The Proposed Capital Penalty Phase Rules Of Evidence, David Mccord, Mark W. Bennett
The Proposed Capital Penalty Phase Rules Of Evidence, David Mccord, Mark W. Bennett
Cardozo Law Review
No person or organization has ever proposed model rules of evidence for the unique penalty phase of a death penalty trial. Now a law professor skilled in the scholarship of both death penalty jurisprudence and evidence, and a federal judge with extensive federal death penalty experience, do just that. This work transcends the hodge-podge of evidentiary approaches taken by the various state jurisdictions and federal law. The result is the Proposed CAPITAL PENALTY PHASE RULES OF EVIDENCE - clear and uniform rules to govern the wide-ranging evidentiary issues that arise in the penalty phase of capital trials. Death penalty trials, …
Mead As (Mostly) Moot: Predictive Interpretation In Administrative Law, Ryan D. Doerfler
Mead As (Mostly) Moot: Predictive Interpretation In Administrative Law, Ryan D. Doerfler
Cardozo Law Review
In National Cable & Telecommunications Ass'n v. Brand X Internet Services, the Supreme Court explained that, within the domain of unclear agency-administered statutes, a federal court is subordinate to an administering agency. When an administering agency speaks authoritatively, federal court practice reflects this. When an agency speaks only informally, however, federal court practice does not. Specifically, when construing an agency-administered statute absent an authoritative agency interpretation, a federal court errs, given its subordinate status, when it exercises independent judgment concerning what interpretation is best. Instead, that subordinate status requires a court to predict what authoritative interpretation the administering agency …

Coming Up Short: The United States' Second-Best Strategies For Corralling Purely Speculative Derivatives, Timothy E. Lynch
Coming Up Short: The United States' Second-Best Strategies For Corralling Purely Speculative Derivatives, Timothy E. Lynch
Cardozo Law Review
Purely speculative derivatives (PSDs) are derivatives in which neither counterparty is engaged in hedging. Unless they are used for entertainment purposes, PSDs are irrational, less-than-zero-sum transactions. Entities that engage in PSDs jeopardize their stakeholders and increase systemic risk. PSDs can also increase moral hazard, can be used for regulatory arbitrage, and can redirect resources away from the efficient allocation of market capital. PSDs should be unenforceable contracts, void for public policy reasons, except where they are expressly permitted to provide gambling entertainment, enhance price discovery, or increase liquidity for hedgers.
In the United States, however, PSDs are often legal and …

Rpas And Non-International Conflict - A Strategic/Legal Assessment, Michael P. Kreuzer
Cardozo Law Review
Remotely Piloted Aircraft (RPAs) have, in recent years, been among the most controversial weapons systems in the U.S. war on terrorism. Debate rages over their overall effectiveness, their legality outside of recognized war zones, such as Afghanistan, and the precedent U.S. RPAs might set for other state and non-state actors in the future. Rather than focusing on the technology of the RPA platform itself, this Article argues that the RPA enables a type of war against individuals that exposes a significant hole in both international law and conventional understanding of the boundaries of warfare. Rather than focusing on treaties to …

Efficacy Of R&D Work In Offshore Captive Centers: An Empirical Study Of Task Characteristics, Coordination Mechanisms, And Performance, Deepa Mani, Kannan Srikanth, Anandhi Bharadwaj
Research Collection Lee Kong Chian School Of Business
Seizing the latest technological advances in distributed work, an increasing number of firms have set up offshore captive centers (CCs) in emerging economies to carry out sophisticated R&D work. We analyse survey data from 132 R&D CCs established by foreign multinational companies in India to understand how firms execute distributed innovative work. Specifically, we examine the performance outcomes of projects using different technology-enabled coordination strategies to manage their interdependencies across multiple locations. We find that modularization of work across locations is largely ineffective when the underlying tasks are less routinized, less analyzable, and less familiar to the CC. Coordination based …

Managing Value In Supply Chains: Case Studies On The Sourcing Hub Concept, Anupam Agrawal, Arnoud De Meyer, Luk N. Van Wassenhove
Research Collection Lee Kong Chian School Of Business
A firm’s raw material sourcing knowledge can be a strategic resource. This article explores how firms can capture and use this knowledge. It examines the sourcing experiences of four firms in four different countries in the automotive industry and identifies the raw material sourcing knowledge-related parameters. Synthesizing the findings from these case studies, it proposes the concept of the sourcing hub—a collaborative center involving the firm, its suppliers, and raw material suppliers—which can effectively capture and deploy the raw material sourcing knowledge for managing value in upstream sourcing.

