Human Trafficking Ngos In Thailand: A Two-Site Case Study Of The Children Served In Education Programs, Robert W. Spires Jul 2014

Human Trafficking Ngos In Thailand: A Two-Site Case Study Of The Children Served In Education Programs, Robert W. Spires

School of Professional and Continuing Studies Faculty Publications

In this qualitative case study, two Thai Non-Governmental Organizations (NGO) shelters/schools working with human trafficking survivors and at-risk populations of children ages 5-18 were examined. This study takes the stance that the work of the NGOs needs to be understood through the first-hand perceptions and attitudes of NGO staff and the children they serve. Education is an intervention designed to achieve the mission of both NGOs. Education is treated as a means of preventing human trafficking and protecting human trafficking survivors from returning to exploitative situations, though the effectiveness of the intervention is unclear.

The Language Of Evidence In Rape Trials, Saumya Maheshwari Jul 2014

The Language Of Evidence In Rape Trials, Saumya Maheshwari

Socio-Legal Review

Sexual assault laws have been amended on several occasions to make the criminal justice system more sensitive to the tribulations of the prosecutrix. However, the manner in which these reforms are implemented in the courtroom and the kind of language that is used by the advocates and judges are instrumental in achieving its objective. In this paper, the reforms mandating in camera trials for rape cases, and excluding past sexual history from evidence have been examined. It is argued that the language used inside the courtroom may serve to defeat the purpose of these reform measures. This argument is based …

The Good, The Bad And The Adulterous: Criminal Law And Adultery In India, Abhinav Sekhri Jul 2014

The Good, The Bad And The Adulterous: Criminal Law And Adultery In India, Abhinav Sekhri

Socio-Legal Review

Adultery is a crime in India, punishable with up to five years imprisonment under Section 497 of the Indian Penal Code, 1860. When you took this fact in, perhaps like me your first reaction was outrage at the State's apparent intrusion into the seemingly private sexual realms of life. Such prudes, those Legislators: imposing their moral compass on the unsuspecting citizenry. In truth, it is a bit more complicated, though I argue that the initial assessment is not far off. The paper begins considering principles guiding criminalisation of conduct, to determine whether some principled justifications exist for criminalising adultery. I …

An Originalist Argument For A Sixth Amendment Right To Competent Counsel, Erica J. Hashimoto Jul 2014

An Originalist Argument For A Sixth Amendment Right To Competent Counsel, Erica J. Hashimoto

Scholarly Works

The Treason Act of 1696 provided a right to counsel in treason cases in England and laid the framework for the right to counsel both in England and in the United States. Evidence suggests that the Treason Act may have influenced the Framers of the Constitution; thus, any historical understanding of the Sixth Amendment right to counsel should consider the quality of representation treason defendants received. If, as appears to be the case, treason defendants had competent, experienced lawyers representing them, then the Sixth Amendment right to counsel may well include that right to such representation. This Essay suggest that …

The War On Drugs In The American States: Variations In Sentencing Policies Over Time, Katherine Anna Neill Jul 2014

The War On Drugs In The American States: Variations In Sentencing Policies Over Time, Katherine Anna Neill

School of Public Service Theses & Dissertations

Since the 1970s US drug policy has focused on harsh punishments for drug offenders. A wealth of research indicates that the social and political context of the drug policy discourse is a greater factor in determining drug policy than rising rates of drug use or drug-related crime. While considerable research has examined the factors driving federal drug policy, fewer studies have examined drug policy at the state level. This dissertation studies state drug sentencing policy to determine what factors may explain variation across states. By focusing on the period from 1975 to 2002, this study concentrates on policies passed during …

Health Promotion Strategies Derived From A Metropolitan Police Weight Loss Competition With Weight Loss Comparisons By Gender And Bmi Category, Robert Boyce, Tyler Willett, Allen Mullins, Glenn Jones, Randy Cottrell Jul 2014

Health Promotion Strategies Derived From A Metropolitan Police Weight Loss Competition With Weight Loss Comparisons By Gender And Bmi Category, Robert Boyce, Tyler Willett, Allen Mullins, Glenn Jones, Randy Cottrell

Internet Journal of Allied Health Sciences and Practice

Background: Weight management is critical in police work. It can have both legal and life-saving implications as it is linked to the health and physical readiness of the officers. A weight loss competition is one way to address weight management in police work. Among the factors to consider is gender impact, as females forge forward within a male environment. Also, assessing weight loss among obesity categories is essential for designing effective programing. Purpose: To compare mass changes among body mass index (BMI) categories and between genders at biweekly weigh-ins during a 12-week competition with recommendations for professionals. Methods: Before the …

Abstract Risk And The Politics Of The Criminal Law, Brenner M. Fissell Jul 2014

Abstract Risk And The Politics Of The Criminal Law, Brenner M. Fissell

Faculty Publications

Much of the criminal law contains what theorists call “abstract endangerment” statutes — crimes that punish not actual, but hypothetical, creation of risk. Consider the case of underage alcohol possession: age does not necessarily imply immaturity, and possession does not necessarily lead to consumption. The crime is therefore doubly “abstract”: many violations will create no risk of harm at all but the conduct is nevertheless prohibited. Theoretical defenses of these overinclusive laws proceed mainly by emphasizing the deficiencies of individuals in assessing their own cases of risk. What these defenses implicitly assume, though, is that the entity the individual must …

Criminalizing Revenge Porn, Danielle K. Citron, Mary Anne Franks Jul 2014

Criminalizing Revenge Porn, Danielle K. Citron, Mary Anne Franks

Faculty Scholarship

Violations of sexual privacy, notably the non-consensual publication of sexually graphic images in violation of someone's trust, deserve criminal punishment. They deny subjects' ability to decide if and when they are sexually exposed to the public and undermine trust needed for intimate relationships. Then too they produce grave emotional and dignitary harms, exact steep financial costs, and increase the risks of physical assault. A narrowly and carefully crafted criminal statute can comport with the First Amendment. The criminalization of revenge porn is necessary to protect against devastating privacy invasions that chill self-expression and ruin lives.

Restoring Our Children's Future: Ending Disparate School Discipline Through Restorative Justice Practices, Kaeanna Wood Jul 2014

Restoring Our Children's Future: Ending Disparate School Discipline Through Restorative Justice Practices, Kaeanna Wood

Journal of Dispute Resolution

This note opens the discussion on disparate school discipline with a case harboring egregious facts, then goes on to explore the history of zero-tolerance policies as the primary method of school discipline, federal civil rights laws prohibiting discrimination based on race in school discipline, and the rise of restorative practices as a means of school discipline. In conclusion, this note argues that in implementing restorative justice practices as an alternative dispute resolution method, schools can end a pattern of disproportionately disciplining African American and Hispanic students and create an environment that fosters success for all children.

A Cross-National Analysis Of The Impact Of Conscription On Crime Rates, Nicolette G. Rose

Sociology & Criminal Justice Theses & Dissertations

This paper examines the relationship between conscription laws (mandatory military or social service) and crime rates across countries. This cross-national study focuses on three major crimes: burglary, robbery, and homicide. In addition to conscription laws several control variables have been included in the analyses are: percent of the labor force that is military, level of civil liberties/freedom, level of industrialization, illiteracy rates, percent of urban population, unemployment rates, percent under the international poverty line, income disparity (measured using the Gini index), and population.

This study assesses the impact of conscription on crime rates by formulating and testing three hypotheses. First, …
