Water You Waiting For? Balancing Private Rights And Public Necessity In The South Atlantic Wetlands, Alison Leary
Water You Waiting For? Balancing Private Rights And Public Necessity In The South Atlantic Wetlands, Alison Leary
Washington and Lee Journal of Energy, Climate, and the Environment
A healthy and robust network of wetlands protects coastal communities from storm damage caused by hurricanes. Unfortunately, development pressures threaten wetlands along the South Atlantic coast, the region most susceptible to an increased risk of climate change induced hurricanes. If these wetlands are not protected from destruction, coastal communities will be left without a buffer against flooding, storm damage, and sea level rise. In addition to putting the public at large in physical danger, significant environmental justice concerns accompany the failure to protect coastal wetlands. In order to protect these ever-diminishing resources, federal and state law makers have enacted regulatory …

A Proposed Reconciliation Of Stakeholder Interests In The Ge Soybean Industry And Role Of Earth Jurisprudence Principles, Kristen N. King Jaiven
A Proposed Reconciliation Of Stakeholder Interests In The Ge Soybean Industry And Role Of Earth Jurisprudence Principles, Kristen N. King Jaiven
Florida A & M University Law Review
The historical art of seed saving ensured farmers would have enough quality seeds for the following season. Traditional and indigenous farmers mastered seed saving techniques, saving the healthiest and strongest seeds to ensure preservation of seed diversity and adequate crop yields. To provide adequate protection and meet maximum sustainability for all interested parties, it is essential that laws governing the soybean industry consider the soybean as a stakeholder.

Researching Environmental Justice: A Conversation, Virginia C. Thomas, William W. Lefevre
Library Scholarly Publications
The U.S. Environmental Protection Agency defines environmental justice as “the fair treatment and meaningful involvement of all people regardless of race, color, national origin, or income with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies.” The concerns that arise in this complex environmental context extend beyond the scope of traditional legal research resources to include historical, social, scientific, and governmental documents that reside in unique archival collections.
Through the conversation that follows, senior archivist William LeFevre of the Walter P. Reuther Library shares his experience and insights on how archival resources can provide essential support …

The Experience Of Reducing Environmental Risks In An Environmental Justice Community, Gabriela Dory
The Experience Of Reducing Environmental Risks In An Environmental Justice Community, Gabriela Dory
Dissertations
Research on Environmental Justice (EJ) communities has focused on quantitative assessment of environmental hazards and general physical health problems. Little is known about how individuals living in EJ communities perceive their environmental risks and how they reduce environmental risks. The purpose of the study is to explore and describe the perceived environmental risks and the experience of reducing environmental risk among individuals living in an EJ community.
A qualitative and longitudinal design with a descriptive phenomenological method is used to recruit 23 participants living in a known EJ community in the urban area of New Jersey. A total of 43 …
Socio-Spatial Transformation And Contested Space At The Street Level In Latin America: The Case Of Cali, Colombia, Maria Janeth Mosquera Becerra
Socio-Spatial Transformation And Contested Space At The Street Level In Latin America: The Case Of Cali, Colombia, Maria Janeth Mosquera Becerra
Dissertations and Theses
Since 2008, more than 50% of the world's population has lived in cities and it is projected that by 2050 around 87% will do so. Designing infrastructure in urban spaces has become increasingly critical for achieving human well-being. This dissertation examines socio-spatial transformation processes related to urbanization, economic development and the marginalization of utilitarian cycling in Cali, Colombia, as a particular expression of the struggle for transportation space occurring in urban areas. The research analyzes (a) the socio-spatial processes that have restricted the use of bicycles as a means of transportation in the city of Cali, Colombia; and (b) the …
Building Socialism From Below: Luxemburg, Sears, And The Case Of Occupy Wall Street, Holly Campbell
Building Socialism From Below: Luxemburg, Sears, And The Case Of Occupy Wall Street, Holly Campbell
Social Justice and Community Engagement
For as long as capitalism has existed, people have struggled against it. However, despite the fact that anti-capitalist social movements have won important battles and at times created change, the global capitalist system remains largely intact, ever growing and expanding. How might waves of resistance help pave the way for a different economic and political system— one based upon the principles of accountability, equity, justice, and production for human need? This paper examines how anti-capitalist theories and writings, as well as a radically democratic social movement, can inform visions of a sustainable future that is productive, just, and built upon …
The Executive And The Environment: A Look At The Last Five Governors In New York, Patricia E. Salkin
The Executive And The Environment: A Look At The Last Five Governors In New York, Patricia E. Salkin
Pace Environmental Law Review
Gubernatorial leadership is the single most important indicator of how sustainable New York will be when it comes to issues of environmental protection and conservation. In preparing for the Kerlin Lecture, one of the things that struck me is that New York governors for at least the last thirty years have consistently identified the critical economic, social, and environmental challenges facing this state. Is it simply political rhetoric to decry that the state is in terrible fiscal shape, that programs need to be funded to help those is need, and that we must pay attention to stewarding the environment today …
Green Infrastructure And The Sustainability Concept: A Case Study Of The Greater New Orleans Urban Water Plan, Jessica Fisch
Green Infrastructure And The Sustainability Concept: A Case Study Of The Greater New Orleans Urban Water Plan, Jessica Fisch
LSU New Orleans Theses and Dissertations
Sustainability has been touted as an ideal in city and environmental planning in recent decades, evolving to include environmental, economic, and equity-focused goals. While much has been written about these ideals, it remains unclear how their inherent tensions and challenges affect planning practice. This thesis analyzes these goals as they are perceived and prioritized in The Greater New Orleans Urban Water Plan, a regional water management plan released by Waggonner and Ball Architects in September 2013, utilizing interviews with architects involved in the plan’s development, staff at agencies involved in green infrastructure implementation, and advocacy groups involved in and affected …

