The Limits Of Child Pornography, Carissa Byrne Hessick
The Limits Of Child Pornography, Carissa Byrne Hessick
Indiana Law Journal
Although the First Amendment ordinarily protects the creation, distribution, and possession of visual images, the Supreme Court has declared that those protections do not apply to child pornography. But the Court has failed to clearly define child pornography as a category of speech. Providing a precise definition of the child pornography exception to the First Amendment has become increasingly important because recent years have seen a dramatic increase in the penalties associated with the creation, distribution, and possession of child pornography.
This Article proposes a clear definition of the child pornography exception. It argues that an image ought to fall …

Did One Veil Give Women A Better Life?, Mary C. Westermann
Did One Veil Give Women A Better Life?, Mary C. Westermann

Unfortunately, a young woman in Renaissance Florence did not have many options for her future. A woman's family usually decided whether she would be able to get married or would have to enter the convent, but sometimes she was able to make this choice. In this paper, I look at the lives of wives and nuns to analyze how their lives differed in responsibilities and freedoms, but also to see how all women had similar restrictions and expectations placed upon them.

Invisible No More: Domestic Workers Organizing In Massachusetts And Beyond, Natalicia Tracy, Tim Sieber, Susan Moir Scd
Labor Studies Faculty Publication Series
Domestic workers across the country are making it clear that, even in a difficult political environment, it is possible to make gains for low-wage workers. For the first time in many, many decades, domestic workers are finding ways to win. They are creat ing policy change that will improve the lives of hundreds of thousands of workers in tangible and substantial ways. The 2014 Massachusetts Domestic Workers’ Bill of Rights is the most expansive codification of rights for this long-overlooked part of the labor force ever to be enacted. In one sense, there is nothing new about domestic workers organizing …

Spatial And Temporal Patterns Of Geo-Tagged Tweets, Yue Li
Open Access Theses
With over 500 million current registered users and over 500 million tweets per day, Twitter has caught the attention of scientists in various disciplines. As Twitter allows users to send messages with location tags, a massive amount of valuable geo-social knowledge is embedded in tweets, which can provide useful implications for human geography, urban science, location-based service, targeted advertising, and social network studies. This thesis aims to determine the lifestyle patterns of college students by analyzing the spatial and temporal dynamics in their tweets. Geo-tagged tweets are collected over a period of six months for four US Midwestern college cites: …
Engineering Community Engagement Partnerships: Investigating Motivation, Nature, And Structure, Julia D. Thompson
Engineering Community Engagement Partnerships: Investigating Motivation, Nature, And Structure, Julia D. Thompson
Open Access Dissertations
Engineering community engagement programs have increased in popularity over the last decade or so, with related research and scholarship in this area focused primarily on student motivation and learning outcomes. Since 2000, however, the wider service-learning field has started investigating partnerships and community voice. Building from the existing service-learning literature, this study aims to better understand community-university partnerships in engineering community engagement programs from the perspectives of both the academic program and the served community. This study addresses three research questions: (1) Why are individuals and local community organizations involved in engineering service-learning partnerships?, (2) How does engineering community engagement …
La Leche League, The Media, And The Nursing Mother: A Broader Perspective On Persona Theory, Erin F Doss
La Leche League, The Media, And The Nursing Mother: A Broader Perspective On Persona Theory, Erin F Doss
Open Access Dissertations
This dissertation builds on current breastfeeding-related scholarship by suggesting that the lived experiences of nursing mothers could be effective arguments for initial and continued breastfeeding. To do this, I analyzed archival materials related to La Leche League, specifically League newsletters, and media articles from publications across the United States to determine how the "nursing mother" functioned as a persona throughout the second half of the twentieth century. First, in my analysis of League newsletters I theorized a new category of personae, the constitutive persona, which includes personae used by a collective to attract new members and provide them with language …
Constructing Community From Corpses In Medieval English And Icelandic Literature, Erin C Kissick
Constructing Community From Corpses In Medieval English And Icelandic Literature, Erin C Kissick
Open Access Dissertations
I argue that the bodies of the dead interred within medieval texts are used as focal points for the communities created within those texts. The most famous textual medieval corpses are the relics of saints as described in hagiographies, relics which, outside of these texts, became the centerpieces of many medieval communities, both religious and secular, as demonstrated by Patrick Geary and Carolyn Walker Bynum. More broadly, material culture scholars such as Howard Williams have shown that the graves of nonsaints played a significant role in the preservation of communal memory. In medieval communities, ancestors and other long-gone ancient communities …

