Textual data—from manuscripts to publications to website content—contains much of extant human knowledge. Unfortunately, the ability to harvest and effectively use this information beyond simple search/retrieval is greatly hampered by the scale of the “reading” problem: there is too much for any one person to read, and computers are not entirely adept at comprehending all information—explicit and implicit—contained in natural language text. Developing increased capability in this area is the focus of ongoing “machine reading” and “reading the web” research initiatives. Interested parties include businesses, the military, and intelligence-gathering agencies. Our own ongoing work with the Church Family History Department’s …

Help-Seeking Attitudes In India: The Role Of Religion, Intergroup Anxiety, Collective Self-Esteem, & Emotional Intelligence, Ashlee M. Beck
Masters Theses
The present study examined religious differences in help-seeking attitudes, intergroup anxiety, collective self-esteem, and emotional intelligence in Hindus and non-Hindus in India. Data were collected from 55 participants, who were predominantly students at either University of Mumbai or St. John's College Agra. Of these participants, 38 were Hindu and 17 were non-Hindu. Participants completed a demographic questionnaire, the Inventory of Attitudes Toward Seeking Mental Health Services, the Intergroup Anxiety Scale, the Collective Self-Esteem Scale, and the Schutte Self-Report Emotional Intelligence Test. Statistical analyses were computed using t tests for independent means, correlational analyses, and descriptive statistics. The results of these …
Placement Of Ell Students In Writing Classrooms: Perceptions, Implications, And Suggestions, Soha Youssef
Placement Of Ell Students In Writing Classrooms: Perceptions, Implications, And Suggestions, Soha Youssef
Masters Theses
This study is a mixed methods approach to exploring English Language Learners' (ELL) perceptions about their placement in either ESL sections of first-year composition courses at a two-year college or mainstreamed sections at a four-year college. After conducting case studies of five students in both types of programs and interviewing the directors of each program, it is evident that students' affects influence their perceptions about placement. This study suggests the need for ELL students' inclusion in their placement decisions.
Reuniting Old Allies: A Case For Creative Composition, Stephen M. Jefferies
Reuniting Old Allies: A Case For Creative Composition, Stephen M. Jefferies
Masters Theses
Since the split between creative writing and composition that largely occurred in the late 1920s, the two departments have wrestled with boundaries that have defined and challenged both courses. Despite the occasionally contentious relationship between creative writing and composition/rhetoric scholars, the two disciplines have served as strong allies in the past. "Reuniting Old Allies" argues that returning to such an alliance could provide a fruitful, blended approach to writing.
This thesis traces the history of this schism from Aristotle to the modern English department, attempting to reconcile the two departments with a middle-ground approach called critical-creative composition that emphasizes the …
Major Structural Relationships: A Survey Of Origins, Development, Classifications, And Assessment, Fredrick J. Long
Major Structural Relationships: A Survey Of Origins, Development, Classifications, And Assessment, Fredrick J. Long
The Journal of Inductive Biblical Studies
A central feature to Inductive Bible Study (IBS) are Major Structural Relationships (MSRs), despite some variation in the number, identification, descriptions, and organization of them. These relationships are endemic to human communication; hence, their description is vital for accurate and holistic observation of biblical materials. The origin of MSRs is traceable to the 19th century art instruction of John Ruskin. He himself was aware that his insights into composition extended beyond artistic to musical and literary composition. Practitioners of IBS have continued to develop and describe rigorously methodologies surrounding the identification of MSRs, especially at Asbury Theological Seminary. A survey …

Sociorhetorical Interpretation (Sri) And Inductive Bible Study (Ibs): Outlines Of Mark, The Lord’S Prayer, And The Son’S Prayer In John 17, Vernon K. Robbins
The Journal of Inductive Biblical Studies
There are many things in common between Inductive Bible Study (IBS) and Sociorhetorical Interpretation (SRI) as I practice it in the context of the Rhetoric of Religious Antiquity (RRA) project.1 Many of the similarities are a result of detailed focus on texts. The multiple strategies of interpreting both the inner texture and the intertexture of texts in SRI share much in common with IBS. As a result, many of the strategies of analysis and interpretation in the sections on “Observing and Asking” and “Answering or Interpreting”2 in particular are highly congenial with or naturally integral to SRI.
