Compliance with the Convention Against Torture (“CAT”) requires effective federal coordination with, and education of, state and local governments. In ratifying the CAT, the United States indicated that state and local governments share authority to implement the treaty. This includes the over 150 state and local civil and human rights agencies that enforce federal, state and local human and civil rights laws and/or conduct research, training and education, and issue policy recommendations within the United States (“Human Rights Agencies”). It also includes the full array of state and local officials with decision-making and enforcement authority, including governors, state attorneys general, …

The Speedy Trial Right And National Security Detentions: Critical Comments On United States V. Ghailani, Anthony O'Rourke
The Speedy Trial Right And National Security Detentions: Critical Comments On United States V. Ghailani, Anthony O'Rourke
Journal Articles
This article reviews the decision of the United States Court of Appeals for the Second Circuit to uphold the conviction and sentence of Ahmed Khalfan Ghailani, the sole Guantánamo detainee to have been transferred to the United States for trial. Ghailani was captured nearly five years before his arraignment and argued that his constitutional right to a speedy trial was violated by the delay. The article contends that, in rejecting Ghailani’s argument, the Second Circuit distorted the doctrinal framework governing speedy trial claims and mischaracterized the interests that the speedy trial right is intended to protect. The article also explores …

Queering Masturbation In Lorde's Life And Writing, Eric Sipyinyu Njeng
Queering Masturbation In Lorde's Life And Writing, Eric Sipyinyu Njeng
CLCWeb: Comparative Literature and Culture
In his article "Queering Masturbation in Lorde's Life and Writing" Eric Sipyinyu Njeng discusses masturbation in Audre Lorde's life and works to signal an important aspect of her oeuvre often neglected in scholarship. Lorde stands out among prominent queer queens by demonstrating theory corporeally thereby going beyond mere theory and positing her body as a space of complex sexual passions. When Judith Butler speaks of gender as performative rather than embodied, Lorde theorizes and foregrounds this in her works and self and celebrates a sexual matrix that ranges from heterosexuality to homosexuality to auto-sexuality. Lorde places masturbation between the binary …

The Original Intent Of The Wire Act And Its Implications For State-Based Legalization Of Internet Gambling, Michelle Minton
The Original Intent Of The Wire Act And Its Implications For State-Based Legalization Of Internet Gambling, Michelle Minton
Occasional Papers
Recognizing the growing threat of organized crime, then U.S. Attorney General Robert F. Kennedy sought to get the “bankrollers and kingpins” by introducing the Federal Wire Act in 1961, which sought to target the mob’s most profitable racket—bookkeeping on horseracing and sports gambling by prohibiting such gambling on the nation’s communication system at the time (telephone and telegraph). More than 30 years later members of Congress sought to use the Wire Act to stop the rise of casino-style gambling on the Internet. However, the scope of the Wire Act has been disputed among lawmakers, courts, and federal agencies. In 2011 …
Child Maltreatment: What Attitudinal Factors Of Commitment, Confidence, And Concern Predict Reporting Practices Of Preservice Speech-Language Pathologists?, Alan Smith
Doctoral Dissertations and Projects
The pervasiveness of child maltreatment is a global issue, although its impact on the United States is markedly severe. The mortality rate for children four years of age and younger continues to rise annually, with an especially alarming increase present for children with disabilities. Although inservice and preservice educators, including speech-language pathologists, are mandated to report suspected maltreatment, several obstacles appear to hinder their actions. Understanding the factors that predict an individuals' likelihood of reporting malfeasance may help minimize maltreatment occurrence and child mortality. Preservice speech- language pathologists attending accredited programs in the United States were surveyed regarding their attitudes …

Making Sense Of Unexpected Preferences, Gordon Alexander Arsenoff
Making Sense Of Unexpected Preferences, Gordon Alexander Arsenoff
All Theses and Dissertations (ETDs)
This dissertation includes three papers using quantitative models to sensibly describe what kinds of preferences political actors will or actually do hold when existing theory offers no insight. The first two papers use evolutionary game theory to predict ways in which politicians, artificially selected on the basis of good performance to remain in office, will in the long run diverge from instrumental rationality as ordinarily assumed in game theory. The first sets out a general principle for producing models of preference evolution in games as political models, namely, that the information about opponent preferences necessary for evolution of non-rational preferences …

Legitimacy Of The Restorative Justice Principle In The Context Of Criminal Law Enforcement, - Sukardi
Legitimacy Of The Restorative Justice Principle In The Context Of Criminal Law Enforcement, - Sukardi
Indonesia Law Review
This research reviews the essence of the restorative justice principle as an approach in the settlement of criminal cases, and it aims to provide an overview of the construction of the restorative justice principle in criminal law enforcement. The outcomes of the research indicate that the restorative justice principle has been subject to frequent study in its understanding as an alternative criminal case settlement method, by way of positioning outside the criminal judiciary system. As it turns out in practice, however, it has certain weaknesses, particularly in view of the accountability and legitimacy aspects of its establishment. Therefore, there is …

Indonesia Law Review
Toward a Progressive Public Prosecutor’s Office: a Study on Investigation, Prosecution and Adjudication of Criminal Acts of Corruption (The Book) is one of the reliable resources in capturing the real picture of Indonesian Law Enforcement Institution–namely Attorney General Offices (AGO)– for its centralistic bureaucracy nature. Written by Dr. Yudi Kristiana, S.H., M.Hum. (Yudi), the idea of The Book came in reaction to ‘the-never-ending’ corruption phenomenon, its massive impacts and the underlying problems to eradicate corruption. Choosing one of the important stake holder to fight corruption. The Book is providing several reasons why the AGO seems not fully-functioned and successful in …
