Beyond Backlash: Legal History, Polarization, And Roe V. Wade, Mary Ziegler

Scholarly Publications

On its fortieth anniversary, Roe v. Wade serves as the most prominent example of the damage judicial review can do to the larger society. Scholars from across the ideological spectrum have related how Roe helped to entrench the ideological positions held by those on either side of the abortion issue, precluding any form of productive compromise. This criticism, which the Article calls the “beyond backlash” argument, has profound legal consequences, serving as both a justification for overruling Roe and as a case study of the benefits of varying interpretive methods.

The Great Proletarian Cultural Revolution period of the People’s Republic of China (1966-1976) was crucial in the creation of modern-day China. The material culture of that period mirrors the turbulent political activity of students and the directives of the Communist Party’s central leadership during the height of the Mao Zedong personality cult. The commercial manufacture of posters, often the sole decoration available for the public and private spheres, offers strong examples of the design style of this time. This dissertation contributes an empirical research on business transformation disruption in the military. Specifically, this exploratory research seeks a better understanding of disruption of business transformation and some of the factors that are likely to impact the transformation process at the military strategic command level. This project proposes a study of works from 20th and 21st Century Latin American Literature and its representation of “lo afro” (blackness). While most studies have focused on the Caribbean, I am interested in working with regions of Latin America that have a history of African heritage that has either been “whitewashed” or erased since the 19th Century creation of independent nations. English parliamentary habeas corpus proceedings have been neglected by scholars. This Article ends that neglect. This Article focuses on the parliamentary habeas corpus proceedings that occurred in the reign of King James. The Article corrects several misunderstandings relating to the history of the writ of habeas corpus in England and to the history of the English Parliament (which in the seventeenth century commonly was referred to as the High Court of Parliament).

The Invading Fly: Innovative Pest Management Solutions For Control Of Bactrocera Invadens In Pemba, Zanzibar, Mccall Calvert, Lindsay Gucker

An integrated pest management study was conducted targeting the invasive fruit fly, Bactrocera invadens, on the island of Pemba, Zanzibar. Male annihilation technique (MAT) traps were set in geographically dispersed sites featuring mango fruit hosts. Three locally sourced essential oils,eucalyptus citriodora, clove and lemongrass were tested against the standard attractant methyl eugenol. Rainfall quantities at each site were collected and interviews with local farmers were conducted on the subject of B. invadens infestation and management. This thesis offers an account of preaching sanctification grounded broadly in the trinitarian economy of salvation and specifically in the person and work of Jesus Christ as receiver, bearer, and giver of the Holy Spirit. Grounded in atonement theory alone, other accounts of preaching sanctification are unable to address any number of concerns that arise in the sanctified life. Recent changes in German foreign policy behavior have led to questions about Germany's European vocation. At the center of this inquiry is Germany's struggle to resolve the intersection between historical memory and present day international responsibility, especially in cases involving the use of force. This dissertation examines how and when historical memory has influenced, shaped, and informed contemporary German foreign and security policy and rhetoric by examining cases within two policy areas: out of area operations and nuclear nonproliferation. In this paper, we investigate the connection between the hierarchical models and the power prior distribution in quantile regression (QReg). Under specific quantile, we develop an expression for the power parameter ( ) to calibrate the power prior distribution for quantile regression to a corresponding hierarchical model. The Ready Materials For Another World: Frontier, Security, And The Hindustan-Tibet Road In The 19th Century Northwestern Himalaya, Kyle J. Gardner

HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies

This article examines the different ways in which the British conceived of and configured the northwestern Himalaya in the mid-19th century. It focuses on the proposal, construction, and justification of the Hindustan-Tibet Road from the late 1840s through to the 1860s. By examining this particular episode in British frontier formation, I hope to show that the pacific perception of this “natural frontier” region allowed for a plurality of configurations that would not be possible on the more contested and violent imperial fronts. This research analyzed the effect that the General State Aid (GSA) Property Tax Extension Limitation Law adjustment and Hold Harmless component had on equity in the Illinois General State Aid funding system. The equity criteria defined in the study was permissible variance, wealth neutrality, and conditional wealth neutrality. This study consisted of four simulations. First, baseline indices were calculated for the Illinois funding system for 2000 to 2011. Second, the Property Tax Extension Limitation Law adjustment (PTELL) was eliminated, the associated cost savings used to increase the GSA foundation level, and new equity indices were calculated.