Culturally Responsive Engineering Education: A Case Study Of A Pre-College Introductory Engineering Course At Tibetan Children's Village School Of Selakui, Marisol Mercado Santiago

Culturally responsive teaching has been argued to be effective in the education of Indigenous youth. This approach emphasizes the legitimacy of a group's cultural heritage, helps to associate abstract academic knowledge with the group's sociocultural context, seeks to incorporate a variety of strategies to engage students who have different learning styles, and strives to integrate multicultural information in the educational contents, among other considerations. ^ In this work, I explore the outcomes of a culturally responsive introductory engineering short course that I developed and taught to Tibetan students at Tibetan Children's Village of Selakui (in Uttarakhand, India). Based on my …

The Emergence Of Constitutionalism As An Evolutionary Adaptation, Fábio Portela L. Almeida
The Emergence Of Constitutionalism As An Evolutionary Adaptation, Fábio Portela L. Almeida
Cardozo Public Law, Policy & Ethics Journal
The emergence of modern societies is an evolutionary puzzle. Homo sapiens is the only animal species capable of cooperating in large-scale societies consisting of genetically unrelated individuals. From a biological point of view, this feature leads to enormous questions. Social scientists typically assume that human life is lived in large-scale societies as a result of cultural, social and institutional history. In this perspective, social institutions such as law, economy and religion enhance cooperation to higher levels. Gene-culture coevolutionary theories have studied this issue in an integrated framework that accounts for social and biological theories of cooperation. These theoretical approaches have …
Nurse Practitioner Screening Practices For Mild Cognitive Impairment In The Older Adult, Margaret Mcilwain
Nurse Practitioner Screening Practices For Mild Cognitive Impairment In The Older Adult, Margaret Mcilwain
Doctor of Nursing Practice (DNP) Translational and Clinical Research Projects
Abstract
Nurse practitioners (NPs/APRNs) who provide primary care services may be the first line providers in situations where adults present with symptoms of memory loss and forgetfulness. Though protocols are available for evaluating dementia, specific guidelines for evaluating early cognitive changes, Mild Cognitive Impairment (MCI), are lacking. This descriptive research project assesses the knowledge, current screening methods, and barriers to screening for MCI by nurse practitioners (APRNs) in the state of Georgia. One hundred and thirty two NPs participated in the survey. Forty-five percent of the participants were unfamiliar with the diagnostic category of MCI. Of the major barriers identified, …
The Unconvincing Case Against Private Prisons, Malcolm M. Feeley
The Unconvincing Case Against Private Prisons, Malcolm M. Feeley
Indiana Law Journal
In 2009, the Israeli High Court of Justice held that private prisons are unconstitutional. This was more than a domestic constitutional issue. The court anchored its decision in a carefully reasoned opinion arguing that the state has a monopoly on the administration of punishment, and thus private prisons violate basic principles of modern democratic governance. This position was immediately elaborated upon by a number of leading legal philosophers, and the expanded argument has reverberated among legal philosophers, global constitutionalists, and public officials around the world. Private prisons are a global phenomenon, and this argument now stands as the definitive principled …

