown Law Faculty Publications and Other Works

In a significant early case, the ICTY commented: “The essence of the whole corpus of international humanitarian law as well as human rights law lies in the protection of the human dignity of every person…. The general principle of respect for human dignity is . . . the very raison d'être of international humanitarian law and human rights law.”

Is it true that international humanitarian law and international human rights law share the same “essence,” and that essence is the general principle of respect for human dignity? Is it true that, in the words of Charles Beitz, humanitarian law is …

The Proportionality Standard And Constitutional Culture: A Comparative Analysis Of Rights Adjudication In Canada And The French Republic, James Peter Barry Jan 2015

The Proportionality Standard And Constitutional Culture: A Comparative Analysis Of Rights Adjudication In Canada And The French Republic, James Peter Barry

LLM Theses

It has been suggested that the migration of proportionality as a standard of constitutional review is bringing about a degree of convergence in rights norms across common and civil law jurisdictions. While scholars have noted its potential to shape rights norms in legal systems into which it is incorporated, few have analysed the ways in which proportionality is affected by the constitutional culture in which it is received. This thesis is a comparative analysis of the application of proportionality in Canada and the French Republic. It sheds light on the extent to which the operation of that standard is affected …

Availability, Use And Quality Of Care For Medical Abortion Services In Private Facilities In Kenya, Wilson Liambila, Francis Obare, Edward Ikiugu, Vitalis Akora, Jesse Njunguru, Michael Njuma, Kate Reiss, Harriet Birungi Jan 2015

Availability, Use And Quality Of Care For Medical Abortion Services In Private Facilities In Kenya, Wilson Liambila, Francis Obare, Edward Ikiugu, Vitalis Akora, Jesse Njunguru, Michael Njuma, Kate Reiss, Harriet Birungi

Reproductive Health

The overall goal of this study was to generate evidence on the availability, use, and quality of care for medical abortion services in private facilities (pharmacies and clinics) in Kenya. With the passing of a new constitution in 2010, there was renewed interest in the right to health and the need to reduce the high levels of maternal morbidity and mortality arising from unsafe abortion in the country. In spite of recent developments, there is limited understanding of the extent to which the changes have influenced the provision of medical abortion information and services in the country, the acceptability of …

Educational Infrastructure And Resources For Sustainable Access To Schooling And Outcomes: The Case Of Early Literacy Development In Southern Tanzania, Marriote Ngwaru, Mary Oluga Jan 2015

Educational Infrastructure And Resources For Sustainable Access To Schooling And Outcomes: The Case Of Early Literacy Development In Southern Tanzania, Marriote Ngwaru, Mary Oluga

Institute for Educational Development, East Africa

Following on the 1990 and 2000 World Conferences on Education for All, African governments increased their focus on access to schooling (but not necessarily on outcomes) by providing more facilities for increased enrollments. The learning outcomes that had been neglected led to a call to focus on more sustainable access – re-examining the quality of some of those facilities against the anticipated quality of educational outcomes. Studies in Southern and Eastern Africa, including the one under discussion here, indicate that the achievement of the Millennium Development Goals (MDGs) will not rely only on school-based factors but also on the careful …

Early Contexts Of Learning: Family And Community Socialization During Infancy And Toddlerhood, Carolyn P. Edwards, Lixin Ren, Jill Brown Jan 2015

Early Contexts Of Learning: Family And Community Socialization During Infancy And Toddlerhood, Carolyn P. Edwards, Lixin Ren, Jill Brown

Department of Child, Youth, and Family Studies: Faculty Publications

The contexts of early learning and socialization are diverse and complex but not without some predictability. The tension between predictability and variation fascinates researchers interested in childhood and culture and motivates careful exploration of different developmental niches to better understand socialization during infancy, toddlerhood, and early childhood. Contexts of early socialization vary in the people and activities present, and the beliefs and norms of caregivers and daily companions. The chapter utilizes anthropological constructs (household structure and composition, settlement patterns and subsistence level, mothers’ workload, gender division of labor, intimacy levels between husbands and wives, and cultural roles and norms pertaining …

