Culture & Schizophrenia: How The Manifestation Of Schizophrenia Symptoms In Hue Reflects Vietnamese Culture, Rebecca Gaines Apr 2014

Culture & Schizophrenia: How The Manifestation Of Schizophrenia Symptoms In Hue Reflects Vietnamese Culture, Rebecca Gaines

Independent Study Project (ISP) Collection

Although schizophrenia has the same essential cognitive basis in all people, the content of the hallucinations and delusions of patients varies significantly across the world. Schizophrenia is a culture-bound illness, which means that a difference in culture can influence how it manifests. Western societies tend to view schizophrenia symptoms as a medical issue, while Eastern societies treat it as a spiritual or supernatural phenomenon. Vietnam has many specific cultural factors rooted in collectivism and Confucian and Buddhism traditions that make sufferers of schizophrenia present drastically different symptoms than patients from Western societies. The role of family, ancestor veneration, traditional healing, …

Characteristics Of Transgender Individuals Entering Substance Abuse Treatment, Annesa Flentje, Nicholas C. Heck, James L. Sorensen Apr 2014

Characteristics Of Transgender Individuals Entering Substance Abuse Treatment, Annesa Flentje, Nicholas C. Heck, James L. Sorensen

Psychology Faculty Research and Publications

Little is known about the needs or characteristics of transgender individuals in substance abuse treatment settings. Transgender (n = 199) and non-transgender (cisgender, n = 13,440) individuals were compared on psychosocial factors related to treatment, health risk behaviors, medical and mental health status and utilization, and substance use behaviors within a database that documented individuals entering substance abuse treatment in San Francisco, CA from 2007 to 2009 using logistic and linear regression analyses (run separately by identified gender). Transgender men (assigned birth sex of female) differed from cisgender men across many psychosocial factors, including having more recent employment, less …

What Books On Law Should Be, Richard A. Posner Apr 2014

What Books On Law Should Be, Richard A. Posner

Michigan Law Review

I have thought it might be useful to our profession, and appropriate to a foreword to a collection of reviews of newly published books on law, to set forth some ideas on how books can best serve members of the different branches of the legal profession — specifically judges, practicing lawyers, law students, and academic lawyers — plus persons outside the legal profession who are interested in law. I am not interested in which already published books should be retained and which discarded, but in what type of book about law should be written from this day forward. I will …

The Banality Of Wrongful Executions, Brandon L. Garrett Apr 2014

The Banality Of Wrongful Executions, Brandon L. Garrett

Michigan Law Review

What is so haunting about the known wrongful convictions is that those cases are the tip of the iceberg. Untold numbers of unnoticed errors may send the innocent to prison — and to the death chamber. That is why I recommend to readers a trilogy of fascinating new books that peer deeper into this larger but murkier problem. Outside the rarified group of highly publicized exonerations, which have themselves done much to attract attention to the causes of wrongful convictions, errors may be so mundane that no one notices them unless an outsider plucks a case from darkness and holds …

Trends In Juvenile Delinquency, David L. Jones Mr.

All NMU Master's Theses

ABSTRACT

TRENDS IN JUVENILE DELINQUENCY

By

David L. Jones

This is a study on trends in juvenile delinquency. The research proposal mentions, within the introduction, factors such as unemployment rates, high school dropout rates, poverty, and juvenile delinquency case rates in the United States, which are actually the variables that are used in the study to illustrate a relationship between them and the current trend in juvenile delinquency. In establishing the link, the paper does a brief literature review of various perspectives associated with juvenile delinquency and mentions some hypotheses that are relevant to the study. Further, the paper gives …

Investigating Integrated Domestic Violence Courts: Lessons From New York, Jennifer Koshan

Osgoode Hall Law Journal

Extensive law and policy reforms in the area of domestic violence have occurred in the last several decades in the United States and Canada, the latest being the development of specialized domestic violence (DV) courts. DV courts typically operate in the criminal realm, particularly in Canada. A recent innovation that is relatively unique in the United States is integrated domestic violence (IDV) courts, where criminal, civil, and family matters are heard together in a one judge/one family model. This article examines the literature on DV and IDV courts in Canada and the United States, and situates these reforms in the …

