Graduate Student Theses, Dissertations, & Professional Papers

This study examined interactions between visitors and mountain goats on the most heavily used trail in Glacier National Park. The primary objective was to give park managers a baseline of unbiased, reliable data with which to make informed decisions and improve the quality of interactions between visitors and mountain goats. Secondarily, this research was intended to achieve a thorough understanding of both human and wildlife responses during interactions on publically protected lands. The study was conducted over a two month period during the summer of 2013, and it was purely observational. Observations were recorded five days a week for approximately …

Scandal! Early Supreme Court News Coverage And The Justice-Journalist Divide, Amy Gajda Jan 2014

Scandal! Early Supreme Court News Coverage And The Justice-Journalist Divide, Amy Gajda

Georgia Law Review

In January of 1900, United States Supreme Court Associate Justice Henry Brown (author of Plessy v. Ferguson) had apparently just about had it with the press. He gave what was called "[t]he principal address" before members of the New York State Bar Association in Albany and focused not principally on law, but on what he called journalism's sensationalistic methods.' "Ugly stories are told," he told the gathered attorneys, "of spies put upon houses to unearth domestic scandals or upon the steps of public men to ferret out political secrets," including early reports of court decisions. The greatest of the cruelties …

Preemption Without Borders: The Modern Conflation Of Tort And Contract Liabilities, Max N. Helveston Jan 2014

Preemption Without Borders: The Modern Conflation Of Tort And Contract Liabilities, Max N. Helveston

Georgia Law Review

Medical device jurisprudence has taken a turn for the worse recently, turning a deaf ear to patients who have been injured or killed by devices and covertly expanding the boundaries of federal preemption in ways that threaten fundamental contractual principles. Ever since the Court's holding in Riegel v. Medtronic, district and appellate courts have effectively immunized the manufacturers of certain devices from contract, as well as tort, liabilities. The lower courts' rulings are not only

problematic as a matter of law, but raise novel concerns about federal regulatory preemption undermining individuals' contract rights. A comprehensive analysis of the Court's medical …

The Impact Of Clapper V. Amnesty International Usa On The Doctrine Of Fear-Based Standing, Amanda M. Mcdowell Jan 2014

The Impact Of Clapper V. Amnesty International Usa On The Doctrine Of Fear-Based Standing, Amanda M. Mcdowell

Georgia Law Review

The Supreme Court's 2013 decision in Clapper v. Amnesty International USA dealt with the government's electronic surveillance authority under the Foreign Intelligence SurveillanceAct (FISA) Amendments. In a 5- 4 opinion, the Court held that a variety of U.S. persons, including attorneys and media organizations, did not have standing to challenge the constitutionality of the FISA Amendments because the plaintiffs' fear of future unlawful surveillance was not "certainly impending." Depending on how lower courts choose to interpret Clapper, the decision could have a significant impact on the doctrine of fear-based standing, which allows plaintiffs to establish standing based on fear of …

Obesity is an increasing problem worldwide, often described as an epidemic. Approximately 70% of men and women nationwide are overweight and/or obese, with roughly 34% meeting criteria for obesity. Women are increasing obesity rates faster than men and more women than men are currently obese nationwide and worldwide. Obesity leads to numerous physical, psychological, and social consequences and often a poor quality of life. Women are at risk for increased health complications, and college in particular has been associated with weight gain. Improper energy balance is a significant contributor. Achieving adequate exercise each week has been proven effective in obesity …

Using Reanalysis Data For The Prediction Of Seasonal Wind Turbine Power Losses Due To Icing, Daniel Burtch Jan 2014

Using Reanalysis Data For The Prediction Of Seasonal Wind Turbine Power Losses Due To Icing, Daniel Burtch

Theses and Dissertations

The Northern Plains region of the United States is home to a significant amount of potential wind energy. However, in winter months capturing this potential power is severely impacted by the meteorological conditions, in the form of icing. Predicting the expected loss in power production due to icing is a valuable parameter that can be used in wind turbine operations, determination of wind turbine site locations and long-term energy estimates which are used for financing purposes. Currently, losses due to icing must be estimated when developing predictions for turbine feasibility and financing studies, while icing maps, a tool commonly used …

