Turning The World Upside Down: How Frames Of Reference Shape Environmental Law, James Salzman, Martin Doyle Jan 2014

Turning The World Upside Down: How Frames Of Reference Shape Environmental Law, James Salzman, Martin Doyle

Faculty Scholarship

Models and representations help us understand complex phenomena. The Mercator map presents a familiar, two-dimensional view of our three-dimensional world, for example, but it can distort as much as it clarifies. In the natural sciences, too, there are very different ways of framing reality. The classic method developed by Leonard Euler measures a system from a fixed point. A competing method developed by Joseph Louis Lagrange measures from the perspective of a particle moving within the system. These Eulerian and Lagrangian methods of measurement dominate the physical sciences and provide different, though equally valid, measures of how the system operates. …

Götterdämmerung, Lawrence G. Baxter Jan 2014

Götterdämmerung, Lawrence G. Baxter

Faculty Scholarship

In his panel remarks on the future direction of financial regulation after the 2012 elections, Professor Lawrence Baxter argues that the age of large banks and “too big to fail” is destined to come to an end, but not through the traditional avenue of governmental oversight. Baxter starts by detailing the warning signs that illuminate the unsustainable nature of the current financial model and moves to a discussion on the deficiencies of modern banking regulations. Some hope for an end to giant banking behemoths, Baxter finally posits, lies in stricter market discipline and a realization that smaller, less-complex banks provide …

Graphene-Like 2-D Nanomaterials And Their Properties, Diana Daikie Aggudey Jan 2014

Graphene-Like 2-D Nanomaterials And Their Properties, Diana Daikie Aggudey

Theses, Dissertations and Culminating Projects

Graphene, unlike other carbon allotropes has recently been the subject of interest in the field of nano material research. Graphene is being utilized as the building block for graphitic materials such as the 0-D fullerenes, 1-D nanotubes and 3-D graphites. Graphene is a single layer material, made up of interconnected hexagons of sp bonded carbon atoms arranged in a honeycomb crystal lattice. Graphene and its derivatives have been shown in previous studies/research to exhibit exceptional high electronic and thermal conductivity, optical transparency and high specific surface area additional to outstanding mechanical flexibility and environmental stability. Graphene is amongst the most …

Green Remediation Of Veterinary Antibiotics In Soil-Water Systems, Pravin Anraj Punamiya Jan 2014

Green Remediation Of Veterinary Antibiotics In Soil-Water Systems, Pravin Anraj Punamiya

Theses, Dissertations and Culminating Projects

Veterinary antibiotics (VAs) are considered emerging contaminants of concern. Considerable efforts have been made to understand the fate and transport of VAs in soil and water environment and very few have attempted to develop novel remediation strategies to overcome the problem of antibiotic resistance and potential toxicity to aquatic species. To our knowledge, the present study is a pioneer study in which it attempts to develop a low-cost, “green” remediation technique utilizing a waste byproduct of the drinking water treatment industry, namely, the Al-based water treatment residuals (Al-WTR), as a sorbent to stabilize tetracycline (TTC) and oxytetracycline (OTC) in aqueous …

Upcycling Church: New Hope For Transforming Declining And Plateaued Churches, Richard J. Frazer Jan 2014

Upcycling Church: New Hope For Transforming Declining And Plateaued Churches, Richard J. Frazer

Great Commission Research Journal

This article introduces new language and an alternative paradigm to the topic of revitalizing declining churches, which presents a transforming process for pastors, church leaders, denominational executives, and consultants to implement when coaching revitalizing churches. The biblical foundation for this writing is Jesus’ letter to the church of Sardis, recorded in Revelation 3:1–6. Five principles for upcycling a declining church are presented: embrace the crisis, answer the wakeup call, strengthen what remains, strengthen who remains, and return to spiritual roots.

The Effect Of Macroeconomic Variables On Stock Market Returns In Ghana (2000-2013), Charles Barnor

Walden Dissertations and Doctoral Studies

Variations in macroeconomic indicators affect the performance of the stock markets. In Ghana, although the performance of the Ghana Stock Exchange (GSE) has been affected by macroeconomic variables from January 2000 to December 2013, the mechanisms of these relationships have not been studied. The purpose of this research was to examine the relationships between selected macroeconomic variables and their effect on the stock market returns on the Ghana stock market. The research questions addressed whether macroeconomic variables had significant effect on stock market returns in Ghana within the specified period. The target sample was all 36 listed firms on the …

African American Race And Culture And Patients' Perceptions Of Diabetes Health Education, Linda Marie Keenan Jan 2014

African American Race And Culture And Patients' Perceptions Of Diabetes Health Education, Linda Marie Keenan

