The March Of Judicial Cosmopolitanism And The Legacy Of Enemy Combatant Case Law, Madalina Lulia Sontrop
The March Of Judicial Cosmopolitanism And The Legacy Of Enemy Combatant Case Law, Madalina Lulia Sontrop
LLM Theses
This thesis explores the concept of judicial cosmopolitanism and its prevalence in enemy combatant case law. The author draws upon the theoretical and philosophical underpinnings of cosmopolitanism and cosmopolitan law to describe judicial cosmopolitanism as form of legal discourse through which judges show a willingness to extend constitutional protections based on a contemporary, functional understanding of sovereign jurisdiction. The purpose of this work is to address the correlation between enemy combatant jurisprudence and the aforementioned understanding of judicial cosmopolitanism. It is argued that a march of judicial cosmopolitanism developed early in enemy combatant cases, and that it came to a …

An Investigation Of The Relationship Between Michigan Department Of Education School Achievement Rankings And School's Percentage Of Economically Disadvantaged Students, Nicholas E. Ceglarek
Master's Theses and Doctoral Dissertations
The primary purpose of this study was to compare the Michigan Department of Education’s (MDE) school ranking system, the Top to Bottom Ranking, to the school’s percentage of economically disadvantaged students as measured by the percentage of free and reduced-price lunch. In addition, finding that a correlation exists, the study sought to identify an alternate method of reporting school effectiveness, taking into consideration the school’s percentage of economically disadvantaged students. Utilizing the current Top to Bottom Ranking system, the Michigan Department of Education assigns an array of requirements, sanctions, and rewards, depending on where a school building ranks. This ranking …

“Muhammad1” is a thoughtful and dedicated youth worker for the local council of a small coastal town in the United Kingdom, where he has been an especially important role model for young refugees from the Horn of Africa, including Sudan and Somalia. Muhammad, a member of Sudan’s dominant Muslim Arab professional class, claimed asylum in the United Kingdom in 1993 along with many other Sudanese.2 After establishing himself professionally, Muhammad applied to the UK Home Office for his wife and four children back in Sudan to join him in the United Kingdom in the late 1990s. Marine biodiversity reaches its pinnacle in the tropical Indo-Pacific region, with high levels of both species richness and endemism, especially in coral reef habitats. While this pattern of biodiversity has been known to biogeographers for centuries, causal mechanisms remain enigmatic. Over the past 20 yrs, genetic markers have been employed by many researchers as a tool to elucidate patterns of biodiversity above and below the species level, as well as to make inferences about the underlying processes of diversification, demographic history, and dispersal. In a quantitative, comparative framework, these data can be synthesized to address questions about this bewildering diversity …

Replacing Myths With Facts: Sex-Selective Abortion Laws In The United States, University Of Chicago Law School - Global Human Rights Clinic, National Asian Pacific American Women’S Forum, Advancing New Standards In Reproductive Health
Global Human Rights Clinic
Sex selection is the practice of attempting to control the sex of one’s offspring in order to achieve a desired sex. One method of sex selection is sex-selective abortion. Laws banning sex-selective abortion are proliferating in the United States. Eight states have enacted laws prohibiting sexselective abortion. Twenty-one states and the federal government have considered such laws since 2009. Those laws prohibit the performance of an abortion if sought based on the sex of the fetus and provide for both criminal and civil penalties in most cases.
A great deal of misinformation exists regarding sex selection in the United States. …

Qualitative Inquiry In An Age Of Educationalese, Gustavo F. Fischman, Adai Tefera
Foundations of Education Publications
In this introduction we reflect on two key questions that initiated this special issue on qualitative inquiry: What can qualitative researchers do to regain their post-paradigm-wars cache? How do we avoid distracting “science wars” in the future? We suggest that the strong tendency to narrow the research methods accepted as “scientific” – because they adopt quantitative perspectives and are presumed a priori to be more rigorous – has created an educationalese, a narrative of rigid categories that has not necessarily contributed to more effective or persuasive educational research. The article ends by suggesting that the use of “knowledge mobilization” strategies …

United States Department of Agriculture, Forest Service / University of Nebraska-Lincoln: Faculty Publications
Climate warming is projected to affect forest water yields but the effects are expected to vary. We investigated how forest type and age affect water yield resilience to climate warming. To answer this question, we examined the variability in historical water yields at long-term experimental catchments across Canada and the United States over 5-year cool and warm periods. Using the theoretical framework of the Budyko curve, we calculated the effects of climate warming on the annual partitioning of precipitation (P) into evapotranspiration (ET) and water yield. Deviation (d) was defined as a catchment’s change in actual ET divided by P …