Continuity And Change In A 19th Century Illustrated Devi Mahatmya Manuscript From Nepal, Katherine Smith
Continuity And Change In A 19th Century Illustrated Devi Mahatmya Manuscript From Nepal, Katherine Smith
Theses and Dissertations
In the Hindu tradition of the Indian subcontinent, worship of the goddess has long been practiced as supreme embodiment of the divine. Around the second century, a Sanskrit Purana (ancient Hindu text that extols deities) titled the Markandeya Purana details the battles of the supreme Goddess Durga against the illusions and negative energy in the universe. This textual version of the Devi Mahatmya “Praise of the Goddess” serves as the foundation for the nineteenth century Nepalese illustrated Devi Mahatmya, commissioned by Tej Bahadur Rana from Pokhara district in Nepal. Because the folios closely follow the textual Devi Mahatmya, …
Quality Of Life In Emerging Adults With Autism Spectrum Disorder, Staci Carr
Quality Of Life In Emerging Adults With Autism Spectrum Disorder, Staci Carr
Theses and Dissertations
This study is focused on exploring quality of life in young adults in the autism spectrum and the factors that contribute to their own perception of satisfaction with their lives. Autism Spectrum Disorder is a neurodevelopmental disability that is associated with deficits in social interaction and communication and with restricted and repetitive behaviors (American Psychiatric Association, 2013). There has been a documented increase in the diagnosis of Autism Spectrum Disorders (ASD), making it to be one of the fastest growing diagnosed disabilities in children (Hartley-McAndrew, 2014). In the United States, the prevalence of ASD is approximately 1 in 68 children, …
Examining The Sensory Characteristics Of Preschool Children With Retentive Fecal Incontinence, Isabelle Beaudry-Bellefeuille
Examining The Sensory Characteristics Of Preschool Children With Retentive Fecal Incontinence, Isabelle Beaudry-Bellefeuille
Theses and Dissertations
Occupational therapists are concerned with individuals´ abilities to engage in daily occupations. When a daily activity such as bowel management is problematic, participation in key occupations can be limited. Retentive fecal incontinence is a common disorder in children. Behavior seems to be partly responsible for this condition. Occupational therapists have hypothesized that some behaviors could be related to sensory over-responsivity. This study investigated the relationship between retentive fecal incontinence and sensory over-responsivity and examined the Toileting Habit Profile Questionnaire, a tool designed to screen for toileting difficulties. The study showed that a group of children (n=16) with retentive fecal incontinence …
Language Skills In Incarcerated Young Offenders: Links With Offending Severity, Pamela Snow
Language Skills In Incarcerated Young Offenders: Links With Offending Severity, Pamela Snow
Language as a Social Justice Issue Conference
Oral language competence (i.e. skills with verbal expression and auditory comprehension) underpins and emerges out of, early social-emotional relationships, and forms the basis of the transition to literacy in early childhood. Some outcomes of suboptimal language development in the early years include difficulties forming and maintaining interpersonal relationships, and identifying and understanding affective states of others. This paper presents findings from a study of 100 incarcerated young male offenders in Victoria, Australia. We sought to determine the prevalence of language impairment in this very high-risk group, and also examined correlates of language impairment that could act as early intervention levers, …

Plotinus: The First Philosopher Of The Unconscious, John Shannon Hendrix
Plotinus: The First Philosopher Of The Unconscious, John Shannon Hendrix
Architecture, Art, and Historic Preservation Faculty Publications
Plotinus is sometimes referred to as “the first philosopher of the unconscious.” In his 1960 essay “Consciousness and Unconsciousness in Plotinus,” Hans Rudolph Schwyzer called Plotinus “the discoverer of the unconscious.” What exactly was Plotinus’ unconscious? In the Enneads, Plotinus asks about soul and intellect: “Why then…do we not consciously grasp them…? For not everything which is in the soul is immediately perceptible” (V.1.12.1–15).[i] In the De anima of Aristotle, “Mind does not think intermittently” (430a10–25).[ii]We cannot remember eternal mind in us, because passive mind is perishable. Is the productive or active intelligence in our mind …

Charter Values And Administrative Justice, Lorne Sossin, Mark Friedman
Charter Values And Administrative Justice, Lorne Sossin, Mark Friedman
Osgoode Legal Studies Research Paper Series
What would the Charter of Rights and Freedoms have looked like if it had been designed for administrative justice? This is a question underlying this study. Ever since the Canadian Supreme Court made clear in Slaight Communications that discretionary decisions of public officials were to be subject to the Charter of Rights and Freedoms, and expanded the reach of the Charter to most adjudicative tribunals, the Court has wrestled with the coherence of the relationship between the Charter and administrative justice. The Court attempted to synthesize its position and chart a new path forward beyond a traditional application of the …