Walden Dissertations and Doctoral Studies

African Americans diagnosed with diabetes are less likely to self-manage diabetes-specific modifiable risk factors. As a result, utilization of healthcare services occurs at a greater rate than other racial groups, and thereby incurs higher than expected healthcare costs. This ethnographic study explored the elements of diabetes educational material African Americans in a large city in the southern part of the United States found most useful to facilitate self-management of their disease. Bandura's self-efficacy theory provided the theoretical framework. Research questions addressed the preferred educational content, layout of material, and methods for educational delivery and caregiver support. A purposive sample of …

Teachers' Expectations And Reading Achievement Of African American Middle School Students, Gloria Denise King Lewis Jan 2014

Teachers' Expectations And Reading Achievement Of African American Middle School Students, Gloria Denise King Lewis

Walden Dissertations and Doctoral Studies

A local and national concern in education is the persistent achievement gap between African American and Caucasian middle school students. Despite numerous reforms, the gap continues to show African American middle school students performing lower in reading. The purpose of this mixed methods study, framed in the theoretical perspective of Culturally Responsive Pedagogy, was to examine teachers' expectations and the relationship between those expectations and the educational outcomes of African American middle school children. Data were collected to identify pedagogical practices, examine teacher expectations, and determine the relationship between those expectations and student Criterion Referenced Competency Test (CRCT) scores. Nineteen …

Prevalence Of Neonatal Tetanus In Northeastern Nigeria, Jalal-Eddeen Abubakar Saleh Jan 2014

Prevalence Of Neonatal Tetanus In Northeastern Nigeria, Jalal-Eddeen Abubakar Saleh

Walden Dissertations and Doctoral Studies

Although efforts have been made towards improving the health of children across the globe with notable results, neonatal tetanus (NNT) remains a major contributor to the neonatal death rates in Nigeria. This problem calls for a concerted effort by the government to achieve the revised global NNT elimination deadline of 2015. The purpose of this cross-sectional quantitative study using secondary data was to establish the prevalence of NNT in Nigeria's northeast region and to ascertain if there was any significant difference in frequency of antenatal care (ANC), trained traditional birth attendants (TBAs), and umbilical cord treatments, using single sample proportions …

The framework that drove this study was based on Pajares's concept that teacher expectations may influence students and their academic performance and behaviors. The data included individual interviews from 15 teachers and teacher/coaches who had a minimum of 5 years …

Generational Cohort Differences In Types Of Organizational Commitment, April Lavette Jones Jan 2014

Generational Cohort Differences In Types Of Organizational Commitment, April Lavette Jones

Walden Dissertations and Doctoral Studies

In hospitals in the United States, the ratio of nurses to patients is declining, resulting in an increase in work demands for nurses. Consequently, organizations face challenges with nurses' organizational commitment. Studies have revealed generational differences, as determined by birth year, in employee levels of organizational commitment in a number of organizational settings. However, there is a gap in the literature regarding the impact of generational cohorts on the organizational commitment of nurses. The purpose of this quantitative, nonexperimental, cross-sectional design was to address whether generational cohorts of nurses differed in their levels of organizational commitment, and to investigate whether …

Spirituality And Hope As Influences On Family Cohesion Among African American Men, Jennifer Joan Desouza Jan 2014

Spirituality And Hope As Influences On Family Cohesion Among African American Men, Jennifer Joan Desouza

Walden Dissertations and Doctoral Studies

Researchers have found that African American men have a history of difficulty in maintaining family cohesion. Researchers have also found that, in comparison to European American men, African American men are more likely to populate the penal systems, are more abusive to their partners, are less supportive of their children, and are less likely to have stable cohesive relationships. Evidence suggests that African American men draw strength from spirituality and hope, which are the core values of their culture. Drawing from these previous findings, as well as the stages of faith theory, hope theory, and the circumflex model of marital …

Stakeholders' Roles In Prioritizing Technical Vocational Education And Training In Postconflict Liberia, Edward S. Forh

Walden Dissertations and Doctoral Studies

Postconflict governments and counterparts have collaborated to provide skills training to communities as a critical postconflict development strategy. In these undertakings, the role of community members remains largely undefined. The purpose of this qualitative descriptive case study was to understand the perceptions held by rural community members regarding the role they played in influencing government's policy priority for technical and vocational education and training (TVET) as a local human development strategy in postconflict Liberia. The conceptual framework was based on human capital theory and concepts of motivation and achievement. Fourteen participants were purposefully selected for the study. Data were collected …

Purpose And Design In Organisms And Artifacts: The Search For A Unified Philosophical Theory Of Function, Mark L. Bourgeois Jan 2014

Purpose And Design In Organisms And Artifacts: The Search For A Unified Philosophical Theory Of Function, Mark L. Bourgeois

Dissertations

This work examines the concept of function in both biological organisms and designed artifacts. Function is routinely attributed within both kinds of systems, yet it is unclear whether it can mean the same thing within each, and indeed whether function attribution within natural systems is legitimate at all. Function is typically understood to have teleological content; yet in true teleological causation, the end is somehow the cause of its own means. In artifacts the consciously envisioned design of an artifact is taken to be the cause of its parts and their roles. Yet in naturalistic science there is no prior …

