Rife With Latent Power: Exploring The Reach Of The Irs To Determine Tax-Exempt Status According To Public Policy Rationale In An Era Of Judicial Deference, Amy L. Moore
Law Faculty Scholarship
Using the case of Bob Jones University v. United States as a springboard, this article contends that the IRS has the legal authority to revoke the 501(c)(3) tax-exempt statuses of any institution that the IRS deems to be in violation of public policy. The first step to such an expansion might be to apply to private, religious universities that practice discrimination in areas other than race (e.g. gender and sexual orientation). This article traces the background and analysis of the Supreme Court decision in Bob Jones and how the Court left the door open for the IRS to make other …
The Quest For Finality: Five Stories Of White Collar Criminal Prosecution, Lucian E. Dervan
The Quest For Finality: Five Stories Of White Collar Criminal Prosecution, Lucian E. Dervan
Law Faculty Scholarship
In this symposium article, Professor Dervan examines the issue of finality and sentencing. In considering this issue, he argues that prosecutors, defendants, and society as a whole are drawn to the concept of finality in various ways during criminal adjudications. Further, far from an aspirational summit, he argues that some outgrowths of this quest for finality could be destructive and, in fact, obstructive to some of the larger goals of our criminal justice system, including the pursuit of truth and the protection of the innocent. Given the potential abstraction of these issues, Professor Dervan decided to discuss the possible consequences …

Over the nearly two de cades since the publication of Academic Capitalism: Politics, Policies, and the Entrepreneurial University (Slaughter and Leslie 1997), the model of academic capitalism has become one of the more widely cited conceptual frameworks in the global literature on higher education. Works in the academic capitalist canon have relied on the two basic understandings of the theory of academic capitalism and the new economy, as articulated by Slaughter and Leslie (1997), Slaughter and Rhoades (2004), and Rhoades and Slaughter (2006). Rhoades and Slaughter (2006) summarize these two conceptual strands as “the increasing engagement of higher education institutions …

Colleges and universities are no strangers to intellectual property. In a higher education environment increasingly challenged by dwindling state appropriations and stagnant or declining tuition revenue, the pressure is on for colleges and universities to generate revenue via new channels. The commercialization of intellectual property has proven to be a popular, albeit imperfect, vehicle in furtherance of these efforts. Although there is no shortage of both legal and higher education commentary focusing on the treatment of patents and copyrights by institutions of higher education, trademark activity by colleges and universities largely has escaped attention. ...
Determining Extraterritoriality, Franklin A. Gevurtz
Determining Extraterritoriality, Franklin A. Gevurtz
McGeorge School of Law Scholarly Articles
This Article addresses an underexplored but critical aspect of the presumption against extraterritoriality. The presumption against extraterritoriality-which the United States Supreme Court has increasingly invoked in recent years-calls for courts to presume that Congress does not intend U.S. statutes to govern events outside the United States. The most difficult issue presented by the presumption arises when relevant events occur both inside and outside the United States, as in the classic example, if a shooter on one side of the border kills a victim on the other, or if, as in the leading case, false statements originating inside the United States …

Sarpa salpa herbivory on shallow reaches of Posidonia oceanica beds.— Here, we examined the temporal and small–scale spatial variability of grazing by the herbivorous fish Sarpa salpa on shallow beds of the temperate seagrass Posidonia oceanica. Herbivory intensity expressed as the percent of leaf area taken by fish bites was higher in September 2006 than in February 2007, and at 0.5 m than at 1.5 m during both sampling times. All S. salpa feeding at the shallow locations studied were juveniles, with bite sizes ranging from 0.03 to 0.62 cm2. Juveniles feeding at 1.5 m were larger in February 2007 …
The Effects Of Pknox1.1 Knockdown On Hoxb1a Expression In R4 Of Danio Rerio Hindbrain, Kevin Hess (Class Of 2015)
The Effects Of Pknox1.1 Knockdown On Hoxb1a Expression In R4 Of Danio Rerio Hindbrain, Kevin Hess (Class Of 2015)
Writing Across the Curriculum
Zebrafish hindbrain development begins with the folding of the neural plate into the neural tube that gives rise to segments in the hindbrain known as rhombomeres. Each rhombomere gives rise to important structures, such as the otic vesicle and various craniofacial nerves. The first of the rhombomeres to develop is r4—modulated by proper development of hoxb1a. Proper development of r4 triggers a cascade of gene expression of other genes such as fgfs, krox-20, and many other genes required for proper segmentation of the rest of the hindbrain. Another one of these genes responsible for proper rhombomere segregation is …