The Amphibious Public: A Historical Geography Of Municipal Swimming And Bathing New York City, 1870 - 2013, Naomi Miriam Adiv
Dissertations, Theses, and Capstone Projects
Since 1870, the city of New York has engaged in a project of building and maintaining enclosed sites for municipal bathing, including building floating `river baths' (1870 - 1942), indoor municipal baths (1901 - 1975), eleven enormous outdoor pools built with WPA funds (1936 - present), and outdoor pools of various sizes built under the Lindsay administration (1968 - present). This dissertation explores the changing rationale, over almost 150 years, for the municipal construction of public bathing places in New York City, and the ways in which the physical structures have taken on new social goals, meanings and ideals, both …
The Essay Industry, Stephanie Owings, Jennifer Nelson
The Essay Industry, Stephanie Owings, Jennifer Nelson
Mountain Plains Journal of Business and Technology
This paper considers the essay industry. The essay industry is an Internet-based collection of firms that provide students with papers, written by others, which satisfy their coursework assignments. We find that the industry is thriving. The firm failure rate is low, profits are high and revenues are, at a minimum, $100 million. Although there are laws in many states prohibiting the sale of essays, we find that these laws are not generally enforced. We review the pricing structure of the industry and the typical compensation rates of their employees. We consider anti-plagiarism software and conclude that it has limited effectiveness …
Displacing The Displaced: Challenging The International Framework For Palestinian Refugees In Light Of The Syria Crisis, Jasmin Fritzsche
Displacing The Displaced: Challenging The International Framework For Palestinian Refugees In Light Of The Syria Crisis, Jasmin Fritzsche
Faculty Journal Articles
In 1948 approximately 750,000 Palestinians were displaced for the first time. As of 2014, the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) counts over 5 million Palestine refugees. Many of those refugees no longer reside in their first country of asylum but have been repeatedly displaced following expulsions, political unrest and conflicts in host countries. In 2011, fighting broke out in Syria, creating over three million refugees fleeing mainly to surrounding Arab countries such as Lebanon and Jordan. Alongside Syrian citizens affected by the conflict is a population of about half a million …

Our 'Patchwork' Health Care System: Melodic Variations, Counterpoint, And The Future Role Of Physicians, William M. Sage
Our 'Patchwork' Health Care System: Melodic Variations, Counterpoint, And The Future Role Of Physicians, William M. Sage
Faculty Scholarship
This Foreword to a forthcoming symposium on the "patchwork" health care system to be published in the Houston Journal of Health Law & Policy considers whether current reactions to fragmentation in health care represent minor variations on a longstanding theme in US health policy or offer a more substantial counterpoint to that theme. The theme is this: that perfect physicians should be allowed to control health care even if safeguards are needed in practice because real physicians are not perfect. The Foreword previews four scholarly articles featured in the published symposium. It concludes that, while all the articles present original …

Generalized Exponentiated Moment Exponential Distribution, Zafar Iqbal, Syed Anwer Hasnain, Muhammad Salman, Munir Ahmad, Gholamhossein Hamedani
Mathematics, Statistics and Computer Science Faculty Research and Publications
Moment distributions have a vital role in mathematics and statistics, in particular in probability theory, in the perspective research related to ecology, reliability, biomedical field, econometrics, survey sampling and in life-testing. Hasnain (2013) developed an exponentiated moment exponential (EME) distribution and discussed some of its important properties. In the present work, we propose a generalization of EME distribution which we call it generalized EME (GEME) distribution and develop various properties of the distribution. We also present characterizations of the distribution in terms of conditional expectation as well as based on hazard function of the GEME random variable.
Mythic Rhetoric: Love, Power, And Companionate Marriage In Puccini's Turandot, Valerie V. Peterson
Mythic Rhetoric: Love, Power, And Companionate Marriage In Puccini's Turandot, Valerie V. Peterson
Peer Reviewed Articles
Using a rhetorical perspective, specifically Kenneth Burke's understanding of myths as "forward looking partisanships," this essay explores the mythic story of Turandot and its relationship to love, power, and companionate marriage.1 First, Burke’s understanding of myth is outlined and connected to the history and travels of Turandot. Then, a detailed rhetorical analysis of the 1998 PBS video of Puccini's opera performed at the Forbidden City, Beijing, suggests why the Turandot myth seems to appear in certain places and moments, and what it might have offered to audiences, in this instance, on a spiritual level.
