Concentrated Ownership And Corporate Control: Wallenberg Sphere And Samsung Group, Hwa-Jin Kim Jan 2014

Concentrated Ownership And Corporate Control: Wallenberg Sphere And Samsung Group, Hwa-Jin Kim

Articles

Samsung Group’s success cannot be attributed to its corporate governance structure, at least thus far. The corporate governance of Samsung has been rather controversial. As the group faces the succession issue the corporate governance has become as crucial as their new products and services. Samsung has discovered a role model on the other side of the planet, Wallenberg Sphere in Sweden. Much effort has been made to learn about Wallenberg’s arrangements and key to its success. However, a fundamental difference between the institutions in Sweden and Korea has made the corporate structures of the two groups radically different. Wallenberg uses …

Variation in the sequence of T cell epitopes between dengue virus (DENV) serotypes is believed to alter memory T cell responses during second heterologous infections. We identified a highly conserved, novel, HLA-B57-restricted epitope on the DENV NS1 protein. We predicted higher frequencies of B57-NS126-34-specific CD8+ T cells in PBMC from individuals undergoing secondary rather than primary DENV infection. However, high tetramer-positive T cell frequencies during acute infection were seen in only 1 of 9 subjects with secondary infection. B57-NS126-34-specific and other DENV epitope-specific CD8+ T cells, as well as total CD8+ T cells, expressed an activated phenotype (CD69+ and/or CD38+) …

Comparison Of Phenotypic Value Changes In Pure Lines Of Bombyx Mori (Lepidoptera: Bombycidae) During Consecutive Generations Following Initial Selection On Cocoon Weight, Alireza Seidavi, Marian R. Goldsmith Jan 2014

Comparison Of Phenotypic Value Changes In Pure Lines Of Bombyx Mori (Lepidoptera: Bombycidae) During Consecutive Generations Following Initial Selection On Cocoon Weight, Alireza Seidavi, Marian R. Goldsmith

Biological Sciences Faculty Publications

The experiments reported here were conducted to investigate the effect of selection on three quantitative traits, namely cocoon weight, cocoon shell weight, and cocoon shell percentage, during four generations by rearing six pure breeds of domesticated silkworm, Bombyx mori L. (Lepidoptera: Bombycidae) of Chinese and Japanese origin compared with random unselected groups as controls. All stages of rearing and data recording were performed over four rearing periods, with generations 1–3 during successive spring seasons and generation 4 during the autumn season in year 3. Each pure line contained two groups of selected and random (control) groups. Comparisons included the effect …

Terpene Chemistry Of Eastern Hemlocks Resistant To Hemlock Woolly Adelgid, E. Alexa Mckenzie, Joseph S. Elkinton, Richard A. Casagrande, Evan L. Preisser, Mark Mayer Jan 2014

Terpene Chemistry Of Eastern Hemlocks Resistant To Hemlock Woolly Adelgid, E. Alexa Mckenzie, Joseph S. Elkinton, Richard A. Casagrande, Evan L. Preisser, Mark Mayer

Biological Sciences Faculty Publications

Recent studies have identified a small number of individual eastern hemlock trees that demonstrate relative resistance to the introduced sap-feeding insect, the hemlock woolly adelgid. Using gas chromatography, we compared concentrations of twenty-two terpenoids in susceptible and relatively resistant trees, both in the forest and in propagated cuttings in a common-garden setting. Terpenoid concentrations were higher in twig tissue of resistant versus susceptible trees, across six sampling dates and at both sites. These changes may be particularly important because the hemlock woolly adelgid feeds on twig tissue. Because the common-garden cuttings were free of herbivores, the higher terpenoid concentrations are …

Evaluation Of Forearm Muscle Fatigue From Operating A Motorcycle Clutch, Megan O. Conrad, Richard W. Marklin Jan 2014

Evaluation Of Forearm Muscle Fatigue From Operating A Motorcycle Clutch, Megan O. Conrad, Richard W. Marklin

Mechanical Engineering Faculty Research and Publications

A laboratory experiment evaluated the effect of motorcycle clutch design on the electromyography (EMG) activity of the primary agonist finger flexor muscle in the forearm. The goal was to compare muscle fatigue resulting from operation of two different motorcycle clutches in simulated traffic. EMG activity from the flexor digitorum superficialis (FDS) muscle of 12 female and 11 males were recorded while each participant operated an existing motorcycle clutch (requiring 98 N peak force) as well as an alternate design (requiring 36 N peak force) during 60-minute simulations. Muscle fatigue was quantified by measuring the decrease in median frequency of the …

Actavis, The Reverse Payment Fallacy, And The Continuing Need For Regulatory Solutions, Daniel A. Crane Jan 2014

Actavis, The Reverse Payment Fallacy, And The Continuing Need For Regulatory Solutions, Daniel A. Crane

Articles

The Actavis decision punted more than it decided. Although narrowing the range of possible outcomes by rejecting the legal rules at the extremes and opting for a rule of reason middle ground, the opinion failed to grapple with the most challenging issues of regulatory policy raised by pharmaceutical patent settlements. In particular, it failed to clearly delineate the social costs of permitting and disallowing patent settlements, avoided grappling with the crucial issues of patent validity and infringement, and erroneously focused on “reverse payments” as a distinctive antitrust problem when equally or more anticompetitive settlements can be crafted without reverse payments. …

