Social Status, Opportunity And Repeat Victimization: The Unequal Distribution Of Safety, Zavin Nazaretian Jan 2014

Social Status, Opportunity And Repeat Victimization: The Unequal Distribution Of Safety, Zavin Nazaretian

Wayne State University Dissertations

This research examines the relationship between victimization, social status and opportunity. More specifically, the effects of social status and opportunity on repeat victimization are examined. How does social status and opportunity simultaneously effect repeat victimization? This report consists of a secondary data analysis of the 2004 and 2009 Canadian Victimization Survey with a combined sample size of 43,200 people who were interviewed by telephone. Opportunity either partially or completely mediated the effects of social status on repeat victimization; however for certain subsamples neither opportunity nor social status explained repeat victimization. Additionally, the groups whose victimization was not explained by opportunity …

Robust Regression Methods For Massively Decayed Intelligence Data, Akiva Joachim Lorenz Jan 2014

Robust Regression Methods For Massively Decayed Intelligence Data, Akiva Joachim Lorenz

Wayne State University Dissertations

Homeland Security, sponsored by governmental initiatives, has become a vibrant academic research field. However, most efforts were placed with the recognition of threats (e.g. theory) and response options. Less effort was placed in the analysis of the collected data through statistical modeling. In a field that collects more than 20 terabyte of information per minute though diverse overt and covert means and indexes it for future research, understanding how different statistical models behave when it comes to massively decayed data is of vital importance.

Using Monte Carlo methods, three regression techniques (ordinary least squares, least-trimmed, and maximum likelihood) were tested …

Mr Hyde Or Dr. Jekyll? Characteristics Of The Information Systems Security Mindset, David Pumphrey Jan 2014

Mr Hyde Or Dr. Jekyll? Characteristics Of The Information Systems Security Mindset, David Pumphrey

Electronic Theses and Dissertations

Information security professionals have a unique challenge in today's connected world. They are charged with protecting digital assets from individuals, groups, and even foreign governments with little or no restrictions limiting their behavior. To be successful, security experts must have the mindset and skills of those who seek to harm their organization, but most are not alloto retaliate, in kind. Instead, they must use these skills only to predict and to prevent future attacks; thus using their technical prowess for good and not for evil. In a survey of 330 information security professionals, the data reveals six mindsets of security …

Is There Sufficient Guidance To Detect, And Obtain A Conviction For, Occupational Fraud In Ireland?, Carmel Buttimer Jan 2014

Is There Sufficient Guidance To Detect, And Obtain A Conviction For, Occupational Fraud In Ireland?, Carmel Buttimer

Masters

There has been an increased focus in the Irish media on fraud, particularly since the collapse of Anglo Irish Bank in 2007. There has however been little academic research undertaken into occupational fraud in Ireland. This study will examine whether or not the current guidance to detect and convict occupational fraud in Ireland is sufficient.

This study achieves its objective by examining the content of press articles reporting thirty-five occupational fraud cases convicted in Ireland in the period 2002 to 2013. It categorises the content of the articles using a framework developed by Cohen et al. (2010), which combines the …

Numbing The Heart: Racist Jokes And The Aesthetic Affect, Tanya Rodriguez Jan 2014

Numbing The Heart: Racist Jokes And The Aesthetic Affect, Tanya Rodriguez

Contemporary Aesthetics (Journal Archive)

People sometimes resist the idea that racist humor fails on aesthetic grounds because they find it funny. They make the case that we can enjoy its comic aspects by controlling our attention, by focusing on a joke’s rhythm or delivery rather than on its racist content. Ironic intent may reside with the joke teller and/or the audience. I discuss how arguments for the immorality of racist jokes fall short. Ironic racist jokes may be acceptable to an audience that already rejects racism but is comfortable with such ironic racist joking precisely because as individuals they feel confident in their own …

A Framework For Understanding Tribal Courts And The Application Of Fundamental Law: Through The Voices Of Scholars In The Field Of Tribal Justice, April L. Wilkinson, Kiowa Tribe Of Oklahoma

Tribal Law Journal

Through an examination of scholarly articles, this paper examines traditional tribal justice systems set in tribal communities in an effort to establish a framework for understanding tribal courts and the unique challenges they face. The research presented describes a spectrum of traditional aspects within tribal courts, and analyzes the impact that changing social dynamics have had on the tribal court construct. A rigorous review of available research concerning traditional tribal courts showed scholars repeatedly arguing that traditional law, also called fundamental law, which existed before Western style courts, exists beyond the tribal court setting and is fundamental to a tribal …

Green And Grey: Water Justice, Privatization, And Resistance, William Mcclanahan Jan 2014