The Association Between Autobiographical Memory Specificity And Memory Sharing In College Students, Nicola Herting Jan 2014

The Association Between Autobiographical Memory Specificity And Memory Sharing In College Students, Nicola Herting

Theses and Dissertations

The way in which memories are stored and communicated makes the construction of autobiographical memories (AM) both an internal process and a social occurrence. Strong associations between reduced AM specificity and psychological adjustment have been found; however, the role significant others have in the socialization and co-construction of AM may have be overlooked. This study examines whether the process of sharing AMs and the perceived benefits of sharing these memories are associated with differences in specificity of AM, as well as explores methodological differences in how AMs are collected. Data from 177 participants was collected on the Most Important Memories …

The Effects Of Whole Body Vibrations On Salivary Cortisol In Young Females In Squat Position, Rohini Gawande

Theses and Dissertations

Purpose: Despite the catabolic effect of cortisol on bone metabolism, and the potentially counteracting anabolic effect of whole body vibration (WBV) on bone, only a few studies have explored the effects of WBV on cortisol, the findings of which have

been inconclusive. Therefore, the purpose of this study was to determine the effect of an acute bout of WBV on salivary cortisol levels in women. Method: This study utilized a randomized cross-over design, consisting of two individual treatment days: the vibration

intervention (V) and the non-vibration control (NV), with a washout period of 2-3 days between the two. Participants consisted …

Space Tourism Law: Lessons From Aviation, Antarctica, And The International Space Station, Denise Meeks Jan 2014

Space Tourism Law: Lessons From Aviation, Antarctica, And The International Space Station, Denise Meeks

Theses and Dissertations

Space tourism has economic, social, and educational benefits, however, unresolved legal issues remain that need to be addressed on state and international levels in order for space tourism to succeed and for these benefits to be realized. Space treaties do not address and federal laws have impeded space tourism efforts. Aviation industry regulations, Antarctic treaties, and International Space Station agreements serve as models to guide the space tourism. In the future, however, the space tourism industry will create its own legal regime based on the technical expertise of its practitioners and the social mores of its participants.

Relational Maintenance Behaviors, Conflict Resolution Strategies, And Their Relation To Loneliness, Courtney O'Brien Jan 2014

Relational Maintenance Behaviors, Conflict Resolution Strategies, And Their Relation To Loneliness, Courtney O'Brien

Theses and Dissertations

The present study examined the relationship between levels of ineffective arguing and loneliness above and beyond levels of relational maintenance behaviors in 182 male and female adults. Correlations did not support a large inverse relationship between loneliness and relational maintenance behaviors for both Romantic Partner Group (RPG) and Friendship Group (FG). This study has shown that there was a moderate relationship between levels of loneliness and relational maintenance behaviors for both groups. As hypothesized, but only for the RPG, regression analyses revealed that ineffective arguing did predict experiences of loneliness above and beyond relational maintenance behaviors only, whereas this was …

A Comparison Of Food Accessibility From 2002 To 2012 In St. Paul, Minnesota, Brett Sergenian Jan 2014

A Comparison Of Food Accessibility From 2002 To 2012 In St. Paul, Minnesota, Brett Sergenian

Theses and Dissertations

This study compared the changes in the healthy food accessibility landscape of St. Paul from 2002 to 2012. Food deserts are areas of limited or no accessibility to healthy food options. Local food landscapes in the U.S. and Canada have changed significantly over the past 50 years as many supermarkets have relocated out of the inner cities and into the suburbs. As a result, many inner city neighborhoods no longer have adequate access to healthy food. Despite supermarkets relocating out of the inner city, small and mid-sized grocers could stock healthy food options. The research questions answered are: Where are …

The Self-Objectification Scale: A New Measure For Assessing Self-Objectification, Sarah Dahl Jan 2014

The Self-Objectification Scale: A New Measure For Assessing Self-Objectification, Sarah Dahl