Copyright Infringement And The Separated Powers Of Moral Entrepreneurship, Joseph P. Fishman Apr 2014

Copyright Infringement And The Separated Powers Of Moral Entrepreneurship, Joseph P. Fishman

Vanderbilt Law School Faculty Publications

This Article examines the copyright industries’ “moral entrepreneurs,” sociologist Howard Becker’s term for enterprising crusaders who seek to change existing social norms regarding particular conduct. Becker’s conception of moral entrepreneurship consists of two groups performing separate tasks: rule creators work to translate their preferred norms into legal prohibitions, and then a separate class of enforcers administer those prohibitions. In a limited sense, U.S. copyright law hews to this scheme. Legislation such as the No Electronic Theft Act of 1997 and the Artists’ Rights and Theft Prevention Act of 2005 has assigned the federal government an increasing role in defining intellectual-property …

Lawyering To The Lowest Common Denominator: "Strickland's" Potential For Incorporating Underfunded Norms Into Legal Doctrine, Lauren Sudeall Apr 2014

Lawyering To The Lowest Common Denominator: "Strickland's" Potential For Incorporating Underfunded Norms Into Legal Doctrine, Lauren Sudeall

Vanderbilt Law School Faculty Publications

This symposium article explores how ineffective assistance of counsel doctrine, by its design, may incorporate and exacerbate the failings of an underfunded indigent defense system. Specifically, it highlights two aspects of the Strickland v. Washington standard for ineffective assistance of counsel: first, its inability to effectively address issues of underfunding through its two-prong test of deficient performance and prejudice; and, second, the way in which its eschewal of specific substantive guidelines for attorney performance in favor of reliance on "prevailing professional norms" may allow legal doctrine to be influenced by anemic, localized practice norms resulting from a lack of resources. …

Empirical Desert And Preventive Justice: A Comment, Christopher Slobogin Apr 2014

Empirical Desert And Preventive Justice: A Comment, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This essay is a response to an article by Paul Robinson, Joshua Barton, and Matthew Lister in this issue of New Criminal Law Review that criticizes an article I authored with Lauren Brinkley-Rubinstein entitled Putting Desert in Its Place, which was itself an analysis of several works published by Robinson and various coauthors making the case for "empirical desert." Robinson's suggestion that utility can be optimized by a focus on desert as it is viewed by the average citizen opens up a new line of inquiry that could lead to a better appreciation of the influence desert should have on …

Managing Systemic Risk In Legal Systems, J.B. Ruhl Apr 2014

Managing Systemic Risk In Legal Systems, J.B. Ruhl

Vanderbilt Law School Faculty Publications

The American legal system has proven remarkably robust even in the face vast and often tumultuous political, social, economic, and technological change. Yet our system of law is not unlike other complex social, biological, and physical systems in exhibiting local fragility in the midst of its global robustness. Understanding how this “robust yet fragile (RYF) dilemma operates in legal systems is important to the extent law is expected to assist in managing systemic risk, the risk of large local or even system-wide failures in other social systems. Indeed, legal system failures have been blamed as partly responsible for disasters such …

Sentencing And Prior Convictions: The Past, The Future, And The End Of The Prior-Conviction Exception To "Apprendi", Nancy J. King Apr 2014

Sentencing And Prior Convictions: The Past, The Future, And The End Of The Prior-Conviction Exception To "Apprendi", Nancy J. King

Vanderbilt Law School Faculty Publications

This article traces the fascinating history of early efforts to identify defendants and their prior convictions as well as the evolving use of prior convictions in aggravating punishment; examines how contemporary repeat offender penalties fall short of punishment goals and contribute to the racially lopsided profile of punishment today; and critiques potential justifications for the prior conviction exception to the rule in Apprendi v. New Jersey, arguing that the exception should be abandoned. The article summarizes empirical research testing the relationship between prior convictions and examining the efficacy of repeat offender sentences in reducing recidivism; collects commentary on the use …