A Local Exploration Of Educators’ Perceptions, Collaboration And Usage Of Natural Sites In Introducing The Outdoors To Marginalized Students, Todd Beasley
Theses and Dissertations
A recent trend in social science research has focused on factors that lead to low participation rates by racial groups, specifically the African American population, within outdoor and wilderness settings as a connection to the issue of low participation rates by these same groups in outdoor and environmental careers. Much of the research has relied upon theories that address the marginalization of the African American population in relation to the social context: marginality, subculture/ethnicity, discrimination, acculturation, and opportunity. However, an area of interest that warrants a deeper examination of potential contributing causality is the role of the educator.
The purpose …

Investigating Local Sustainable Environmental Perspectives Of Kenyan Community Members And Teachers, Cassie Quigley, James Dogbey, S Megan Che, Jeffrey Hallo
Publications
Efforts to conserve and preserve the environment in developing or marginalized locales frequently involve a one-way transfer of knowledge and materials from a source in a more developed location. This situation often degenerates into a short-term donor project which risks little to no long-term impacts on local or indigenous relationships with the environment. This research study with educators in Narok, Kenya investigates the current perspectives of local key stakeholders on the environment and sustainability with the purpose of sharing these understandings among local groups to generate a locally constructed meaning of environmental conservation and sustainability. It is the researchers’ aim …

Beyond The Civil Rights Act Of 1964: Confronting Structural Racism In The Workplace, William M. Wiececk, Judy L. Hamilton
Beyond The Civil Rights Act Of 1964: Confronting Structural Racism In The Workplace, William M. Wiececk, Judy L. Hamilton
Louisiana Law Review
Since 1967, sociologists have produced a compelling body of literature on structural racism that explains why severe racial disparities persist throughout American society in all social domains: employment, education, residential patterns, wealth accumulation, and so on. Structural racism perpetuates the effects of past, overt discrimination because it does its work through organizational procedures and social policies that appear to be race neutral. Dealing with structural racism requires us to focus on social structure instead of the intentions of bigoted individuals. In this Article, we link the disciplines of sociology and constitutional history to demonstrate that the U.S. Supreme Court has …
An Empirical Analysis Of The Role Of Geography In Sustainability Education, Makayla Jane Bonney
An Empirical Analysis Of The Role Of Geography In Sustainability Education, Makayla Jane Bonney
Theses
Many within and outside of the discipline of geography see it as a highly appropriate home for sustainability studies. Despite a history of human-environment education within geography and support from professional research or education organizations, some studies show that geography has not developed a lead role in sustainability education. This study examines the role of geography in offering "Sustainability Focused" courses as reported by AASHE STARS institutions with geography programs. The results show that although geography departments are highly utilized when available at an institution -offering the highest proportion of sustainability courses, averaging 14% of "Sustainability Focused" curriculum- there is …

