Legally Blind: Hyperadversarialism, Brady Violations, And The Prosecutorial Organizational Culture, Hadar Aviram
Legally Blind: Hyperadversarialism, Brady Violations, And The Prosecutorial Organizational Culture, Hadar Aviram
St. John's Law Review
(Excerpt)
Part I presents the problem through an analysis of the opinion of the Court, Justice Scalia’s concurrence, and Justice Ginsburg’s dissent. Part II shows the role played by causation and culpability in framing the responsibility of prosecutors in discovery proceedings. Part III discusses the implications of discovery violations for § 1983 suits, in contrast to their role in direct and collateral review of the conviction itself. Part IV presents evidence from a solid body of literature in sociology and political science, explaining why the debate misses the essential understanding of how prosecutorial offices work. Part V tackles the thorny …

He Said, She Said: Sex Crime Prosecutions And Spousal Privileges Under The Federal Rules Of Evidence, Jennifer Kelly
St. John's Law Review
(Excerpt)
This Note argues that federal courts, in considering the applicability of either the spousal communications privilege or the adverse testimonial privilege, should look to the type of crime alleged against the defendant and should carve out an exception rendering these privileges unavailable wherever the defendant has been charged with a sex crime, regardless of the victim’s age or relationship to the defendant. This Note discusses and explains the uniquely heinous nature of such crimes, their markedly devastating effects on victims, and the inherent challenges and difficulties in successful prosecution, in order to emphasize the importance of allowing them special …

An Examination Of Correctional Nursing Competencies For Improved Patient Care, Bing Zheng
An Examination Of Correctional Nursing Competencies For Improved Patient Care, Bing Zheng
Honors Scholar Theses
The concept of this honors project was to explore correctional nursing competency, working closely with my advisor and the research team. Key findings from the initial competency assessment evaluation phase were compiled, organized, and analyzed. A podium presentation “Advancing Correctional Nurse Competencies for Quality Care: Evaluation of Simulation Learning and Satisfaction” was given at the 2013 American Correctional Health Services Association (ACHSA) Multidisciplinary Educational Conference on Correctional Healthcare: Ring a Bell. Additionally, a poster presentation, “Correctional Nurse Competencies: Evaluation of Simulation Learning and Satisfaction,” was given at the 2013 Frontiers conference. A poster presentation was given at the University of …

2014 Research Day Posters
Participating in the National Model United Nations Assembly in New York is a rewarding experience. Participating in this conference required months of research, practice, fund-raising, and paper writing. During the week of the Assembly, participants had the opportunity to apply their findings to simulated international relations scenarios based on real world events and nations. The University of Alaska Fairbanks sent ten students to represent the University. These students were assigned as delegates representing Rwanda on the Security Council, and Chad on four General Assemblies (GAs), the World Health Organization (WHO), and the United Nations Environment Programme (UNEP). In recognition of …

Drug Use And Social Support Outcomes In Probationers: A Longitudinal Social Network Analysis, Anne Rhodes
Drug Use And Social Support Outcomes In Probationers: A Longitudinal Social Network Analysis, Anne Rhodes
Theses and Dissertations
This study focuses on the social networks of probationers, who comprise the largest segment of the criminal justice population in the United States, but about whom there are few studies of network processes. It provides information on how elements of a probationer’s social network change over time and can affect drug use. This study employs longitudinal analysis of the social networks for 251 substance abusers on probation to examine how these networks are influenced by an intervention designed to increase pro-social behaviors and how network changes impact drug use. Baseline drug use of the probationers was examined according to the …

The Virtues Of Justice, John Thrasher, David Schmidtz
The Virtues Of Justice, John Thrasher, David Schmidtz
Philosophy Faculty Books and Book Chapters
"This essay considers (and endorses) three complementary conceptions of justice as virtue. To the two senses of justice just mentioned-justice as a virtue of the soul and of the polis-we add a third that bridges these two. Virtue can be a kind of outreach rather than a kind of internal harmony, because we are talking about essentially social beings. The harmony that is this virtue's object is harmony with a community. Thus, a person who is just in this sense is disposed to respect (play within the rules of) institutions that command respect by virtue of actually working-that is, actually …

The Promise Of Healthcare Reform In Transforming Services For Jail Detainees, Maureen Mcdonnell, Laura Brookes, Arthur J. Lurigio
The Promise Of Healthcare Reform In Transforming Services For Jail Detainees, Maureen Mcdonnell, Laura Brookes, Arthur J. Lurigio
Psychology: Faculty Publications and Other Works
Chronic behavioral health conditions, such as psychiatric and substance use disorders, affect at least half of all arrestees, with two-thirds suffering from at least one chronic medical disorder. These conditions contribute to their criminal behaviors and propensities to recycle through the criminal justice system (Binswanger et al. Journal of Urban Health 89:183-190, 2012). Despite their limited resources, jails have nonetheless become de facto settings for the delivery of healthcare services. With the passage of the Affordable Care Act (ACA) of 2010, jail releasees will become eligible for government-subsidized healthcare coverage in 2014. The widespread availability of integrated healthcare services for …

Creating A Cultural Analysis Tool For The Implementation Of Ontario's Civil Mental Health Laws, Roby Dhand
Creating A Cultural Analysis Tool For The Implementation Of Ontario's Civil Mental Health Laws, Roby Dhand
PhD Dissertations
The purpose of the study was to develop a Cultural Analysis Tool (CAT). The CAT consists of specific thematic questions that can serve as a cultural and equity analysis instrument for practitioners to use in the implementation of Ontario’s civil mental health laws. The rationale behind creating the CAT is based on research suggesting that ethno-racial people with mental health disabilities experience inequities and differential outcomes while interacting with Ontario’s civil mental health laws. Given the increasing multi-racial population in Ontario, there is a need to develop mechanisms to address these intersecting issues. Other countries that have created evaluative tools …
