Resolving The Original Sin Of Bolling V. Sharpe, Gregory Dolin Jan 2014

Resolving The Original Sin Of Bolling V. Sharpe, Gregory Dolin

All Faculty Scholarship

On May 17, 1954 the Supreme Court handed down two decisions that for the first time categorically held that racial segregation in public schools was per se unlawful – Brown v. Board of Education and Bolling v. Sharpe. Ostensibly, both cases dealt with a same question; however, in Brown the entity accused of discrimination was a creature of the State of Kansas, while in Bolling the discrimination was practiced by the federal government. The problem that the Supreme Court faced was the language of the Fourteenth Amendment, which, by its own terms, guaranteed “equal protection of the laws” only vis-à-vis …

Crime? No, It Wasn't Really Crime': Using Oral History And Memoirs To Teach Crime History, Rosalind Watkiss-Singleton Jan 2014

Crime? No, It Wasn't Really Crime': Using Oral History And Memoirs To Teach Crime History, Rosalind Watkiss-Singleton

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

This article suggests that oral interviews, autobiographies and memoirs provide a new perspective on the teaching of crime history. Oral testimony can augment the traditional sources which are generally used for this purpose, giving fresh insights into popular attitudes to criminal activities and behaviour. Through the use of interviews, either student-generated or culled from existing oral history archives, the words and opinions of the perpetrators, victims and the general public will allow students and lecturers to supplement existing evidence in a way which will enhance both their critical understanding of behavioural patterns and developments within society. Student motivation may be …

Outrageous Violations: Enabling Students To Interpret Nineteenth Century Newspaper Reports Of Sexual Assault And Rape, Kim Stevenson Jan 2014

Outrageous Violations: Enabling Students To Interpret Nineteenth Century Newspaper Reports Of Sexual Assault And Rape, Kim Stevenson

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

This article is divided into two parts: the first highlights some of the difficulties and limitations for students and tutors who wish to explore the historiography of rape and sexual assault. In particular it addresses the problematic issue of accessing and interpreting the official records of such proceedings in the criminal courts. As an alternative it is suggested that nineteenth century newspaper reports written by professional lawyer-reporters can provide an effective substitute and can be justified as a primary research source. The second part offers a series of four case studies of sexual assaults as reported in The Times newspaper …

Smedley D. Butler And The Militarisation Of The Philadelphia Police, 1924-1925, Ellen Leichtman Jan 2014

Smedley D. Butler And The Militarisation Of The Philadelphia Police, 1924-1925, Ellen Leichtman

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

The importance of the military as a police model in the U.S. had been eliminated, for the most part, from criminal justice and police studies until the 1980s-1990s, even as the professional model was studied extensively. The military, however, had been a strong presence since at least the turn of the last century. As reformers from that time began to fight against machine rule in city after city, they often adopted the military paradigm as their police model, and sought those with military backgrounds to head police departments. The new mayor of Philadelphia chose a Marine Brigadier General, Smedley D. …

The Prisoners' Counsel Act 1836: Doctrine, Advocacy And The Criminal Trial, Cerian Charlotte Griffiths Jan 2014

The Prisoners' Counsel Act 1836: Doctrine, Advocacy And The Criminal Trial, Cerian Charlotte Griffiths

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

In recent years greater numbers of thinkers have considered the Prisoners' Counsel Act 1836 but have viewed the Act through the lens of Whig history, as a further manifestation of the modernisation of criminal justice in the inevitable march towards adversarialism. This article addresses how the Act has been understood within broader literature concerning the nineteenth century felony trial. In particular, greater attention is paid to how counsel reacted to the Act, considering the nature of the contemporary Bar, the apparent silence from the Bar in reaction to the Act, what evidence might be drawn upon to gauge how members …

Empathy Or Entertainment? The Form And Function Of Violent Crime Narratives In Early-Nineteenth Century Broadsides, Kate Bates Jan 2014

Empathy Or Entertainment? The Form And Function Of Violent Crime Narratives In Early-Nineteenth Century Broadsides, Kate Bates

