Blogs For Workplace Assessment, Julie Dunne, Sinead Ryan
Assessment & Feedback Cases
Students out on work placement undertake a period of writing individual reflective blogs (4 x weekly blog @ 400 words per blog) to capture their experiences and reflections on experiences. Assigned to small groups, they also are required to interact with the blogs of peers though reflective comments. Students are also encouraged to read as many blogs written by their peers (outside their assigned group) and comment if they wish. Marking is across several desired outcomes (see rubric). Feedback is provided after the first blog which is not marked. Feedback is via a comment on the student blog. All students …

Robotics (DT009/3) fulfils joint function of lab book and mini project (report). I use Wordpress.com (a free resource). The students are required to enter four posts during the semester. Topics are specified but some are flexible for substitution, as they cover the learning outcomes from the module descriptor. Posts: these are like lab write ups. They have more flexibility with the schedule. Feedback is formative until the end of semester. Pages: practical application, proof of concept, undertake work (4-5 weeks). This is like a long lab report, structured like a final year project report.
Proposal To Government, Geraldine French
Proposal To Government, Geraldine French
Assessment & Feedback Cases
It is a project to write an informed and authoritative 3000 word proposal to a government minister. The module is Perspectives on Early Childhood Education: Issues in policy, practice and research. Because the field of early childhood education is evolving the course is flexible to respond to emerging issues. The students need to be informed on the bigger policy backdrop in Early Childhood Education. The brief is responsive to whatever is currently happening regarding government policy in this area. At this point in time a National Early Years Strategy is being developed by the Minister for Children and Youth Affairs, …
Trips-Plus Trade And Investment Agreements: Why More May Be Less For Economic Development, Christine Farley
Trips-Plus Trade And Investment Agreements: Why More May Be Less For Economic Development, Christine Farley
Scholarly Articles in Law Reviews & Journals
Conventional wisdom -- but not empirical research -- maintains that strong intellectual property (“IP”) rights trigger not only foreign direct investment, but also local innovation. Thus investors seek, and developing countries compete to offer, the highest levels of IP protections. But evaluating the level of IP protection in any given country has become increasingly complex. A proliferation of bilateral agreements, such as free trade agreements (“FTAs”) and bilateral investment treaties (“BITs”), intended to enhance the minimum standards set forth in The Agreement on Trade Related Aspects of Intellectual Property Rights (“TRIPS”), have created uncertainty about precisely what IP protections are …

Personal Curtilage: Fourth Amendment Security In Public, Andrew Ferguson
Scholarly Articles in Law Reviews & Journals
Do citizens have any Fourth Amendment protection from sense-enhancing surveillance technologies in public? This article engages a timely question as new surveillance technologies have redefined expectations of privacy in public spaces. This article proposes a new theory of Fourth Amendment security based on the ancient theory of curtilage protection for private property. Curtilage has long been understood as a legal fiction that expands the protection of the home beyond the formal structures of the house. Curtilage recognizes a buffer zone beyond the four corners of the home that deserves protection, even in public, even if accessible to public view. Based on …

Turkish Journal of Zoology
The rhythms of the Northern Shoveller's (Anas clypeata Linnaeus, 1758) activities during its wintering period in 2 wetlands, Garaet Hadj-Tahar (North-East Algeria) and Garaet Timerganine (Oum El-Bouaghi, Algerian highlands), were studied during 2 wintering seasons in Garaet Hadj-Tahar from November 2007 to March 2008 and November 2008 to March 2009, and in the Timerganine wetland from November 2007 to March 2008. They were linked to certain spatiotemporal variables, i.e. daytime activities and 2 different wetlands. During the wintering season, the main activity at Garaet Hadj-Tahar was sleeping (70%), followed by swimming (12%). By contrast, feeding was the dominant activity at …

Turkish Journal of Zoology
The effects of temperature, dissolved oxygen, nitrate, phosphate, and chlorophyll-\alpha concentration on the body length and egg production of a cyclopoid copepod, Thermocyclops crassus, and a calanoid, Eudiaptomus drieschi, were evaluated. Sampling was conducted in Yenişehir Lake (Hatay, Turkey) on a monthly basis between May 2003 and April 2004. The results of the present study showed that, among the parameters considered, temperature and chlorophyll-\alpha concentration were the main parameters influencing the body length of T. crassus and E. drieschi in Yenişehir Lake. For E. drieschi, egg production was also affected by chlorophyll-\alpha levels.

