New laws were signed by Governor Andrew Cuomo in 2013 regarding notice requirements in the Brownfield Cleanup Program, Bottle Bill enforcement, mercury thermostats, oversized lobsters, shark fins, and Eurasian boars, among other things. On the regulatory front, the state promulgated final regulations concerning New York’s participation in the Regional Greenhouse Gas Initiative and regulatory relief for certain dairy farms, and proposed regulations for liquefied natural gas facilities and invasive species.
This annual survey describes new environmental laws that were enacted in New York in 2013, as well as several significant regulatory developments. The survey identifies the laws by their chapter …

Professors Joseph Fishkin’s and Heather Gerken’s essay for this symposium, The Two Trends That Matter for Party Politics, along with the larger project of which it is a part, marks a notable turn (or return) in the law-of-democracy field. Unlike much recent scholarship, Fishkin’s and Gerken’s work does not offer a comprehensive theory of corruption or equality, but instead analyzes the relationship between campaign finance law and the actual functioning of political parties in our democracy. In brief, Fishkin and Gerken tell us that our contemporary political parties are at once highly polarized and oddly weak. They claim this is …

Four million Americans with extensive tax preferences are subject to the Alternative Minimum Tax (AMT). By taxing a broad definition of income, the AMT makes it possible to have a tax system that both encourages certain activities with generous tax preferences and maintains a semblance of distributional equity. The same rationale supports the imposition of an Alternative Maximum Tax (AMxT), which would cap tax liabilities of individuals with very few preference items and thereby afford Congress greater flexibility in designing the income tax. The original 1969 AMT proposal included an AMxT; it is difficult to justify imposing one without the …

Many pelagic fishes engage prey at high speeds supported by high metabolic rates and anaerobic metabolic capacity. Epipelagic squids are reported to have among the highest metabolic rates in the oceans as a result of demanding foraging strategies and the use of jet propulsion, which is inherently inefficient. This study examined enzymatic proxies of anaerobic metabolism in two species of pelagic squid, Dosidicus gigas and Doryteuthis pealeii (Lesueur 1821), over a size range of six orders of magnitude. We hypothesized that activity of the anaerobically poised enzymes would be high and increase with size as in ecologically similar fishes. In …

Ticks are notorious vectors of disease for humans, and many species of ticks transmit multiple pathogens, sometimes in the same tick bite. Accordingly, a broad-spectrum vaccine that targets vector ticks and pathogen transmission at the tick/host interface, rather than multiple vaccines against every possible tickborne pathogen, could become an important tool for resolving an emerging public health crisis. The concept for such a tick protective vaccine comes from observations of an acquired tick resistance (ATR) that can develop in non-natural hosts of ticks following sensitization to tick salivary components. Hepatitis C virus (HCV) is a major cause of liver disease. Spontaneous resolution of infection is associated with broad, MHC class I- (CD8+) and class II-restricted (CD4+) T cell responses to multiple viral epitopes. Only 20% of patients clear infection spontaneously, however, most develop chronic disease. The response to chemotherapy varies; therapeutic vaccination offers an additional treatment strategy. To date, therapeutic vaccines have demonstrated only limited success in clinical trials. Vector-mediated vaccination with multi-epitope-expressing DNA constructs provides an improved approach. IVIG is frequently used in the ‘pre-conditioning’ regimens for higher risk transplants; its effects are attributed in part to induction of Tregs. We have identified regulatory T cell (Treg) epitopes, now known as Tregitopes, in IgG, the main component of intravenous immunoglobulin therapy (IVIg). Tregitopes provide one explanation for the expansion and activation of Treg cells following IVIg treatment. Tregitopes are peptides that exhibit high affinity binding to multiple human HLA Class II DR; they are conserved across IgG isotypes and mammalian species. Background: Human leptospirosis is an emerging infectious disease of global significance, and is endemic to several countries in the Pacific. Zoonotic transmission dynamics combined with diagnostic challenges lead to difficulties in prevention and identification of cases. The Federated States of Micronesia (FSM) lacks surveillance data for human leptospirosis. This hospital-based serologic survey sought to estimate the burden of leptospirosis, collect information relating to associated factors, and assess the leptospirosis point-of-care rapid diagnostic test (RDT) commonly used in FSM. Skeletal muscle wasting is a consequence of numerous physiological conditions, including denervation, corticosteroid treatment, immobilization, and aging. The E3 ubiquitin ligases, MuRF1 and MAFbx, are induced under nearly all atrophy conditions and are believed to play a key role in protein degradation in atrophying muscle. However, the preliminary data described in this study provides new evidence that MuRF1 may also act as a transcriptional modulator of atrophy-induced gene activity, including the regulation of MAFbx and MuRF1 expression. This piece provides an application of care ethics to the typical American diet. In the first chapter, the problems surrounding the Standard American Diet are discussed at both the individual, familial, global, animal, and environmental levels. The second chapter provides an overview of the theoretical components of care ethics, and lays a framework for analysis. The third and final chapter demonstrates how in applying many of the core principles of care, great strides can be made in remedying the numerous problems that are a direct result of typical consumption habits in the United States.