Unfriendly Unilateralism, Monica Hakimi Jan 2014

Unfriendly Unilateralism, Monica Hakimi

Articles

This Article examines a category of conduct that I call “unfriendly unilateralism.” One state deprives another of a benefit (unfriendly) and, in some cases, strays from its own obligations (noncompliant), outside any structured international process (unilateral). Such conduct troubles many international lawyers because it looks more like the nastiness of power politics than like the order and stability of law. Worse, states can abuse the conduct to undercut the law. Nevertheless, international law tolerates unfriendly unilateralism for enforcement. A victim state may use unfriendly unilateralism against a scofflaw in order to restore the legal arrangement that existed before the breach. …

Essential Health Benefits And The Affordable Care Act: Law And Process, Nicholas Bagley, Helen Levy Jan 2014

Essential Health Benefits And The Affordable Care Act: Law And Process, Nicholas Bagley, Helen Levy

Articles

Starting in 2014, the Affordable Care Act (ACA) will require private insurance plans sold in the individual and small-group markets to cover a roster of "essential health benefits." Precisely which benefits should count as essential, however, was left to the discretion of the Department of Health and Human Services (HHS). The matter was both important and controversial. Nonetheless, HHS announced its policy by posting on the Internet a thirteen-page bulletin stating that it would allow each state to define essential benefits for itself. On both substance and procedure, the move was surprising. The state-by-state approach departed from the uniform, federal …

The Ethical Debate Of Drone Journalism: Flying Into The Future Of Reporting, John C. Jarvis Jan 2014

The Ethical Debate Of Drone Journalism: Flying Into The Future Of Reporting, John C. Jarvis

Research Papers

Unmanned aerial vehicles – a.k.a. drones – have left the realm of science fiction and are making their way into use by businesses, the Department of Homeland Security, law enforcement officials and news organizations in the United States. Their potential as a newsgathering tool is only just now being explored – but can these machines maneuver around the ethical and legislative obstacles that threaten to block their use? This paper will look at the definition of what constitutes a drone, the legal arguments for and against their use and the status of drone legislation in the United States, the pros …

Rate Of False Conviction Of Criminal Defendants Who Are Sentenced To Death, Samuel R. Gross, Barbara O'Brien, Chen Hu, Edward H. Kennedy Jan 2014

Rate Of False Conviction Of Criminal Defendants Who Are Sentenced To Death, Samuel R. Gross, Barbara O'Brien, Chen Hu, Edward H. Kennedy

Articles

The rate of erroneous conviction of innocent criminal defendants is often described as not merely unknown but unknowable. There is no systematic method to determine the accuracy of a criminal conviction; if there were, these errors would not occur in the first place. As a result, very few false convictions are ever discovered, and those that are discovered are not representative of the group as a whole. In the United States, however, a high proportion of false convictions that do come to light and produce exonerations are concentrated among the tiny minority of cases in which defendants are sentenced to …

Wage And Employment Fluctuations In The Us Manufacturing Industry, Amal T. Mendis Jan 2014

Wage And Employment Fluctuations In The Us Manufacturing Industry, Amal T. Mendis

Research Papers

The volume of trade between the US and developing nations has increased substantially over the past three decades. The resulting fluctuations in employment and wages of domestic and foreign workers, as well as export and import trends, are in agreement with

Hoeschker-Ohlin-Samuelson. We take as our base case the manufacturing industry. We find that the wages of unskilled relative to skilled US workers has increased, while overall employment of unskilled workers has decreased. We also look at a subsample of plants in the Mexican automobile industry following the implementation of NAFTA and find that exports and TFP growth have increased, …

"We Are Pioneers": Polyamorists' Stigma Management Strategies, Jessica M. Young Jan 2014

"We Are Pioneers": Polyamorists' Stigma Management Strategies, Jessica M. Young

Research Papers

Despite a shift in our late-modern period to erode more traditional forms of relationships and a growth in polyamory’s popularity, non-monogamy remains highly stigmatized. Polyamory is a relationship style wherein participants have multiple romantic and/or sexual partners with whom they focus on building commitments, sharing intimacy, and establishing honesty (Sheff 2006). While scholarship on polyamory and the stigma of non-monogamies generally is growing, little is known about how polyamorists manage their stigmatized identities. Using Goffman’s (1963) theory of stigma management, I inductively analyze discussion board posts on a polyamorous community’s website and find that polyamorists manage their stigma differently in …

Fritz Zwicky And The Search For Dark Matter, Kurt Winkler

Faculty Publications

This paper will discuss the life of the Swiss native, Fritz Zwicky, and this article will present information in a linear fashion, starting with some attention-grabbing information about Zwicky's knowledge of dark matter and then lead to a discussion of his youth and some decisions he made at that time, especially dealing with his education. This essay will then describe some of Zwicky's personal relationships and how his sometimes commanding and abrasive personality affected them. The bulk of this article will deal with how Zwicky was ahead of his time in the areas of astrophysics and the theory of dark …

Utilizing The Tone Row In Jazz Pedagogy- A Technique To Create Tonal Harmony In An Atonal Environment, Paul Musso Jan 2014

Utilizing The Tone Row In Jazz Pedagogy- A Technique To Create Tonal Harmony In An Atonal Environment, Paul Musso

Journal of Music Theory Pedagogy E-Journal 2013-2017

This paper examines a jazz pedagogical method, based on a Bill Evans composition, that utilizes Schoenberg's serial tone row in a harmonically tonal setting. By exploring the extensive harmonic possibilities produced by one tone row, this method guides students through the creation of harmonic options to produce tonal accompaniment against atonal melodic content. The result of this exercise establishes numerous harmonic possibilities for the tone row and may also serves as a rigorous theoretical exercise in chord construction. The paper further discusses the unique capacity of the exercise to help students connect intuitive organic music choices with empirical pedagogical elements.
