Statutory Royalty Damages Under The Uniform Trade Secrets Act And The Federal Patent Code, Richard F. Dole Jr.
Statutory Royalty Damages Under The Uniform Trade Secrets Act And The Federal Patent Code, Richard F. Dole Jr.
Vanderbilt Journal of Entertainment & Technology Law
Optional statutory royalty damages are provided for by both the version of the Uniform Trade Secrets Act that has been enacted by most of the forty seven adopting states and the federal patent code remedies for infringement of utility patents. Notwithstanding periodic recommendations that the Uniform Act follow the patent code concept of statutory royalty damages, this article takes the position that differences between the Uniform Act and the Patent Code regarding monetary remedies make it reasonable for the Uniform Act statutory royalty provisions to be construed more objectively than their federal counterpart. This will preclude statutory royalty damages acquiring …
Benthic And Pelagic Pathways Of Methylmercury Bioaccumulation In Estuarine Food Webs Of The Northeast United States, Celia Y. Chen, Mark E. Borsuk, Deenie M. Bugge, Terill Hollweg
Benthic And Pelagic Pathways Of Methylmercury Bioaccumulation In Estuarine Food Webs Of The Northeast United States, Celia Y. Chen, Mark E. Borsuk, Deenie M. Bugge, Terill Hollweg
Dartmouth Scholarship
Methylmercury (MeHg) is a contaminant of global concern that bioaccumulates and bioamagnifies in marine food webs. Lower trophic level fauna are important conduits of MeHg from sediment and water to estuarine and coastal fish harvested for human consumption. However, the sources and pathways of MeHg to these coastal fisheries are poorly known particularly the potential for transfer of MeHg from the sediment to biotic compartments. Across a broad gradient of human land impacts, we analyzed MeHg concentrations in food webs at ten estuarine sites in the Northeast US (from the Hackensack Meadowlands, NJ to the Gulf of Maine). MeHg concentrations …
Synthetic Triterpenoids Can Protect Against Toxicity Without Reducing The Efficacy Of Treatment With Carboplatin And Paclitaxel In Experimental Lung Cancer, Karen T. Liby
Dartmouth Scholarship
Synthetic oleanane triterpenoids are multifunctional drugs being developed for the prevention and treatment of a variety of chronic diseases driven by inflammation and oxidative stress. Low nanomolar concentrations of triterpenoids inhibit the induction of inflammatory cytokines, and these drugs are potent activators of the Nrf2 cytoprotective pathway. In contrast, low micromolar concentrations of triterpenoids increased the production of ROS and induced apoptosis in a dose-dependent manner in malignant MCF10 CA1a breast cancer cells. Because cancer cells respond differently to ROS than normal cells, it should be possible to exploit these differences therapeutically. In an experimental model of lung cancer, the …

The literature provides support for the hypothesis that some major repeaters (individuals with >=5 lifetime suicide attempts) are addicted to suicidal behavior (SB). This study explores whether major repeaters are addicted to SB or not using 7 criteria: tolerance (Criterion 1), withdrawal (Criterion 2), loss of control (Criterion 3), problems in quitting/cutting down (Criterion 4), much time spent using (Criterion 5), substantial reduction in activities (Criterion 6), and adverse physiological/physical consequences (Criterion 7). Total dependence on SB was indicated by the presence of 3 or more of the 7 criteria in the last 12 months. This cross-sectional study at Puerta …

Nicotine dependence plays a critical role in addiction to tobacco products, and thus contributes to a variety of devastating tobacco-related diseases (SGR 2014). Annual costs associated with smoking in the US are estimated to be between $289 and $333 billion. Effective interventions for nicotine dependence, especially in smokers, are a critical barrier to the eradication of tobacco-related diseases. This overview highlights research presented at the Plenary Symposium of Behavior, Biology and Chemistry: Translational Research in Addiction Conference (BBC), hosted by the UT Health Science Center San Antonio, on March 9–10, 2013. The Plenary Symposium focused on tobacco addiction, and covered …

This study analyzed the overlap between roles and activities that health care navigators perform and competencies identified by the Medical Library Association's (MLA's) educational policy statement. Roles and activities that health care navigators perform were gleaned from published literature. Once common roles and activities that health care navigators perform were identified, MLA competencies were mapped against those roles and activities to identify areas of overlap. The greatest extent of correspondence occurred in patient empowerment and support. Further research is warranted to determine the extent to which health sciences librarians might assume responsibility for roles and activities that health care navigators …

In this chapter we summarize the limited studies on post-pubertal consequences of female childhood sexual abuse that includes both psychological distress and physiological stress. The characteristics of sexual abuse are discussed and determined to play a major role in the degree of trauma experienced and in the later effects. The concept of hormones and how disruptions in various endocrine systems can affect the development of these females are examined, especially during the pubertal period. Outcomes of interest included competence, in terms of cognitive, social, self-esteem, and locus of control, and psychopathology including depression, anxiety, dissociation, and hypersexuality. Direct physical results …

