“Chapter 8: Coastal Effects” In Fourth National Climate Assessment, U.S. Global Change Research Program Jan 2014

“Chapter 8: Coastal Effects” In Fourth National Climate Assessment, U.S. Global Change Research Program

State & Federal Reports and Publications

The Coasts chapter of the Third National Climate Assessment, published in 2014, focused on coastal lifelines at risk, economic disruption, uneven social vulnerability, and vulnerable ecosystems. This Coastal Effects chapter of the Fourth National Climate Assessment updates those themes, with a focus on integrating the socioeconomic and environmental impacts and consequences of a changing climate. Specifically, the chapter builds on the threat of rising sea levels exacerbating tidal and storm surge flooding, the state of coastal ecosystems, and the treatment of social vulnerability by introducing the implications for social equity.

To align with the recommendations set forth by the World Health Organization regarding eHealth, this study aims to develop a concept design of a suitable data warehouse for healthcare using electronic medical recording of ECG-EMG. This concept design once implemented aims to assist health care providers in improving patient’s healthcare data management. The system consists of three main layer: data source layer; software application layer; and data service database layer. The data source layer consists of patient profile, patient consultation, and patient test. Patient test was conducted using Olimex ECG-EMG shield and NI myDAQ module. The software application layer, developed …

Management Processes For Agility, Speed, And Innovation, Stuart Winby, Christopher G. Worley Jan 2014

Management Processes For Agility, Speed, And Innovation, Stuart Winby, Christopher G. Worley

All Faculty Open Access Publications

The new business environment favors innovation and agility: companies that not only execute novel ideas once but do so repeatedly. The ability to generate novel ideas, develop viable products, services, or processes, and drive new value for the corporation is required to sustain organization effectiveness. More broadly, the ability to make timely, effective, and sustained organization change is necessary to thrive in increasingly complex environments. Based on collaborative research and practice through the Center for Effective Organizations, this paper describes the design of agile organizations and a management process that can support continuous innovation with speed and quality. Two case …

Seeking Survival, Justice, And Recovery: Citizen Critics’ Therapeutic Interpretation Of Alice Sebold’S Lucky, Sarah Stone Watt Jan 2014

Seeking Survival, Justice, And Recovery: Citizen Critics’ Therapeutic Interpretation Of Alice Sebold’S Lucky, Sarah Stone Watt

All Faculty Open Access Publications

This essay explores reader reviews of Alice Sebold’s memoir, Lucky, which describes her rape in college while simultaneously employing and confronting dominant rape scripts. Even so, reviews of the memoir on Amazon.com employ a therapeutic interpretation of the story that emphasizes Sebold’s ability to survive, seek justice, and recover. I argue that readers’ reliance on therapeutic rhetoric reinforces the myth that rape is a problem for individual women, rather than society as a whole, and reflects an ongoing barrier to the success of feminist anti-rape efforts.

Confidential Ideas And Independent Contractors: Trade Secret Ownership In The Age Of The Hired Gun, Rob P. Saka Jan 2014

Confidential Ideas And Independent Contractors: Trade Secret Ownership In The Age Of The Hired Gun, Rob P. Saka

UC Law Business Journal

Does an independent contractor or a party hiring the contractor own the new, confidential ideas that fall outside of what the contract or is hired to provide, but that arise during the course of that work? The issue of tradesecret ownership is important due to the growing use of contractors, particularly in the tech development industry. This note explores the emerging issue of trade secret ownership in the post- Great Recession era of increased reliance on contractor-inventors. In concluding that-absenta contrary written agreement- contractor- inventors are the rightful owners of their incidentally created trade secrets while assigned to a project, …

Creating A Culture Of Compliance: Why Departmentalization May Not Be The Answer, Michele Destefano Jan 2014

Creating A Culture Of Compliance: Why Departmentalization May Not Be The Answer, Michele Destefano

UC Law Business Journal

Over the past few decades, as corporate criminal liability rules, sentencing guidelines, and settlement incentives have changed, there has been increased emphasis on and resources devoted to the compliance function at large publicly held companies. In this article, Professor DeStefano traces the development of the compliance function at large corporations and questions the recent mandate by certain governmental entities that malfeasant corporations designate a chief compliance officer and separate the compliance gatekeeping function from the legal department so that this chief compliance officer does not report to the general counsel. She categorizes the types of arguments made for and against …

The Individual Mandate Tax Penalty, Jeffrey H. Kahn Jan 2014

The Individual Mandate Tax Penalty, Jeffrey H. Kahn

University of Michigan Journal of Law Reform

In 2010, President Obama signed legislation that significantly altered the healthcare and health insurance markets in the United States. An integral part of that reform is the individual mandate, a provision that requires individuals to purchase and maintain healthcare insurance. Failure to maintain such coverage subjects an individual to a tax penalty. The Supreme Court upheld the constitutionality of that provision under Congress’s taxing power. Despite the Supreme Court upholding the individual mandate, fundamental questions remain. This Article addresses the question of whether the use of a tax penalty to encourage taxpayers to do something that the government desires is …

Solitary Confinement, Public Safety, And Recdivism, Shira E. Gordon Jan 2014

Solitary Confinement, Public Safety, And Recdivism, Shira E. Gordon

University of Michigan Journal of Law Reform

As of 2005, about 80,000 prisoners were housed in solitary confinement in jails and in state and federal prisons in the United States. Prisoners in solitary confinement are generally housed in a cell for twenty-two to twenty-four hours a day with little human contact or interaction. The number of prisoners held in solitary confinement increased 40 percent between 1995 and 2000, in comparison to the growth in the total prison population of 28 percent. Concurrently, the duration of time that prisoners spend in solitary confinement also increased: nationally, most prisoners in solitary confinement spend more than five years there. The …

Ridding The Law Of Outdated Statutory Exemptions To Antitrust Law: A Proposal For Reform, Anne Mcginnis Jan 2014

Ridding The Law Of Outdated Statutory Exemptions To Antitrust Law: A Proposal For Reform, Anne Mcginnis

University of Michigan Journal of Law Reform

Antitrust law is designed to be an overarching check against anticompetitive conduct that harms the free market system. Almost as soon as the first antitrust laws were enacted in the United States, however, industry groups began lobbying Congress for exemptions from these laws. Most of the statutory exemptions created over the last one hundred years remain in place, despite widespread changes in economic theory, market structures, and overall antitrust law. Today, some exemptions are merely irrelevant, while others actively harm society by transferring wealth to private individuals and hampering beneficial competition. This Note proposes a fourpart legislative solution to rid …