International Migration Of Health Professionals And The Marketization And Privatization Of Health Education In India: From Push-Pull To Global Political Economy, Margaret Walton-Roberts Jan 2015

International Migration Of Health Professionals And The Marketization And Privatization Of Health Education In India: From Push-Pull To Global Political Economy, Margaret Walton-Roberts

Geography and Environmental Studies Faculty Publications

Health worker migration theories have tended to focus on labour market conditions as principal push or pull factors. The role of education systems in producing internationally oriented health workers has been less explored. In place of the traditional conceptual approaches to understanding health worker, especially nurse, migration, I advocate global political economy (GPE) as a perspective that can highlight how educational investment and global migration tendencies are increasing interlinked. The Indian case illustrates the globally oriented nature of health care training, and informs a broader understanding of both the process of health worker migration, and how it reflects wider marketization …

Domestic Violence Advocacy In California: Social Influences, Legal Limitations, And Client-Centered Practice, Claire Shum Jan 2015

Domestic Violence Advocacy In California: Social Influences, Legal Limitations, And Client-Centered Practice, Claire Shum

Scripps Senior Theses

This project explores domestic violence advocacy in California by tracing historical, social, and cultural influences; examining the limit of the law and bias of those who uphold it; and analyzing a local domestic violence agency that provides services to survivors. Through the frameworks of anti-essentialization, and intersectionality I analyze gender roles and stereotypes ingrained in our culture. The essentialization of what it is to be a women renders women’s differences invisible, making it difficult for law and policy to address. By looking at domestic violence through an intersectional lens, the multi-layered nature women’s experiences can be revealed. However, not all …

The Tragedy Of The Vital Commons, M. Alexander Pearl Jan 2015

The Tragedy Of The Vital Commons, M. Alexander Pearl

Faculty Articles

The concept of the Tragedy of the Commons is well known, but it does not adequately capture the gravity of harm caused by the mismanagement of certain common pool resources (CPR). Not all commons are created equal; some are more important than others. If the common pasture where cows graze is overused and rendered barren, the community shifts to a vegan diet. But, if the groundwater aquifer used to grow soybeans and other foods is exhausted and no water remains for extraction, then individuals, families, and entire communities perish. Present commons scholarship is unable to differentiate between varying levels of …

Energy Access For The "Powerless": The Role Of Relational Connectivity Between Entrepreneurs And Private Capital Investors, Michael E. Desa Jan 2015

Energy Access For The "Powerless": The Role Of Relational Connectivity Between Entrepreneurs And Private Capital Investors, Michael E. Desa

Student Scholarship

Although $1.6 trillion was invested in 2013 in global energy, of which $254 billion was in renewable energy, small power producer (SPP) entrepreneurs that focused their operations on the 1.4 billion powerless populations received a trifling $2.2 billion--less than $2 per person and 1.37% of overall investment. Prevailing research details policy methods, finance mechanisms, and business models intended to attract private capital and enlarge energy access; however, the nominal investment levels signify that private capital remains uninterested. This qualitative study used a grounded theory approach to discover the role of interaction experiences between SPP entrepreneurs and investors and the factors …

Competition Expressed: Marking Places Within Rural And Urban Landscapes, Ralph J. Hartley, Sharon L. Kennedy Jan 2015

Competition Expressed: Marking Places Within Rural And Urban Landscapes, Ralph J. Hartley, Sharon L. Kennedy

Department of Anthropology: Faculty Publications

The extent to which marking places with images, symbols and/or script on a landscape reflect the dynamics of a socio-economic environment continues to be a subject of interest in social science. Places become socio-culturally meaningful often because of the content of the markings on non-portable surfaces. In some contexts the information content of the markings reveal a perception of propriety when competition for space or other resources between groups and non-kin related individuals characterizes a social environment. In other contexts the content of markings reflect competition between individuals for resources, status, or prestige. Urban environments, dense with diverse human activities, …