Tort Law For Cynics, Dan Priel
Tort Law For Cynics, Dan Priel
Osgoode Legal Studies Research Paper Series
Various tort scholars have in recent years come to the defence of a ‘traditional’ or ‘idealist’ view of tort law. In the context of negligence this view implies that having a duty of care means that the law considers violating this duty as something that the duty-holder must make an effort not to do. Idealists contrast this view with a ‘cynical’ view according to which having a duty of care implies a legal requirement to pay damages for breach of the duty of care. In this essay I defend the cynical view against its critics. Descriptively, I argue that the …
Equally Recognized? The Indigenous Peoples Of Newfoundland And Labrador, Sébastien Grammond
Equally Recognized? The Indigenous Peoples Of Newfoundland And Labrador, Sébastien Grammond
Osgoode Legal Studies Research Paper Series
In Canada, certain indigenous groups are struggling to obtain official recognition of their status and rights. This is particularly so in Newfoundland and Labrador, where the authorities took the stance, when the province joined Canada in 1949, that no one would be legally considered indigenous. This paper analyzes the claims of the indigenous groups of that province, which have resulted, over the last 30 years, in various forms of official recognition. In particular, it highlights how the concept of equality was used by those groups to buttress their claims. Equality, in this context, was mainly conceived of as “sameness in …
Justice As A Rounding Error? Evidence Of Subconscious Bias In Second-Degree Murder Sentences In Canada, Craig Jones, Micah B. Rankin
Justice As A Rounding Error? Evidence Of Subconscious Bias In Second-Degree Murder Sentences In Canada, Craig Jones, Micah B. Rankin
Osgoode Legal Studies Research Paper Series
There are few areas of law that grant judges as much discretion as the sentencing of criminal offenders. This discretion necessarily leads to concerns about the influence of biases, including those that result from subconscious processes associated with human cognition; that is to say, “heuristics”. In this article, the authors explore one heuristic – “number preference” – through an examination of all reported second degree murder parole ineligibility decisions between 1990 and 2012. Number preference leads individuals to predictably “round off” measurements to certain favoured numbers. The authors identify a tendency for parole ineligibility decisions to “cluster” around even numbers …
Towards A Pedagogy Of Diversity In Legal Education, Faisal Bhabha
Towards A Pedagogy Of Diversity In Legal Education, Faisal Bhabha
Osgoode Legal Studies Research Paper Series
There is resounding consensus that diversity in legal education is a priority. Yet, North American law schools continue to be criticized for failing to reflect the diversity of the society that they are training lawyers to serve. With the backdrop of critical scholarship and empirical evidence, this paper is a project of conceptual reorientation. The first part examines the past 20 years of diversity promotion in legal education and concludes that, while several advances have been made, especially in increasing numerical representation of diverse groups in law schools, the promise of meaningful diversity remains unfulfilled. The next part situates the …
No Lawyer For A Hundred Miles? Mapping The New Geography Of Access Of Justice In Canada, Jamie Baxter, Albert Yoon
No Lawyer For A Hundred Miles? Mapping The New Geography Of Access Of Justice In Canada, Jamie Baxter, Albert Yoon
Osgoode Legal Studies Research Paper Series
Recent concerns about the geography of access to justice in Canada have focused on the dwindling number of lawyers in rural and remote areas, raising anxieties about the profession’s inability to meet current and future demands for localized legal services. These concerns have motivated a range of policy responses that aim to improve the education, training, recruitment and retention of practitioners in underserved areas. We surveyed lawyers in Ontario to better understand their physical proximity to clients and how, if at all, that proximity promotes access to justice. We find that lawyers' scope of practice varies based on a number …
Losing Relevance: Quebec And The Constitutional Politics Of Language, Emmanuelle Richez
Losing Relevance: Quebec And The Constitutional Politics Of Language, Emmanuelle Richez
Osgoode Legal Studies Research Paper Series
This article is interested in evaluating whether Quebec has lost relevance in the constitutional politics of language. It proposes a doctrinal analysis of the Supreme Court’s Charter jurisprudence, with an emphasis on the most recent body of case law, and an assessment of its political consequences in the area of language policy in Quebec. The article will argue that constitutional review has increasingly protected individual rights over Quebec’s collective right to maintain its language and culture. This can be explained by the move towards an implacable parallel constitutionalism and a redefinition of official minority linguistic rights in the jurisprudence, as …