Numerical Simulations Of In Vitro Nanoparticle Toxicity – The Case Of Poly(Amido Amine) Dendrimers., Marcus Maher, Pratap Naha, Sourav Prasanna Mukherjee, Hugh Byrne
Articles
A phenomenological rate equation model is constructed to numerically simulate nanoparticle uptake and subsequent cellular response. Polyamidoamine dendrimers (generations 4-6) are modelled and the temporal evolution of the intracellular cascade of; increased levels of reactive oxygen species, intracellular antioxidant species, caspase activation, mitochondrial membrane potential decay, tumour necrosis factor and interleukin generation is simulated, based on experimental observations.
The dose and generation dependence of several of these response factors are seen to well represent experimental observations at a range of time points. The model indicates that variations between responses of different cell-lines, including murine macrophages, human keratinocytes and colon cells, …

Surface Enhanced Raman Scattering With Gold Nanoparticles: Effect Of Particle Shape, Furong Tian, Franck Bonnier, Alan Casey, Anne Shanahan, Hugh Byrne
Articles
The dependence of the Surface Enhanced Raman Scattering (SERS) by gold nanoparticles on their shape is examined using the organic dye, rhodamine 6G (R6G) as probe molecule. SERS has been explored extensively for applications in sensing and imaging, but the design and optimisation of efficient substrates is still challenging. In order to understand and optimise the SERS process in nanoparticles, gold nanospheres and their aggregates, nanotriangles, and nanostars of similar dimensions were synthesised and characterised according to their average size, zeta potential and UV/visible absorption. SERS from R6G was negligible for unaggregated nanospheres at 532 nm, close to the maximum …

Romantic Relationship Quality As A Protective Factor Against Suicidal Ideation In Young Adulthood, Darla Marie Still
Romantic Relationship Quality As A Protective Factor Against Suicidal Ideation In Young Adulthood, Darla Marie Still
Electronic Theses and Dissertations Archive
Sociological research on suicide often emphasizes Durkheim’s notion that social integration provides protection against self-harm; however, research in medical sociology demonstrates that social relationships are not always beneficial to mental health. With this study, I use the National Longitudinal Study of Adolescent to Adult Health to examine how social integration via romantic relationships shapes suicidality in young adulthood. Interestingly, the mere presence of a romantic relationship is not protective against suicidal thoughts; for example, married or cohabiting individuals are no less likely to report suicide ideation than single individuals. However, men and women in high quality romantic relationships are less …

A Quantitative Assessment Of Livability Principles For Neighborhood-Level Analysis, Kelsey Elizabeth Ford
A Quantitative Assessment Of Livability Principles For Neighborhood-Level Analysis, Kelsey Elizabeth Ford
Electronic Theses and Dissertations Archive
The Partnership for Sustainable Communities, which includes the United States Department of Transportation (DOT), Housing Urban Development (HUD), an the Environmental Protection Agency (EPA), has established six principles of livability. The principles are defined in a qualitative way, and limited research exits to establish a quantitative measurement of livability goals. This research develops a quantitative metric to assess the six livability principles and applies the metric to measure the livability of Memphis, Tennessee neighborhoods. The results are compared to existing residential survey data for the Memphis area to determine how well the defined livability principles align with residential stakeholder perceptions …
Multiscale Finite Element Models Of The Growth Plate Under Compressive Loads, Jie Gao
Multiscale Finite Element Models Of The Growth Plate Under Compressive Loads, Jie Gao
Electronic Theses and Dissertations Archive
It is generally accepted that mechanical loading of the growth plate influences bone growth and development. Previous computational studies of growth plate mechanics have been carried out at the tissue level and have focused on the beginning stage of development before and after the formation of the secondary center of ossification. This has led to the formulation of mechanoregulatory bone growth theories in terms of tissue level hydrostatic stresses and tensile strains. However, growth continues until the growth plate is a thin undulating structure sandwiched between bone layers. Within this structure, it is the chondrocytes, organized and arranged in columnar …