In this chapter we address gaps in existing research by examining the relationship between academic performance and attention problems with juvenile firesetting. Two datasets from the Achenbach System for Empirically Based Assessment (ASEBA) were used. The Factor Analysis Dataset (N = 975) was utilized and results indicated that adolescents who report lower academic performance are more likely to set fires. Additionally, adolescents who report a poor attitude toward school are even more likely to set fires. Logistic regressions were run to determine if attention problems predicted firesetting and the findings indicated that attention problems are predictive of self-reported firesetting. The …
Adolescent Bereavement, Leslie Robin, Hatim A. Omar
Adolescent Bereavement, Leslie Robin, Hatim A. Omar
Pediatrics Faculty Publications
Depending on cognitive and emotional development, an adolescent may grieve very differently than a child or an adult. While mature enough to understand death's irreversibility, adolescents may not fully comprehend the enduring consequences of a loved one's death. As the desire to separate from their families and forge new intimate relationships with peers assumes increasing priority, adolescents can seem egocentric in their reaction to death, a response which often frustrates and perplexes adults. Because volatile behavior is characteristic of adolescence, health providers struggle to differentiate between normal and complicated bereavement. Here we review the commonly-accepted characteristics of normal and complicated …
Disability And Women's Health, Stephanie Stockburger, Hatim A. Omar
Disability And Women's Health, Stephanie Stockburger, Hatim A. Omar
Pediatrics Faculty Publications
Children, adolescents, and women with disabilities experience the same sexual development, pubertal changes, concerns, and desire to reproduce as their typically developing counterparts. However, society has tended to stigmatize women with disabilities as "asexual" and ignore this aspect of their health care. These women are less likely to receive gynecological exams, contraception, and evaluation of sexual dysfunction. Unfortunately, having a disability places women at risk for sexual exploitation and abuse as well as sexually transmitted infections. Therefore, reproductive health care for these women is imperative. A number of barriers to receiving reproductive care exist. However, with proper education and knowledge …

Family Environmental Health And Teen Outcomes, Lesley Davidson, Alissa Briggs, Hatim A. Omar
Pediatrics Faculty Publications
Understanding the impact of family dynamics on health has become an environmental health priority in the field of adolescent medicine. Family dynamics are much more complex than they were 60 years ago and so are behavioral outcomes. This transformation in the American family has led towards a large array of adolescent living situations. Rural Kentucky is a prime example of an area with a high rate of nontraditional family composition. Poor family dynamics may be associated with increased rates of high risk behaviors among teenagers. Among these behaviors are drug use, sexual activity, and depression. In this study, we evaluated …

Theses
Adolescence is a particularly vulnerable life stage during which mental health challenges can occur and “in order to create a positive state of mental health and well-being it is imperative for young people to be able to recognise which aspects of life have a positive and damaging effect on their mental health” (HSE, 2007: 14). Irish research states that “Positive mental health enables young people to live fulfilling lives and promoting the mental health and wellbeing of our young people is a shared responsibility and is everybody’s business” (Department of Education and Skills & Health Service Executive & Department of …
Do Irish Consumers Understand Financial Risk In Savings And Investment Products In The Irish Financial Services Market?, Alan N. Burrows
Do Irish Consumers Understand Financial Risk In Savings And Investment Products In The Irish Financial Services Market?, Alan N. Burrows
Theses
This thesis focuses on Irish adult consumers and examines whether they understand the financial risk pertaining to the savings and investment products that they purchase in the Irish financial services market. This study is important because there is no up to date data currently available on this topic, specifically and solely related to Ireland and to Irish consumers. The findings of this study are significant because, if consumers lack an understanding of financial risk, it can potentially lead to mistakes in financial decisions which may lead to negative financial repercussions for consumers throughout their life and into retirement. In this …

The Value Of Words: Narrative As Evidence In Policymaking, Dmitry Epstein, Josiah Heidt, Cynthia R. Farina
Cornell Law Faculty Publications
Policymakers today rely primarily on statistical, financial, and other forms of technical data as their basis for decision-making. Yet, there is a potentially underestimated value in substantive reflections of the members of the public who will be affected by a particular piece of regulation. We discuss the value of narratives as input in the policy making process, based on our experience with Regulation Room–a product of an interdisciplinary initiative using innovative web technologies in real-time online experimentation. We describe professional policymakers and professional commenters as a community of practice that has limited shared repertoire with the lay members of the …
The Rate And Process Of Mangrove Forest Expansion On Above- And Belowground Carbon Relations In Coastal Louisiana, Hai Thanh Pham
The Rate And Process Of Mangrove Forest Expansion On Above- And Belowground Carbon Relations In Coastal Louisiana, Hai Thanh Pham
Dissertations
Global climate change is a major environmental threat to natural and cultural resources in low-lying coastal zones and deltas worldwide. It is expected to have a significant effect on the development of coastal wetlands by changing species range expansion. In fact, recent studies have shown that there has been an increasing mangrove encroachment poleward in the Southern and Northern Hemispheres into temperate saltmarsh zones due to the lack of freeze events. This phenomenon could have a critical impact on the structure and function of tidal wetlands at critical latitudes, especially in carbon sequestration, since mangroves are thought to sequester more …

