Group To Individual Inference In Scientific Expert Testimony, Christopher Slobogin, David Faigman, John Monahan Jan 2014

Group To Individual Inference In Scientific Expert Testimony, Christopher Slobogin, David Faigman, John Monahan

Vanderbilt Law School Faculty Publications

A fundamental divide exists between what scientists do as scientists and what courts often ask them to do as expert witnesses. Whereas scientists almost invariably inquire into phenomena at the group level, trial courts typically need to resolve cases at the individual level. In short, scientists generalize while courts particularize. A basic challenge for trial courts that rely on scientific experts, therefore, concerns determining whether and how scientific knowledge derived from studying groups can be helpful in the individual cases before them (what this Article refers to as "G2i'). To aid in dealing with this challenge, this Article proposes a …

The Implications Of Private Environmental Governance, Michael P. Vandenbergh Jan 2014

The Implications Of Private Environmental Governance, Michael P. Vandenbergh

Vanderbilt Law School Faculty Publications

If we look back twenty years from now, will private governance be as much a part of environmental law and policy as market mechanisms, or will it have faded into the woodwork along with many other promising new developments? In this Essay, I briefly examine four issues that will play a large role in determining the answer to this question. Part I examines whether PEG is a coherent, discrete concept. Part II explores the extent to which PEG affects environmental behavior and environmental quality. Part III discusses the interactions between private and public environmental governance. Part IV then evaluates whether …

Designing Administrative Law For Adaptive Management, J.B. Ruhl, Robin Craig Jan 2014

Designing Administrative Law For Adaptive Management, J.B. Ruhl, Robin Craig

Vanderbilt Law School Faculty Publications

Administrative law needs to adapt to adaptive management. Adaptive management is a structured decision-making method the core of which is a multi-step iterative process for adjusting management measures to changing circumstances or new information about the effectiveness of prior measures or the system being managed. It has been identified as a necessary or best practices component of regulation in a broad range of fields, including drug and medical device warnings, financial system regulation, social welfare programs, and natural resources management. Nevertheless, many of the agency decisions advancing these policies remain subject to the requirements of either the federal Administrative Procedure …

Generational Dream: First Generation American Citizens And Their Relationship To The American Dream, Anna A. Mintz Jan 2014

Generational Dream: First Generation American Citizens And Their Relationship To The American Dream, Anna A. Mintz

Honors Theses

The term the "American Dream" was coined in 1939 by James Truslow Adams and has undoubtedly become an integral part of the American ethos. This narrative has brought thousands of immigrants to American shores with the promises of prosperity and success for centuries. Yet in 2014, it must be questioned whether this dream still holds significance for the young people of this country. By studying first-generation American citizens, whose parents did not grow up here, it can be ascertained how relevant this narrative still is and the sort of power that it retains. The following research describes my interactions with …

Staffing Practices Of Elementary School Principals For Teachers In Primary Grades And Implications For The Prek-3rd Continuum, Laura Albers-Biddle Jan 2014

Staffing Practices Of Elementary School Principals For Teachers In Primary Grades And Implications For The Prek-3rd Continuum, Laura Albers-Biddle

Electronic Theses and Dissertations

Principals are considered the educational leaders of their schools and face pressure to improve the quality of education across all levels and disciplines. Principals were interviewed to understand their beliefs, knowledge, and dispositions on staffing teachers in the primary grades. A purposive sample of elementary school principals was drawn from one mid-size suburban district in Florida. Data were analyzed using Bolman and Deal's four-frame organizational theory framework, Cohen's cognitive frame, and Boote's theory of professional discretion. The data strongly suggest that principals do not understand the foundations of early childhood practice. In addition, they do not understand the differences between …

Supporting Middle School Students With Emotional Or Behavioral Disorders In Blended Learning: A Fraction Intervention Using Virtual Manipulatives, Barbara Serianni Jan 2014

Supporting Middle School Students With Emotional Or Behavioral Disorders In Blended Learning: A Fraction Intervention Using Virtual Manipulatives, Barbara Serianni