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

This article will explore the meaning and morality of popular accounts of violent crime in early-nineteenth century broadsides. Broadsides were a form of street literature and, for almost 300 years until the latter half of the nineteenth century, they were a forerunner to our modern tabloid newspapers. These flimsy sheets were published on a wide range of topics, but by far the most prevalent were those covering violent crime, especially murder. The publication of these broadsides reached a peak in the first half of the nineteenth century and their popular appeal was greatest among the labouring poor. This has led …

Our Free Society Is Worthy Of Better': Caryl Chessman, Capital Punishment, And Cold War Culture, David Ruth Jan 2014

Our Free Society Is Worthy Of Better': Caryl Chessman, Capital Punishment, And Cold War Culture, David Ruth

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

Convict author Caryl Chessman was the focus of international attention from 1954 until his 1960 execution at San Quentin. Americans used Chessman to articulate understandings about themselves, their society, and their place in the world. Many used the case to comment on new understandings of behaviour and its modifiability, the apparent post-war rise in juvenile delinquency, and the prospects for individual autonomy in an increasingly conformist society. Cold War concerns profoundly shaped the discourse about Chessman. For some activists, global save-Chessman sentiment pointed to the possibility of transcending bitter international divisions. Execution opponents believed commutation would highlight the progressive social …

Just Water: A Feminist Catholic Response To The Commodification Of Water, Rachel Noelle Hart Winter Jan 2014

Just Water: A Feminist Catholic Response To The Commodification Of Water, Rachel Noelle Hart Winter

Dissertations

Any Catholic ecological ethic today that does not focus sustained attention to our worldwide water crisis is inadequate, for it fails to engage one of today's core social justice violations and neglects to offer any moral guidance for one of the human family's most pressing challenges. A responsible Catholic approach to water justice that addresses the problems stemming from a commodified view of water must be informed by ecofeminist concerns and by the Catholic social justice tradition of moral reasoning. As populations grow and water sources run dry, access to water has become a pressing ethical issue. Today, nearly one …

Host Entry Factors For Human Coronaviruses, Taylor Heald-Sargent Jan 2014

Host Entry Factors For Human Coronaviruses, Taylor Heald-Sargent

Dissertations

Coronaviruses infect a diverse range of animals from birds to pigs and cats to humans. Coronaviruses employ RNA-based replicative processes and as such are genetically adaptable to acquire novel host ranges. A coronavirus from one species can jump to another by shifting its entry requirements. As we learned from the Severe Acute Respiratory Syndrome (SARS) pandemic, this shift in species can have detrimental consequences. Thus, it is imperative that we understand the virus-host interaction during the entry process.

This dissertation focuses on host entry factors that influence human coronavirus entry. Recently, a new class of proteases, the type II transmembrane …

'We're Not Little Babies Anymore': A Cultural History Of Small Girls In America, 1920-1945, Stella A. Ress Jan 2014

'We're Not Little Babies Anymore': A Cultural History Of Small Girls In America, 1920-1945, Stella A. Ress

Dissertations

The appearance of high-profile girl characters in popular culture media of all types soared between the years from 1924, when Little Orphan Annie first appeared in the comic section of newspapers, to 1945, when teenage girls replaced their younger sisters in the spotlight. As such, girl culture of the 1920s through the 1940s experienced a boon in popularity never before witnessed. And yet, despite substantial evidence that point to the impact preadolescent girls had on society during this time, surprisingly scholars have left the experiences of these girls and their depictions in popular entertainment unexplored. For historians, this raises a …

Examining The Words And Actions Superintendents Used To Lead An Educational System Through A Culture Shift Following The Occurrence Of A Scandalous Critical Incident, Dale Ross Fisher

Dissertations

The dissertation examines the words and actions district superintendents used to lead an educational system through a culture shift following the occurrence of a scandalous critical incident. This qualitative study deeply investigated the specific words and actions as offered by the superintendents of two educational systems and members of their respective leadership teams. Those actions were then filtered through two lenses. The first lens was John Kotter's eight steps for change, and the second lens was Thomas Sergiovanni's five sources of authority. The study generated five themes of specific actions taken by the superintendents, determined that four of Kotter's eight …

Identifying Novel Factors Involved In Biofilm Formation By Vibrio Fischeri, Valerie Ray Jan 2014

Identifying Novel Factors Involved In Biofilm Formation By Vibrio Fischeri, Valerie Ray