Rhetoric, Rights, And Pragmatism In The Germanies: Enlightenment Reform In Eighteenth-Century Prussia And Bavaria, Benjamin T. Harris
Mahurin Honors College Capstone Experience/Thesis Projects
This project highlights the nature of Enlightenment reform in 18th-century Germany, particularly in the Kingdom of Prussia and the Electorate of Bavaria under Frederick II and Maximilian III Joseph. Both of these rulers launch similar reforms under the guise of enlightened absolutism and enlightenment rhetoric with very different results, each catering to the specific needs of their respective principalities. Reform is offered along the lines of compulsory education, codification, humanitarian legal reform, and religious toleration, all in the spirit of the Enlightenment. However, when the extent and details of these reforms are examined, it can be demonstrated that …

Judicial Selection In Tennessee: Deciding “The Decider”, Margaret L. Behm, Candi Henry
Belmont Law Review
This article includes an overview of judicial selection in Tennessee, as well as providing the author's personal perspectives on the subject. The quality of judges and the manner of selecting them matters; this is a basic premise underpinning the rule of law in the United States. From the inception of the United States’ democratic system, the judiciary’s Damoclean Sword has been the threat of subrogation at the hands of the Legislature, and perhaps the easiest way to rattle the sword has been to legislatively interfere with judicial selection — whether by changing the manner of appointment or by simply refusing …
Ships That Do Not Sail: Antinauticalism, Antitheatricalism, And Irrationality In Stephen Gosson, Kent Lehnhof
Ships That Do Not Sail: Antinauticalism, Antitheatricalism, And Irrationality In Stephen Gosson, Kent Lehnhof
English Faculty Articles and Research
Stephen Gosson's similes, particularly in 1579's The Schoole of Abuse, commend affective restraint, value stasis over motion, and idealize immobility. Combined with his Platonic mistrust of emotion and his dislike of stage plays for the emotional response they provoke, his criticisms can be seen to express a desire to slow cultural change and social mobility. The effect of this in The Schoole of Abuse is that it deprives objects and agents of their essential identify by removing the action that best defines them, implying that to become our best selves, we must give up the very qualities that define us.

The Mink Framework: Investigating Individual Knowledge Indicators, Mohamed Ragab, Amr Arisha
Conference papers
Purpose – Effective knowledge management (KM) entails knowledge assessment capability to enable identification of knowledge assets and proper governance of value creation dynamics. Although some studies have attempted to use different methods to measure knowledge at the organisational level, few have addressed the individual knowledge holder. The purpose of this paper is to present a state-of-the-art framework, referred to as MinK, that enables organisations to measure individual knowledge in the business context using a novel diversity of indicators.
Design/methodology/approach – The model was developed based on a comprehensive conceptual framework. A pilot study composed of 20 semi- structured interviews elicited …

Morquio A syndrome (mucopolysaccharidosis IVA) is an autosomal recessive disorder that results from deficient activity of the enzyme N-acetylgalactosamine-6-sulfatase (GALNS) due to alterations in the GALNS gene, which causes major skeletal and connective tissue abnormalities and effects on multiple organ systems. The GALNS alterations associated with Morquio A are numerous and heterogeneous, and new alterations are continuously identified. To aid detection and interpretation of GALNS alterations, from previously published research, we provide a comprehensive and up-to-date listing of 277 unique GALNS alterations associated with Morquio A identified from 1,091 published GALNS alleles. In agreement with previous findings, most reported GALNS …

This article will consider a possible avenue for filling 'gaps' when the 1980 Hague Abduction Convention or the 1996 Child Protection Convention do not apply in child custody/abduction cases. Specifically, it will explore utilizing internal US domestic relations law to facilitate the return of a child who has been abducted to the USA from a non-signatory country. To better illustrate the potential effects, the article will explore this 'gap filler' through the lens of a case study involving Japan, the most prominent first world country that is not yet a signatory to the Convention. The article also considers the implications …

Mitigating Milliken? School District Boundary Lines And Desegregation Policy In Four Southern Metropolitan Areas, 1990–2010, Genevieve Siegel-Hawley
Mitigating Milliken? School District Boundary Lines And Desegregation Policy In Four Southern Metropolitan Areas, 1990–2010, Genevieve Siegel-Hawley
Educational Leadership Publications
Over the past half century, law and policy have helped cement tremendous inequities into the structure of our cities. District boundary lines separating multiple, unequal school systems within a single metropolitan (metro) area play a central role in structuring racial and economic isolation. Using data from the National Center for Education Statistics, this study explores how patterns of school segregation are linked to desegregation policy and district boundary arrangements in four southern metro areas. Findings indicate that while city-suburban mergers create far more potential for meaningful school desegregation within a school system, simply eliminating district boundaries is not enough. Corresponding …

This Article explores the significant policy purposes achieved by CAPA through the lens of the law's history and present challenges. Part II reviews the historical context and events leading to the adoption of CAPA in 1984. Part III then describes the present challenges associated with the law due to the failure of Congress and the Treasury Department to rectify the issue of who is an appropriate high-level Treasury official under CAPA. Finally, Part IV concludes with recommended solutions for restoring the law consistent with congressional intent in adopting CAPA-solutions that could easily be achieved through a simple amendment to the …