In this study, the human leukemic monocyte lymphoma cell line U-937 was used as an in vitro model for monitoring monocyte/macrophage differentiation. Phorbol 12- myristate (13) (PMA) was used to activate U-937 cells into macrophage-like cells (M0). After 24 hours of PMA treatment, non- adherent U-937 cells became tightly adherent to the culture plates forming M0 cells. M0 cells were then polarized into the M1 macrophage phenotype by treatment with LPS and IFN-γ for another 24 hours. Each of the cytokines IL-4, IL-13, or IL-10 was applied separately to three M0 cultures for 24 hours to induce the M2 macrophage …

Challenge Accepted: Self-Enhancement Through The Pursuit Of Difficulty, Julie Anne Steinke
Browse all Theses and Dissertations
Individual resilience is popular topic whereby researchers attempt to identify characteristics of individuals who react positively to stress. However, such research uses a reactionary approach, attempting to characterize successful individuals after they experience adversity and does not explain why some individuals proactively seek out challenging circumstances. Pursuing challenge is a new construct that explains why individuals proactively increase stress as a strategic mechanism for developmental purposes. I developed and validated a measurement tool for pursuing challenge in multiple studies. Additionally, I explored relationships between pursuing challenge and similar constructs (e.g., grit, proactive personality, and self-efficacy), as well as the extent …

Silver nanoparticles (AgNPs) due to their unique antimicrobial properties are among the most widely utilized nanoparticle. Because of the nature of the products that utilize AgNPs, environmental release of AgNPs is inevitable. At greatest risk is the aquatic ecosystem due to known toxicity of the Ag + ion to aquatic organisms. Our goal was to use two fish models, fathead minnows (Pimephales promelas; FHMs) and zebrafish ( Danio rerio; ZFs), to study the effects of AgNPs on gill histopathology, Na+/K+-ATPase immunoreactivity, mucus production, bioaccumulation, particle uptake characterization, gill gene expression, and lethality in varying water parameters in comparison to the …

Regulators Of Repo: A Search For Gcm/Repo Transcription Factors, Kathy Ann Nipper
Electronic Theses and Dissertations
The role of the Drosophila melanogaster gene glial cells missing (gcm) is that of a binary switch in both the central nervous system (CNS) and the peripheral nervous system (PNS) in specification of the glial fate for multipotent precursor cells. However, Gcm is also essential for maturation of hematocytes and tendon cells ( Alfonso and Jones, 2002; Jones, et al., 1995; Hosoya et al., 1995; Soustell et al., 2004). The varied outcomes of gcm expression imply the interaction of co-factors capable of giving the Gcm protein different "meanings" in different developmental contexts. The Gcm target repo is expressed exclusively in …

Oneota migration into the central Illinois River valley around ad 1300 resulted in a number of different interactions with Mississippian groups. Milner and colleagues (1991) identified significant numbers of perimortem injuries at the Norris farms 36 cemetery, along with biological markers for poor health, such as cribra orbitalia and porotic hyperostosis. They suggested that the threat of violence may have forced the Oneonta at Morton village to limit subsistence activities to circumscribed areas close to the settlement, thereby reducing the resource base and negatively impacting the health of the community. However, recent research (Bengtson et al. 2012; Bengtson and O'Gorman …

Methane (CH4), nitrous oxide (N2O), and carbon dioxide (CO2) fluxes from agricultural landscapes may contribute significantly to regional greenhouse gas budgets due to stimulation of soil microbial activity through fertilizer application. Few studies have made measurements of CH4, N2O, and CO2 from the dominant landscape features of the agricultural landscape: farmland, riparian zone, and wetland habitat. This study assessed gas emission variability from the Mississippi Delta agricultural landscape and explored the effects of hydrology and hydrophytic vegetation on gas emissions.
Gas collection chambers were utilized to make gas measurements from soybean and corn farmland, vegetated riparian buffer, and two vegetated …

Abstract
PCBs were originally used as industrial chemicals in many devices and applications, including electrical capacitors and transformers, lubricants, and sealants in buildings. PCBs have been investigated and their use has been slowly phased out starting in the U.S. in the 1970s. A worldwide ban was put on the use and manufacturing of PCB in 2001, however they remain in the food chain because of their lipophilic properties and their long half-life. Major sources of PCB include wild-life, fish, and other seafood. Individuals exposed to PCB during development can experience negative effects on neurobiological, cognitive, and behavior functioning in both …