Dissertations

Biofilm formation by bacteria provides them with a means to survive harsh environmental conditions and promote colonization of a particular surface (biotic or abiotic). Due to the resistance properties of biofilms, biofilm-forming bacteria are difficult to treat in the context of host infections. Thus, investigating the processes that control biofilm formation will promote the development of novel therapeutics. To study biofilm formation in the context of a host, I utilized as a model system the marine bacterium Vibrio fischeri, which must be competent to form a biofilm to colonize its squid host Euprymna scolopes. Biofilm formation by V. fischeri requires …

Mutations In Phospholamban Alter The Structure And Function Of The Calcium Atpase Regulatory Complex, Neha Abrol Jan 2014

Mutations In Phospholamban Alter The Structure And Function Of The Calcium Atpase Regulatory Complex, Neha Abrol

Dissertations

Phospholamban (PLB) is an integral membrane protein that plays an important role in regulation of cardiac calcium handling and contractility. PLB exists as a homopentamer in the membrane, which upon deoligomerization into active monomers reversibly inhibits sarco/endoplasmic reticulum calcium ATPase (SERCA). Mutations in PLB that change the PLB monomer-pentamer equilibrium result in dysregulation of SERCA. To determine the structural and regulatory role of the C-terminal residues of PLB in the membranes of living cells, we fused fluorescent protein tags to PLB and SERCA. We then studied the effect of C-terminal alanine substitutions and truncation mutations on PLB oligomerization and SERCA …

The Role Of Spirituality/Religion As A Coping Mechanism During Treatment For Disordered Eating, David Franczyk Jan 2014

The Role Of Spirituality/Religion As A Coping Mechanism During Treatment For Disordered Eating, David Franczyk

Dissertations

The purpose of this study was to investigate the role of spirituality/religion used as a coping mechanism during treatment for disordered eating. Given the mixed outcome results of current therapeutic and pharmacological treatment methods for disordered eating, it is important to investigate other factors which may influence the treatment process. This study evaluated the role of spirituality/religion used as a coping mechanism among 61 patients who were admitted into an eating disorder treatment program and then discharged over a period of 15 months. In this quantitative study, the Brief RCOPE measure was self-administered at admission to determine the levels of …

Investigation Of Pharmaceutical Mass Transfer Phenomena Using Molecular Dynamics Simulations, Yi Gao Jan 2014

Investigation Of Pharmaceutical Mass Transfer Phenomena Using Molecular Dynamics Simulations, Yi Gao

Dissertations

Molecular dynamics (MD) simulation has been widely used in understanding the physical basis of the structure and function of biological macromolecules. However, its application in pharmaceutical research is still at an early stage. This dissertation attempts to establish the use of MD simulation in studying several important pharmaceutical mass transfer processes. The three-series study included (1) the understanding of drug crystal dissolution at molecular level, (2) the elucidation of an unique mechanism for facile polymorphic transformation of crystalline drugs in solutions, and (3) the determination of drug-polymer interactions at water-crystal interface and the implications to crystallization inhibition.

A drug crystal …

Identification And Analysis Of Omentum Derived Suppressor Cells In Regards To Th17 Inhibition, Nick Huang Jan 2014

Identification And Analysis Of Omentum Derived Suppressor Cells In Regards To Th17 Inhibition, Nick Huang

Dissertations

Omentum has been harnessed by surgeons for hundreds of years, providing an ideal environment for graft healing and acceptance. However, little is known about the cellular mechanisms that promote the tolergenic environment of the omentum. We examined the cellular composition and role of activated omentum in regards to T-cell immunomodulation. We then tested activated omentum as a cellular therapy in a mouse allogenic lung transplantation model.

Our findings demonstrated activated omentum is mostly comprised of non-hematopoietic cells resembling mesenchymal stem-like cells (MSCs) and myeloid derived suppressor cells (MDSCs). Activated omentum exhibited anti-inflammatory properties through suppression of Th1 and Th17, while …

There's A Place For Us: How Ethnic Identities Are Revealed In Ethnic-Specific Organizations, Crystal Jackson Jan 2014

There's A Place For Us: How Ethnic Identities Are Revealed In Ethnic-Specific Organizations, Crystal Jackson

Dissertations

Ethnic-specific organizations have long been features of American society. Historically, they have provided ethnic actors with

a means of preserving culture and history. They have also been sites where collective interests are pursued. In this dissertation I study two ethnic-specific organizations. Using identity, incorporation and

inequality, as essential dimensions of American ethnicity, I describe how the political and civic work that occurs in two organizations reveals

group boundaries.

