Journal Articles
Objective: Police officers' decisions and behaviors are impacted by the neighborhood context in which police encounters occur. For example, officers may use greater force and be more likely to make arrests in disadvantaged neighborhoods. We examined whether neighborhood characteristics influence police encounters with individuals suspected to have a serious mental illness, addictive disorder, or developmental disability. Method: We obtained data on 916 encounters from 166 officers in six jurisdictions in Georgia, USA and abstracted geographical data pertaining to the location of these encounters from United States Decennial Census data. Encounters were nested within 163 census tracts. Officer-reported data covered general …

Exposure To Pre-Incident Behavior And Reporting In College Students, Mario Scalora, Brandon A. Hollister, Sarah Hoff, Alissa Marquez
University of Nebraska Public Policy Center: Publications
Campus targeted violence is preceded by noticeable, alarming behavior, and reporting improvement efforts have been suggested to increase students’ willingness to inform campus authorities of forewarning actions. Reporting improvement techniques have been most successful with material appealing to the perceptions of high-risk students (i.e., those likely to observe and not report). The current study examined the characteristics of students that view threatening behavior and lack willingness to report with a large, Midwestern, undergraduate sample (n 450). Approximately 35% of the sample (i.e., n 157) indicated observing pre-incident behavior on campus, and 65% of these individuals (i.e., n 101) described unwillingness …

Philosophically Speaking: Reflections Of Teaching Philosophy With A Service Learning Component, Krishna Mallick
Philosophically Speaking: Reflections Of Teaching Philosophy With A Service Learning Component, Krishna Mallick
Pedagogy and the Human Sciences
In this paper, the author writes about her first experience of teaching Eastern Philosophy at the undergraduate level with a service-learning component. Many Philosophy faculty members think that a service-learning component diminishes the academic rigor in a credit-bearing course. The author argues that credit is given for learning and not service. By analyzing the relevant service-learning literature and explaining the preparations needed and the implementation process, the author argues that service learning as a pedagogical tool enhances student learning because students can make the connection between the theoretical aspect of the course and the practical experiences through their service with …

After The Cheering Stopped: Decriminalization And Legalism's Limits, Wayne A. Logan
Scholarly Publications
To the great relief of many, American criminal law, long known for its harshness and expansive prohibitory reach, is now showing signs of softening. A prime example of this shift is seen in the proliferation of laws decriminalizing the personal possession of small amounts of marijuana: today, almost twenty states and dozens of localities have embraced decriminalization in some shape or form, with more laws very likely coming to fruition soon. Despite enjoying broad political support, the decriminalization movement has, however, failed to curb a core feature of criminalization: police authority to arrest individuals suspected of possessing marijuana. Arrests for …

Prosecution Complex: America's Race To Convict And Its Impact On The Innocent, Kathleen M. Donovan
Political Science Faculty/Staff Publications
In lieu of an abstract, here is the review's first paragraph:
They say the first step to curing addiction is admitting that you have a problem. Daniel Medwed’s terrific book, PROSECUTION COMPLEX: AMERICA’S RACE TO CONVICT AND ITS IMPACT ON THE INNOCENT, attempts to do exactly that. The thesis of the book is laid out in the first few pages: prosecutors are professionally and politically incentivized to earn the greatest number of convictions. In conjunction with vast discretion over an individual’s case and powerful psychological forces that discourage prosecutors from critically entertaining the possibility of being wrong, an estimable but …

Democracy Enhancement In Criminal Law And Procedure, Janet Moore
Democracy Enhancement In Criminal Law And Procedure, Janet Moore
Faculty Articles and Other Publications
There is a democracy deficit at the intersection of crime, race, and poverty. The causes and consequences of hyperincarceration disproportionately affect those least likely to mount an effective oppositional politics: poor people and people of color. This Article breaks new ground by arguing that the democracy deficit calls for a democracy-enhancing theory of criminal law and procedure that modifies traditional justifications of retributivism and deterrence by prioritizing self-governance. Part I contextualizes the argument within cyclical retrenchments in movements for racial and economic justice. Part II sketches the contours of a democracy-enhancing theory. Parts III and IV turn that theoretical lens …

Seek Justice, Not Just Deportation: How To Improve Prosecutorial Discretion In Immigration Law, Erin B. Corcoran
Seek Justice, Not Just Deportation: How To Improve Prosecutorial Discretion In Immigration Law, Erin B. Corcoran
Law Faculty Scholarship
Bipartisan politics has prevented meaningful reform to a system in dire need of solutions: Immigration. Meanwhile there are eleven million noncitizens with no valid immigration status who currently reside in the United States and the Department of Homeland Security (DHS) does not have the necessary resources to effect their removal. DHS does have the authority through prosecutorial discretion to prioritize these cases and provide relief to individuals with compelling circumstances that warrant humanitarian consideration; nonetheless, DHS’s exercise of prosecutorial discretion is underutilized, inconsistently applied and lacks transparency. This Article suggests a remedy – that the immigration prosecutor’s role should redefined …
Contraceptive Sabotage, Leah A. Plunkett
Contraceptive Sabotage, Leah A. Plunkett
Law Faculty Scholarship
This Article responds to the alarm recently sounded by the American College of Obstetricians and Gynecologists over “birth control sabotage”—the “active interference [by one partner] with [the other] partner’s contraceptive methods in an attempt to promote pregnancy.” Currently, sabotage is not a crime, and existing categories of criminal offenses fail to capture the essence of the injury it does to victims. This Article argues that sabotage should be a separate crime—but only when perpetrated against those partners who can and do get pregnant as a result of having sabotaged sex. Using the principle of self-possession—understood as a person’s basic right …

Objective. To evaluate the long-term safety and tolerability of lurasidone in schizophrenia and schizoaffective disorder patients switched to lurasidone. Method. Patients in this multicenter, 6-month open-label, flexible-dose, extension study had completed a core 6-week randomized trial in which clinically stable, but symptomatic, outpatients with schizophrenia or schizoaffective disorder were switched to lurasidone. Patients started the extension study on treatment with the same dose of lurasidone taken at study endpoint of the 6-week core study; following this, lurasidone was flexibly dosed (40-120 mg/day), if clinically indicated, starting on Day 7 of the extension study. The primary safety endpoints were the proportion …