Electronic Theses and Dissertations

Students with emotional or behavioral disorders (EBD) are more likely than other students with disabilities to drop out of school (Blackorby & Wagner, 1996) and suffer societal consequences that include higher probabilities and rates of incarceration, poverty, drug abuse, homelessness, low wages, and unemployment (Bradley, Doolittle, & Bartolotta, 2008; Wagner, 1995). High school graduation is a critical factor to improve post-secondary outcomes for students with EBD; yet it is often mathematics, specifically algebra, that stands in the way of graduation (Blackorby & Wagner). Students with EBD often enter middle school lacking foundational mathematics skills, such as fractions, which sets them …

Privatization Of Florida Juvenile Residential Facilities, Katherine Hancock Jan 2014

Privatization Of Florida Juvenile Residential Facilities, Katherine Hancock

Electronic Theses and Dissertations

Privatization of juvenile facilities and services has been the norm since the inception of the juvenile justice system. However, little research has been performed examining the impact of privatization on juvenile justice, despite the possible repercussions of this policy for the juveniles served. Prior research on privatization in other fields has tended to find a connection between privatization and outcomes; however, very little research has examined how privatization impacts operations, how operations impact recidivism, and how privatization and operations interact to produce juvenile justice outcomes. This exploratory study, informed by cybernetic systems theory and principal-agent theory, examined the mechanism by …

Novel Developments On The Extraction And Analysis Of Polycyclic Aromatic Hydrocarbons In Environmental Samples, Walter Wilson Jan 2014

Novel Developments On The Extraction And Analysis Of Polycyclic Aromatic Hydrocarbons In Environmental Samples, Walter Wilson

Electronic Theses and Dissertations

This dissertation focuses on the development of analytical methodology for the analysis of polycyclic aromatic hydrocarbons (PAHs) in water samples. Chemical analysis of PAHs is of great environmental and toxicological importance. Many of them are highly suspect as etiological agents in human cancer. Among the hundreds of PAHs present in the environment, the U.S. Environmental Protection Agency (EPA) lists sixteen as "Consent Decree" priority pollutants. Their routine monitoring in environmental samples is recommended to prevent human contamination risks. A primary route of human exposure to PAHs is the ingestion of contaminated water. The rather low PAH concentrations in water samples …

The Modern Gender Gap In Partisanship And Ideology: A Cross-National Analysis, Tiffany Quick Jan 2014

The Modern Gender Gap In Partisanship And Ideology: A Cross-National Analysis, Tiffany Quick

Electronic Theses and Dissertations

This thesis updates and expands upon the developmental theory of the gender gap in party and ideological identification originally posited by Norris and Inglehart (2000) to explain why women in advanced industrial nations are more likely to hold more leftist ideological identification than men. A comparative cross-national analysis using data from the World Values Survey (2004-2008) extends Norris and Inglehart's study, with an examination of the gender gap in advanced industrial, post-communist and developing nations. To further explore the nature of the gender gap in the United States, data from the American National Election Study (Cumulative File and 2012 cross-section) …

Meeting The Needs Of Students Through A Targeted Professional Development, Anthony Copelin Jan 2014

Meeting The Needs Of Students Through A Targeted Professional Development, Anthony Copelin

Electronic Theses and Dissertations

This study presents a complex problem of practice occurring at Primrose Elementary school [pseudonym]. A large portion of Primrose Elementary School's population has been unable to meet Florida's state reading proficiency standards over the last twelve years. Students of Primrose Elementary have a poor foundation in language on which to build vital reading skills. Consequently, students cannot overcome this deficiency because teachers lack the content knowledge to meet the students' language and subsequent reading deficiencies, in spite of 12 years of reading professional development. This dissertation in practice will propose the use of targeted professional development to address below grade …

Movements, Fishery Interactions, And Unusual Mortalities Of Bottlenose Dolphins, Steven Shippee Jan 2014

Movements, Fishery Interactions, And Unusual Mortalities Of Bottlenose Dolphins, Steven Shippee

Electronic Theses and Dissertations

Bottlenose dolphins inhabiting coastlines and estuaries in Florida have been impacted in the past decade by development, algal blooms, catastrophic pollution, and fishery interactions (FI). Dolphins react to disturbance and environmental stressors by modifying their movements and habitat use, which may put them in jeopardy of conflict with humans. FI plays an increasing role in contributing to dolphin mortalities. I investigated dolphin movements, habitat use, residency patterns, and frequency of FI with sport fishing. Tagging studies with short-term data tags and bolt on radio-transmitters were done in several locations in Florida and the east coast providing fine-scale measurements of swimming, …

