The incidence of tick-borne rickettsial disease in the southeastern United States has been rising steadily through the past decade, and the range expansions of tick species and tick-borne infectious agents, new and old, has resulted in an unprecedented mix of vectors and pathogens. The results of an ongoing 4-year surveillance project describe the relative abundance of questing tick populations in southeastern Virginia. Since 2009, more than 66,000 questing ticks of 7 species have been collected from vegetation in a variety of habitats, with Amblyomma americanum constituting over 95% of ticks collected. Other species represented included Ixodes scapularis, Dermacentor variabilis …

In March 2012, the authors met at the National Evolutionary Synthesis Center (NESCent) in Durham, North Carolina, USA, to discuss approaches and cooperative ventures in Indo-Pacific phylogeography. The group emerged with a series of findings: (1) Marine population structure is complex, but single locus mtDNA studies continue to provide powerful first assessment of phylogeographic patterns. (2) These patterns gain greater significance/power when resolved in a diversity of taxa. New analytical tools are emerging to address these analyses with multi-taxon approaches. (3) Genome-wide analyses are warranted if selection is indicated by surveys of standard markers. Such indicators can include discordance between …

Citizen Litigants Citizen Regulators: Four Cases Where Citizen Suits Drove Development Of Clean Water Law, Karl S. Coplan
Citizen Litigants Citizen Regulators: Four Cases Where Citizen Suits Drove Development Of Clean Water Law, Karl S. Coplan
Elisabeth Haub School of Law Faculty Publications
One of the key innovations of the 1970s regulatory environmental revolution was the provision for citizen enforcement of regulatory standards. This innovation upset the previous bipolar regulatory model, which was a two-way negotiation between the regulated industries and the (often captive) regulatory agencies. By removing agency enforcement discretion as a means of underenforcing statutory norms, the citizens suit brought a new constituency to the regulatory bargaining table. The citizen suit had the intended effect of implementing a regime of full enforcement of the new environmental norms.
But the revolutionary effect of the newly minted citizen suit was not limited to …

The arginine binding protein from Thermatoga maritima (TmArgBP), a substrate binding protein (SBP) involved in the ABC system of solute transport, presents a number of remarkable properties. These include an extraordinary stability to temperature and chemical denaturants and the tendency to form multimeric structures, an uncommon feature among SBPs involved in solute transport. Here we report a biophysical and structural characterization of the TmArgBP dimer. Our data indicate that the dimer of the protein is endowed with a remarkable stability since its full dissociation requires high temperature as well as SDS and urea at high concentrations. In order to elucidate …

Regulation Of Derivative Financial Instruments (Swaps, Options, And Futures), Ronald H. Filler, Jerry W. Markham
Books
As a result of the Dodd-Frank Act Wall Street Reform and Consumer Protection Act of 2010, derivatives regulation has become a hot topic on Wall Street and is, therefore, of much interest to law firms with financial institutions as clients. An increasing number of classes on this subject are being taught at law schools around the country, but, to date, there has been no casebook on the subject.
This casebook explores the regulation of swaps, futures and options by the Commodity Futures Trading Commission and the Securities and Exchange Commission. It examines the regulatory history of derivative instruments and traces …

Testing, Discrimination, And Opportunity: A Reply To Professor Harvey Gilmore, Dan Subotnik
Scholarly Works
This article was written as part of an ongoing dialog about the author’s previous article, "Does Testing = Race Discrimination?: Ricci, The Bar Exam, the LSAT, and the Challenge to Learning," which defended the Supreme Court’s decision in Ricci v. DeStefano, as well as defending testing more generally against charges of irrelevance, racial obtuseness, and most seriously, race discrimination.
This article specifically responds to an article written by Professor Harvey Gilmore which focuses mostly on the SAT and the LSAT.

Recent Developments In Land Use Ethics, Patricia E. Salkin
Scholarly Works
Current events across the country reveal no shortage of allegations of unethical conduct in the land use review process. Sadly, there are countless other media accounts of alleged and proven conflicts of interest and other ethical misconduct. In this annual review of reported decisions involving ethics in land use, recent decisions are discussed in the hopes that municipal attorneys will use this information as the basis of ongoing training for members of planning boards, zoning boards, and local legislative bodies who must be routinely reminded of not only their legal but ethical responsibilities in upholding the public trust.

New York City is a city on the waterfront. With 520 miles of coastline, New York City’s coastline is longer than the coastlines of Miami, Boston, Los Angeles and San Francisco combined. Nearly nine million New Yorkers live in areas vulnerable to flooding, storm surges and other natural disaster-related risks that are increasing as a result of climate change.
New York City didn’t wait for a devastating storm to begin comprehensively addressing the effects of climate change. The City’s extensive climate change mitigation and resiliency efforts and communications strategy have put the City in a league of its own. But, …
The Executive And The Environment: A Look At The Last Five Governors In New York, Patricia E. Salkin
The Executive And The Environment: A Look At The Last Five Governors In New York, Patricia E. Salkin
Scholarly Works
Gubernatorial leadership is the single most important indicator of how sustainable New York will be when it comes to issues of environmental protection and conservation. In preparing for the Kerlin Lecture, one of the things that struck (the author) is that New York governors for at least the last thirty years have consistently identified the critical economic, social, and environmental challenges facing this state. Is it simply political rhetoric to decry that the state is in terrible fiscal shape, that programs need to be funded to help those is need, and that we must pay attention to stewarding the environment …