Visual Representations Of Gender In Engineering Trade Journals Of Professional Societies During 1998-2012: A Content Analysis Of Hierarchy And Stereotypes, Tracy Ettel Morris Jan 2015

Visual Representations Of Gender In Engineering Trade Journals Of Professional Societies During 1998-2012: A Content Analysis Of Hierarchy And Stereotypes, Tracy Ettel Morris

LSU Doctoral Dissertations

Recruiting and retaining women in engineering have stagnated since the mid-1990's partially due to the marginalization of women in education and the workforce. This research analyzed the quality and quantity of representation of women and men in visual images of professional science and engineering trade journals to illuminate the marginalizing climate of engineering. A mixed methods approach using visual content analysis was performed for a 15-year period during 1998-2012 of three different trade journals of professional societies representing various disciplines of engineering: the first has a low percentage of women, the second has a higher percentage of women, and the …

Measuring Primary Health Care Accessibility In Mississippi State Using An Extended Kernel Density 2sfca Method, Lijie Zhang

LSU Master's Theses

The accessibility of primary health care is fundamentally important to people’s life quality and wellbeing. Based on the block group level 2010 census data from the U.S. Census Bureau and primary health care data from Association of American Medical Colleges, this study focuses on measuring the primary health care accessibility using an extended kernel-density two Step Float Catchment Area method. The study area is the Mississippi State, which is ranked last state for health care. The objectives of this study are to calculate the accessibility and analyze the spatial and non-spatial disadvantages of communities in accessibility of primary health care …

The Saxophone In Puerto Rico: History And Annotated Bibliography Of Selected Works, Marcos David Colón-Martín Jan 2015

The Saxophone In Puerto Rico: History And Annotated Bibliography Of Selected Works, Marcos David Colón-Martín

LSU Doctoral Dissertations

The tradition of classical saxophone performance in Puerto Rico officially began quite recently in 1994. Musicians performing regularly in the style are few and local composition of new music for the instrument is rare. This research provides a historical overview of the saxophone in the musical culture of Puerto Rico and explores reasons for the delay on saxophone classical performance to develop. In an attempt to help promote the local performance and composition of new works, the author provides an annotated bibliography of music for saxophone by selected Puerto Rican composers.

Planning Towards Equal Spatial Accessibility Of Nci Cancer Centers Across Geographic Areas And Demographic Groups In The U.S., Cong Fu Jan 2015

Planning Towards Equal Spatial Accessibility Of Nci Cancer Centers Across Geographic Areas And Demographic Groups In The U.S., Cong Fu

LSU Doctoral Dissertations

The Cancer Centers designated by the National Cancer Institute (NCI) form the “backbone” of the cancer care system in the United States. Awarded via a peer-review process and being re-evaluated every 3 to 5 years, an NCI Cancer Center receives substantial financial support from NCI grants. When the quality standard is not compromised, we argue that an additional criterion for improving and promoting equal accessibility should be factored into the designation and planning process of NCI Cancer Centers. With the help of regression and dummy variables, this research evaluates geographic disparities in spatial accessibility of the NCI Cancer Centers across …

Backyard Archaeology: A Snapshot Of Life On The Home Front In The Hamline Neighborhood, Yvonne M. Thorpe Jan 2015

Backyard Archaeology: A Snapshot Of Life On The Home Front In The Hamline Neighborhood, Yvonne M. Thorpe

Departmental Honors Projects

The Levin site is a household archaeology deposit dated to the 1940s. This site is a distinctive example of the emerging branch of both backyard archaeology and twentieth century archaeology. This backyard site is an essential piece in reconstructing the history of the Hamline-Midway neighborhood. The Levin site also provides unique insights into changing consumption patterns, the roles of class and gender, and the evolution of American identity. The Levin collection utilizes archaeological and historical methods to answer a number of questions. What can the everyday life of a family in the Hamline-Midway neighborhood say about national changes in the …