My data and analysis support three major findings. First, I find

that the identities that emerge from this kind of organizational work are transactional identities. Transactional identities are identities that are confirmed …

Toward The Development Of Roman Catholic Teaching About Contraception In Light Of The Experience Of South Korean Catholic Women, Taeeun Kim Jan 2014

Toward The Development Of Roman Catholic Teaching About Contraception In Light Of The Experience Of South Korean Catholic Women, Taeeun Kim

Dissertations

In recent decades, the morality of artificial contraception has been hotly debated in the Roman Catholic Church. Many theologians and ethicists have challenged the hierarchical church teachings in the last fifty years. The opening chapter of the dissertation reviews Catholic Church teachings on birth control throughout history, and in Chapter Two I explore the theo-ethical reflections on artificial contraception from two different approaches (traditionalist and revisionist) and support the revisionists' perspectives, findings, and arguments. Then, in order to lay the context for my interpretations of my ethnographic interviews with ten participants, in Chapter Three I explore South Korean sexual culture …

Pirates Of Romanticism: Intellectual Property Ideology And The Birth Of British Romanticism, Jason Isaac Kolkey Jan 2014

Pirates Of Romanticism: Intellectual Property Ideology And The Birth Of British Romanticism, Jason Isaac Kolkey

Dissertations

This dissertation traces the role of unauthorized publication in the posthumous construction of British Romanticism as a literary movement. It argues that Romantic ideology emerged from conflicting claims about the nature of intellectual property and the circulation of political and artistic ideas, apparent in the texts and paratexts of pirated books. I examine how these disputes play out in reprints of the works by Percy Bysshe Shelley and Robert Southey that became cornerstones of radical culture. The dissertation goes on to discuss how the underground economy of literary piracy affected Sir Walter Scott and Lord Byron's publication strategies, the significance …

Master's Students' Experiences In A Graduate Preparation Program: Multicultural Competency And Social Justice Curriculum, Kristin I. Mccann

Dissertations

This dissertation study focused on master's students experiences with multicultural competency curriculum in graduate preparation programs (GPPs) and contributes to gaps in the extant literature on multicultural issues in higher education. The two overarching research questions for the study considered how, if at all, students' understanding of core concepts of the required course (privilege, oppression, and social justice) changed over time as evidenced by a primary curricular component called the photo elicitation project. Educators' experiences were also addressed, per their impact on the context in which students learned. This study employed a qualitative approach and, in line with the study's …

Internalization Of Race Messages Among Mixed Race Individuals, Jennifer Moulton Jan 2014

Internalization Of Race Messages Among Mixed Race Individuals, Jennifer Moulton

Dissertations

The present study used grounded theory qualitative methodology to explore mixed race individuals' experiences within specific racial socialization contexts of family, friends, community, and society, to identify messages received within these contexts. How messages influence both their understandings of mixed race identity and how they racially identify themselves was also examined. Mixed race identity development was found to follow an ecological framework, in which racial socialization messages serve as a mechanism through which experiences within contexts may be interpreted, to then inform conceptions of racial identity and identification choices. Common themes of experiences emerged within contexts, including disownments/disapproval, sibling differences, …

The Ethics Of Vision And Black Theology And Experience, Angelo Sylvester Riley Jan 2014

The Ethics Of Vision And Black Theology And Experience, Angelo Sylvester Riley

Dissertations

To this day, philosophical ethics and dominant discussions in Christian ethics have paid insufficient attention to how vision shapes the moral life. Too much focus is given to moral decision-making and action, while too little focus is given to the way vision and patterns of attentiveness ground our capacities for genuine morally responsible action. Therefore, in this study, I draw on important works in philosophical and Christian ethics to examine both the ethics of responsibility and the central role that an ethics of vision plays in our attempts to live responsibly. I use the "ethics of vision" as method and …