Preparing Law Students To Become Litigators In The New Legal Landscape, Paul Radvany
Faculty Scholarship
The legal world has undergone rapid change over the past few years and law schools and law students are in the midst of adjusting to this new legal landscape. Employers increasingly want to hire students who are ready to practice. As a law student, I participated in an externship, simulation classes, and an in-house, live-client litigation clinic; as a professor, I have taught all three types of classes. 1 My experience, first as a law student, then as a litigator, and now as a professor, has taught me the importance and educational value of experiential learning in helping law students …
Charitable Giving, Tax Expenditures, And Direct Spending In The United States And The European Union, Lilian V. Faulhaber
Charitable Giving, Tax Expenditures, And Direct Spending In The United States And The European Union, Lilian V. Faulhaber
Georgetown Law Faculty Publications and Other Works
This Article compares the ways in which the United States and the European Union limit the ability of state-level entities to subsidize their own residents, whether through direct subsidies or through tax expenditures. It uses four recent charitable giving cases decided by the European Court of Justice (ECJ) to illustrate the ECJ’s evolving tax expenditure jurisprudence and argues that, while this jurisprudence may suggest a new and promising model for fiscal federalism, it may also have negative social policy implications. It also points out that the court analyzes direct spending and tax expenditures under different rubrics despite their economic equivalence …
Disruptive Technologies And The Law, Neal K. Katyal
Disruptive Technologies And The Law, Neal K. Katyal
Georgetown Law Faculty Publications and Other Works
In the past two decades, the concept of disruptive technology has gone from theory, to buzz word, to the captivation of the popular imagination. Disruptive innovation goes beyond improving existing products; it seeks to tap unforeseen markets, create products to solve problems consumers don't know that they have, and ultimately to change the face of industry. We are all the beneficiaries of disruption. Every smartphone carrying, MP3-listening, Netflix-watching consumer is taking advantage of technologies once unimaginable, but that now feel indispensable. Silicon Valley's pursuit of disruption will continue to benefit and delight a world of consumers. But where disruption may …
Elementary Statutory Interpretation: Rethinking Legislative Intent And History, Victoria Nourse
Elementary Statutory Interpretation: Rethinking Legislative Intent And History, Victoria Nourse
Georgetown Law Faculty Publications and Other Works
This article argues that theorists and practitioners of statutory interpretation should rethink two very basic concepts—legislative intent and legislative history. Textualists urge that to look to legislative history is to seek an intent that does not exist. This article argues we should put this objection to bed because, even if groups do not have minds, they have the functional equivalent of intent: they plan by using internal sequential procedures allowing them to project their collective actions forward in time. What we should mean by legislative “intent” is legislative “context.” For a group, context includes how groups act—their procedures. Once one …
All Of This Has Happened Before And All Of This Will Happen Again: Innovation In Copyright Licensing, Rebecca Tushnet
All Of This Has Happened Before And All Of This Will Happen Again: Innovation In Copyright Licensing, Rebecca Tushnet
Georgetown Law Faculty Publications and Other Works
Claims that copyright licensing can substitute for fair use have a long history. This article focuses on a new cycle of the copyright licensing debate, which has brought revised arguments in favor of universal copyright licensing. First, the new arrangements offered by large copyright owners often purport to sanction the large-scale creation of derivative works, rather than mere reproductions, which were the focus of earlier blanket licensing efforts. Second, the new licenses are often free. Rather than demanding royalties as in the past, copyright owners just want a piece of the action—along with the right to claim that unlicensed uses …
Pandemic Disease, Biological Weapons, And War, Laura K. Donohue
Pandemic Disease, Biological Weapons, And War, Laura K. Donohue
Georgetown Law Faculty Publications and Other Works
Over the past two decades, concern about the threat posed by biological weapons has grown. Biowarfare is not new. But prior to the recent trend, the threat largely centered on state use of such weapons. What changed with the end of the Cold War was the growing apprehension that materials and knowledge would proliferate beyond industrialized states’ control, and that “rogue states” or nonstate actors would acquire and use biological weapons. Accordingly, in 1993 senators Samuel Nunn, Richard Lugar, and Pete Dominici expanded the Cooperative Threat Reduction Program to assist the former Soviet republics in securing biological agents and weapons …