Corporate Social Responsibility In The Nigerian Banking Sector, Cecily Joy Adeleke Jan 2014

Corporate Social Responsibility In The Nigerian Banking Sector, Cecily Joy Adeleke

Walden Dissertations and Doctoral Studies

Corporate social responsibility is presently defined by the World Business Council of Sustainable Development as persistent commitment by businesses to behave ethically and contribute to economic development while also increasing the quality of life of employees, their families, and the community. Guided by Freeman's stakeholder theory, this study examined the relationship between corporate social responsibility and the Nigerian bankers' reported satisfaction with the Nigerian banking sector. Survey data were collected from a convenience sample of 99 Nigerian bankers, including branch managers, zonal managers, tellers, marketers, and investors. A single-stage sampling procedure was used to elicit their satisfaction with the Nigerian …

Liberty Without Capacity: Why States Should Ban Adolescent Driving, Vivian E. Hamilton Jan 2014

Liberty Without Capacity: Why States Should Ban Adolescent Driving, Vivian E. Hamilton

Georgia Law Review

Car crashes kill more teens each year than any other cause, and of the crashes in which they are involved, teens are overwhelmingly at fault. Teens crash at rates far higher than those of older drivers, and the younger the teen driver, the higher the risk-sixteen-year-old drivers have crash rates 250% higher than those of eighteen-year- olds. Driving experience does not explain the difference; younger beginners crash at rates higher than those of older beginners. Instead, younger teens' increased crash risk results primarily from immature regulatory competence. In other words, the capacities required for driving competence are still immature in …

The Impact Of Clapper V. Amnesty International Usa On The Doctrine Of Fear-Based Standing, Amanda M. Mcdowell Jan 2014

The Impact Of Clapper V. Amnesty International Usa On The Doctrine Of Fear-Based Standing, Amanda M. Mcdowell

Georgia Law Review

The Supreme Court's 2013 decision in Clapper v. Amnesty International USA dealt with the government's electronic surveillance authority under the Foreign Intelligence SurveillanceAct (FISA) Amendments. In a 5- 4 opinion, the Court held that a variety of U.S. persons, including attorneys and media organizations, did not have standing to challenge the constitutionality of the FISA Amendments because the plaintiffs' fear of future unlawful surveillance was not "certainly impending." Depending on how lower courts choose to interpret Clapper, the decision could have a significant impact on the doctrine of fear-based standing, which allows plaintiffs to establish standing based on fear of …

Climate Change Adaptation And Mitigation: A Local Solution To A Global Problem, Sarah J. Adams-Schoen Jan 2014

Climate Change Adaptation And Mitigation: A Local Solution To A Global Problem, Sarah J. Adams-Schoen

Scholarly Works

Local land use laws offer powerful tools for climate change adaptation and mitigation. However, notwithstanding New York municipalities’ many impressive efforts, local laws are not yet being utilized sufficiently to create disaster-resilient or disaster-adaptive communities. New York City has done substantially more than many other cities, including, critically, setting specific CO2 emissions reduction targets and amending zoning and building codes. But, in light of the evidence of climate change and its impacts, local decision makers, resource managers, and planners throughout the state must ask whether we are doing enough. Failure to do so will continue to be costly in terms …

On The Waterfront: New York City's Climate Change Adaptation And Mitigation Challenge (Part 2 Of 2), Sarah J. Adams-Schoen

Scholarly Works

New York City, like other major cities around the world, has acknowledged the problem of climate change and begun to implement proactive policies to decrease the city’s contribution to the problem (i.e., mitigation) and to make the city less vulnerable to the effects of climate change (i.e., adaptation). The City’s initiatives have been comprehensive and progressive, especially its climate change-related data analysis and communication initiatives including NPCC, and its comprehensive reform of building and other related codes. The City’s commitment to reduce greenhouse gas emissions by 30% by 2030 and its progress toward that goal are also laudable, but the …

This article specifically responds to Richard Delgado’s article, Standardized Testing as Discrimination: A Reply to Dan Subotnik.

The Relationship Between Hate Groups And Far-Right Ideological Violence, Amy Adamczyk, Jeff Gruenwald, Steven M. Chernak, Joshua D. Freilich Jan 2014

The Relationship Between Hate Groups And Far-Right Ideological Violence, Amy Adamczyk, Jeff Gruenwald, Steven M. Chernak, Joshua D. Freilich

Publications and Research

This study examines whether the presence of hate groups increases the likelihood of serious ideologically motivated violence committed by far-rightists. While hate crime research has generally focused on a single state or made comparisons across several states, we seek to examine this relationship within the context of U.S. counties. A smaller unit of analysis allows for the simultaneous consideration of several social processes operating at the community level, which might also influence ideologically motivated offending by far-right extremists. We test the relationship using data from the Extremist Crime Database (ECDB) for the dependent measure, the Southern Poverty Law Center (SPLC) …