Mortuary Practices And Social Identity At Matrix 101, La Leche Valley, Peru, Jenna Renee Hurtubise Jan 2015

Mortuary Practices And Social Identity At Matrix 101, La Leche Valley, Peru, Jenna Renee Hurtubise

LSU Master's Theses

This thesis focuses on the social identity of the individuals buried at a Late Middle Sicán (A.D. 1050-1120) mass grave designated Matrix 101. Matrix 101 is located in the Great Plaza of the Pomac forest archaeological complex in the La Leche Valley, north coast of Peru. My objectives are threefold: (1) to understand the social identities of the individuals, (2) to examine the complex mortuary practices that took place during the construction of the burial, and (3) to infer socio-political reasons for the construction of Matrix 101 and to see how they might relate to the Sicán societal collapse. Initial …

Just Throw It In The Pot! The Cultural Geography Of Hidden Landscapes And Masked Performances In South Louisiana Gumbo Cooking, Corey David Hotard Jan 2015

Just Throw It In The Pot! The Cultural Geography Of Hidden Landscapes And Masked Performances In South Louisiana Gumbo Cooking, Corey David Hotard

LSU Doctoral Dissertations

One of Louisiana's gifts to the world is gumbo. Yet, gumbo is not just a local dish of renown. It is a metaphor which describes the people, a food that represents a region, and a symbol that stands in for the state. It is also the official dish of Louisiana. The association of gumbo with South Louisiana is recognized worldwide. The word itself evokes images of Louisiana's swampy Cajun landscapes. Yet gumbo is not indigenous to Louisiana nor is it a strictly Cajun dish. This dissertation is about the cultural and historical geography of gumbo. This study delves into the …

Paradoxical Agency: The Ethics Of Women's Rhetoric In Shakespeare's Rome, Catherine Riley Godbold Jan 2015

Paradoxical Agency: The Ethics Of Women's Rhetoric In Shakespeare's Rome, Catherine Riley Godbold

LSU Doctoral Dissertations

In this project, I address the problems of ethics and agency for women’s speech in Shakepseare’s Roman plays—Julius Caesar, Antony and Cleopatra, Titus Andronicus, and Coriolanus—and the narrative poem The Rape of Lucrece. Regardless of their rhetorical skill, virtue, or agency, it seems that the Roman women in these works are doomed to fail: either their lives become unlivable or they lose the people most important to them. This prompts the project’s initiating question: why do Shakespeare’s Roman women speak if their words have no long-term effect? For these characters, rhetorical success in Shakespeare’s Rome is dependent upon a particular …

Delineating Hospital Service Areas In Florida Based On Patients’ Travel Patterns, Peng Jia Jan 2015

Delineating Hospital Service Areas In Florida Based On Patients’ Travel Patterns, Peng Jia

LSU Doctoral Dissertations

Longer travel times to hospitals and other medical resources have been shown to be associated with decreasing health outcome and increasing mortality risk. Many countries have actively responded to the call of the World Health Organization (WHO) on creating local environments for the provision of and residents’ access to health resources. The hospital service areas (HSAs) and hospital referral regions (HRRs) have been proposed as more proper functional units for analysis of performance of healthcare market. However, the widely used Dartmouth HSAs and HRRs were produced solely based on two-decade-old Medicare hospitalization records. In this study, the effectiveness of the …

Excavations And Interpretation Of Two Ancient Maya Salt-Work Mounds, Paynes Creek National Park, Toledo District, Belize, Rachel Mariah Watson Jan 2015

Excavations And Interpretation Of Two Ancient Maya Salt-Work Mounds, Paynes Creek National Park, Toledo District, Belize, Rachel Mariah Watson