This Master’s Thesis examines the ways in which the culturally distinct groups who inhabited the pre-colonial and colonial Southeast approached cross-cultural communication. The extensive and violent entradas led by Spaniards into the Southeastern interior in the 1500s represent a watershed moment in North American history that deeply impacted the economic, social, and geopolitical landscapes of an already well-populated and politically sophisticated region. The subsequent establishment of St. Augustine in 1565 and the arrival of the British in the mid-seventeenth century are similarly seen as pivotal moments in the region’s history that forced many culturally and linguistically dissimilar groups to interact. …

Each student receiving special education services in the public school system, roughly 6.4 million students, has an Individualized Education Program (IEP) that is mandated by the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). IDEA dictates that a team of people familiar with the student, including the parents, should create the IEP. Unfortunately, research indicates that many parents believe their participation is not welcome. While only a small percentage of parents may actually be dissatisfied with the IEP process, the cost of dissatisfaction is high, further stretching already limited resources that could be better used in the classroom.

The use of standardized test scores to hold schools, students, and teachers accountable for their performance has been at the heart of education reform efforts throughout the United States for years. Ongoing evaluation of current practice and incorporation of evidence based research into guidelines and protocols is a requirement for the provision of high quality, cost efficient care. Despite some literature describing observational data, midline catheters (MCs) are not an appropriate vascular access device for Newborn Intensive Care Unit (NICU) patients due to insufficient high level evidence demonstrating safety and efficacy. In addition, national guidelines for MC use in neonatal and infant patients lacks sufficient information for safe and effective use of MCs.

The purpose of this quality improvement project was to increase physical activity among postoperative adult liver transplant patients, improve documentation of daily activity, and ultimately influence quality of life (QOL). Quality of life has been shown to improve dramatically after liver transplant, as patients enter transplant severely debilitated with limitations on their physical activity which carry over following transplant. The literature supports that liver transplant patients should engage in physical activity which may improve QOL. According to a 2012 American Coal Ash Association Coal production Survey Report, US coal fired power plants produced more than 109 million tons of waste that year. Approximately half of this waste is the valuable by-product fly ash. There are three classes of fly ash: cementitious class C and non-cementitious classes F and N. Over half of the fly ash produced is used in the geotechnical/construction industries. Most geotechnical soil stabilization studies using fly ash are focused on controlling shrink-swell potential of clays. A Systematic Exploration Of Different Stimulus Combinations Using The Implicit Relational Assessement Procedure, Kail H. Seymour

The Implicit Associations Test (IAT) and the Implicit Relational Assessment Procedure (IRAP) recently have been used to examine implicit attitudes (i.e., implicit bias). Although both methods attempt to assess implicit attitudes about two categorical stimuli (e.g., Black people and White people), the IRAP assesses attitudes toward each stimulus separately. Conversely, IAT procedures inherently produce a comparison between the two attitudes in an “oppositional” fashion (e.g., a pro-Black people:anti-White people attitude or a pro-White people:anti-Black people attitude). As IRAP data have demonstrated non-oppositional relationships for such attitudes (e.g., co-occurring pro-Black people and pro-White people attitudes), alternative experimental stimulus pairings may produce …

Understanding of agricultural systems has been an accepted and necessary aspect of a child’s education for centuries. Conventional agricultural education has proven effective in creating well-trained agricultural professionals and scholars, but has had the unintentional effect of limiting access to agricultural concepts to the non-agricultural student. This effect has potentially negative cultural consequences considering the importance agricultural issues. Most favored nation (MFN) clauses have recently started drawing the attention of antitrust authorities, regardless of their common use in international trade and multilateral agreements, and irrespective of the common view that they have mostly pro-competitive effects. MFN clauses allow customers to obtain profitable commercial conditions, minimize the risk related to the launch of new products, as well as reduce transaction costs. The paper analyses decisions on infringements of collective consumer interests issued by the President of UOKiK between 2013-2014 towards entities engaged in the provision of financial services, including banking services. Considered in particular are lenders providing consumer loans, also those that are not subject to the supervision of the Financial Supervision Authority Commission. It is the purpose of this paper to show the irregularities in the provision of consumer loans that emerged from the analysis of the decisions of the President of UOKiK, and which have been qualified as practices infringing collective consumer interests

This article assesses whether there is a convergence in the approach of the EU and national competition authorities (NCAs) in how they define product markets for the purpose of merger control. The hypothesis of such convergence is tested in the sector of sales of groceries in large retail stores. The analysis of decisions issued by various European NCAs shows that some have adopted an asymmetric market definition: from the perspective of supermarkets and discount stores hypermarkets form part of the same product market, whilst hypermarkets are not constrained by supermarkets and discount stores.
