Physical Activity Barriers And Facilitators Among Working Mothers And Fathers, Emily L. Mailey, Jennifer Huberty, Danae M. Dinkel, Edward Mcauley

Health and Kinesiology Faculty Publications

Background: The transition to parenthood is consistently associated with declines in physical activity. In particular, working parents are at risk for inactivity, but research exploring physical activity barriers and facilitators in this population has been scarce. The purpose of this study was to qualitatively examine perceptions of physical activity among working parents.

Methods: Working mothers (n = 13) and fathers (n = 12) were recruited to participate in one of four focus group sessions and discuss physical activity barriers and facilitators. Data were analyzed using immersion/crystallization in NVivo 10.

Results: Major themes for barriers included family responsibilities, guilt, lack of …

Romanies Versus The Mafia: “Us” And “Them” In Italian Crime Reports, Theresa Catalano Jan 2014

Romanies Versus The Mafia: “Us” And “Them” In Italian Crime Reports, Theresa Catalano

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Denaturalization is the act of making something appear less natural or less human which functions to “subordinate other living creatures to human beings” and “to justify denigration of certain groups of people” (Santa Ana 1999). In this study, the denaturalization of Romanies in Italy as represented in newspaper crime reports was identified and compared to the opposing naturalization of Italian crime organizations. This was accomplished through careful, multidisciplinary, scientific analysis of over 20 articles taken from Italian newspapers of assorted political tendencies from the years 2005-2010. A corpus analysis was conducted and lexical choices were categorized as denaturalization, naturalization or …

The Attrition Of Rights Under Parole, Tonja Jacobi, Song Richardson, Gregory Barr Jan 2014

The Attrition Of Rights Under Parole, Tonja Jacobi, Song Richardson, Gregory Barr

Faculty Articles

We conduct a detailed doctrinal and empirical study of the adverse effects of parole on the constitutional rights of both individual parolees and the communities in which they live. We show that parolees' Fourth, Fifth and Sixth Amendment rights have been eroded by a multitude of punitive conditions endorsed by the courts. Punitive parole conditions actually increase parolees' vulnerability to criminal elements, and thus likely worsen recidivism. Simultaneously, the parole system broadly undermines the rights of nonparolees, including family members, cotenants, and communities. We show that police target parolee-dense neighborhoods for additional Terry stops, even when income, race, population, and …

The Cure For Young Prosecutors' Syndrome, Ronald F. Wright, Kay L. Levine Jan 2014

The Cure For Young Prosecutors' Syndrome, Ronald F. Wright, Kay L. Levine

Faculty Articles

Although legal scholars treat prosecutors like interchangeable parts, we argue—based on interviews and surveys of over 200 state prosecutors in eight offices—that scholars should be alert to the differences among them, because new prosecutors experience their professional role differently than their veteran colleagues do. This divergence happens because, as new prosecutors gain experience, their professional identities shift—they become more balanced over time. This Article explores the prosecutor’s professional transformation and the possible catalysts for that change.

When experienced prosecutors describe their career trajectories, they regret the highly adversarial posture they adopted earlier in their careers. While the constant quest for …

Uncovering The Silent Victims Of The American Medical Liability System, Joanna Shepherd Jan 2014

Uncovering The Silent Victims Of The American Medical Liability System, Joanna Shepherd

Faculty Articles

A frequently overlooked problem with the current medical liability system is the vast number of medical errors that go uncompensated. Although studies indicate that 1% of hospital patients are victims of medical negligence, fewer than 2% of these injured patients file claims. In this Article, I explain that many victims of medical malpractice do not file claims because they are unable to find attorneys willing to take their cases.

I conducted the first national survey of attorneys to explore medical malpractice victims' access to the civil justice system. The results from the survey indicate that the economic reality of litigation …

A Prequel To Law And Revolution: A Long Lost Manuscript Of Harold J. Berman Comes To Light, John Witte Jr., Christopher J. Manzer Jan 2014

A Prequel To Law And Revolution: A Long Lost Manuscript Of Harold J. Berman Comes To Light, John Witte Jr., Christopher J. Manzer

Faculty Articles

The late Harold Berman was a pioneering scholar of Soviet law, legal history, jurisprudence, and law and religion; he is best known today for his monumental Law and Revolution series on the Western legal tradition. Berman wrote a short book, Law and Language, in the early 1960s, but it was not published until 2013. In this early text, he adumbrated many of the main themes of his later work, including Law and Revolution. He also anticipated a good deal of the interdisciplinary and comparative methodology that we take for granted today, even though it was rare in the …

Neighborhood Effects And Mobility Patterns Among Residents Of Chicago's Residential Homeless System, Julie Frances Hilvers

Dissertations

This study explores the effects of location and neighborhood characteristics on the probability that residents in shelters, Interim, and Permanent Supportive Housing (PSH) programs in Chicago's homeless system move to market-rate housing or intend to leave their communities in the near future. The study uses survey data collected in 2009-2011 by Loyola University Chicago's Center for Urban Research and Learning in cooperation with the Chicago Alliance to End Homelessness and the City of Chicago. These data were collected as part of the Evaluation of Chicago's Plan to End Homelessness.