The Role Of Invitational Theory On Minority Student Enrollment In Advanced Placement Courses, Jason Mcdonald Jan 2014

The Role Of Invitational Theory On Minority Student Enrollment In Advanced Placement Courses, Jason Mcdonald

Electronic Theses and Dissertations

The number of students enrolling in Advanced Placement (AP) classes has been increasing in Florida and across the nation over the last decade. However, this trend is not happening for traditionally underserved groups of students such as African Americans, Hispanics, and students from low socioeconomic backgrounds. These minority groups are underrepresented in AP classes, while Asian and White students are overrepresented. This trend is alarming because there are qualified minority students who have a great chance of being successful in AP classes according to AP Potential data. For some reason though, these qualified minority and low income students are nevertheless …

Photo-Induced Protonation Of Polyaniline Composites And Mechanistic Study Of The Degradation Of Polychlorinated Biphenyls With Zero-Valent Magnesium, Candace Kirkland Jan 2014

Photo-Induced Protonation Of Polyaniline Composites And Mechanistic Study Of The Degradation Of Polychlorinated Biphenyls With Zero-Valent Magnesium, Candace Kirkland

Electronic Theses and Dissertations

As technology advances, a need for non-metal, conductive materials has arisen for several types of applications. Lithographic techniques are helpful to develop some of these applications. Such techniques require materials that are insulating and become conductive after irradiated. Composites of polyaniline in its emeraldine base form (PANI-EB) doped with photo-acid generators (PAG) become conductive upon photo-irradiation. This increase in conductivity is due to the protonation of PANI-EB. Such materials may be utilized to fabricate conducting patterns by photo-irradiation; however, the conductivity obtained by direct irradiation of PANI-EB/PAG composites is normally quite low (<10-3 S/cm) due to aggregation of highly loaded PAG. In this work, poly(ethylene glycol) (PEG), a proton transfer polymer, was added to PANI-EB/PAG. Results showed the addition of low molecular weight (MW) (550) PEG significantly enhanced the photo-induced conductivity to a level comparable to that of PANI-salt synthesized by oxidizing aniline in the presence of an acid. High MW (8000) PEG is less effective than PEG 550, and composites of PANI-EB and N-PEG-PANI showed conductivity as high as 102 S/cm after treatment with HCl vapor. The photo-induced conductivity of the N-PEG-PANI/PANI-EB/PAG composite reached 10-2-10-1 S/cm. Polychlorinated biphenyls (PCBs) are a class of chemicals with 209 different congeners, some of which are known carcinogens, and are persistent organic pollutants in the environment. After its synthesis, it was seen as a phenomenal additive in a multitude of different applications leading to the wide spread use of PCBs and a need for a safe, effective, and inexpensive remediation technique. While it is known that magnesium can degrade PCBs, the mechanism of this reaction was not well-understood. In order for magnesium to be broadly used as a remediation tool, it is necessary to fully understand how the reaction is taking place and if the PCBs are able to be fully dechlorinated into biphenyl. This research focuses on the hydrodechlorination of PCBs with zero-valent magnesium in acidified ethanol. The degradation pathways of 2, 2', 3, 5, 5', 6- hexachlorobiphenyl were investigated to determine the identity of the daughter PCBs produced, how and if they continue to be dechlorinated into biphenyl. The proton source for this hydrodehalogenation reaction was also studied using both deuterated solvent and acid to give more detail to the mechanism of this reaction.