The Tubificids (Annelida, Oligochaeta) Of Lake Trasimeno And Lake Piediluco In Central Italy, With A Study Of Sem Morphology Of Some Species, Enzo Goretti, Caterina Marcucci, Alessandra Di Veroli, Angelisa Fabrizi, Elda Gaino
Turkish Journal of Zoology
Freshwater oligochaetes are studied worldwide because of their relevance as bioindicators in aquatic ecosystems. Nevertheless, species identification is still difficult because it is mainly based on the male reproductive system. The morphology of the chaetae offers an additional set of characters and the fine organization of these elements can help in solving crucial aspects allowing specific attribution. In spite of this, somatic chaetae are poorly investigated under scanning electron microscopy (SEM). A SEM analysis of the chaetae has been carried out on the tubificids Branchiura sowerbyi, Limnodrilus hoffmeisteri, Tubifex tubifex, and Psammoryctides barbatus from Trasimeno and Piediluco lakes (Central Italy). …

Turkish Journal of Zoology
Diplodinium rangiferi was observed in rumen contents from a single animal out of 25 cattle surveyed in the area of Kastamonu, Turkey. It constituted 2.7% of the total ciliate population and had a 4% frequency of appearance. The size and percentage occurrence of this species in the present study are compared to those previously reported for other animal hosts living in different geographical locations. This study reports for the first time in Turkey and the world the naturally occurring presence of D. rangiferi in cattle.

Last Words: A Survey And Analysis Of Federal Judges' Views On Allocution In Sentencing, Ira Robbins
Scholarly Articles in Law Reviews & Journals
Allocution-the penultimate stage of a criminal proceeding at which the judge affords defendants an opportunity to speak their last words before sentencing-is a centuries-old right in criminal cases, and academics have theorized about the various purposes it serves. But what do sitting federal judges think about allocution? Do they actually use it to raise or lower sentences? Do they think it serves purposes above and beyond sentencing? Are there certain factors that judges like or dislike in allocutions? These questions-and many others-are answered directly in this first-ever study of judges' views and practices regarding allocution. The authors surveyed all federal …

The Price Is Wrong: Reimbursement Of Expenses For Acquitted Criminal Defendants, Ira P. Robbins

"Not guilty "-these two simple words elicit intense relieffrom any defendant at the conclusion of a criminal trial. As one harrowing ordeal ends, however, a new one inevitably takes shape: picking up the pieces of a life shattered physically, emotionally, and, for nonindigent defendants, _financially. Where do defendants who have successfully defended themselves against criminal prosecution turn for assistance in paying the debts incurred in securing their freedom? Some states, as well as the federal government, have implemented laws that allow acquitted defendants to seek public reimbursement of certain legal expenses they incurred in their defense. These reimbursement methods differ …

Educational Programmes For Spatial Information Sciences In The Technological University Of Dublin, William Prendergast, Eamonn Murphy, Audrey Martin, Avril Behan
Conference papers
The ever increasing spatial information needs of society, the rapid development of new surveying technologies, and the global demand for appropriately qualified surveyors, have triggered a radical re-evaluation of geomatics education worldwide. Significant enhancements have been made to the educational programmes in the spatial information science discipline in the Technological University of Dublin’s (DIT) during the last decade including the provision of a BSc in Geomatics and various masters’ programmes to cater for the increasingly specialised needs of the Geographic Information sector in Ireland.

Split Strongly Abelian P-Chief Factors And First Degree Restricted Cohomology, Jorg Feldvoss, Salvatore Siciliano, Thomas Weigel
University Faculty and Staff Publications
In this paper we investigate the relation between the multiplicities of split strongly abelian p-chief factors of finite-dimensional restricted Lie algebras and first degree restricted cohomology. As an application we obtain a characterization of solvable restricted Lie algebras in terms of the multiplicities of split strongly abelian p-chief factors. Moreover, we derive some results in the representation theory of restricted Lie algebras related to the principal block and the projective cover of the trivial irreducible module of a finite-dimensional restricted Lie algebra. In particular, we obtain a characterization of finite-dimensional solvable restricted Lie algebras in terms of the second Loewy …

