Compliance Of Canada’S Utility Doctrine With International Minimum Standards Of Patent Protection, Jerome H. Reichman

This article analyzes the Canadian court case of Eli Lilly v. Novopharm and the "utility" doctrine in Canada, and international standards of patent protection including TRIPS and NAFTA. The ‘‘promise of the patent’’ doctrine in Canada seeks to ensure that firms do not obtain a legal monopoly on the basis of speculative claims about increased utility — especially claims about therapeutic efficacy — that were unsubstantiated at the time of filing. Under this test, some of Eli Lilly’s patented pharmaceutical products have been invalidated retroactively.

In December of 2012, the President’s Council of Advisors on Science & Technology (PCAST) issued a report to the President on Agricultural Preparedness and the Agriculture Research Enterprise. The PCAST report recognizes the long-term history of public investment in agricultural research. The report also recognized significant private investment into agricultural research. Significantly, the report is adamant that the agricultural research enterprise is not prepared to meet the challenges of the 21st century. The report cited two reasons:
- too little competitive research and
- an imbalance of research priorities between private and public funding sources.

As a framework regulation for innovation markets, the patent system needs to be tailored to the innovation process, which it is supposed to serve, and to the competitive environment, within which it must operate. In order to ensure an efficient functionality of the patent system as an innovation policy tool, patent rights ought to be defined, justified and continually reconsidered by reference to their socio-economic benefits and costs.
Sovereign states should retain the discretion to adopt a patent system that best suits their technological capabilities as well as their social, cultural and economic needs and priorities, with the proviso that …

The United States of America has a rich tradition in philanthropy. Originating with industry titans in the late nineteenth century and embraced by everyday citizens of today, nonprofit organizations benefit from individuals who volunteer their time, make financial contributions, or both. As evidence points to a new generation of donors who value volunteer involvement prior to making a financial gift, nonprofit organizations must employ specific strategies and tactics to cultivate their volunteers into financial supporters. Literature findings demonstrate that individuals are motivated to volunteer and give financially due to organizational efficacy, values, personal benefit, and reputation. Recognizing that Non-Governmental Organizations (NGOs) do not exist in isolation, this article seeks to analyze NGOs in South Africa who have the mission of addressing HIV/AIDS and how they impact, and are in turn affected, by the surrounding environment. Specific examples of this exchange are provided, along with an example of NGOs who are not best responding to the needs of the community. HIV/AIDS in South Africa is a prevailing public health issue. Background
Few studies have investigated vitamin D status in association with modifiable lifestyle factors and clinical characteristics among breast cancer patients, with no studies among Chinese women, who may be at higher risk of vitamin D deficiency. We aimed to evaluate circulating 25-hydroxyvitamin D (25(OH)D) levels in association with clinical and lifestyle factors among 1,940 Chinese breast cancer patients.
Methods
Participants included breast cancer cases aged 22–77 from a population-based case-control study conducted in Shanghai, China during 1996–1998 (n = 1,044) and 2002–2005 (n = 896). Circulating 25(OH)D levels were measured in plasma samples (95% collected ≤6 months post-diagnosis). Prevalence …

The purpose of this research was to measure university students' perceived risk of diabetes and self-reported diabetes risk factors. Informed consent forms and survey questionnaires were distributed to students in randomly sampled courses (n=357), with students aged 18 to 24. Out of the 357 surveys completed, 325 surveys were used for analysis of this study. Forty-eight percent of participants between ages 18 to 24 perceived themselves at minimal risk for developing type II diabetes. Moved To Move: Socially Contextualizing Women's Exercise Motivations, Dusti Rae Werner

Using qualitative data from 11 interviews with women who exercise regularly, this research explores women's motivations to exercise, how they make social comparisons and how they self-evaluate their bodies through the social context of gender, socio-economic status and race. Women with intrinsic motivations to exercise find more positive, long term outcomes than those with extrinsic motivations. Women compare themselves to similar others, such as their peers to form self-evaluations more readily than they do media images. Respondents also indicated the importance of relationships in beginning and maintaining exercise regimes.

The accuracy of disease metrics is dependent on the quality of population-based data. Many diseases, including diabetes, are age and sex dependant. Accurate age- and sexspecific population survey data, population estimates and projections are required to assess the scale and trends in the burden of these diseases. No assessment of the quality of population data being used in the UAE diabetes metrics has been published. Purpose: To determine factors associated with the development of stress fractures in female athletes.

