The Political Foundations Of Miranda V. Arizona And The Quarles Public Safety Exception, Aaron J. Ley, Gordie Verhovek

When Dzhokhar Tsernaev was taken into custody after the Boston Marathon bombing, the Obama Administration’s Justice Department moved to invoke the Quarles Public Safety Exception rather than inform the accused of his rights. A widespread debate about the utility of informing all suspects of their Miranda rights ensued. In this article, we use the Congressional Record to examine the political foundations of the Miranda rule, the Congressional response to Miranda, and the development of the Public Safety Exception announced in Quarles v. The United States is poised to integrate commercial unmanned aircraft systems (UAS) into the national airspace and enable government entities to use UAS in a more expedient manner. This policy change, mandated by the Federal Aviation Administration (FAA) Modernization and Reform Act of 2012, offers new economic, social and scientific opportunities as well as enhanced law enforcement capacity. However, such benefits will be accompanied by concerns over misuse and abuse of the new technologies by criminals and terrorists. Public and scholarly analysis of the troubled relations of Natives and non-Natives (settlers) has been predominantly directed to the former, long-framed as “the Indian Problem.” This dissertation takes the different stance of focusing on the mind-sets of settlers and their society in perpetuating the trans-historical trauma and injustice resulting from foundational acts of dispossession.The approach is autoethnographic:after considering the settler world in which I grew up, critical episodes and developments in my career working with British Columbian First Nations are described and analyzed.This includes working with Kwakwaka’wakw, Haida, Wuikinuxv, Nuxalk and Lheidli T’enneh Nations over a 25-year period.I also look …

In the last decade of the 20th century, several large-scale studies suggested that the developmental trajectory for students diagnosed with emotional disturbance is bleak. Middletip School (MTS) is an alternative day treatment program that serves emotionally disturbed (ED) students (ages 12-19) through a daily offering of academic classes, and counseling and treatment groups. Using individually tailored, strength-based programming, MTS is designed to help ED youth in the areas of emotion regulation and behavior management, with a focus on building coping, relational, social, and communication skills. The Contribution Of Forced Medical Retirement To Symptoms Of Depression, Anxiety And Stress In Law Enforcement Officers, Kimberley Blackmon

This research explored whether a statistically significant difference exists between symptoms of depression, anxiety and stress in police officers who were forced into medical retirement as compared to those who retired after years of completed service. The sample population of retired police officers as well as the appropriate testing instruments for these targeted individuals is discussed. In addition, the dissertation addresses how the survey determined the type of retirement they were subjected to (voluntary or involuntary) and any depressive or other psychological symptoms since that retirement. Inadequate prison health care has created a health crisis for reentering prisoners and their communities--a crisis that is exacerbated by barriers to employment and other collateral consequences of release. This Note will first examine how current Eighth Amendment doctrine has failed to sufficiently regulate prison health care so as to have any significant effect on the crisis. Next, it will argue that the Affordable Care Act (ACA) alters the Eighth Amendment analysis by triggering a change in the "evolving standards of decency" that guide the doctrine. In Examining Wrongful Convictions: Stepping Back, Moving Forward, the premise is that much can be learned by “stepping back” from the focus on the direct causes of wrongful convictions and examining criminal justice systems, and the sociopolitical environments in which they operate. HCV infection is a serious concern among people who inject drugs. Despite imposing a major disease burden in countries with high rates of injection drug use such as Kazakhstan, other Central Asian and East Asian countries, Eastern Europe, and Russia, HCV remains an understudied issue. This study includes 728 individuals (364 couples) from Almaty, Kazakhstan, where at least one member of the dyad reported recent injection drug use. Participants were recruited to participate in a couple-based HIV prevention study. A substantial body of research has been undertaken in recent years giving prominence to the additional and distinctive challenges faced by female entrepreneurs and by ethnic entrepreneurs. However, other groups of minority entrepreneurs have received relatively little attention and so remain underexplored within entrepreneurship literature. This article introduces some of these minority communities (Ex–Prisoners, Disabled People, Travellers/Gypsies, Grey and Gay) and highlights the research opportunities that exist for entrepreneurship academics who might wish to analyse such ‘silent’ minorities. Childrens Services Committees (CSC) in Ireland are structures to bring together all agencies involved in childrens services in a region. Their aim is to achieve better co-ordination in service delivery. This paper describes an ongoing programme developed by the authors to facilitate individuals within six working groups within one CSC to examine the effectiveness of their interagency collaboration. The programme entails engagement of participants in two workshops as well as the creation of a space for action learning within monthly working group meetings. his study examined the portrayal of victims and offenders of human trafficking in three major newspapers from 2005- 2012. Additionally, this study examined if the age, gender, and legal status effected the portrayal of victims and offenders in the newspapers. Also included is an examination of groups of claims-makers and whether different groups portrayed victims and offenders same or differently. Utilizing a quantitative and qualitative content analysis to analyze the newspapers’ framing of victims and offenders, this research compared the portrayal of its groups. Cervical cancer is the second most common cancer and cause of cancer-related death for women worldwide. The aims of this study were to investigate the prevalence of cervical neoplasia and examine factors associated with high-grade cervical squamous intraepithelial lesions (HSIL) among women taking part in a cervical cancer screening program in Beijing.

In the last few decades researchers have attempted to determine correlates for school violence. While the number of extreme incidents of school violence remains relatively small, extreme incidents cause the most concern for parents, teachers, law enforcement, and educational administrators. In her article Exploitation Creep and the Unmaking of Human Trafficking Law, Janie Chuang insightfully describes transformations in the discourse on trafficking as it shifted from sex trafficking to human trafficking, and as human trafficking came to be understood as forced labor, and now modern day slavery. With each of these transformations, the United States government, self-anointed “global sheriff” of anti-trafficking efforts, deepened its emphasis on a prosecution-oriented strategy focused on individual perpetrator accountability. This Article offers a new interpretation of the founding of the Department of Justice (DOJ) in 1870 as an effort to shrink and professionalize the federal government. The traditional view is that Congress created the DOJ to increase the federal government's capacity to litigate a growing docket due to the Civil War. More recent scholarship contends that Congress created the DOJ to enforce Reconstruction and ex-slaves' civil rights. However, it has been overlooked that the DOJ Act eliminated about one-third of federal legal staff. The founding of the DOJ had less to do with Reconstruction, and more to do with …

Fragmentation in the field ofPsychology has persisted throughout its history (Slife, 2000). One example of this fragmentation is the gap between researchers and clinicians (Teachman, Drabick, Hershenberg, Vivian, & Wolfe 2012). Although many attempts have been made to bridge this gap, there is still no consensus regarding its resolution. ThisDissertation provides an explanation for the gap at the philosophical level and provides a method for communicating across potentially incommensurable philosophies, based on Gadamer's (1960/1989) hermeneutic opus: Truth and Method.