Within the literature exists an extensive body of research examining neighborhood …

Kidnapping Incorporated: The Unregulated Youth-Transportation Industry And The Potential For Abuse, Ira Robbins Jan 2014

Kidnapping Incorporated: The Unregulated Youth-Transportation Industry And The Potential For Abuse, Ira Robbins

Scholarly Articles in Law Reviews & Journals

Strangers come into a child's room in the middle of the night, drag her kicking and screaming into a van, apply handcuffs, and drive her to a behavior modification facility at a distant location. What sounds like a clear-cut case of kidnapping is complicated by the fact that the child's parents not only authorized this intervention, but also paid for it. This scarcely publicized practice-known as the youth-transportation industry-operates on the fringes of existing law. The law generally presumes that parents have almost unlimited authority over their children, but the youth-transportation industry has never been closely examined regarding exactly what …

Disputed Paraphilia Diagnoses And Legal Decision Making: A Case Law Survey Of Paraphilia Nos, Nonconsent, Christopher M. King, Lindsey E. Wylie, Eve M. Brank, Kirk Heilbrun Jan 2014

Disputed Paraphilia Diagnoses And Legal Decision Making: A Case Law Survey Of Paraphilia Nos, Nonconsent, Christopher M. King, Lindsey E. Wylie, Eve M. Brank, Kirk Heilbrun

Department of Psychology: Faculty Publications

Paraphilia diagnoses applied in forensic settings are an ongoing subject of debate among psycholegal professionals and scholars. Disagreements pertain to both means-related issues having to do with issues of diagnostic reliability and validity, and ends-related issues regarding the consequences inherent to the legal contexts in which the diagnoses arise. To provide a fresh outlook on some of the issues, the present study entailed a systematic survey of U.S. case law to investigate the history, extent, and nature of forensic uses of a controversial paraphilia diagnosis, paraphilia not otherwise specified, nonconsent. Descriptive analyses revealed that use of the diagnosis, which occurred …

We’Ll Meet Again: Revealing Distributional And Temporal Patterns Of Social Contact, Thorsten Pachur, Lael J. Schooler, Jeffrey R. Stevens

Department of Psychology: Faculty Publications

What are the dynamics and regularities underlying social contact, and how can contact with the people in one’s social network be predicted? In order to characterize distributional and temporal patterns underlying contact probability, we asked 40 participants to keep a diary of their social contacts for 100 consecutive days. Using a memory framework previously used to study environmental regularities, we predicted that the probability of future contact would follow in systematic ways from the frequency, recency, and spacing of previous contact. The distribution of contact probability across the members of a person’s social network was highly skewed, following an exponential …

The Politics Of The Face-In-The-Crowd, Mark S. Mills, Kevin B. Smith, John R. Hibbing, Michael Dodd Jan 2014

The Politics Of The Face-In-The-Crowd, Mark S. Mills, Kevin B. Smith, John R. Hibbing, Michael Dodd

Department of Psychology: Faculty Publications

Recent work indicates that the more conservative one is, the faster one is to fixate on negative stimuli, whereas the less conservative one is, the faster one is to fixate on positive stimuli. The present series of experiments used the face-in-the-crowd paradigm to examine whether variability in the efficiency with which positive and negative stimuli are detected underlies such speed differences. Participants searched for a discrepant facial expression (happy or angry) amid a varying number of neutral distractors (Experiments 1 and 4). A combination of response time and eye movement analyses indicated that variability in search efficiency explained speed differences …

Indigenous Rights Litigation, Legal History, And The Role Of Experts, Kent Mcneil Jan 2014

Indigenous Rights Litigation, Legal History, And The Role Of Experts, Kent Mcneil

Articles & Book Chapters

Litigation involving the rights of Indigenous peoples in Canada usually involves historical facts and events from a long time ago, sometimes as far back as 400 years. This reality presents significant challenges for proof of the facts upon which these rights are based. In addition to historical documents, the parties have to rely on testimony by Indigenous witnesses who are able to present the oral histories and traditions of their people, as well as on the opinion evidence of experts such as archaeologists, anthropologists, linguists, historians, ethnohistorians, and legal historians. In this paper, I examine the role of legal historians …