LSU Doctoral Dissertations

In 2012, excavations were conducted at Witz Nabb’ and Killer Bee the last remaining above sea level features Paynes Creek National Park, Belize. Salt is a basic biological necessity that was in limited supply at inland Maya cities. The ancient Maya of coastal Belize produced by fire enhanced evaporation of salt enriched brine. Survey and excavation at inundated salt works in a shallow lagoon in Paynes Creek National Park provide extensive evidence of this technique in the form of briquetage, the remains of pots used in the fire evaporation. Lacking is any evidence that the salinity of seawater was enriched …

Corporate Lobbying – The Tradeoff Between Payback, Accountability/Responsibility, And Democracy, Bruce A. Kibler Phd, Kathleen V. Kibler Jan 2015

Corporate Lobbying – The Tradeoff Between Payback, Accountability/Responsibility, And Democracy, Bruce A. Kibler Phd, Kathleen V. Kibler

Journal of Business, Industry, and Economics

his paper attempts to lay out a general framework of democracy and the role of economic actors within this framework drawing on the principles of corporate governance and the checks and balances of the Principle-Agency theory. The discussion necessarily encompasses the concept of externalities, i.e., costs encompassed by the license to operate and the developmental path of how these have been handled by the economic and political spheres over time.

This research is a longitudinal study of Jungian personality traits and academic success of students enrolled in Computer Information Systems (CIS) courses. The Myers-Briggs Type Indicator (MBTI) measurement scale was self-analyzed by students in CIS courses from fall 2001 through spring 2013. The results of this study indicate that both Extroverts and Judgers have increased as percentage of enrollment between 2001-2003 and 2012-2013. There was no change in academic success, as measured by grades achieved, by personality type from 2001-2003 and 2012-2013.

The Fight That Must Be Fought: Reflections On Race, School, Struggle And Sacrifice On The South Side Of Chicago, David Stovall Jan 2015

The Fight That Must Be Fought: Reflections On Race, School, Struggle And Sacrifice On The South Side Of Chicago, David Stovall

Public Interest Law Reporter

The following paragraphs are centered in the realities of life in a hyper-segregated city that moves to displace, marginalize and isolate certain members of its population while making space for new investments in housing and other infrastructure. The story is layered and multi-pronged, while deeply imbued in the politics of race, class, and government. Fortunately for some members of the city, the struggle for the basic needs of housing, education and quality of life has not ended. Instead, a public awakening has begun to ignite city members to work in unison to change the current condition.

Living In An (Im)Material World: Consuming Exhausted Narratives In New Grub Street, Emma C. Eisenberg Jan 2015

Living In An (Im)Material World: Consuming Exhausted Narratives In New Grub Street, Emma C. Eisenberg

Honors Papers

Journalists often write about the death of various print and media forms—deaths that have yet to occur, but which we continually anticipate in deference to a tacit law which discards the past as a “useless encumbrance” of outmoded styles of consumption. But is that encumbrance necessarily useless? In this paper, I argue that George Gissing’s New Grub Street (1891), which narrates the deaths of two realist novelists and has been called an “epitaph for Victorian fiction,” lives out its own virtual death to good purpose. I discuss how Gissing uses the realist novel’s transitional or partially exhausted state to conserve …

Into The Fray: Norman Jacobson, The Free Speech Movement And The Clash Of Commitments, Kai Gardner Jan 2015

Into The Fray: Norman Jacobson, The Free Speech Movement And The Clash Of Commitments, Kai Gardner

Honors Papers

Norman Jacobson, a renowned political theorist at the University of California, Berkeley, experienced firsthand the radical campus politics of the 1960s. Through an analysis of Jacobson's letters, speeches and lectures, this thesis seeks to reconstruct the way Jacobson understood and experienced the 1964 Free Speech Movement. Jacobson attempted to authentically face an overwhelming political crisis at the university. Ultimately, Jacobson knew he must take a stand in response to the student protests. By simply focusing on the concrete political action Jacobson did take, however, one risks overlooking the complexity of his political thought.
