Legal Formalism, Procedural Principles, And Judicial Constraint In American Adjudication, Christopher J. Peters
Legal Formalism, Procedural Principles, And Judicial Constraint In American Adjudication, Christopher J. Peters
All Faculty Scholarship
American proponents of legal formalism, such as Supreme Court Justice
Antonin Scalia, worry (quite reasonably) that unfettered judicial discretion
poses a threat to democratic legitimacy, and they offer formalism – the mechanical
implementation of determinate legal rules – as a solution to this threat. I argue
here, however, that formalist interpretive techniques are neither sufficient nor
necessary to impose meaningful constraint on judges. Both the text and the
“original meaning” of legal rules are endemically under determinate, leaving much
room for judicial discretion in the decision of cases. But meaningful judicial
constraint can and does flow from other sources in …

Why do we care about morphological complexity?
-
Typologically languages vary in how many morphosyntactic properties they express; morphological systems can have a large number of inflection classes, morphological distinguishers (e.g. exponents) to express these properties

The Identification Of Variables And Factors Related To Preservice Teacher Candidates’ Passing A State Teacher Certification Examination At An Hbcu, Melanie Frizzell, Noran L. Moffett
Georgia Educational Research Association Conference
This study sought to examine the outcome of teacher education candidates’ performance on a state content exam. Seventeen participants from the class of 2012 were identified for the study of which 12 participants fully participated in the study. This study utilized data collected from the participants through the Teacher Quality Enhancement Subcontract Grant Summer/Fall/Spring 2011-2012 Workshop Series held at the private HBCU. The research design used a QUAN- QUAL-QUAN to triangulate the data through three methods of data collection: GACE early childhood education (ECE) data, GACE ECE survey questionnaire and class of 2012 member interviews. The findings from the survey …
Today's Dream Keepers: Exploring The Personal And Professional Beliefs Of Teachers Who Successfully Provide Literacy Instruction To African American Males In Grades 3-5, Lateshia Warren
Georgia Educational Research Association Conference
The purpose of this study was to describe the personal and professional beliefs of teachers who were successful with providing literacy instruction to elementary school African American males in a Title I elementary school. This study examined the literacy practices of teachers and their beliefs about African American males. It also investigated their use of culturally relevant teaching practices. It was hypothesized that by exploring the beliefs and practices of successful teachers with African American males, this research could provide evidence of effective strategies, which could be used to impact the literacy achievement of African American males. A qualitative case …

A Comparison Of Student Achievement In The Second Language Acquisition Of Spanish In Both Total Online And Traditional College Level Courses, Vanessa P. F. Crump
Georgia Educational Research Association Conference
This quantitative, comparable study examined student achievement in online and traditional on-campus college level courses in SPAN 1001 and SPAN 1002 through an ex-post facto model of study. This area of study yielded little research and provided a unique view into course achievement. In this particular study, there were two types of final exams examined, the final oral exam and the final written exam. The study took place at a two-year college in middle Georgia. The student population included college level students that enrolled in the courses over a six-semester period. The students varied in age, previous foreign language background, …

The Meme Of Voter Fraud, Atiba R. Ellis
The Meme Of Voter Fraud, Atiba R. Ellis
Catholic University Law Review
The meme of voter fraud is the idea that unworthy voters are attacking the electoral system by voting fraudulently through impersonation or other bad acts. Although scholars of election law aptly demonstrate that the meme is a myth, the meme nonetheless endures as a rationale for the continued passage of heightened voter regulations like voter identification laws. Scholarship critiquing the voter fraud meme relies on partisanship as the prime explanation for voter fraud arguments. This explanation is incomplete in light of the fact that proponents of the myth continue to believe it on an ideological level even when the lack …

The Effect Of Social Media On Public Awareness And Extra-Judicial Effects: The Gay Marriage Cases And Litigating For New Rights, Sarahfina Aubrey Peterson
The Effect Of Social Media On Public Awareness And Extra-Judicial Effects: The Gay Marriage Cases And Litigating For New Rights, Sarahfina Aubrey Peterson
Dissertations and Theses
When the Supreme Court grants new rights, public awareness is a crucial part of enforcement. Gerald N. Rosenberg and Michael J. Klarman famously criticized minority rights organizations for attempting to gain new rights through the judiciary. The crux of their argument relied heavily on the American media's scanty coverage of Court issues and subsequent low public awareness of Court cases. Using the 2013 United States v. Windsor and Hollingsworth v. Perry rulings as a case study, I suggest that the media environment has changed so much since Rosenberg and Klarman were writing that their theories warrant reconsideration. Minority rights groups …

