When a fatal traffic accident happens, we expect the local police and prosecutors to handle the investigation and criminal charges. When afatal airplane crash occurs, however, we turn instead to the National Transportation Safety Board (NTSB). The reason is that air crashes are complicated and the NTSB has vast expertise. Without that expertise, investigations falter. We need look no further than the mess made by Malaysian authorities in the search for Flight 370 to see the importance of expertise in handling complicated investigations and processes. It is easy to point to a similar series of mistakes by local prosecutors and …
The All-Pay Auction With Complete Information And Identity-Dependent Externalities, Bettina Klose, Dan Kovenock
The All-Pay Auction With Complete Information And Identity-Dependent Externalities, Bettina Klose, Dan Kovenock
Economics Faculty Articles and Research
We derive a necessary and sufficient condition for the existence of equilibria with only two active players in the all-pay auction with complete information and identity-dependent externalities. This condition shows that the generic equilibrium of the standard all-pay auction is robust to the introduction of "small" identity-dependent externalities. In general, however, the presence of identity-dependent externalities invalidates well-established qualitative results concerning the set of equilibria of the first-price all-pay auction with complete information. With identity-dependent externalities equilibria are generally not payoff equivalent, and identical players may earn different payoffs in equilibrium. These observations show that Siegel’s (2009) results characterizing the …
Future Of The Fourth Amendment: The Problem With Privacy, Poverty And Policing, Kami Chavis Simmons
Future Of The Fourth Amendment: The Problem With Privacy, Poverty And Policing, Kami Chavis Simmons
Faculty Publications
For decades, the reasonable expectation of privacy has been the primary standard by which courts have determined whether a "search" has occurred within the meaning of the Fourth Amendment. The Supreme Court's recent decision in U.S. v. Jones, however, has reinvigorated the physical trespass doctrine's importance when determining whether there has been a "search" triggering constitutional protection. Recognizing the unpredictability of the reasonable expectation of privacy doctrine and that doctrine's bias against the urban poor, many scholars hope that the Jones opinion may ameliorate the class divide that has developed in Fourth Amendment jurisprudence.

Coercive Assimilationism: The Perils Of Muslim Women's Identity Performance In The Workplace, Sahar F. Aziz
Coercive Assimilationism: The Perils Of Muslim Women's Identity Performance In The Workplace, Sahar F. Aziz
Michigan Journal of Race and Law
Should employees have the legal right to “be themselves” at work? Most Americans would answer in the negative because work is a privilege, not an entitlement. But what if being oneself entails behaviors, mannerisms, and values integrally linked to the employee’s gender, race, or religion? And what if the basis for the employer’s workplace rules and professionalism standards rely on negative racial, ethnic or gender stereotypes that disparately impact some employees over others? Currently, Title VII fails to take into account such forms of second-generation discrimination, thereby limiting statutory protections to phenotypical or morphological bases. Drawing on social psychology and …
A Framework For Advancing Negotiation Theory: Implications From A Study Of How Lawyers Reach Agreement In Pretrial Litigation, John M. Lande
A Framework For Advancing Negotiation Theory: Implications From A Study Of How Lawyers Reach Agreement In Pretrial Litigation, John M. Lande
Faculty Publications
The prevailing negotiation theory tries to fit lots of square pegs into just two round holes–adversarial or cooperative bargaining. In the real world, negotiation comes in many different shapes, not just circles and squares. Analyzing law school textbook definitions of the traditional models, this article demonstrates that the two “round holes” in current negotiation theory are poorly defined. It also presents empirical accounts of actual pretrial negotiations to demonstrate that the theoretical models do not fit some real-life negotiations. It argues that it is time to replace the traditional models with a flexible framework that can accommodate virtually all legal …

Mindful Eating: Trait And State Mindfulness Predict Healthier Eating Behavior, Christian H. Jordan, Wan Wang, Linda R. Donatoni, Brian P. Meier
Psychology Faculty Publications
Obesity and excess weight are significant societal problems. Mindfulness may encourage healthier weight and eating habits. Across four studies, we found a positive relation between mindfulness and healthier eating. Trait mindfulness was associated with less impulsive eating, reduced calorie consumption, and healthier snack choices. In addition, we found a causal effect of mindfulness on healthier eating. An experimental manipulation of state mindfulness led participants to consume fewer calories in a spontaneous eating task. We also found preliminary evidence that mindfulness affects eating behavior by encouraging attitudinal preferences for healthier foods. Taken together, these results provide strong evidence that mindfulness encourages …

