Extraterritorial Avoidance Actions: Lessons From Madoff, Edward R. Morrison

The Madoff case continues to provide fertile ground for testing boundaries of the U.S. Bankruptcy Code (Code). In July 2014, Judge Rakoff issued an important decision regarding the extraterritorial scope of the Code’s avoidance rules. The Trustee for the Madoff Estate, Irving Picard, sought to recover cash withdrawn by “feeder funds.” These funds pooled customer assets, invested them in Bernard L. Madoff Investment Securities (Madoff Securities), withdrew proceeds from the investment prior to Madoff’s SIPA filing, and distributed the proceeds to customers before the funds themselves collapsed. In this paper, a model is established to predict the swelling ratio of high-volatile bituminous coal during pyrolysis, based on the assumption that the structure of bubble distribution in the particle at the beginning of the plastic stage is a central bubble surrounded by many surrounding bubbles. The initial number and size of the bubbles when the particles become plastic are calculated by the pressure in the particle. The chemical percolation devolatilization (CPD) model is used to describe pyrolysis. Purpose: This study investigated the effect of age on articulatory movement and stability in young, middle-age, and older adults. It also examined the potential influence of linguistic complexity on speech motor control across utterances that differed in their length and grammatical complexity. Method: There were 60 participants in 3 age groups:20–30 years, 40–50 years, and 60–70 years, with equal numbers of men and women in each group. The speakers produced 10 repetitions of 5 different stimuli—each of which included the same bilabial-loaded phrase in different grammatical contexts—while their lip movements were recorded. Purpose: The majority of supervision literature has focused on the supervision of graduate students. The purpose of this study was to examine the preparation of and explore the thinking styles of mentoring speech-language pathologists (SLPs) of Speech-Language Pathology graduates who are completing their clinical fellowship. Method: A questionnaire was sent to 1626 SLPs by email who reported working in school settings and 102 participants responded. They were asked questions about demographics, caseloads, supervisory experiences, knowledge of the American Speech-Language-Hearing Association (ASHA, 2008) standards for supervision, and thinking styles. Studies have found that Mormons and non-Mormons in Utah exhibit significant linguistic differences. We break this down further by investigating whether there are also differences between Mormons who actively participate in the religion and those who do not, and find significant differences with a medium or larger effect size between the groups for multiple variables. We conclude that when investigating the linguistic correlates of religious affiliation in a community, it is vital to elicit not just respondents’ religious affiliations, but also their level of participation within that religion.

The Consumer Financial Protection Bureau (CFPB) was launched in 2011 by Congress through the Dodd-Frank Wall Street Reform and Consumer Protection Act. The CFPB site, available in English and Spanish, is updated daily and provides information about a wide range of financial products and services, including paying for college, foreclosure prevention, loan discrimination, credit reporting and scores, credit card agreements, and mortgage disclosures.

GEM houses the results of research conducted by the Global Entrepreneurship Research Association (GERA) on the level of entrepreneurship around the world. This research, which involves annual surveys and interviews, was initiated in 1999 by Babson College and the London Business School. Data are collected and harmonized by GERA staff. The project started with 10 participating countries and has expanded to include more than 69 countries.

Ample research has documented the long-term interaction between Mesoamerica and the U.S. Southwest/Northwest Mexico (SW/NW). Nelson (2006:345) has used the phrase ''Mesoamerican interaction markers" as a way to describe evidence of the is contact in the SW /NW. He further defines these as "a variety of archaeological patterns that are reminiscent of Mesoamerican counterparts" including "objects, practices, and styles." In a period marked by extensive cross-national interactions, nationality may present an important focal point that individuals coordinate on. This study uses an experimental approach to study whether nationality serves as a coordination device. We let subjects from Japan, Korea, and China play coordination games in which we vary information about their partner. The results show that nationality serves as a coordination device if common nationality is the only piece of information available to the subjects. The strength of this device is nationality-dependent and diminishes when participants are provided with additional information about their partner. We also find that subjects …

Vemurafenib is a selective B-Raf^V600E inhibitor in melanoma targeted therapy which also inhibits the wild type B- and C-Raf. In oocyte maturation, the C-Raf/MAPK pathway acts as an important self-enhancing and promoting system, w hereas in embryo development, the C-Raf/M APK pathway participates in pre- and post- implantation embryo proliferation and differentiation.

The goal of this study was to explore the different effects of parental alcoholism and history of trauma exposure on depressive symptoms in an emerging adult, college population. In particular, mediating effects of resilience, social support, and family satisfaction were evaluated for both parental alcoholism and previous interpersonal trauma exposure using structural equation modeling (SEM). Participants were 708 students (217 male, 491 female) attending a large mid-Atlantic state university. Photoproduction of the π⁰ meson was studied using the CLAS detector at the Thomas Jefferson National Accelerator Facility using tagged incident photon energies spanning the range E_γ = 1.1 GeV - 5.45 GeV. The measurement is performed on a liquid hydrogen target in the reaction γp → pe ⁺e^–(γ). The final state of the reaction is the sum of two subprocesses for π⁰ decay, the Dalitz decay mode of π⁰ → e ⁺e^–γ and conversion mode where one photon from π⁰ → γγ decay is converted into a …

This article explores how rhetorical myth can be used as a tool for persuading employees to accept change and to maintain consensus during the process. It defines rhetorical myth using three concepts: chronographia (a rhetorical interpretation of history), epideictic prediction (defining a present action by assigning praise and blame to both past and future), and communal markers (using Burkean identification and rhetorically defined boundary objects to define a community). Background/Aims: This study explored the interest in genomic testing for modest changes in colorectal cancer risk and preferences for receiving genomic risk communications among individuals with intermediate disease risk due to a family history of colorectal cancer. Methods: Surveys were conducted on 272 men and women at intermediate risk for colorectal cancer enrolled in a randomized trial comparing a remote personalized risk communication intervention (TeleCARE) aimed at promoting colonoscopy to a generic print control condition. Fur trade historians have longed for more documentation to answer questions relating to the for trade in 1826. That year marked William Ashley's last foray (and Robert Campbell's inaugural venture) into the Rockies. Fortunately, a missing piece of that puzzle has now been found in the form of an 1826 diary and rendezvous business record that provides some answers while simultaneously raising a few additional questions. This Article explores the underappreciated role that agency insiders play in directing outside oversight of their employer agencies and, in turn, manipulating agency policy development. Specifically, the Article defines, documents, and evaluates the phenomenon of "soft whistleblowing"-an agency employee's deliberate, unsanctioned,substantive, and instrumental disclosure of nonpublic information about issues of policy. This phenomenon is ubiquitous but has received no systematic attention in the academic literature. As the Article demonstrates, agency employees regularly engage in soft whistleblowing to congressional staff, journalists, and agency watchdog groups, in an effort to bring outside pressure to bear on their employer agencies to shift policymaking …

In September 2013, California Governor Jerry Brown signed into law SB 606, criminalizing attempts to photograph or videotape a child if the reason for doing so was because the child's parent is a celebrity or public official.
