Trusting The Courts: Redressing The State Court Funding Crisis, Michael J. Graetz Jan 2014

Trusting The Courts: Redressing The State Court Funding Crisis, Michael J. Graetz

Faculty Scholarship

In recent years, state courts have suffered serious funding reductions that have threatened their ability to resolve criminal and civil cases in a timely fashion. Proposals for addressing this state court funding crisis have emphasized public education and the creation of coalitions to influence state legislatures. These strategies are unlikely to succeed, however, and new institutional arrangements are necessary. Dedicated state trust funds using specific state revenue sources to fund courts offer the most promise for adequate and stable state court funding.

Division I College Student-Athlete Career Situation And Attitudes Toward Career Counseling, Adrian J. Ferrera Jan 2014

Division I College Student-Athlete Career Situation And Attitudes Toward Career Counseling, Adrian J. Ferrera

Graduate Theses, Dissertations, and Problem Reports (ETD)

Few student-athletes advance to the professional level following their collegiate athletic career, leaving many to pursue alternative career paths. Although much attention has been dedicated to student-athlete academic progress and graduation rates, little attention has been given to student-athlete career development and their attitudes toward career counseling. Since the career development of student-athletes is complex and is affected by several variables, the purposes of the present study were threefold: 1) determine the career situation of male and female student-athletes attending an NCAA Division I university, 2) determine if differences existed between student-athletes and non-athlete students in their attitudes toward career …

Compositions Of Criticism: A Reinterpretation Of Gustave Courbet's Paintings Of Nudes, Amanda M. Guggenbiller Jan 2014

Compositions Of Criticism: A Reinterpretation Of Gustave Courbet's Paintings Of Nudes, Amanda M. Guggenbiller

Graduate Theses, Dissertations, and Problem Reports (ETD)

This paper investigates the mythological paintings created by Gustave Courbet (1819-1877) in the nineteenth-century, and their connection to Courbet's relationship with the political regime of the French Second Empire. In 1862, Courbet began three variations of one painting, originally titled Study of Women, and shortly after changed to Venus in Jealous Pursuit of Psyche. The mythological context of the paintings was commonly represented in the arts, although the scene Courbet depicted was unusual, and unlike any other. The principles upon which Courbet created his art, which also shaped the concept of Realism, the movement which Courbet started, strongly opposed all …

Sugary Drinks, Happy Meals, Social Norms, And The Law, Lindsay Wiley Jan 2014

Sugary Drinks, Happy Meals, Social Norms, And The Law, Lindsay Wiley

Scholarly Articles in Law Reviews & Journals

What role should government play in discouraging harmful overconsumption? What modes of government intervention best strike the balance between effectiveness and political acceptability? It is well established that government has a legitimate interest in protecting the health and safety of the people, even from their own choices and actions. Furthermore, there is no fundamental right to sell or purchase particular services or products in particular configurations. The appropriate question, then, is not what government may do to prevent non- communicable diseases that are associated with individual behavior choices, but rather what government should do. This comment on David Friedman's Public …

Aquaponic Production Of Lettuce (Lactuca Sativa L.) Using Effluent From A Cold Water Flow-Through Aquaculture System, Gaylynn Elise Johnson Jan 2014

Aquaponic Production Of Lettuce (Lactuca Sativa L.) Using Effluent From A Cold Water Flow-Through Aquaculture System, Gaylynn Elise Johnson

Graduate Theses, Dissertations, and Problem Reports (ETD)

Aquaponics is the integration of aquaculture (the rearing of fish) and hydroponics (the conventional method of soilless farming). Effluent produced from the production of fish can be utilized as a source of nutrients by plants for growth in a hydroponic subsystem. Lettuce (Lactuca sativa) is an economically important vegetable crop that can be grown aquaponically. However, the suitability of lettuce for production in cold water flow-through systems (FTSs) is poorly described. The purpose of this study was to evaluate the growth, market rating, and nutrient uptake of lettuce grown in a cold water FTS. Three objectives were established to examine …

The Political Economy Of Pork-Barrel Spending, J. Zachary Klingensmith Jan 2014

The Political Economy Of Pork-Barrel Spending, J. Zachary Klingensmith

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation consists of five papers which examine the impact pork-barrel spending has on legislative decision-making. In chapter 1, I introduce the theory behind pork-barrel spending, legislative coalitions and other similar topics. In chapter 2, I determine if pork-barrel spending has any impact on state employment levels. I use both a spatial and non-spatial modeling methodology to answer the question. Chapter 3 examines the relationship between the amount of pork-barrel spending appropriated by the Senator and the amount of money the Senator is able to fundraise. Chapter 4 integrates the results from chapter 3 to develop two-stage and three-stage models …

Constitutional Amendments And The Consolidation Of The Rule Of Law In Democratizing Francophone West Africa: Case Study Of Benin, Burkina Faso, And Senegal, Bagnini Kohoun Jan 2014

Constitutional Amendments And The Consolidation Of The Rule Of Law In Democratizing Francophone West Africa: Case Study Of Benin, Burkina Faso, And Senegal, Bagnini Kohoun

Graduate Theses, Dissertations, and Problem Reports (ETD)