In their new book, Originalism and the Good Constitution, John McGinnis and Michael Rappaport attempt to vanquish what they call constructionist originalism with an approach that I call methodist originalism. Unlike constructionist theories, which allow for non-originalist construction of underdetermined texts, methodist originalism proposes filling in the historical gaps with what McGinnis and Rappaport claim were the originally accepted methods of interpretation. This is originalism all the way down.
It’s a creative effort, and one that appropriately rejects some of the more latitudinous originalist theories currently in play. Unfortunately, the same history McGinnis and Rappaport rely upon fatally undermines …

Anyone who teaches intellectual property law knows how exciting the subject matter can be for students. They inundate professors not only with questions about the classroom material but also with news about emerging technologies, cutting-edge litigation, and legislative initiatives. And the attentive professor will seek to turn these exchanges into teaching moments.
One favorite of students involves a classic intellectual-property mechanism, the cease-and-desist letter. It’s a favorite, I think, because such correspondence can be over the top, and the responses can be quite funny – making this a perfect topic for this April Fool’s edition of IP Viewpoints. [...]
The Arbitral Tribunal: Selection And Replacement Of Arbitrators, Chiara Giorgetti
The Arbitral Tribunal: Selection And Replacement Of Arbitrators, Chiara Giorgetti
Law Faculty Publications
The great majority of international investment arbitrations are decided by a three-member arbitral panel, where each party selects one arbitrator, and the presiding arbitrator is selected either by agreement of the parties, the party-appointed arbitrators, or, more often, by a neutral appointing authority. Their selection is not only a characteristic feature of international investment arbitration, but also one of the most important and delicate acts taken by the parties during the proceedings. Indeed, as frequent arbitrator Professor William W. Park noted, while “in real estate the three key elements are ‘location, location, location,’ . . . in arbitration the applicable …
Filling The District Of Arizona Vacancies, Carl W. Tobias
Filling The District Of Arizona Vacancies, Carl W. Tobias

The judicial vacancy crisis must end. The federal bench has experienced nearly a ten percent vacancy rate over an unprecedented four and a half-year period. The substantial number and protracted character of those openings have imposed numerous detrimental effects. These phenomena have delayed the scheduling of jury trials in many civil cases and even propelled termination of some litigation because the Speedy Trial Act requires that criminal matters have precedence. Indeed, the emergency designation has meant that some criminal proceedings were delayed in the Arizona District. The vacancy crisis places additional pressure on sitting judges, particularly the eight senior judges …

Metathesis Reaction Of Ethylene And 2-Butene On Molybdenum-Based Catalysts, Benjamas Netiworaruksa
Chulalongkorn University Theses and Dissertations (Chula ETD)
This dissertation studies and develops the supported molybdenum catalyst for metathesis reaction of ethylene and 2-butene to produce propylene. It was found that the major factor affecting the catalytic performance for metathesis reaction is the catalyst support. From this study, it was firstly revealed that the suitable support for molybdenum-based catalyst is the mixed support of alumina and zeolite. The catalyst containing alumina support prepared from aluminium nitrate physically mixed with HBeta support could provide high selectivity of propylene. The optimum ratio of the composite support of alumina and zeolite was 3:1. However, the most optimum support obtaining propylene selectivity …

Effect Of Additives In Lubricant On Cobalt-Iron Alloy Lapping, Wiraya Anamnart
Chulalongkorn University Theses and Dissertations (Chula ETD)
To maintain this flying height of read-write head (called slider) at 12 nm across the disk, read and writer elements will be lapped to meet designed surface roughness, surface topography, as well as magnetic property. The writer element was made from cobalt-iron alloy (CoFe). Final lapping process of sliders uses lubricant to control surface morphology and to avoid corrosion. The aim of this study was to determine the effect of additives on corrosion protection of CoFe. The corrosion was studied by potentiostat technique and atomic force microscopy (AFM). Water content was determined by Karl Fischer method. Thin film passivation was …