Objective: Interventions utilizing vibration may increase bone mass and size which may reduce forearm fractures in children. This randomized controlled pilot trial tested the feasibility, compliance and efficacy of forearm loading regimes in an after-school program in pre-pubertal children aged 6-10 years. Methods: A 12-week randomized controlled trial incorporated high (HMMS; N=10) and low (LMMS; N=10) magnitude mechanical stimulation vibration, floor exercises (N=9), and controls (N=10). Radial bone measures by DXA and pQCT were compared at the end of intervention (12-weeks) and 4-months post-intervention (4- months post). This article examines efforts states are making to expand access to community-based services for elderly and disabled Medicaid beneficiaries and suggests several options that might improve such access nationally. Like much of Medicaid, Medicaid long term services and supports (LTSS) have developed through a complex process of accretion. Policymakers appear only rarely to have considered an overarching view of such services and the needs of those who require them. Rationalizing Medicaid LTSS will accordingly require not only additions but also substantial pruning, and may even warrant a reconsideration of who should have ultimate authority to develop and direct such services. …

Metabolic syndrome, diabetes and diabetes complications pose a growing medical challenge worldwide, accentuating the need of safe and effective strategies for their clinical management. Here we present preclinical evidence that the sorbitol derivative meglumine (N-methyl-D-glucamine) can safely protect against several features of metabolic syndrome and diabetes, as well as elicit enhancement in muscle stamina. Meglumine is a compound routinely used as an approved excipient to improve drug absorption that has not been ascribed any direct biological effects in vivo. Normal mice (SV129) administered 18 mM meglumine orally for six weeks did not display any gastrointestinal or other observable adverse effects, …

À partir de 1890, plusieurs revues de recettes de cuisine commencèrent à évoquer les habitudes culinaires des peuples colonisés. Les articles et recettes naviguèrent sans cesse entre deux pôles. Le plus puissant consistait à susciter une forme de dégoût chez le lecteur, fondant ainsi un sentiment d’altérité et de supériorité vis-à-vis de populations présentées comme primitives car mangeant du chien, des insectes ou des aliments avariés. Mais parallèlement, il existait un exotisme acceptable, non transgressif, lié à la consommation de fruits tropicaux ou de plats au curry, qui trouvèrent alors leur place dans la cuisine bourgeoise de l’entre-deux-guerres.

This paper shows that the use of child soldiers in armed conflict has the potential to be considered as genocide. A brief background of genocide is presented prior to the analysis. Part I of the analysis will discuss three issues: first, the modern understanding of genocide and the substantive areas of law that govern it; second, the definition of “child” within the international arena as it relates to child soldiering; third, a discussion to determine if children can constitute a “group” in the context of the law of genocide.

Cross Fit TM is a relatively new strength and conditioning program defined as “constantly varied, functional movements, performed at a high intensity”. The goal of the program is to increase “work capacity across broad time and modal domains” [1]. Methylmercury (MeHg) is a contaminant of global concern that bioaccumulates and bioamagnifies in marine food webs. Lower trophic level fauna are important conduits of MeHg from sediment and water to estuarine and coastal fish harvested for human consumption. However, the sources and pathways of MeHg to these coastal fisheries are poorly known particularly the potential for transfer of MeHg from the sediment to biotic compartments. Across a broad gradient of human land impacts, we analyzed MeHg concentrations in food webs at ten estuarine sites in the Northeast US (from the Hackensack Meadowlands, NJ to the Gulf of Maine). OBJECTIVE: To describe the etiology of hepatitis and identify occult hepatitis B virus (HBV) infection.
CLINICAL PRESENTATION AND INTERVENTION: A 40-year-old man presented with severe abdominal pain and jaundice, a history of acute HBV infection that had cleared as well as the use of acetaminophen, methamphetamine, buprenorphine and marijuana. He admitted to having had unprotected sex with multiple partners of both genders. A thorough skin examination revealed papulosquamous lesions on his penis, scrotum, upper and lower extremities and feet. Transaminases and bilirubin were elevated. His rapid plasma reagin was reactive, and hepatitis serologies showed occult HBV. Liver biopsy showed severe …

Children, adolescents, and women with disabilities experience the same sexual development, pubertal changes, concerns, and desire to reproduce as their typically developing counterparts. However, society has tended to stigmatize women with disabilities as "asexual" and ignore this aspect of their health care. These women are less likely to receive gynecological exams, contraception, and evaluation of sexual dysfunction. Unfortunately, having a disability places women at risk for sexual exploitation and abuse as well as sexually transmitted infections. Impact Of Gums On The Growth, Viability, And Enzyme Activity Of Lactobacillus Species, Bernice D. Karlton-Senaye