Corrections For Racial Disparities In Law Enforcement, Christopher L. Griffin Jr., Frank A. Sloan, Lindsey M. Eldred Apr 2014

Corrections For Racial Disparities In Law Enforcement, Christopher L. Griffin Jr., Frank A. Sloan, Lindsey M. Eldred

William & Mary Law Review

Much empirical analysis has documented racial disparities at the beginning and end stages of criminal cases. However, our understanding about the perpetuation of—and even corrections for—differential outcomes in the process remains less than complete. This Article provides a comprehensive examination of criminal dispositions using all DWI cases in North Carolina from 2001 to 2011, focusing on several major decision points in the process. Starting with pretrial hearings and culminating in sentencing results, we track differences in outcomes by race and gender. Before sentencing, significant gaps emerge in the severity of pretrial release conditions that disadvantage black and Hispanic defendants. Yet …

Habeas Corpus Proceedings In The High Court Of Parliament In The Reign Of James I, 1603-1625, Donald E. Wilkes Jr. Apr 2014

Habeas Corpus Proceedings In The High Court Of Parliament In The Reign Of James I, 1603-1625, Donald E. Wilkes Jr.

Scholarly Works

English parliamentary habeas corpus proceedings have been neglected by scholars. This Article ends that neglect. This Article focuses on the parliamentary habeas corpus proceedings that occurred in the reign of King James. The Article corrects several misunderstandings relating to the history of the writ of habeas corpus in England and to the history of the English Parliament (which in the seventeenth century commonly was referred to as the High Court of Parliament).

Part I of the Article provides answers to questions concerning the historical background and context of the parliamentary habeas corpus proceedings in the High Court of Parliament during …

The “Chicago Way”: Inner-City Street Gangs And The Battle For Civil Rights In The Windy City, 1966- 1970, Benjamin Ray Linzy Apr 2014

The “Chicago Way”: Inner-City Street Gangs And The Battle For Civil Rights In The Windy City, 1966- 1970, Benjamin Ray Linzy

Academic Leadership Journal in Student Research

The Civil Rights Movement unfolded uniquely in Chicago; in the North Lawndale and Woodlawn neighborhoods two street gangs, the Conservative Vice Lords (CVL) and the Almighty Black P Stone Nation (BPSN ) assumed the role of community organizations. They used their neighborhood connections and street savvy to alleviate racial pressures oppressing Chicago’s urban African American youths: high dropout rates, poor job opportunities, and the stress of dealing with increasingly unstable and declining communities. While the gangs’ established hierarchies led to rapid formation of community organizations, their efforts fell apart over a brief four-year period due to an inability to divest …

Dating Violence On The College Campus: Exploring Student Perception And Awareness, Patrice Gibson Apr 2014

Dating Violence On The College Campus: Exploring Student Perception And Awareness, Patrice Gibson

Undergraduate Theses and Capstone Projects

Dating violence is a crime that plagues college students all over the world. Many students are unaware of what specifically constitutes dating violence and what resources are available to those who are affected by this crime. Colleges and universities tend to have vague or nonexistent rules and regulations regarding dating violence; there is also a lack of education provided to first-year students about dating violence and resources available to them. The present study explored student perception of dating violence and focused on students from small, liberal arts colleges in the central and southwest part of Virginia. Furthermore, this study built …

Data Mining The Liberal Arts, Jerry Scripps Apr 2014

Data Mining The Liberal Arts, Jerry Scripps

2014 Conference Presentations

Data mining is one of the tool sets that has been enlisted to help make sense of the massive amount of data that has been collecting over the past few years. Most people associate its use with targeted marketing and government oversight. However, they can also provide scholars in the liberal arts with powerful tools to discover new insights and questions. In this talk, I will discuss some ways in which researchers have recently used data mining to uncover new knowledge in some diverse areas.