Causing A Racket: Unpacking The Elements Of Cultural Capital In An Assessment Of Urban Noise Control, Live Music, And The Quiet Enjoyment Of Private Property, Sara Ross
Osgoode Legal Studies Research Paper Series
I examine the tension between and the treatment of the elements of cultural capital within dynamic mixed-use spaces, and posit that Canada's current noise control and noise pollution legislation, by-laws, and case law demonstrate a hierarchical protection framework placing greater importance on the "quiet enjoyment of private property" over live music culture, where performances are often the subject of noise complaints. While the elements of cultural capital valued by those who favour the value of quiet enjoyment of private property is well represented throughout legislation, by-laws, and case law, the elements of cultural capital valued by those who favour the …
Corporate Reporting Under The U.S. Securities And Exchange Commission's Diversity Disclosure Rule: A Mixed-Methods Content Analysis, Aaron A. Dhir
Corporate Reporting Under The U.S. Securities And Exchange Commission's Diversity Disclosure Rule: A Mixed-Methods Content Analysis, Aaron A. Dhir
Osgoode Legal Studies Research Paper Series
This is chapter 6 of Challenging Boardroom Homogeneity: Corporate Law, Governance, and Diversity (Cambridge University Press, forthcoming in 2015). In this chapter I investigate the disclosure-based approach to addressing diversity in corporate governance. In 2009, the United States Securities and Exchange Commission adopted a rule requiring publicly traded firms to report on whether they consider diversity in identifying director nominees and, if so, how. The rule also requires firms that have adopted a diversity policy to describe how they implement the policy and assess its effectiveness. The rule does not define “diversity,” however, leaving it to corporations to give this …
Out Of Tune: Why Copyright Law Needs Music Lessons, Carys J. Craig, Guillaume Laroche
Out Of Tune: Why Copyright Law Needs Music Lessons, Carys J. Craig, Guillaume Laroche
Osgoode Legal Studies Research Paper Series
This chapter offers a critical analysis of copyright law that integrates insights from music. The authors argue that the unique qualities of musical works magnify the mismatch between creative practices and copyright doctrine, and suggest that an interdisciplinary analysis can shine a revealing light on both the problem and potential paths to improvement. Beginning with an overview of copyright doctrine in Canada in respect of musical works and music infringement claims, the authors then borrow analytical concepts from the discipline of music theory to problematize copyright’s “reasonable listener” test for determining substantial copying. Using a specially-designed musical composition, the authors …
Feminist Aesthetics And Copyright Law: Genius, Value, And Gendered Visions Of The Creative Self, Carys J. Craig
Feminist Aesthetics And Copyright Law: Genius, Value, And Gendered Visions Of The Creative Self, Carys J. Craig
Osgoode Legal Studies Research Paper Series
Copyright law is fundamentally concerned with the value of cultural works — both the recognition and the creation of this value. Yet it is seldom acknowledged that copyright law makes or requires any value judgment in the sense of an aesthetic evaluation of copyright’s subject matter. Indeed, it is often emphasized that copyright protects original works of authorship regardless of their quality or merit. That copyright protection demands the satisfaction of only the most minimal of qualitative standards does not, however, dispose of the larger claim that forms the basis of this chapter: our copyright system is dominated by a …

Between The Scylla Of Legal Formalism And The Charybdis Of Policy Conceptualism: Yale's Policy Science And International Law, Hengameh Saberi
Osgoode Legal Studies Research Paper Series
An invisible but enduring legacy of the New Haven School, understood through this paper’s counter-narrative, is a new vista through which to caution against the pitfalls of policy reasoning and to demand its promises. International legal theory has a relatively clear sense about abuse of deduction when found in legal interpretation, but it has little to say about similar defects in policy reasoning. Equally undertheorized are our ideas about the very concept of policy and its place in international legal argumentation. Pursued policy objectives might be principled or flexible and their application flexible or principled. So a combination of principled …
Evictions, Aspiration And Avoidance, Brian E. Ray
Evictions, Aspiration And Avoidance, Brian E. Ray
Law Faculty Articles and Essays
In December 2011 four of the Constitutional Court’s five socio-economic rights cases turned on evictions.2 The Court decided three eviction-related cases in the 2012 term and two more in 2013.3 For a Court that averages fewer than 30 decisions per term 10 decisions in less than two and a half years is an extraordinary level of attention devoted to a single area of constitutional law.4 Does this sustained attention to eviction cases harbinger a significant development in the Court’s approach to the right to housing in FC s 26 and to socio-economic rights more generally? The cases provide some evidence …
