Agency Enforcement Of Spending Clause Statutes: A Defense Of The Funding Cut-Off, Eloise Pasachoff Jan 2014

Agency Enforcement Of Spending Clause Statutes: A Defense Of The Funding Cut-Off, Eloise Pasachoff

Georgetown Law Faculty Publications and Other Works

This article contends that federal agencies ought more frequently to use the threat of cutting off funds to state and local grantees that are not adequately complying with the terms of a grant statute. Scholars tend to offer four arguments to explain—and often to justify—agencies’ longstanding reluctance to engage in funding cut-offs: first, that funding cut-offs will hurt the grant program’s beneficiaries and so will undermine the agency’s ultimate goals; second, that federalism concerns counsel against federal agencies’ taking funds away from state and local grantees; third, that agencies are neither designed nor motivated to pursue funding cut-offs; and fourth, …

The Western Prairie Fringed Orchid (Platanthera praeclara) is a threatened species found on the Sheyenne National Grassland in southeast North Dakota, USA. This conservation area that is a vital refuge for this species is subject to management for multiple uses including livestock grazing and recreation. Orchids are subject to continuous monitoring, but knowledge of the relationship between landscape indicators and orchid locations is limited. Research is needed to provide a greater understanding …

Measuring The Effect Of Weighted Devices On Exercise Enjoyment, Nicholas Kruse Jan 2014

Measuring The Effect Of Weighted Devices On Exercise Enjoyment, Nicholas Kruse

Theses and Dissertations

Physical activity provides an important health benefit for both males and females. Seven out of every ten U.S. deaths are from chronic disease and many of those deaths could have been preventable. With a lack of physical activity and poor diet, chronic illnesses such as obesity, cancer, cardiovascular disease, and type II diabetes were reported, (CDC, 2004). There is a steep decline in exercise from high school to college, which indicates that exercise adherence in college students is an issue. In this study, three conditions were examined with students at the University of North Dakota going through a plyometric protocol …

The purpose of this study was to identify potential maternal biomarkers associated with GBS colonization. Descriptive statistics were conducted to depict sample characteristics (n=42 pregnant women) and identify potential confounding variables including, but not limited to: medical history, race, weight, …

The Interplay Between Aging, Growth Hormone, The Methionine Pathway, And Epigenetic Methylation Marks And Mechanisms, Vanessa Louise Armstrong Jan 2014

The Interplay Between Aging, Growth Hormone, The Methionine Pathway, And Epigenetic Methylation Marks And Mechanisms, Vanessa Louise Armstrong

Theses and Dissertations

Methylation reactions are important for the establishment and maintenance of epigenetic methylation tags on DNA and histone molecules that are critical for the development and life-long function of an organism. While epigenetics has been studied extensively during embryological development and age-related disease such as cancer, little is known about whether epigenetic methylation enzyme expression change in normally aging or long-living mammals. Because growth hormone (GH) plays an important role in determining the lifespan of many organisms, we have focused our studies on the long-living growth hormone deficient model the Ames dwarf mouse. We focused our studies on epigenetic methylation in …

Governing By Guidance: Civil Rights Agencies And The Emergence Of Language Rights In Schools And Workplaces, Ming Hsu Chen

Faculty Scholarship

On the fiftieth anniversary of the Civil Rights Act of 1964, this Article asks federal civil rights laws evolved to incorporate the needs of non-English how speakers following landmark immigration reform (the 1965 Hart-Cellar Act) that led to unprecedented migration from Asia and Latin America. Based on a comparative study of the emergence of language rights in schools and work places from 1965 to 1980, the Article demonstrates that regulatory agencies used nonbinding guidances to interpret the undefined statutory term "national origin discrimination" during their implementation of the Civil Rights Act of 1964. Their efforts facilitated the creation of language …

Marker Assisted Selection Increases The Efficiency Of Breeding For Potato Virus Y Resistance In Potato, Whitney Ann Harchenko Jan 2014

Marker Assisted Selection Increases The Efficiency Of Breeding For Potato Virus Y Resistance In Potato, Whitney Ann Harchenko

Plant Sciences

Potato Virus Y (PVY) is an important virus of potato due to the non-persistent mode of transmission by aphids causing yield losses. Genetic resistance is the recommended control since insecticides cannot adequately control the spread of PVY by aphids. The gene Ryadg from S. tuberosum ssp. andigena provides resistance to all strains of PVY. This gene has genetically been mapped to chromosome XI, and linked polymerase chain reaction (PCR) based DNA markers have been identified. This study identified PVY resistant progeny by the use of the molecular sequence-characterized amplified region (SCAR) marker RYSC3. The RYSC3 marker allowed a simple and …

From Theory To Practice: Two Ecosystemic Approaches And Their Applications To Understanding School Bullying, Guckin C Mc, Stephen James Minton

School of Psychology

School professionals, particularly school counsellors and school psychologists, require detailed knowledge of many important factors that contribute to the personal, academic, and vocational development of the students in their charge (e.g., psychosocial development, curricula developments, local community developments and initiatives, national and international policy developments). The amount of detail and knowledge required by school counsellors/psychologists is bewildering, even before consideration of the individual differences in those who require their help. A framework can provide school professionals with a parsimonious approach to organising, synthesising and understanding all the information that needs to be considered in relation to a child within a …

School of Biological and Marine Sciences

AbstractParasites play key ecological and evolutionary roles through the costs they impose on their host. In wild populations, the effect of parasitism is likely to vary considerably with environmental conditions, which may affect the availability of resources to hosts for defense. However, the interaction between parasitism and prevailing conditions is rarely quantified. In addition to environmental variation acting on hosts, individuals are likely to vary in their response to parasitism, and the combined effect of both may increase heterogeneity in host responses. Offspring hierarchies, established by parents in response to uncertain rearing conditions, may be an important source of variation …