The Effect Of Free Primary Education Programs On Marriage For Kenyan Women., Joanna Eisele Jan 2014

The Effect Of Free Primary Education Programs On Marriage For Kenyan Women., Joanna Eisele

Electronic Theses and Dissertations

This dissertation investigates the effect of education on the chances and age of marriage during the transition from adolescence into young adulthood among Kenyan women age 15-22. Women who receive more education are more likely to delay marriage. The literature suggests that occupation and age at sexual debut are also significantly associated with age of marriage. This study considers how these and other factors may possibly affect the life course of women in Kenya over a period of time and increases our understanding of marriage predictors. Data comes from the 2003 and 2008 Kenya Demographic and Health Surveys. Binary logistic …

The Contribution Of School Counselors' Self-Efficacy And Professional Quality Of Life To Their Programmatic Service Delivery, Patrick Mullen Jan 2014

The Contribution Of School Counselors' Self-Efficacy And Professional Quality Of Life To Their Programmatic Service Delivery, Patrick Mullen

Electronic Theses and Dissertations

The purpose of this investigation was to examine the directional relationship between practicing school counselors' level of professional quality of life and self-efficacy to their programmatic service delivery activities. This investigation tested the theoretical model that practicing school counselors' level of professional quality of life (as measured by the Professional Quality of Life Scale [ProQOLs; Stamm, 2010]) and their self-efficacy (as measured by the School Counselor Self-Efficacy Scale [SCSEs; Bodenhorn & Skaggs, 2005]) contributes to their service delivery activity (as measured by the School Counselor Activity Rating Scale [SCARS; Scarborough, 2005]). Specifically, this study examined the hypothesized directional relationship that …

Mobile Phone Short Message Service (Sms) To Improve Malaria Pharmacoadherence In Zambia, Elinda Steury Jan 2014

Mobile Phone Short Message Service (Sms) To Improve Malaria Pharmacoadherence In Zambia, Elinda Steury

Electronic Theses and Dissertations

Malaria significantly contributes to morbidity and mortality rates in Zambia. The currently accepted malaria treatment is artemisinin-based combination therapy (ACT); it is more than 97% effective when the regimen is strictly adhered to. However, the mean ACT adherence rate in sub-Saharan Africa is only approximately 38-48%. Poor pharmacoadherence remains a significant barrier to malaria control and elimination. The purpose of this study was to determine if adherence rates to a six-dose ACT antimalarial treatment differ between patients in Zambia who received short message service (SMS) reminders and those who did not. An experimental, randomized, controlled trial was conducted to collect …

A majority of diabetes self-management programs have been shown to improve knowledge, attitude, practice, and health care outcomes. However, in the literature the underlying causal mechanisms for the improvement attributable to health education have not been explored, especially, how diabetes educational intervention may affect diabetes care outcomes. The purpose of the present study was to identify the causal mechanisms responsible for improved knowledge, attitude, practice and outcomes, so that educational interventions can be tailored efficiently and effectively to patients who are most likely to benefit from self-care management. The study used the knowledge, attitude, practice and outcome (KAP-O) framework. The …

Modeling Risk For Sexually Transmitted Infections In Women In A Court-Ordered Substance Treatment Program, Frances Deavers Jan 2014

Modeling Risk For Sexually Transmitted Infections In Women In A Court-Ordered Substance Treatment Program, Frances Deavers

Electronic Theses and Dissertations

Developing a comprehensive model of Sexually Transmitted Infection (STI) risk factors and their inter-relationships is vital to improving methods of risk identification and treatment delivery. The CDC posed three general categories that may serve as a framework for such a model: sexual network, individual behavior, and social/ structural risk. None of the extant risk models incorporate measures from all three categories. Additionally, none of these models, generally focused on individual behavior, use medical data on infection as their outcome variable. This is problematic because the ultimate outcome of infection is also influenced by sexual network and social/ structural variables, in …

The Relationship Of State Political Instability And Economic Failure To Predatory Organized Crime In Multiple Nations: A Global Comparative Anaylsis, Terrance Ruth

Electronic Theses and Dissertations

This dissertation examines the relationship of political instability and economic failure to predatory organized crime in multiple nations. This is an important issue since each year the increase in predatory crime networks contributes to international economic failure, security risks, and the spread of organized crime. In an effort to understand the relationship between state failure and economic failure on the one hand, and organized crime on the other, this study will seek to address three goals. First, the study tests the degree to which variables that imply economic failure and state failure correlate with predatory organized crime. Second, the study …

Role Of Cardiac Catecholamines In Embryos And Adults Under Stress, Candice Baker Jan 2014