Influence Of Composition On The Structure And Optoelectronic Properties Of Pb_Xin_{25-X}Se_{75} Thin Films, Hesham Azmi Elmeleegi, Zeinab El Sayed El Mandouh, Ahmed Abdel Moez
Turkish Journal of Physics
Pb_xIn_{25-x}Se_{75} thin films with 2 compositions were prepared by thermal evaporation. The surface topography of these films was studied by transmission electron microscope. The optical reflectance and transmittance were studied in order to determine the optical parameters such as optical energy gap, refractive index, extinction coefficient, dielectric loss, and dielectric tangent loss for these films. A single oscillator theory equation was applied for these films in order to determine both dispersion energy and oscillating energy, and the ratio of free carrier concentration/effective mass (N/m*) was determined optically. It was found that change in the composition of these films affects strongly …
Fast Numerical Algorithm For A High-Precision 6d Electromagnetic Positioning Navigation System, Qian Xiang, Shiqing Wang, Haifeng Liu
Fast Numerical Algorithm For A High-Precision 6d Electromagnetic Positioning Navigation System, Qian Xiang, Shiqing Wang, Haifeng Liu
Turkish Journal of Physics
A fast numerical algorithm is proposed for the 6 degrees of freedom electromagnetic navigation system, which can be used to improve surgical operations guided by medical images. Both the rotation transformation technique and optimization technique are adopted in the algorithm. The results from simulations show that the calculating time is improved greatly under the required precision in the surgery. A navigation system based on the algorithm can make the medical device's dimensions miniaturized and the structure simplified and portable. The performance and application scope of the electromagnetic positioning navigation system can be improved.

Gan Nanostructuring For The Fabrication Of Thin Membranes And Emerging Applications, Ion Tiginyanu, Veaceslav Ursaki
Turkish Journal of Physics
We present a review of technological methods developed in recent years for the purpose of gallium nitride nanostructuring, with the main focus on fabrication of thin GaN membranes. In particular, we report on traditional methods of wet etching undercutting for membrane manufacturing, technologies applied for the fabrication of photonic crystal structures based on GaN nanomembranes, double side processing, and surface charge lithography. Prospects of membrane applications in photonic devices, sensors, and microoptoelectromechanical and nanoelectromechanical systems are discussed, taking into account the advantageous piezoelectric, optical, and mechanical properties of GaN and related III-V nitride materials.
Self-Assembled Nanocrystalline Zno Thin Film Transistor Performance Optimization For High Speed Applications, Burhan Bayraktaroglu, Kevin Leedy
Self-Assembled Nanocrystalline Zno Thin Film Transistor Performance Optimization For High Speed Applications, Burhan Bayraktaroglu, Kevin Leedy
Turkish Journal of Physics
ZnO nanocrystals grown at relatively low temperatures using various vacuum deposition techniques can yield semiconducting thin films of self-assembled nanocolumns 20-50 nm in diameter. Such films are suitable for the fabrication of high speed and transparent thin film transistors (TFTs). Unlike amorphous TFTs, the performance of ZnO transistors depends both on the crystal quality of nanocrystals and the electrical properties of boundary layers between them. We investigated the use of radio frequency sputtering, atomic layer deposition, and pulsed laser deposition techniques to fabricate self-assembled nanocrystalline thin films and determined the influence of deposition conditions on the performance of transistors. Device …
Optical Properties Of Zno/(Zn, Mg)O Quantum Wells, Thierry Bretagnon
Optical Properties Of Zno/(Zn, Mg)O Quantum Wells, Thierry Bretagnon
Turkish Journal of Physics
This paper reviews the optical properties of ZnO/(Zn, Mg)O single quantum wells grown by molecular beam epitaxy. Both heteroepitaxial quantum well growth along the polar c-direction and homoepitaxial quantum well growth on the nonpolar M plane cases are considered. The optical properties of these quantum wells are investigated by using reflectance, continuous wave photoluminescence, and time-resolved photoluminescence spectroscopies. The quantum-confined Stark effect dominates the properties of the excitons for polar quantum wells. The magnitude of the internal electric field that is induced by both spontaneous and piezoelectric polarizations is determined by comparing the experimental results with a variational calculation of …

Synthesis And Gas Sensor Applications Of Nanostructured Zno Grown At Low Temperatures, Oleg Lupan, Thierry Pauporte, Lee Chow
Turkish Journal of Physics
ZnO nanoarchitecture-based nano- and microdevices came into the focus due to their multifunctional operation. In this work, we summarize cost-effective procedures to grow ZnO nano- and microstructures, namely hydrothermal growth and electrochemical deposition. These techniques allow the controllable growth of ZnO nano- and microarchitectures at relatively low temperatures, below 100 °C, and do not require sophisticated equipment. We report on technological details for synthesis of ZnO and its characterization and applications in different novel devices such as gas sensors. Nanosensors and microsensors were fabricated using a focused ion beam and by metal welding an individual nano- and microstructure to form …

Turkish Journal of Physics
We investigated the properties of 7 different titanium dioxide nanostructures with different crystal structures (3 anatase, 2 rutile, and 2 mixed anatase--rutile phase). Nanoparticle samples and mesoporous sphere samples were investigated. Even for the same crystal structure, significant variations in performance were observed for anatase titania samples, while 2 rutile samples exhibited similar performance inferior to anatase-based anodes. Mixed-phase samples also exhibited lower specific capacity compared to the best performing anatase samples, and in this case a significant difference in performance was observed between nanoparticles and mesoporous spheres.