Critically Developing Real Capabilities, Christopher Byron Jan 2014

Critically Developing Real Capabilities, Christopher Byron

UNF Graduate Theses and Dissertations

Critical Realism, the Capabilities Approach, and Marxism, all have underdeveloped theoretical problems. For Critical Realism, the ceteris paribus clause, which is used to asses an ideological critique, does not properly specify what other things warrant the dismissal or acceptance of said critique. For the Capabilities Approach, a proper ontology or metaphysics is missing, and the claim that the Capabilities Approach can be metaphysically neutral is false. Finally, Marxism is good at describing the more onerous aspects of capitalism (e.g., alienation, exploitation, crisis), but it does not provide normative force for seeing these descriptions as bad. I argue that these three …

Organizational Development Consulting: A Study Of Expert Consultants' Key Strategies, Mona Vosoughi Jan 2014

Organizational Development Consulting: A Study Of Expert Consultants' Key Strategies, Mona Vosoughi

UNF Graduate Theses and Dissertations

The present study was conducted to capture the collective voice of expert organizational development consultants. Until now, very few studies have been conducted that take into account the collective voices of organizational development consultants. More specifically, the purpose of the present study is to explore and gain a deeper understanding of the approaches expert organizational development consultants use throughout their engagement with their clients in an attempt to add value to and enhance organizational capacity. To understand the process used by this distinct group of leaders, phenomenological qualitative inquiry was the methodology used to conduct this study. Data were collected …

The Future Of Legal Education: Three Visions And A Prediction, Harry W. Arthurs Jan 2014

The Future Of Legal Education: Three Visions And A Prediction, Harry W. Arthurs

Articles & Book Chapters

In this article, the author examines three visions of the future of law schools. The first vision is that they should focus on producing "practice ready lawyers" to meet the immediate needs of today's legal profession. The second is that law schools should focus on training "tomorrow's lawyers, "graduates who are able to adapt to a rapidly-changing world. The third insists that law schools are knowledge communities whose many functions include, but are not limited to, providing students with a large and liberal understanding of law that will prepare them for a variety of legal and non-legal careers and for …

How Effects Of Local Labor Demand Shocks Vary With Local Labor Market Conditions, Timothy J. Bartik Jan 2014

How Effects Of Local Labor Demand Shocks Vary With Local Labor Market Conditions, Timothy J. Bartik

Upjohn Institute Working Papers

This paper estimates how effects of shocks to local labor demand on local labor market outcomes vary with initial local economic conditions. The data are on U.S. metro areas from 1979 to 2011. The paper finds that demand shocks to local job growth have greater effects in reducing local unemployment rates if the local economy is initially depressed than if the local economy is booming. Demand shocks have greater effects on local wage rates if the local unemployment rate is initially low, but lesser effects if local job growth is initially high. These different effects of local demand shocks imply …

Learning In Circles: The Power Of A Humanizing Dialogic Practice, Carmen Veloria, Carolyn Boyes-Watson Jan 2014

Learning In Circles: The Power Of A Humanizing Dialogic Practice, Carmen Veloria, Carolyn Boyes-Watson

Journal of Pedagogy, Pluralism, and Practice

There is an increasing sense of urgency to reconnect to the basic notion of a humanizing dialogic practice. A practice that prioritizes lived experiences and recognizes students and teacher as active, knowledgeable and insightful participants of the school community. Given the emphasis placed on test scores, assessments and other accountability measures, students and teacher voices are often omitted from the national dialogue on what is working and what needs to change in order to foster caring schools and responsive classrooms. Yet their voices are precisely the ones we need to hear from as any kind of educational reform efforts will …

This research investigates the relative effects of lower-order and higher-order aspects of quality of work life (QWL) on employee job satisfaction and overall life satisfaction in Thai workplaces. The data were collected by means of questionnaires mailed to employees of 6 selected companies-3 companies in each of the service and manufacturing sectors in Thailand with respective response rates of 72 and 74 percent. The results reveal that the two aspects of QWL in all companies have a positive impact on both aspects of employee satisfaction: job satisfaction and overall life satisfaction. The results also reveal a generally more important role …

How Corporate Cultures Drive Advertising And Promotion Budgets Best Practices Combine Heuristics And Algorithmic Tools, Douglas West, John B. Ford, Paul W. Farris Jan 2014

How Corporate Cultures Drive Advertising And Promotion Budgets Best Practices Combine Heuristics And Algorithmic Tools, Douglas West, John B. Ford, Paul W. Farris

Marketing Faculty Publications

This study provides a survey of the methods used by U.S. advertisers to set advertising and promotions budgets and the effects of culture, risk, and organizational experience on these choices. Findings suggest that heuristics provide checks on analytically based budget methods and may also help managers deal with risks. Understanding the role played by heuristics in budgeting provides the first step toward process improvements in advertising and promotions budgeting.