Theses and Dissertations

Many of the measures for self-objectification have theoretical or psychometric issues related to their use. For this reason, the development of a new measure addressing these concerns would be beneficial to the research on self-objectification. Towards this goal of developing and validating a new measure for self-objectification, the Self-Objectification Scale (SOS) was developed. The Self-Objectification Scale is the first scale to be created with two alternative forms for measuring trait and state self-objectification that have undergone analyses for reliability and validity with both men and women. A pilot study of 40 undergraduate men and women was conducted to check the …

Trauma Experiences And Symptoms Reported By American Indian And Caucasian Sex Offenders, Regina Sioux Ertz Jan 2014

Trauma Experiences And Symptoms Reported By American Indian And Caucasian Sex Offenders, Regina Sioux Ertz

Theses and Dissertations

American Indian/Alaskan Native (AI/AN) people are known to have a history of man-made trauma that corresponds to the colonization of the Americans. Trauma experienced by AI/AN sex offenders has not been evaluated in the research as it relates to their treatment planning. The lack of data reflecting intervention needs for AI/AN sex offenders is problematic. The current study hypothesized that American Indian sex offenders would report a greater number of trauma experiences, endorse increased symptoms of Posttraumatic Stress Disorder (PTSD), display more traumatic cognitions, and endorse higher dissociative experiences than Caucasian sex offenders. Statistical results yielded did not support the …

Development And Applications Of Gold-Silica Nanohybrids For Bioanalysis, Jiao Chen Jan 2014

Development And Applications Of Gold-Silica Nanohybrids For Bioanalysis, Jiao Chen

Theses and Dissertations

In the first project, both non-spherical and spherical silica nanomateirals with hollow interiors were synthesized by a one-step soft-templating method. By simply changing the applied solvent from ethanol to 1-propanol, or 1-pentanol, three different shapes of nanomaterials, including nanosphere, nanowire, and nanotadpole, could be obtained, respectively. The effects of other factors on morphology were also systematically studied to propose a growth mechanism. It was found that the PVP-water droplet was the crucial factor on the formation of hollow interiors. Without the addition of PVP, only solid silica nanomaterials, such as solid nanoparticles, nanorods, and nanowires, were synthesized. This developed method …

Goose-Derived Igy: A Potential Therapeutic Antibody For The Treatment Of Infectious Disease, Ashley Louisa Fink Jan 2014

Goose-Derived Igy: A Potential Therapeutic Antibody For The Treatment Of Infectious Disease, Ashley Louisa Fink

Theses and Dissertations

IgY, the predominate avian antibody isotype, has biochemical properties that make it attractive for a human immunotherapy: IgY does not bind to mammalian Fc receptor (FcR) or rheumatoid factor; IgY does not activate the mammalian complement; and IgY has no heteroagglutinins. Anseriformes (waterfowl, e.g. ducks and geese) produce 2 isoforms of IgY, full length IgY and alternatively spliced IgY lacking the Fc region and a stable equivalent to mammalian F(ab')2 fragment, and the predominate isoform following hyperimmunization. We, and others, have demonstrated that egg-derived avian polyclonal antibodies are prophylactic or therapeutic for a variety of different infectious agents including bacteria, …

Homicides And The American Dream: An Empirical Application Of Institutional Anomie Theory At The Census Tract Level, Stacie Jergenson Jan 2014

Homicides And The American Dream: An Empirical Application Of Institutional Anomie Theory At The Census Tract Level, Stacie Jergenson

Theses and Dissertations

Guided by the Institutional Anomie Theory (IAT) of Steven F. Messner and Richard Rosenfeld (2007), this study examines the strength and interaction of social institutions (economy, education, family and polity) in relationship to homicides occurring in Minneapolis, Minnesota between 2007 and 2011. It utilizes census tracts as the units of analysis, an attempt to extend IAT from the cross-national to the local level. Rather than focusing on specific offenders, it explores broader cultural and structural characteristics employing exploratory, ordinary least squares (OLS), and geographically weighted regressions (GWR). Although interactions did not reach statistical significance, relationships were found between homicides rates …