Constitutional stability is usually perceived as an invaluable asset in democratic regimes. Constitutional amendments become suspicious when they occur too often, particularly in countries newly engaged in the democratic process. This dissertation argues that recent constitutional amendments in democratizing Francophone West African countries are not necessarily made to advance democracy or the rule of law. Instead, they are designed to reinforce the political agenda of incumbent power-holders. Using a case study of three Francophone African countries (Benin, Burkina Faso, and Senegal), I try to understand why there are so many constitutional amendments in so short a period of time in …

Solder Joint Reliability: A Unified Thermo-Mechanical Model Approach, Gurmukh Hiro Advani Jan 2014

Solder Joint Reliability: A Unified Thermo-Mechanical Model Approach, Gurmukh Hiro Advani

Industrial and Manufacturing Engineering

Due to an unprecedented pervasiveness of electronics in high performance applications, the dependability of mission critical equipment and systems, often solely depends on the reliability of underlying embedded electronic sub-systems. This includes reliability of the solder joints which are subject to fatigue failure over time in harsh operating environments replete with thermo-mechanical stresses. Fatigue behavior of the solder joints has been previously studied under the separate domains of microstructure evolution and non-linear plastic deformations. The proposed study captures the underlying physics of failure mechanisms to model the failure initiation and degradation phases to obtain a unified model characterizing the overall …

Promoting Positive Youth Development: A Crash Course For Youth Ministers, Lynsey Ann Rittenbach Jan 2014

Promoting Positive Youth Development: A Crash Course For Youth Ministers, Lynsey Ann Rittenbach

Human Development and Family Science

This paper explores the role religion can play in the Positive Youth Development (PYD) approach to youth development. The relevant literature suggests there is a missing link between youth workers in religious institutions and training in youth development. The majority of youth workers (paid, volunteer, part- and full-time) in various religious institutions are not trained in youth development, particularly in the PYD approach due to lack of resources and availability. Therefore, the purpose of this paper is to provide “a crash course for youth ministers” to gain an understanding of PYD and the role their programing and congregations can play …

However, the extent of research regarding barriers and facilitators to the use of EBP within athletic training lags behind that of other health care …

Stray Gas Occurrences In Groundwater In Randolph County, West Virginia, Usa, Lindsey J. Bowman Jan 2014

Stray Gas Occurrences In Groundwater In Randolph County, West Virginia, Usa, Lindsey J. Bowman

Graduate Theses, Dissertations, and Problem Reports (ETD)

Stray gas in groundwater is a rising health and safety concern and previous research has documented the enhancement of deep fluid migration to shallow aquifers by shale gas activity. However, stray gas can be generated or migrate naturally into shallow aquifers and more research is needed to establish baseline conditions prior to energy development in a region. A previous survey of groundwater in central West Virginia revealed that some high stray gas concentrations in groundwater wells could possibly be related to coal mining or oil and gas development (Mulder 2012). However, a few wells in Randolph County had high levels …

Between The Local And The National: The Free Territory Of Trieste, "Italianita," And The Politics Of Identity From The Second World War To The Osimo Treaty, Fabio Capano

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation examines the politicized use of the city of Trieste and its surrounding territory, a cosmopolitan municipality that became the theatre of one of the most heated disputes of the early Cold War years. Scholars have extensively studied the diplomatic dimension of the confrontation between Italy and former Yugoslavia, yet many have largely neglected the significance of the broader political process that led to the Osimo Treaty of 1975, the final settlement of Italy's eastern border. This dissertation reaffirms the importance of the Triestine territory as a contested socio-political space that experienced the logic of both Cold War containment …

Self Perceptions Of Aging: Women's Views Of The Aging Process, Eryn Nichole Jager Jan 2014

Self Perceptions Of Aging: Women's Views Of The Aging Process, Eryn Nichole Jager

Human Development and Family Science

Society has generally taught women in a rather subliminal way they should remain young, thin, and beautiful (Horton, Baker, Cote, & Deakin, 2008; Mock & Eibach, 2011; Stark- Wroblewski, Edelbaum, & Bello, 2008). As the number of older adults increase, the driving forces that determine self-perceptions of aging are essential. Using a hierarchical regression analysis, the current study examined self-perceptions of aging among older adult women. For the study, 102 females (age 60 and older) in the Red River Valley area completed a survey on selfperceptions of aging. Sense of mastery was significantly related to negative self-perceptions of aging. The …

Estimating A Path Through A Map Of Decision Making, W. A. Brock, R. A. Bentley, Michael J. O'Brien, C. S. Caiado Jan 2014

Estimating A Path Through A Map Of Decision Making, W. A. Brock, R. A. Bentley, Michael J. O'Brien, C. S. Caiado

History Faculty Publications (Archived)

Studies of the evolution of collective behavior consider the payoffs of individual versus social learning. We have previously proposed that the relative magnitude of social versus individual learning could be compared against the transparency of payoff, also known as the "transparency" of the decision, through a heuristic, two-dimensional map. Moving from west to east, the estimated strength of social influence increases. As the decision maker proceeds from south to north, transparency of choice increases, and it becomes easier to identify the best choice itself and/or the best social role model from whom to learn (depending on position on east-west axis). …