Nepalis To El Norte: Questions For The Emerging Trend Of Nepali Migration To The United States Via Latin America, Andrew Nelson
Nepalis To El Norte: Questions For The Emerging Trend Of Nepali Migration To The United States Via Latin America, Andrew Nelson
Himalayan Policy Research Conference
In this paper, I explore the research possibilities for a relatively unknown yet growing phenomenon of Nepali migratory routes to the United States via Latin America. While it is no secret that Nepalis are increasingly entering into foreign labor migration schemes that contribute to nearly one-quarter of the country’s GDP, these routes tend to be limited to Asian parts of the world, such as India, the Arabian Gulf, Malaysia, South Korea and Japan. Although labor migration of Nepalis to the United States has existed for some time, it has tended to be based on plane travel via tourist, student, employment …
The Predicament Of The Tamangs In Search Of Identity, Gayatri Bhattacharyya
The Predicament Of The Tamangs In Search Of Identity, Gayatri Bhattacharyya
Himalayan Policy Research Conference
It is in the frame of recent nation-centric politics – in patterns of ethnic (caste/tribe/religion/language) strategizing common to greater South Asia – that pan-Himalayan Tamang identity begins to be more forcefully asserted in Nepal and India. To examine the nature of formation and assertion of Tamang identity is to revisit the debate over the relationship of ethnicity, identity politics, religion and other aspects of culture in defining and redefining the nature of communities in the South-Asian nation-states. In the history of modern India as in other parts of greater South Asia, the concept and reality of ‘nation’ has acquired very …

Gate Keeping And The Politics Of Access To Prisons: Implications For Qualitative Prison Research, Janani Umamaheswar
Qualitative Criminology (QC)
"In this article, I draw on and contribute to existing literature on reflexivity and access in qualitative research, specifically in the context of prison research. I do this through a critical discussion of the research process involved in conducting a study on women prisoners in the U.S. In addition to describing the obstacles I faced in gaining access to a research site in which to conduct the study, I also discuss the implications of gate keeping for knowledge produced about women prisoners. Finally, I build on Bosworth et al.’s (2005) discussion of prison research using communication by mail. I argue …

Toying With Fantasy: The Postmodern Playground Of Terry Pratchett's Discworld Novels, Daniel Luthi
Toying With Fantasy: The Postmodern Playground Of Terry Pratchett's Discworld Novels, Daniel Luthi
Mythlore: A Journal of J.R.R. Tolkien, C.S. Lewis, Charles Williams, and Mythopoeic Literature
Attempts to discover exactly how Terry Pratchett manages to get away with violating the rules of the fantasy tradition laid out in Tolkien’s “On Fairy-stories.” Pratchett consistently revels in the absurdity of Discworld as a concept, breaks the fourth wall, and disrupts Tolkien’s proviso against satirizing magic itself; and yet the Discworld sails on, imperturbable. Pratchett’s concept of narrative imperative is discussed as one of the keys to the success of his invented world.

Who Is A Jew?: Reflections On History, Religion, And Culture, Leonard Greenspoon
Who Is A Jew?: Reflections On History, Religion, And Culture, Leonard Greenspoon
Studies in Jewish Civilization
Jewish identity is a perennial concern, as Jews seek to define the major features and categories of those who “belong,” while at the same time draw distinctions between individuals and groups on the “inside” and those on the “outside.” From a variety of perspectives, scholarly as well as confessional, there is intense interest among non-Jewish and Jewish commentators alike in the basic question, “Who is a Jew?”
This collection of articles draws diverse historical, cultural, and religious insights from scholars who represent a wide range of academic and theological disciplines. Some of the authors directly address the issue of Jewish …

Cults Of Lovecraft: The Impact Of H.P. Lovecraft's Fiction On Contemporary Occult Practices, John Engle
Mythlore: A Journal of J.R.R. Tolkien, C.S. Lewis, Charles Williams, and Mythopoeic Literature
Examines a particularly troubling use of fiction: the adoption of an author’s work, against his own intentions, as a quasi-religious text for cultic practices. Lovecraft’s mythos is thus observed in the process of deliberately being made into a worship tradition by occult and Satanic practitioners, in spite of the author’s personal scientific rationalism.

From Too Little To Too Much: Sorting Through The Online Resource Environment In Education, Nathalie Carrier, Jacqueline Sohn, Limin Jao, Saira Shah
Journal of Educational Research and Practice
The Internet is considered to be one of the most important mechanisms for sharing research (Chavkin & Chavkin, 2008), raising questions about the scope and variety of research-based education resources available online. Whereas years ago, the challenge for educators was to find relevant research information for practice, this challenge has shifted to one of sorting through the “infoglut” (Edmunds & Morris, 2000), or the abundance of information claiming to be grounded in research, and being able to judge which resources are most valuable and reliable. Drawing on scholarship that seeks to mobilize evidence between researchers, practitioners, and policymakers (Levin, 2011), …

Background:
Because of the deceased donor organ shortage, more kidney patients are considering whether to receive kidneys from family and friends, a process called living donor kidney transplantation (LDKT). Although Blacks and Hispanics are 3.4 and 1.5 times more likely, respectively, to develop end stage renal disease (ESRD) than Whites, they are less likely to receive LDKTs. To address this disparity, a new randomized controlled trial (RCT) will assess whether Black, Hispanic, and White transplant patients’ knowledge, readiness to pursue LDKT, and receipt of LDKTs can be increased when they participate in the Your Path to Transplant (YPT) computer-tailored …