Role Of Cardiac Catecholamines In Embryos And Adults Under Stress, Candice Baker

Electronic Theses and Dissertations

Cardiovascular disease is responsible for the loss of one life every 38 seconds and accounts for 26.6 percent of all infants that die of congenital birth defects. Adrenergic hormones are critically important regulators of cardiovascular physiology in embryos and adults. They are key mediators of stress responses and have profound stimulatory effects on cardiovascular function, and dysregulation of adrenergic function has been associated with many adverse cardiac conditions, including congenital malformations, arrhythmias, ischemic heart disease, heart failure, and sudden cardiac death. Despite intensive study, the specific roles these hormones play in the developing heart is not well-understood. Further, there is …

Pro-Life Progressivism: The Effect Of Abortion Attitudes On Attitudes Towards Government Welfare Programs, Lauren Gilmore Jan 2014

Pro-Life Progressivism: The Effect Of Abortion Attitudes On Attitudes Towards Government Welfare Programs, Lauren Gilmore

Electronic Theses and Dissertations

There is an extensive body of literature exploring the way in which a variety of factors affect a person's attitudes towards abortion. There is significantly less research, however, on the way in which a person's attitude towards abortion affects their attitudes towards other issues. At the same time, there is evidence to suggest that a growing number of people are using their "pro- life" stance on abortion to influence their stance on other issues that revolve around the quality and sustenance of life, and that Generation Y may be more liberal than previous generations on most, if not all, issues. …

The purpose of this dissertation in practice is to address the problem of online credit recovery. Although online enrollments have skyrocketed in recent years and all preliminary research indicates a large percentage of those enrollments are from students seeking credit recovery, much of the curriculum currently being offered is not research-based. Following a literature review focused on the history of credit recovery as well as successful current methods, we designed CRIT (Credit Recovery Instructional Treatment), a research-based approach to curriculum design for credit recovery. CRIT is a standards based curriculum relying on criterion based assessments. This approach was then applied …

A Study Of Authentic Leadership Adopting The Job Demands And Resources Approach In Predicting Work-Related Flow And Job Performance, Yiqing Wang Jan 2014

A Study Of Authentic Leadership Adopting The Job Demands And Resources Approach In Predicting Work-Related Flow And Job Performance, Yiqing Wang

Lingnan Theses

The authentic leadership model posits that authentic leaders can foster personal development of their subordinates in order to produce better job outcomes. The current study has investigated authentic leadership using the job demands and resources (JD-R) approach to examine how leaders’ authenticity can empower employees in terms of resources-building (e.g. PsyCap, supervisor support); and to examine how these resources can offset negative stressors (e.g. work overload, emotional demands) so that employees may achieve a peak psychological state of flow (Bakker, 2005, 2008) and better job performances. To date, very few studies have tried to explain authentic leader behaviors in the …

North Central Extension Risk Management Education Center, Christine Lockert, Bradley D. Lubben Jan 2014

North Central Extension Risk Management Education Center, Christine Lockert, Bradley D. Lubben

Cornhusker Economics

After several years of growing agricultural prosperity and record net farm income that peaked at $130 billion in 2013, average United States net farm income is forecast to drop more than 25 percent, to just under $96 billion for 2014 (United States Department of Agriculture (USDA) Economic Research Service). The large drop from 2013 to 2014 after nearly a decade of strong growth in agricultural income presents a new challenge to agricultural producers, and an increased need to carefully manage risk on the farm or ranch. The drop is buffered in part by the underlying strength of the agricultural sector. …

Catholic Healing Masses: Intersections Of Health And Healing In Yucatan, Suzanne Draper Jan 2014

Catholic Healing Masses: Intersections Of Health And Healing In Yucatan, Suzanne Draper

Electronic Theses and Dissertations

The conception of illness and healing in contemporary Mexican Catholic discourse highlights both particular and ubiquitous instances of a health experience perceived locally and widespread. Catholic healing masses are utilized as supplemental methods of individual health restoration coupled with Western medicinal techniques in Catholic dramas. Aside from the spiritual and religious significance of this practice, the use of healing masses as an additional means to achieving an optimal health status implies that something is lacking in current biomedical models. The purpose of my research is to explore the humanistic terms under which healing masses operate and translate these terms into …