Reevaluation Of The Aapm Tg-43 Brachytherapy Dosimetry Parameters For An 125I Seed, And The Influence Of Eye Plaque Design On Dose Distributions And Dose-Volume Histograms, Prakash Aryal
Theses and Dissertations--Physics and Astronomy
The TG-43 dosimetry parameters of the AdvantageTM 125I model IAI-125A brachytherapy seed were studied. An investigation using modern MCNP radiation transport code with updated cross-section libraries was performed. Twelve different simulation conditions were studied for a single seed by varying the coating thickness, mass density, photon energy spectrum and cross-section library. The dose rate was found to be 6.3% lower at 1 cm in comparison to published results. New TG-43 dosimetry parameters are proposed.
The dose distribution for a brachytherapy eye plaque, model EP917, was investigated, including the effects of collimation from high-Z slots. Dose distributions for …
Magneto-Optical Effects And Precision Measurement Physics: Accessing The Magnetic Faraday Effect Of Polarized 3He With A Triple Modulation Technique, Gretchen Phelps
Magneto-Optical Effects And Precision Measurement Physics: Accessing The Magnetic Faraday Effect Of Polarized 3He With A Triple Modulation Technique, Gretchen Phelps
Theses and Dissertations--Physics and Astronomy
This work is comprised of the study of two magneto-optical phenomena: the Kerr effect and the Faraday effect. Neutron physics experiments often utilize polarized neutrons, and one method to generate or guide polarized neutrons involves the use of a system of magnetic super-mirrors. Experience shows that the magnetization of the super-mirror may decay with time; therefore, we implemented the surface magneto-optical Kerr effect (SMOKE) to study the temporal behavior of the magnetization of a magnetized remnant super-mirror sample, where a sensitivity of 0.1 mrad was obtained. Unique to our set-up was the method in which the various magnetization directions were …
The Dijet Cross Section Measurement In Proton-Proton Collisions At A Center Of Mass Energy Of 500 Gev At Star, Grant D. Webb
The Dijet Cross Section Measurement In Proton-Proton Collisions At A Center Of Mass Energy Of 500 Gev At Star, Grant D. Webb
Theses and Dissertations--Physics and Astronomy
Polarized deep inelastic scattering experiments play a vital role in the exploration of the spin structure of the proton. The polarized proton-proton collider at RHIC provides direct access to the gluon spin distribution through longitudinal double spin asymmetry measurements of inclusive jets, pions, and dijets. This thesis presents the measurement of the dijet double differential cross-section in proton-proton collisions at center of mass energies of √s = 500 GeV. The data represent an integrated luminosity of 8.7 pb-1 recorded by the STAR detector during the 2009 RHIC run. A comprehensive jet analysis was performed to determine the ideal …

Theses and Dissertations--Physics and Astronomy
One of the most important results emerging from string theory is the gauge gravity duality (AdS/CFT correspondence) which tells us that certain problems in particular gravitational backgrounds can be exactly mapped to a particular dual gauge theory a quantum theory very similar to the one explaining the interactions between fundamental subatomic particles. The chief merit of the duality is that a difficult problem in one theory can be mapped to a simpler and solvable problem in the other theory. The duality can be used both ways.
Most of the current theoretical framework is suited to study equilibrium systems, or …

Nuclear Structure Relevant To Double-Beta Decay: Studies Of ⁷⁶Ge And ⁷⁶Se Using Inelastic Neutron Scattering, Benjamin P. Crider
Theses and Dissertations--Physics and Astronomy
While neutrino oscillations indicate that neutrino flavors mix and that neutrinos have mass, they do not supply information on the absolute mass scale of the three flavors of neutrinos. Currently, the only viable way to determine this mass scale is through the observation of the theoretically predicted process of neutrinoless double-beta decay (0νββ). This yet-to-be-observed decay process is speculated to occur in a handful of nuclei and has predicted half-lives greater than 10²⁵ years. Observation of 0νββ is the goal of several large-scale, multinational efforts and consists of detecting a sharp peak in the summed β energies at the Q-value …
A New Set Of Spectroscopic Metallicity Calibrations For Rr Lyrae Variable Stars, Eckhart Spalding
A New Set Of Spectroscopic Metallicity Calibrations For Rr Lyrae Variable Stars, Eckhart Spalding
Theses and Dissertations--Physics and Astronomy
RR Lyrae stars are old, iron-poor, Helium-burning variable stars. RR Lyraes are extremely useful for tracing phase-space structures and metallicities within the galaxy because they are easy to identify, have consistent luminosities, and are found in large numbers in the galactic disk, bulge, and halo. Here we present a new set of spectroscopic metallicity calibrations that use the equivalent widths of the Ca II K, Hγ, and Hδ lines to calculate metallicity values. Applied to spectroscopic survey data, these calibrations will help shed light on the evolution of the Milky Way and other galaxies.