Do Men Matter? A Current Population Survey Study Of Characteristics Affecting Delayed Fertility, Patrick Mobley Jan 2014

Do Men Matter? A Current Population Survey Study Of Characteristics Affecting Delayed Fertility, Patrick Mobley

Theses and Dissertations

Fertility research has traditionally assumed male fertility behavior was constant, overlooking the role of male economic factors, due largely to data restrictions. I use three models to analyze separate perspectives of data from the 2011 - 2013 Annual Social and Economic Supplement (ASEC) of the Current Population Survey (CPS) to determine whether male circumstances have a statistically significant effect on fertility behavior. This paper shows that the assumption that male fertility behavior is constant is invalid. Just like women, men prefer childbearing at certain life stages and will delay to maximize their own utility. Student enrollment has a particularly strong …

Electron Donor Contributions To Denitrification In The Elk Valley Aquifer, North Dakota, Amanda M. Krieger Jan 2014

Electron Donor Contributions To Denitrification In The Elk Valley Aquifer, North Dakota, Amanda M. Krieger

Theses and Dissertations

Six denitrification tracer tests were performed over eight and a half years in in situ mesocosms (ISMs) in the Elk Valley Aquifer (EVA) in east-central North Dakota. Groundwater samples were analyzed to determine how much nitrate was lost beyond that explained by dilution of the bromide tracer. Additional losses were attributed to denitrification. The denitrification rates varied from 0.10 to 0.23 mg N/L/day for the six tests. In general, the major electron donors for denitrification are organic carbon (OC), pyrite (FeS2), and ferrous iron silicate minerals. In the EVA tracer tests, increases in sulfate indicated that the oxidation of pyrite …

Patient-Centered Appointment Scheduling Using Agent-Based Simulation., Ayten Turkcan, Tammy Toscos Phd, Brad N Doebbeling Jan 2014

Patient-Centered Appointment Scheduling Using Agent-Based Simulation., Ayten Turkcan, Tammy Toscos Phd, Brad N Doebbeling

Health Services and Informatics Research

Enhanced access and continuity are key components of patient-centered care. Existing studies show that several interventions such as providing same day appointments, walk-in services, after-hours care, and group appointments, have been used to redesign the healthcare systems for improved access to primary care. However, an intervention focusing on a single component of care delivery (i.e. improving access to acute care) might have a negative impact other components of the system (i.e. reduced continuity of care for chronic patients). Therefore, primary care clinics should consider implementing multiple interventions tailored for their patient population needs. We collected rapid ethnography and observations to …

Research outputs 2014 to 2021

Although studies of seed banks in arid ecosystems are commonplace, they are lacking for the large arid zone of Western Australia. Across the six major plant communities fringing a large salt lake within this zone, topsoil (0-5 cm depth) was collected from 12 to 36 sites per community. Samples were dried, spread out on a bed of vermiculite in seedling trays and placed in a well-watered glasshouse to determine the readily germinable component of the soil seed bank. Subsamples of topsoil were treated with smoke water, hot water or flooding to help determine seed bank of species with dormancy mechanisms. …

A Method To Optimize A Typology-Based Classification System, Christopher Schnitzler, James Croft, Chris Button, Mats Ulmers, Keith Davids Jan 2014

A Method To Optimize A Typology-Based Classification System, Christopher Schnitzler, James Croft, Chris Button, Mats Ulmers, Keith Davids

Research outputs 2014 to 2021

This study sought to provide guidelines for implementing typology-based qualitative analysis of human movement patterns. Fifteen participant-analysts were instructed how to classify treading water behaviours into eight different categories using a training set of videos. They were later provided with two additional sets of videos called validation, and test sets. Results first identified reliable (n=9), and not reliable (n=6) analysts. A decision study outlined that one analyst was sufficient to reliably categorize the behaviours in the 'reliable' analyst group, whereas up to four were necessary in the 'unreliable' group. These data provided new insights into more objective qualitative analysis methods …