This study investigated the impact of ten selected gums (carrageenan, carrageenan-maltodextrin, guar, locust bean, pectin, pectin- dextrose, pectin-carrageenan, guar-locust bean-carrageenan, inulin, and xanthan) on the growth of eight Lactobacillus strains in laboratory media. The bacterial population for eight Lactobacillus strains was determined in modified basal media at different concentration (0%, 0.25% and 0.5% w/v) of gums stored up to 12 hours at 37 °C. Findings show significant differences (p < 0.05) between the treated and control sample. Guar was found to be the best gum to enhance growth of L. rhamnosus GG B101, L. rhamnosus GG B101, L. delbrueckii subsp. bulgaricus SD35, L. delbrueckii subsp. bulgaricus SD33, L. acidophilus SD 16, L. acidophilus EF7, L. reuteri DSM20016, L. reuteri CF2-2F during 12 hours of storage at 37 C in laboratory media. The population of L. rhamnosus GGB101 in the samples containing gums were significantly (p < 0.05) higher than the control without gums. Samples containing 0.5% gums showed slightly higher bacterial population than those with 0.25% of gum. A minimum of 12 hour of incubation period was shown to be adequate to reach a bacterial population of 6 log CFU/mL in the presence of gums. Addition of guar (0.5%) led to the highest (1.31 log CFU/mL) increase in population of the treated L. rhamnosus GGB101 over the control. There was no marked (p < 0.05) change in pH and titratable acidity. Four different gums (carrageenan, carrageenan-maltodextrin, pectin-carrageenan, guar-locust bean-carrageenan) were selected to determine the effect on the growth, viability and betagalactosidase activity of four selected Lactobacillus strains (L. rhamnosus GG B101, L. rhamnosus GG B101, L. reuteri DSM20016, L. reuteri CF2-2F). Effect of the four selected gums on thegrowth L. rhamnosus GG B101, L. rhamnosus GG B101, L. reuteri DSM20016 in milk were compared to those in modified basal media. Results showed that xanthan induced highest growth of L. rhamnosus GG B103, L. rhamnosus GG B101 in milk whereas carrageenanmaltodextrin led to highest growth of L. reuteri DSM 20016 in the media. Marked differences (p < 0.05) in viability were observed between milk samples containing gums and the control. The presence of carrageenan-maltodextrin led to the highest viable counts (8.76 ± 0.03 log CFU/mL) of L. rhamnosus GGB103 during storage. The average population of L. rhamnosus GGB101 and Lactobacillus rhamnosus GGB103 was 8 log CFU/mL, whereas that of Lactobacillus reuteri DSM20016 and Lactobacillus reuteri SD2112 decreased slightly ( 0.15-0.64 log CFU/mL) to 7 log CFU/mL during the storage period. Viable counts were retained at 7-8 log CFU with no significant difference in the control versus treated strains except in the presence of carrageenanmaltodex. Guar-locust bean-carrageenan led to significant (p < 0.05) highest levels of β-gal activity of L. rhamnosus GGB103 (1287 ± 4.24 Miller units/ mL) compared to the control (78 ± 2.83 Miller units/ mL). L. rhamnosus GG B101and L. rhamnosus GG B103 were the best strains to attain enhanced levels of β-galactosidase activity. This shows that the inclusion of carrageenan-maltodextrin and guar-locust bean-carrageenan in milk could improve growth, viability and achieve an enhanced level of β-galactosidase activity in L. rhamnosus GG B101 and L. rhamnosus GG B103. The information gleaned from this study could be used in the food industry to improve the quality of probiotic functional foods and thereby contribute to the alleviation of lactose malabsorption.

Existing scholarship on self-concept and its relevance to personal agency in the classroom does not incorporate the lived experiences of African American middle school boys. Today, in the United States, only 10% of 8th grade African American boys can read proficiently (Holzman, 2011). Oneota migration into the central Illinois River valley around ad 1300 resulted in a number of different interactions with Mississippian groups. Milner and colleagues (1991) identified significant numbers of perimortem injuries at the Norris farms 36 cemetery, along with biological markers for poor health, such as cribra orbitalia and porotic hyperostosis. They suggested that the threat of violence may have forced the Oneonta at Morton village to limit subsistence activities to circumscribed areas close to the settlement, thereby reducing the resource base and negatively impacting the health of the community. This research examines student food insecurity at Bowling Green State University (BGSU) and available resources in Bowling Green, Ohio. Seven classes from BGSU’s main campus were randomly chosen to complete a survey regarding participant background information, details concerning food attainment, food security level, and use of community resources to allow for food acquisition. These classes included undergraduate classes and ranged from 15 to 272 students per class. Less than one quarter of student participants had food insecurity (19%), and food insecurity was significantly associated with financial dependence (P=0.04).
