The Economic Perspective On Sentencing, Joshua B. Fischman
The Economic Perspective On Sentencing, Joshua B. Fischman
Loyola University Chicago Law Journal
Although economists have been actively engaged in research on criminal sentencing, the synergies between the two fields are hardly obvious. This Essay considers what economists have to contribute to the study of sentencing. One common explanation—that economists’ use of rational choice modeling has applicability to the study of deterrence—does not adequately account for much of the sentencing research that economists are producing. This Essay considers two alternative explanations. First, empirical research in both fields is predominately observational. Due to practical limits on controlled experimentation, economists have developed a variety of tools for making causal inferences from observational data, many of …

Dirty Work: The Effects Of Viewing Disturbing Media On Military Attorneys, Natalie Lynn Sokol
Dirty Work: The Effects Of Viewing Disturbing Media On Military Attorneys, Natalie Lynn Sokol
All Graduate Theses, Dissertations, and Other Capstone Projects
This study examines the psychological effects of viewing disturbing media on military attorneys who are part of the JAG Corps. Twenty seven legal professionals who work with cases involving child pornography and sexual violence completed measures of secondary traumatic stress disorder (STSD), burnout, perceptions of social stigma, and feelings of protectiveness and distrust towards others. A substantial number of participants reported poor well-being, though exposure to disturbing media was not predictive of these outcomes. However, defense attorneys and prosecuting attorneys differed significantly in severity of their perception of social stigma, which was linked to increased negative outcomes. Furthermore, qualitative results …

Proving A Violation: Rhetoric, Research And Remedy, Alan N. Young
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper explores the uses and abuses of relying upon legislative fact evidence to prove a violation of a claimant’s constitutional rights. The Supreme Court of Canada has stated that, in the criminal law context, an accused is entitled to challenge a law that violates the constitutional rights of third parties but that applies in a constitutionally sound manner with respect to the accused. This principle spawned the conventional wisdom that in order to obtain a declaration that a statute is invalid, a litigant must present voluminous legislative fact evidence to demonstrate that the statute unjustifiably limits rights of third …

By adapting multiple metrics used for journal article evaluation and replicating recent publisher metrics, the authors tested methods for evaluating scholarly book publishers. Using monographs published in journalism between 2007 and 2011 as a test case, results indicate these methods may be useful to other scholarly disciplines.

Why Crime Rates Are Falling Throughout The Western World, Michael Tonry
Why Crime Rates Are Falling Throughout The Western World, Michael Tonry
Articles
Crime rates have moved in parallel in Western societies since the late Middle Ages. Homicide rates declined from 20 to 100 per 100,000 population in western Europe to one per 100,000 in most Western countries by the beginning of the twentieth century. Crime rates in major cities and in countries fell from the early nineteenth century until the middle of the twentieth. From the 1960s to the 1990s, rates for violent and property crimes rose in all wealthy Western countries. Since then, rates in all have fallen precipitately for homicide, burglary, auto theft, and other property crimes. The patterns appear …
Legal And Ethical Issues In The Prediction Of Recidivism, Michael Tonry
Legal And Ethical Issues In The Prediction Of Recidivism, Michael Tonry
Articles
Use of predictions of recidivism is ubiquitous in American criminal justice systems from pretrial detention to parole release and proceeds largely oblivious to fundamental ethical problems that were widely recognized and examined in the 1970s. They include the false positive problem that most people predicted to commit acts of serious violence would not, and their confinement for that reason is unjustified, that common use of fixed characteristics such as age and gender punish people for matters over which they have no control is per se unjust, that commonly used socioeconomic factors such as marital status, employment, education, and living discrimination, …
An Analysis Of Military Sexual Assault And Subsequent Punishment, Christina Durham
An Analysis Of Military Sexual Assault And Subsequent Punishment, Christina Durham
Criminology & Criminal Justice Theses - Archive
In recent years, national attention has been drawn to the issue of sexual assault in the military. This is largely in part due to the number of reported offenses increasing each year, jumping 50% between 2012 and 2013 alone (DoD, 2013). Research has shown sexual assault offenses are greatly underreported and that the victimization rates among service members are higher than those of civilians (Turchik & Wilson, 2010). Past research efforts to understand why sexual assaults are so prevalent in the military have focused heavily on the victim and the effectiveness of preventative programs (Turchick & Wilson, 2010). Additionally, theories …