Green And Grey: Water Justice, Privatization, And Resistance, William Mcclanahan

Online Theses and Dissertations

Since its initial proposal in the 1990s, `green criminology' has focused on environmental crimes and harms affecting non-human and human life, ecosystems, and the planet as a whole. Describing global trends toward privatization of water supply systems and the criminalization of several water conservation activities and tactics, this paper employs theoretical perspectives offered by green, cultural, and critical criminologies, focusing on overt resistance to water privatization and oppressive regulations governing rainwater storage and residential water recycling. Taking a critical theoretical perspective, this paper examines water access and autonomy, individuals and groups openly resisting the criminalization of household water reuse and …

Social Class And Capital Punishment: A Theoretical And Empirical Analysis, Jennifer L. Tilley Jan 2014

Social Class And Capital Punishment: A Theoretical And Empirical Analysis, Jennifer L. Tilley

Online Theses and Dissertations

While it is generally assumed that virtually all persons executed in the United States are poor, the social class - execution link has not been well documented or theorized in the literature. Far more research has analyzed the relationship of race and gender to execution. Using data on executions carried out in Texas between 2000 and 2012, individuals sentenced to death from the Supreme Court's Gregg decision through 1997 in Tennessee, narrative case studies, and a content analysis of state-defined mitigating circumstances, this study provides both detailed documentation of the social class characteristics of those executed, as well as a …

Exploring The Responsibilities Of Wildlife Law Enforcement Officers: An Examination Of Citations Issued By Kentucky Conservation Officers, Conrad Morgan Lanham

Online Theses and Dissertations

Conservation officers are law enforcement agents whose primary responsibility is the enforcement of statutes regarding wildlife. Several bodies of research have noted the expansion of law enforcement capabilities and responsibilities of conservation officers to include the enforcement of general laws that fall outside the conservation officers' original mandate. The purpose of this study is to explore the work roles of contemporary conservation officers in Kentucky. Using data from citations issued by Kentucky conservation officers from 2006 to 2011, this research examines patterns of wildlife violations, boating violations, and general violations across time and space. Comparisons of these types of violations …

Bankster's Paradise: The Importance Of Discourse In Creating A Haven For Criminogenic Banks In The United States, Maria Jacqueline Bordt Jan 2014

Bankster's Paradise: The Importance Of Discourse In Creating A Haven For Criminogenic Banks In The United States, Maria Jacqueline Bordt

Online Theses and Dissertations

This work examines the ways in which language can contribute to a cultural climate in which white-collar crime is no longer considered "deviant," but rather is considered part of a normally functioning political economy. The 2012 money laundering case involving HSBC is examined in conjunction with the rhetoric of popular financial counselor Dave Ramsey. This research seeks to define how language involving the accumulation of capital is equated with virtuousness, thus constructing a myth about the criminality inherent to "legitimate" capital enterprises.

The Heroin Problem: Learning From Past Experiments In Narcotic Maintenance, Ashley Marie Phillips Jan 2014

The Heroin Problem: Learning From Past Experiments In Narcotic Maintenance, Ashley Marie Phillips

Online Theses and Dissertations

The following paper examines the ongoing political, legal and cultural debate regarding heroin maintenance in the U.S. that emerged after the passage of the Harrison Act. Moreover, it focuses on the United States' very brief experimentation with narcotics maintenance clinics from 1914-1924 and why the clinic system was ultimately dismantled by the Treasury Department. This paper also highlights the U.S. public policy debate that emerged as early as the 1950s and continues today to develop heroin maintenance trials.

The Relationship Between Teachers' Perceptions Of Student Management With Out-Of-School Suspensions And High School Graduation Rates, Caryn Letcher Huber

Online Theses and Dissertations

Teachers' perceptions contribute to who is removed from the classroom (Fenning & Rose, 2007). The Kentucky Department of Education use a teacher self-report instrument called the Teaching, Empowering, Leading and Learning (TELL) survey to assess teaching conditions in eight areas to predict teacher satisfaction, employment trajectories and ultimately guide school improvement. The New Teacher Center found a correlation exists between the Managing Student Conduct construct of the TELL Kentucky Survey responses and student achievement (National Teacher Center, 2013). This study investigates the relationship between Managing Student Conduct construct with Graduation Rates and Out-of-School Suspension. Graduation Rate is one of five …

Exploring The Attitudes Of Criminal Justice And Homeland Security Students Regarding Assessment Techniques In Online Courses, Terry Allen Taylor

Online Theses and Dissertations

Substantial increases in online education since the start of the 21st century requires investigation in to how online courses differ from traditional face-to-face courses. It is particularly important to discover how online students learn and which assessment methods they prefer and see as most beneficial to online learning. Using online assessment techniques that correspond with those rated highly my online students can lead to better student experiences in online courses and improved persistence rates in online courses, which have traditionally be lower compared to face-to-face courses.