The Institution Of Green: The Interaction Of Green Strategies And Key Stakeholders, Jennifer Martinez
Electronic Theses and Dissertations Archive
By empirically connecting the legitimization process with individual stakeholder groups, this research enhances our understanding of the impact of the institutional environment on organizational efforts toward sustainability, and suggests a new approach to examining the influence of stakeholders on green strategies. This dissertation consists of two papers. In the first paper, the role of consumers and the process of legitimization of the green organization is examined. Hypotheses are tested experimentally, wherein subjects consider a range of green organizational behaviors. Analysis reveals that all green behaviors result in the organization earning some legitimacy. Further, there is no significant difference in consumers' attitudes …
A Fortunate Rivalry: The Installation And History Of Pipe Organs In Three Churches In Natchez, Mississippi, Sharon Lynn Rouse
A Fortunate Rivalry: The Installation And History Of Pipe Organs In Three Churches In Natchez, Mississippi, Sharon Lynn Rouse
Electronic Theses and Dissertations Archive
In the 1920s three large Möller pipe organs were installed within a three-block radius in three historic churches in Natchez, Mississippi, a small, eclectic town on the Mississippi River. What was the catalyst that resulted in a seemingly extravagant use ofresources? Through information available in church archives, newspapers, books, journals, and documentsfrom organ companies, this study traces the historyof the organs and suggests possible reason for their original installation. The factors influencing thepurchases include the geography of Natchez, the location fo the churches, savvy salesmen, and a healthy competition among the church congregations. An overview of the people who factored …
Biodiversity Measures Of Bats In Western Tennessee, Jeremy Scott Dennison
Biodiversity Measures Of Bats In Western Tennessee, Jeremy Scott Dennison
Electronic Theses and Dissertations Archive
Biodiversity measures of bats were investigated at three sites in western Tennessee. Mist nets were used to capture bats during summer months, and biological indices were derived. A Shannon index was used to calculate species diversity, and a Berger-Parker Index was utilized to determine dominance for the most abundant species at each site. Percent biomass of each species captured was calculated for each taxon at each site. In total, eight species were recorded (eastern red bat, Lasiurus borealis; tricolored bat, Perimyotis subflavus; evening bat, Nycticeius humeralis; southeastern myotis, Myotis austroriparius; little brown myotis, M. lucifugus; gray myotis, M. grisescens; silver-haired …
What Do Young Adults Consider To Be "Smoking?" A Study Of Individual Differences, Amy Susan Farrell
What Do Young Adults Consider To Be "Smoking?" A Study Of Individual Differences, Amy Susan Farrell
Electronic Theses and Dissertations Archive
Study validity often depends on accurate self-reports of participant smoking. However, a dearth of empirical literature exists addressing how individuals define ‘being a smoker.’ The purpose of this study was to explore predictors of how young adults define smoking, including ethnicity, gender, and amount smoked. A measure of what constitutes “smoking” was created, ranging from very restrictive definitions of smoking to not at all restrictive definitions. A 3-way factorial ANOVA revealed an interaction effect between ethnicity and smoking level. Pairwise comparisons yielded significant differences between Caucasian light and intermittent smokers (LITS) and Caucasian heavy smokers. Caucasian LITS were more likely …
A New Set Of Focal Mechanisms And A Geodynamic Model For The Eastern Tennessee Seismic Zone, Matthew T. Cooley
A New Set Of Focal Mechanisms And A Geodynamic Model For The Eastern Tennessee Seismic Zone, Matthew T. Cooley
Electronic Theses and Dissertations Archive
A new set of focal mechanisms is determined for the eastern Tennessee seismic zone (ETSZ). The 26 solutions are consistent with previous solutions in the northern and middle portions of the ETSZ and extend coverage into the southern portion. The solutions exhibit strike-slip and oblique normal faulting, with nodal planes generally oriented N-S/E-W and NE-SW/NW-SE. Strike-slip solutions dominate the middle and northern portions of the zone. To the south, near the Tennessee/Georgia border, a group of focal mechanisms for relatively shallow events exhibit normal faulting. To examine a possible cause of the normal faulting, a geodynamic model is developed which …

String Quartet No. 1 is a five-movement work inspired by my travels to Cappadocia, a region in central Turkey known for its unusual landscapes. In the summer of 2012 I attended a music festical located in Mustafapasha, a small village in the heart of Cappadocia. I was amazed by the dramatic alien-like landscapes carved out of the volcanic plateau by eons of erosion. Early human inhabitants carved dwellings out of the soft rock resembling giant termite mounds. Early Christians continued the practice of carving dwellings as well as churches out of the rocks. It is in this region of Turkey …

Exposure to the potent synthetic estrogenic compound diethylstilbestrol (DES) during early development has been found to elicit numerous detrimental effects. Prescribed to millions of pregnant women from the 1930s to the 1970s, it has been shown that exposure to DES caused significant reproductive organ abnormalities and dysfunction in both men and women (DES sons and daughters, respectively) who were exposed in utero. A high incidence of psychiatric disorders has also been reported, primarily in adult DES daughters. Because of estrogen's well-known influence on emotion, it has been suggested that exposure to this estrogenic compound may be able to disturb the …