A Professional Perspective Into The World Of Domestic Minor Sex Trafficking, Lira M. Polanco
Criminology & Criminal Justice Theses - Archive
The purpose of this study is to analyze the knowledge and perceptions of professionals involved in the world of domestic minor sex trafficking. Specifically, the perceptions of advocates, social workers, law enforcement and medical professionals in the Dallas/Ft. Worth area are examined via survey responses. An exploratory approach is used to measure the views of professionals working in the area of domestic minor sex trafficking, through the use of a non-experimental, cross-sectional questionnaire composition, which consists of a single observation of professionals in the Dallas/Ft. Worth area involved in the aid of victims of domestic minor sex trafficking. A non-probability …

Rule Of Law With Chinese Characteristics: An Empirical Cultural Perspective On China, Hong Kong And Singapore, Jeffrey E. Thomas
Faculty Works
This article uses empirical data to analyse the meaning of rule of law with Chinese characteristics. It compares rule of law data on China, Hong Kong and Singapore from the World Justice Project and finds patterns of more limited protection of individual rights and fewer limits on governmental powers. It then uses Geert Hofstede’s cultural dimensions to consider whether those patterns are related to common cultural characteristics. It finds low scores on the cultural value of individualism in those three jurisdictions are correlated with lower protection for individual rights, and that high scores on Hofstede’s Power Distribution Index are inversely …

Military Sexual Trauma And Mental Health Diagnoses In Female Veterans Returning From Afghanistan And Iraq: Barriers And Facilitators To Veterans Affairs Care, Kelly H. Koo, Shira Maguen
UC Law SF Journal on Gender and Justice
As a result of the increasing number of women participating in the military, more women than ever before have been accessing VA care. For those female veterans who experienced military sexual trauma while on active duty, VA care has thus far proved deficient to address the physical and mental repercussions trauma. This Article stresses that understanding military sexual trauma as a unique stressor in female veterans is crucial to providing better care for them. Mss. Koo and Maguen define what exactly military sexual trauma is, provide estimates of its prevalence today, and describe barriers and facilitators to care. Most importantly, …
Mercenary Criminal Justice, Wayne A. Logan
Mercenary Criminal Justice, Wayne A. Logan
Scholarly Publications
To some degree, money has always figured in criminal justice. Early on, private enforcers of the criminal law received payments for their work. Remuneration played a less explicit but still prominent role in the nineteenth and twentieth centuries as public actors carried out the work of criminal justice. Today, amid significant budget pressures brought on by the Great Recession and the costs of running the nation’s massive criminal justice apparatus, courts and other system actors rely heavily on a growing number of legal financial obligations (“LFOs”) as revenue sources. When this happens, courts and other system actors become mercenaries, in …
General And Special Education Teachers' Perspectives Of Full Membership For Students With Disabilities, Pamela S. Morgan
General And Special Education Teachers' Perspectives Of Full Membership For Students With Disabilities, Pamela S. Morgan
Doctoral Dissertations
The idea of full membership (FM) for students with disabilities (SWD) originated with the 1975 Education for all Handicapped Children Act which required equal educational access for these students. Full membership has evolved from mainstreaming to focusing on acceptance and belonging in a school community where all stakeholders have a voice and the culture is reflective of these values and beliefs. Despite American public education policy, there appears to be minimal progress for SWD in gaining FM. This phenomenological qualitative study was conducted to gain insight into the perceptions and lived experiences of teachers. Comparing two high schools in the …