Trends In Environmental Law Scholarship 2008-2013, Michael P. Vandenbergh, Linda K. Breggin, David L. Stabb, Emma T. Doineau
Vanderbilt Law School Faculty Publications
As part of the article selection process each year, Vanderbilt University Law School students assemble and review the environmental law articles published during the previous academic year. In this Article, we draw on the results of the ELPAR article selection process to report on trends in environmental legal scholarship for academic years 2008-2013.
Specifically, this Article reports on the number of environmental law articles published in general law reviews and environmental law journals. We find that although the total varied somewhat from year to year, more than 400 environmental law articles were published each year during the 2008-2013 period. Additionally, …
Using The Spatial Variability Of Lead In Urban Soils And Demographic Variables To Predict Exposure Risks: An Environmental Justice Analysis In Terre Haute, Indiana, Heather A. Foxx
All-Inclusive List of Electronic Theses and Dissertations
Terre Haute, Indiana, is similar to many older cities throughout the United States with a history of manufacturing and industry that relied on extensive road and rail networks. This industrial history has resulted in the presence of over 20 brownfields and even a Superfund Site within the city today. Historic neighborhoods and abundance of pre-1950’s homes is another characteristic of the city. Unfortunately, improper removal and deterioration of lead (Pb) paints, as well as high Pb solder used in gutters, appear to be significant sources of soil Pb in Terre Haute. Despite the fact that most new environmental sources of …
Alternative Ways To Enumerate Data On Race In Puerto Rico: Are Racial Segregation And Spatial Clustering More Evident When Using A Culturally Grounded Methodology?, Reuben Allen
All-Inclusive List of Electronic Theses and Dissertations
Nationalist discourse concerning race in Puerto Rico generally states that residents are of the same racially mixed heritage—a combination of Spanish, West African, and indigenous ancestry of various degrees. However, literature and casual observations suggest that the population is characterized by greater variation in physical appearances than what is posited by “admixture” discourse. Moreover, and further complicating the understanding of race, 2010 U.S. Census data show that over 75 percent of Puerto Ricans self-identified as “White, alone”, and that only 3.3 percent of respondents indicated “Two or More Races.” Researchers, employers, and governmental agencies attempting to address or further analyze …

Climate Change: Threats To Social Welfare And Social Justice Requiring Social Work Intervention, Lauren Caroline Achstatter
Climate Change: Threats To Social Welfare And Social Justice Requiring Social Work Intervention, Lauren Caroline Achstatter
21st Century Social Justice
The article looks at climate change though a social development framework, with emphasis on social justice and social welfare. It evaluates how market-based capitalism continues to contribute to the problem while ignoring the warnings from the scientific community. The article goes on to report that despite the devastation of climate change, concerns – mainly financial in nature - continue to hinder progress towards reform. The article then argues that given the evidence, climate change qualifies as a topic of interest for social workers. The article goes on to advocate for social work involvement highlighting some suggested areas for action.
Social Movements And Framing Decisions: Ecuador's Campaign For The Rights Of Nature, Maria Fernanda Enriquez Szentkiralyi
Social Movements And Framing Decisions: Ecuador's Campaign For The Rights Of Nature, Maria Fernanda Enriquez Szentkiralyi
Doctoral Dissertations
This study investigates why and how social movements frame their campaigns in the ways they do. It explores Ecuador’s environmental movement, which framed its campaign in terms of the rights of nature. This framing decision is intriguing considering the ideological divisions within the movement, the absence of debate over the plausibility of the frame, and the multiple understandings of the meaning and implications of the rights of nature frame. Surprisingly the framing decision proposed by intellectuals within the movement was endorsed by participants without much clash and disputes.
Challenging current explanations of how framing decisions are made, this study complicates …