The participants for the study sample included online students majoring in Bachelor of Science …

Safety During A Disaster: A Comparison Of Disaster Events, Lauren Webb Jan 2014

Safety During A Disaster: A Comparison Of Disaster Events, Lauren Webb

Online Theses and Dissertations

Disasters such as hurricanes disrupt the lives of everyone in their path. The preparation for and response during and after such an event can make all the difference for those involved. Past hurricanes need to be learned from, hurricanes such as Katrina and Hugo; lessons learned from events like these can be applied in future ones such as they were in Sandy and Gustav. This thesis reviews past research done concerning problems and themes of unsafe situations during hurricanes in urban centers, finding these themes and making suggestions to be used in the future to attempt to prevent future re-occurrences. …

From Community Policing And Crime Control To Security Policing And Citizen Control: Rural And Small-Town Policing In Post 9/11 America, Josh Yeager Jan 2014

From Community Policing And Crime Control To Security Policing And Citizen Control: Rural And Small-Town Policing In Post 9/11 America, Josh Yeager

Online Theses and Dissertations

Research is lacking on rural and small-town policing in the post 9/11 era. This is unfortunate in view of changing perceptions of threat and insecurity, the financial crisis of 2008 and curtailments placed on funding for rural and small-town police agencies. This thesis argues that the proliferation of homeland security resources and priorities has significantly shaped rural and small-town policing in recent years. Rural and small-town law enforcement agencies, often lagging behind in resources and funding as compared to their urban counterparts, have embraced homeland security agendas, priorities and technologies as a means of securing their financial goals and abilities. …

Politics And The Public’S Right To Know, Lloyd Hitoshi Mayer Jan 2014

Politics And The Public’S Right To Know, Lloyd Hitoshi Mayer

Journal Articles

In the United States it is taken for granted that members of the public should have access to information about their government. This access takes many forms, including the ability to obtain copies of government documents, the ability to attend meetings of government officials, and the related obligations of government officials to document their activities and to reveal certain otherwise private information about themselves. This access also is often limited by countervailing concerns, such as the privacy of individual citizens and national security. Nevertheless, the presumption both at the federal level and in every state is to provide such access. …

The terrorist attacks of September 11, 2001, led to profound changes in societal viewpoints, political agendas, and the legal authorization to combat terrorism. The United States continues to struggle with keeping its population safe while maintaining the principles of democracy and the rule of law essential to the nation’s character. The U.S. response to terrorism has been multifaceted and expansive, reflective of the U.S. role in global security; debate over these matters will continue for the foreseeable future.

This report, prepared for the American Society of Comparative Law, offers summary, analysis and critique of many aspects of counterterrorism law, including …

Systemic Barriers To Effective Assistance Of Counsel In Plea Bargaining, Peter A. Joy, Rodney J. Uphoff Jan 2014

Systemic Barriers To Effective Assistance Of Counsel In Plea Bargaining, Peter A. Joy, Rodney J. Uphoff

Scholarship@WashULaw

In a trio of recent cases, Padilla v. Kentucky, Missouri v. Frye, and Lafler v. Cooper, the U.S. Supreme Court has focused its attention on defense counsel's pivotal role during the plea bargaining process . At the same time that the Court has signaled its willingness to consider ineffective assistance of counsel claims at the plea stage, prosecutors are increasingly requiring defendants to sign waivers that include waiving all constitutional and procedural errors, even unknown ineffective assistance of counsel claims such as those that proved successful in Padilla and Frye. Had Jose Padilla and Galin Frye been forced to sign …

Inmates For Rent, Sovereignty For Sale: The Global Prison Market, Benjamin Levin Jan 2014

Inmates For Rent, Sovereignty For Sale: The Global Prison Market, Benjamin Levin

Scholarship@WashULaw

In 2009, Belgium and the Netherlands announced a deal to send approximately 500 Belgian inmates to Dutch prisons, in exchange for an annual payment of £26 million. The arrangement was unprecedented, but justified as beneficial to both nations: Belgium had too many prisoners and not enough prisons, whereas the Netherlands had too many prisons and not enough prisoners. The deal has yet to be replicated, nor has it triggered sustained criticism or received significant scholarly treatment. This Article aims to fill this void by examining the exchange and its possible implications for a global market in prisoners and prison space. …