Transforming Traditional Classrooms Into Student-Centered 21 St Century Classrooms: A Developmental Process For Professional Development, Monica Mccartney
Graduate Theses, Dissertations, and Problem Reports (ETD)
This design-based action research study utilized a model of design, implementation, and evaluation across four school semesters to improve the professional development provided to teachers in a new one-to-one computing environment. Data sources collected across all semesters helped guide changes to the design and implementation phases of the professional development. This study had one guiding research question: What are the appropriate professional development sessions and process for designing professional development in order to meet the needs of teachers as they to transform traditional classrooms into student-centered 21 st century classrooms?
A Method Of Pricing European Style Equity Options, David Harris
A Method Of Pricing European Style Equity Options, David Harris
Graduate Theses, Dissertations, and Problem Reports (ETD)
The study of option pricing has a very short history, when compared with other elements of economics. Since the publication of a method to price European style equity options by Fischer Black and Myron Scholes in 1973 a vast amount of research on option pricing has occurred. Ultimately, the pricing of equity options depends upon the match of the model and reality. A new method to price option contracts is proposed. It is argued that the distributional assumptions of standard models are uncorrelated with nature. A new model is proposed as a start to a new class of models.
The Use Of Hand Bacteria As A Human Biometric Identifier, Amanda Holbert
The Use Of Hand Bacteria As A Human Biometric Identifier, Amanda Holbert
Graduate Theses, Dissertations, and Problem Reports (ETD)
Molecular and bio-molecular biometrics are an advancing field that involves the analysis of a person's unique biological markers at a molecular level to ascertain identity. Bacteria communities found on the skin of the human hand have shown to be highly diverse and to have a low percentage of similarity between individuals. The goal of this research effort is to see if a person's demographics, primarily ethnicity, share a relationship with the bacteria communities that exist on their hand. A sample collection was carried out in which the left and right inner palms of 250 individuals were swabbed to obtain a …

Implementing Human Rights In Closed Environments Through The United Nations Convention Against Torture, Claudio Grossman
Implementing Human Rights In Closed Environments Through The United Nations Convention Against Torture, Claudio Grossman
Scholarly Articles in Law Reviews & Journals
Closed environments pose a major challenge to the full and effective implementation of human rights norms and conventions. However, many conventions contain mechanisms that can be used to further advance implementation of human rights in those closed environments. The United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (the Convention) has several mechanisms in place that play an important role in enforcing and implementing human rights obligations. Along with the creation of a supervisory organ, the Committee against Torture (the Committee), the Convention provides a framework for: State Party reporting and concluding observations (COBs) under …

Converting Benchslaps To Backslaps: Instilling Professional Accountability In New Legal Writers By Teaching And Reinforcing Context, Heidi K. Brown

A search in published and unpublished court decisions for derivations of phrases like "poorly written brief" or "failure to follow court rules" yields an alarming multitude of case opinions in which judges admonish lawyers of all levels of experience for shoddy briefs or for flouting non-negotiable substantive and procedural rules. Legal bloggers have affectionately dubbed these public reprimands "benchslaps."
Section I of this article provides a contextual background that professors and practitioners can share with rookie legal writers, using judicial opinions to demonstrate the eight most-common ways that attorney work product falls short of judges' expectations and, more importantly, how …

Improving Hedge Fund Governance, Houman B. Shadab
Articles & Chapters
This article provides a comprehensive analysis of the internal governance of hedge funds. The primary components of hedge fund governance are investors with a high propensity to exercise their short-term redemption rights; managers with high pay performance sensitivity, because they are being compensated with an annual performance-based fee plus earnings from their own investment in the funds they manage; sophisticated investors who demand quality governance; and short-term creditors and derivatives counterparties who provide close monitoring. Hedge fund governance needs the most improvement in the areas of performance reporting (valuation) and the timing of performance-fee calculations. Further, counterintuitively, in some circumstances …

Improving Hedge Fund Governance, Houman B. Shadab
Improving Hedge Fund Governance, Houman B. Shadab
Articles & Chapters
This Article provides the first comprehensive scholarly analysis of the internal governance of hedge funds. Hedge fund governance consists of the funds’ underlying legal regime and the practices they adopt in response to lacking permanent capital and to reduce agency costs. Hedge fund governance is important because better governance can improve investor returns and help managers raise and retain capital. I argue that hedge fund governance is best understood as a type of responsive managerialism. It is a type of managerialism because applicable law and contracting structures give managers uniquely wide-ranging control over the fund and its operations. Hedge fund …

On February 28, 2013, I was honored to deliver the Paul Robeson lecture at Columbia Law School, an annual event to commemorate the life and legacy of Paul Robeson, a graduate of Columbia Law School (Class of 1923). This article is a slightly expanded version of my lecture.
This article will have four components: first, it will highlight the achievements of this extraordinary man, an advocate for social justice, a world-renowned artist, and an accomplished sportsman. Second, in this article I explore Paul Robeson’s connections and commitment to the African anti-colonial struggle, and in particular the struggle against apartheid in …
