Unaccountable Midnight Rulemaking? A Normatively Informative Assessment, Edward H. Stiglitz Jan 2014

Unaccountable Midnight Rulemaking? A Normatively Informative Assessment, Edward H. Stiglitz

Cornell Law Faculty Publications

Under a common view, the administrative state inherits democratic legitimacy from the President, an individual who is envisioned both to control administrative agencies and to be electorally accountable. Presidents' administrations continue issuing rules, however, even after Presidents lose elections. Conventional wisdom holds that Presidents use the "midnight" period of their administrations-the period between the election and the inauguration of the next President-to issue unpopular and controversial rules. Many regard this midnight regulatory activity as democratically illegitimate. Yet we have scant evidence that presidential administrations in fact issue controversial or unpopular rules during the midnight period. In this Article, I examine …

“Private” Means To “Public” Ends: Governments As Market Actors, Robert C. Hockett, Saule T. Omarova Jan 2014

“Private” Means To “Public” Ends: Governments As Market Actors, Robert C. Hockett, Saule T. Omarova

Cornell Law Faculty Publications

Many people recognize that governments can play salutary roles in relation to markets by (a) “overseeing” market behavior from “above,” or (b) supplying foundational “rules of the game” from “below.” It is probably no accident that these widely recognized roles also sit comfortably with traditional conceptions of government and market, pursuant to which people tend categorically to distinguish between “public” and “private” spheres of activity.

There is a third form of government action that receives less attention than forms (a) and (b), however, possibly owing in part to its straddling the traditional public/private divide. We call it the “government as …

Achalasia is an esophageal motility disorder characterized by incomplete relaxation of the lower esophageal sphincter (LES) and aperistalsis of the esophageal body. Treatment of achalasia is aimed at decreasing the resting pressure in the LES. Peroral endoscopic myotomy (POEM), derived from natural orifice transluminal endoscopic surgery (NOTES) and advances in endoscopic submucosal dissection (ESD), presents a novel, minimally invasive, and curative endoscopic treatment for achalasia. POEM involves an esophageal mucosal incision followed by creation of a submucosal tunnel crossing the esophagogastric junction and myotomy before closure of the mucosal incision. Although the procedure is technically demanding and requires a certain …

Visual Harmony In Relation To Camp Santanoni: User's Perceptions And Interpretations Of Visual Harmony Between Historic Rustic Architectural Design And The Natural Environment Based On Recommendations Made By Downing, Olmsted And Wicks, Nina L. Caruso

Historic Preservation Theses

The purpose of this study is to understand how users of Camp Santanoni perceive and interpret the visual harmony between historic rustic architectural design and the natural environment and if these meanings are congruent with the design recommendations from Downing, Olmsted, and Wicks. The main goal is to understand the congruent relationships between how a designer wished to achieve visual harmony between buildings and landscapes, and how people actually perceive this interaction. The meaningful relationships between users (the people) of Camp Santanoni’s buildings and the surrounding landscape (the place) were documented.

Reclaimed Identity/Innov - Roc: The Innovation Hub + Revitalization Of High Falls, Rochester, Ny, Justin M. Dufresne

Architecture Theses and Projects

This project is not about creating a piece of architecture that will serve as an icon to an idea or movement. Rather, this project is about how a series of smaller architectural interventions can reinforce a context that is already established and has roots that can be traced back to the city’s founding. A series of smaller programs linked together, and to the larger urban context will serve as a means of re-energizing this forgotten district, and re-energizing a city that has been in steady decline for the last several decades. The project must draw on several community partners and …

Architecture For Ruins: How Building New Can Showcase The Old In Barboursville, Va, Alison B. Fredericks

Architecture Theses and Projects

This project will explore the relationships between newly built, contemporary architecture and existing ruins. The product will be an architecture that works with historic preservation to highlight the values of the old and will achieve a stimulating yet respectful design that demonstrates how ruins can be used in modern day settings as a means of bringing people closer to ruins. It will be an architecture that can be used to integrate historic ruins back into their contemporary settings. The focus of this project will be an early nineteenth-century ruin in Barboursville, Virginia that is located on the site of a …

Architecture Of Illusion: An Investigation Into Cinematic Deception In Camden Town, London, Kathryn Klesseck Jan 2014

Architecture Of Illusion: An Investigation Into Cinematic Deception In Camden Town, London, Kathryn Klesseck

Architecture Theses and Projects

This thesis project departs from Guy Debord’s Society of the Spectacle by claiming that architecture temporarily supports a passive acceptance of the environment. Architecture has the ability to confront its own crisis of spectacle by offering a different illusion. This thesis project proposes to create an architectural device through which an illusion can occur that aids in altering the perception of reality and counter the illusion of spectacle described by Debord. The illusion to act as a model for this project will be the cinematic illusion. An architecture of cinematic illusion seeks to question how reality can be perceived through …

Architecture Of Rehabilitation: Rehabilitation And Reinsertion Center For Adolescent Offenders, Patricio Solines Jan 2014

Architecture Of Rehabilitation: Rehabilitation And Reinsertion Center For Adolescent Offenders, Patricio Solines

Architecture Theses and Projects

The proposal for this project is to create a Rehabilitation Center for Adolescent Offenders that offers the possibility to reinsert them back into society as positive individuals.

Despite the deficiency in laws and the lack of an efficient judicial process, the goal for this project is to set an example and demonstrate how, even with those difficulties, adolescents can be rehabilitated and reinserted back into society successfully, leaving their criminal past behind. Eventually, this project aims to become an important contribution for the future generations of Ecuador by being a motivation that leads to the creation of similar centers across …

The Relationship Of Sorority Membership With Body Objectification And Social Pressure In Sorority Women At A Midwestern University, Hannah Elizabeth Tower Jan 2014

The Relationship Of Sorority Membership With Body Objectification And Social Pressure In Sorority Women At A Midwestern University, Hannah Elizabeth Tower

Graduate Research Theses & Dissertations

Body objectification and social pressure are risk factors for developing eating disorders. Currently there is limited research on specific populations like sorority women who are at an increased risk for developing these disorders. This study used Dr. Nita McKinley's Objectified Body Consciousness Scale and the Social Pressure subscale from the Sociocultural Attitudes Towards Appearance Questionnaire-4 to better understand the relationship of sorority membership with body objectification and social pressure. It was found that the longer women were members of a sorority the less body shame they experienced and the longer they lived in a sorority house the less body surveillance, …

Teaching The Health At Every Size® Curriculum To Dietetics Students : A Look At Anti-Fat Attitudes, Amber Marie Rosalez Jan 2014

Teaching The Health At Every Size® Curriculum To Dietetics Students : A Look At Anti-Fat Attitudes, Amber Marie Rosalez

Graduate Research Theses & Dissertations

The purpose of this study was to determine if teaching about the Health At Every Size (HAES) paradigm, using the recently developed HAES curriculum, to dietetics students could decrease anti-fat attitudes, increase knowledge of HAES, improve attitudes and beliefs about HAES and increase self-efficacy for using HAES. Justification for this study includes ample scientific evidence that anti-fat attitudes are pervasive among health care professionals, including Registered Dietitian Nutritionists (RDNs). The aim of this research was to contribute to the literature on possible interventions for preparing dietetics students to work with people of all shapes and sizes without bias.||A pretest/posttest study …
