SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

In recent years greater numbers of thinkers have considered the Prisoners' Counsel Act 1836 but have viewed the Act through the lens of Whig history, as a further manifestation of the modernisation of criminal justice in the inevitable march towards adversarialism. This article addresses how the Act has been understood within broader literature concerning the nineteenth century felony trial. In particular, greater attention is paid to how counsel reacted to the Act, considering the nature of the contemporary Bar, the apparent silence from the Bar in reaction to the Act, what evidence might be drawn upon to gauge how members …

The Special Investigation Branch (SIB) of the Royal Military Police (RMP) was formed in 1940, after the military authorities became concerned at the widespread theft of military stores by members of the British Expeditionary Force (BEF), and following a report on the matter by Chief Inspector George Hatherill of Scotland Yard. As a result 19 volunteer detectives from Scotland Yard joined the BEF to form the initial intake of the SIB. This article seeks to show that the creation of the SIB in early 1940, also entailed the transmission of civilian detective practices to the Royal Military Police, following the …

Western Australia introduced a new Western Australian Certificate of Education (WACE) Music course for Year 11 and 12 students in 2009. The construction of the course was protracted due to political interference at the ministerial level, input from vested interests within the music teaching community and adverse publicity in the wider community. The result has been the creation of a long and potentially confusing syllabus document. This paper reports on music teacher experiences with the WACE music course five years after its initial implementation. Until the late twentieth century, courses in voice and diction were a staple of the field of communication studies. Increasingly these classes are disappearing from departments around the country, largely over concerns regarding the prescription of strict speech standards. At the same time, an interest in vocal training has increased in BFA and MFA actor training programs. This study looks to the shared history of voice training between the fields of communication studies and theatre instruction to provide a critical pedagogy for vocal performance, specifically for the area of performance studies, but also for use in other disciplines. In this project I study Joseph Cornell’s practices of art-making through a performative lens. Rather than focusing on his finished products, I am interested in his embodied processes of assemblage. I call on Mikhail Bakhtin’s theory of the chronotope to articulate how time and space operate within Cornell’s finished works and his processes of assemblage art. In so doing, I conceptualize Cornell’s textual chronotope, métaphysique d’éphemera or “everyday magic,” as well as his chronotopes of assemblage: wandering, archiving, collaging, and assembling. Initial development of this guideline's purpose and scope included three teleconference focus groups with a total of 26 topic experts and health-care practitioners across Canada, and one in-person focus group with 20 older adults living in Ontario. The purpose of this document is to explore the viola music of the unknown Russian multi-talented musician Andrei Fedorovich Arends, in his two compositions written for that instrument: the Ballade for viola and piano, Op. 4 (1885) and the Concertino for viola and orchestra, Op. 7 (1886). Despite its obscurity, Sinfonietta, Op. 188 by Joachim Raff (1822-1882) is an important chamber work for winds and should find its place more frequently on the concert programs of university wind ensembles. In order to test this hypothesis, I investigate Raff’s biography for evidence that might explain its obscurity while leaving the door open to question that status. Furthermore, I investigate the Sinfonietta from a conductor’s perspective and apply a critique of its artistic merit. Several factors explain Raff’s fall from acclaim; none of them relegate his music to permanent obscurity. Based on the composer’s historical significance, analytical results, and …

This study investigates the use of theater as a rehabilitation tool for people who have suffered a mild Traumatic Brian Injury (TBI). In this study, two middle aged women agreed to participate in theater workshops once-a-week for a 5 week period. The workshops focused on different areas of communication: eye contact, movement, spontaneity, creativity, diction, and volume of voice. Based on research done on how a TBI affects an individual, it was found that individuals who are living with a TBI say that they have a loss of socialization skills, a loss of social support and a feeling of being …