Examining Perceptions Of A Smartphone-Based Intervention System For Alcohol Use Disorders, Danielle Giroux, Samantha Bacon, Diane K. King, Patrick Dulin, Vivian Gonzalez
ISER Articles
This study presents results from qualitative interviews conducted with participants in a study on the effectiveness of the Location-Based Monitoring and Intervention System for Alcohol Use Disorders (LBMI-A), a smartphone-based, stand-alone intervention application (app) for adults with alcohol use disorders. Materials and Methods: Participants were provided an LBMI-A-enabled smartphone to use during a 6-week pilot study. The LBMI-A was composed of psychoeducational modules, assessment and feedback of alcohol use patterns, geographic high-risk location monitoring and alerts, and in vivo assessment and intervention for alcohol cravings and help with managing psychological distress. Semistructured interviews were conducted with all participants following 6 …

By explaining the cultural mechanism of 'prolepsis' through examples of my own teaching, I posit that all too often educators' and teacher educators' (purely 'ideal') recall of our pasts and imagination of our students' futures become fundamentally materialized constraints on our students' life experiences in the present.

Verbal Compliments As A Differential Source Of Mate Poaching Threat For Men And Women, Christina M. Brown, Emily R. Daniels, Christopher J.N. Lustgraaf, Donald F. Sacco

Two studies tested whether people feel threatened by another individual verbally complimenting their romantic partner. Such compliments may indicate that the other person is a potential rival who will try to "poach" their mate. Across two studies, women were more threatened than men when imagining another person complimenting their partner's physical appearance. There were no sex differences in response to imagining another person complimenting their partner's sense of humor. When another person compliments one's partner's physical appearance, this indicates that they may be sexually attracted to the partner. Mediation analyses revealed that the sex difference occurs because women believe men …

The Limits Of Child Pornography, Carissa Byrne Hessick
The Limits Of Child Pornography, Carissa Byrne Hessick
Indiana Law Journal
Although the First Amendment ordinarily protects the creation, distribution, and possession of visual images, the Supreme Court has declared that those protections do not apply to child pornography. But the Court has failed to clearly define child pornography as a category of speech. Providing a precise definition of the child pornography exception to the First Amendment has become increasingly important because recent years have seen a dramatic increase in the penalties associated with the creation, distribution, and possession of child pornography.
This Article proposes a clear definition of the child pornography exception. It argues that an image ought to fall …
Rights In Recession: Toward Administrative Antidiscrimination Law, Stephanie Bornstein
Rights In Recession: Toward Administrative Antidiscrimination Law, Stephanie Bornstein
UF Law Faculty Publications
This Article documents how, over the past six years and coinciding with the “Great Recession of 2008,” both public and private antidiscrimination enforcement mechanisms have become increasingly constrained, such that the ability to enforce the mandate of Title VII of the Civil Rights Act of 1964 - the main federal law prohibiting employment discrimination - may be facing a crisis point. While enforcement mechanisms for federal antidiscrimination law have long left room for improvement, recent developments in the economy, due to the 2008 recession, and in federal case law, due to a series of procedural decisions by the Roberts Court, …
Designing A Regional Trail Network Of High Conservation Value Using Principles Of Green Infrastructure, Carroll I. Courtenay, Todd R. Lookingbill
Designing A Regional Trail Network Of High Conservation Value Using Principles Of Green Infrastructure, Carroll I. Courtenay, Todd R. Lookingbill
Geography and the Environment Faculty Publications
Conservation and recreation planning potentially share many common goals, including the desire to increase landscape connectivity. Trail networks, however, typically develop independently of ecological corridors, with emphasis placed solely on their human services. The failure to align conservation and human use values results in missed opportunities to maximize the benefits of new trail development. This study uses concepts of green infrastructure and tools of connectivity modeling to identify priority locations for a regional trail network in the James River watershed, Virginia U.S.A. The approach uses methods derived from circuit theory to identify potential pathways that meet basic trail design criteria …