The present study looked at whether theatre could be used as a successful intervention for refugees living in the United States. Using Boal’s (1985) Theatre of the Oppressed model, Karen refugees from Laos and Thailand, now living in Minnesota completed a four day workshop. Before and after the theatre workshop the participants were tested on overall well-being (self-esteem and mood), creativity, and English language abilities. Significant improvements were found for overall well-being. In addition, the workshops were shown to have the greatest impact on those who had a lower English language ability to start. Research in the area of performance poetry is still relatively new to the field of communication. Using Hecht’s Communication Theory of Identity, this study explores performance poetry as a communicative tool for identity management. By observing the performances of five poets from six seasons of HBO’s Def Poetry Jam, a thematic analysis of the communication practices that occurred during the performances was used to code the processes of identity management. Additionally, this study explores how validation of enacted identity occurs between the poets and their audiences. My dissertation, “Gathering Thinglessness”: Samuel Beckett’s Essayistic Approach to Nothing, responds to the dominant strand in Beckett criticism that figures the writer as a philosopher of “nothing” whether of Democritean, existentialist, or deconstructionist voids. In contrast, I argue that Beckett’s literary texts approximate philosophy in their essayistic style, characterized by the incorporation of multiple, contradictory sources in a fragmented form. While philosophical analyses are often designed to demonstrate that the literary texts are the equivalent of philosophical discourse, in the first chapter I argue that they actually serve to re-subordinate literature to philosophy since they depend on the pre-existing philosophical …

In recent years, we have come to better understand how nineteenth-century burlesques critiqued and lampooned the respectable humbuggery of patent theater productions and middle-class culture. Their carnivalesque spectacle and low humor turned topsy-turvy what was falsely revered or pretentious in English society. This study, however, explores the extent to which some burlesques responded conservatively to social and legislative change, which supposedly weakened established hierarchies constituting English culture and society. My chapters examine how two burlesques of Shakespeare’s Othello—Charles M. Westmacott’s Othello, the Moor of Fleet Street (1833) and Maurice M. M. G. Despite radical differences in their political commentary, Amiri Baraka and V.S. Naipaul’s literary careers have obsessively centered on the divided Self of the colonized artist. Esther Jackson argues that Baraka’s “search for form” becomes “symbolic of a continuing effort to mediate between warring factions within the perceiving mind” (38). Similarly, many critics have interpreted Naipaul’s grave manifestos as the outpourings of a writer disenchanted with his own past and national identity. The purpose of this study was to identify disparities in the delivery of standards based dance education in the K-12 learning environment in the state of Florida and to give specific attention to curricular choices and instructional design. A mixed-methods approach was used and included a survey of K-12 dance educators in Florida as well as interviews with leaders in dance and arts education in the state. This inquiry identified common areas where curriculum choice and instructional design meet the barriers of time, space, place, learner population, expected educational outcomes, and teacher preparation. This dissertation reconstructs and investigates the origins of the Pérez Art Museum Miami. In 2013, the museum re-opened in a new, county-funded building to great acclaim and international attention, but the museum’s origins in the 1970s have been largely forgotten. A result of the 1972 “Decade of Progress” bond vote by county taxpayers that allocated funds to build a new art museum, the museum opened as the Center for the Fine Arts in 1983 as a non-collecting institution dedicated to displaying traveling exhibitions. In 1767, Mme Benoist published an epistolary libertine novel entitled Lettres du Colonel Talbert. Although she has received little critical attention to date, she was a prolific author who appeared with great regularity at minor literary salons. Her presence at these salons is well-established in personal memoirs and correspondences, and actively remarked upon by other authors—men and women—of the period, including Mme Roland and Choderlos de Laclos. This thesis analyzes three of the plays inspired by the Haitian Revolution and written by black playwrights. The first chapter covers William Edgar Easton’s Dessalines, a Dramatic Tale: A Single Chapter from Haiti’s History. It discusses Easton’s decision to depict Dessalines as a man of faith, a believer, a Christian. The second chapter employs Langston Hughes’ play, Troubled Island, to argue Dessalines’ modernity. The third play, by Saint Lucian playwright Derek Walcott, is The Haitian Earth. The thesis concludes with a brief discussion of his play and its contribution to black consciousness. The postcolonial African state has been the subject of extensive study and scrutiny by various scholars of great repute such as Colin Legum, Crawford Young, Robert H. Jackson and Carl G. Rosberg, Pierre Englebert and Jean-Francois Bayart to name but a few. Crawford Young's work is especially interesting because of the manner in which he treats the process of state formation.
