The Effects Of Living In A Springboard House During One's First Year At The University Of Northern Iowa, Laura Trettin Jan 2014

The Effects Of Living In A Springboard House During One's First Year At The University Of Northern Iowa, Laura Trettin

Dissertations and Theses @ UNI

This study examines the effects and benefits of college students residing in a Springboard house community at UNI during one’s entire freshmen year. Springboard house communities are unique to the University of Northern Iowa as they provide a living environment in which first-year students can self-select to participate. However, there is no common class that complements the community. In addition, the RAs do not go through any separate training to learn how to work with the springboard house students, but they do offer programming that is geared towards first-year students. This study investigated the freshmen experience by gathering data regarding …

Gender Differences In Self-Concept Consistency And Career Choices Under Stereotype Threat, Asha Ganesan Jan 2014

Gender Differences In Self-Concept Consistency And Career Choices Under Stereotype Threat, Asha Ganesan

Dissertations and Theses @ UNI

Associating careers with a specific gender can lead to women and men turning away from jobs atypical of their gender (e.g., math-related for women and care-related for men). The effects of stereotype threat, defined as the negative impact associated with the fear of confirming negative stereotypes about one’s social group (Steele & Aronson, 1995) on women and men’s working self-concept (a dynamic view of oneself) may provide some insight as to whether genderization of careers can affect women and men at the individual level. The current research examined the role played by gender-related stereotype threat cues in self-concept consistency (SCC). …

Geometric Morphometric Analysis Of Skeletal Shape Variation Across The Pleuronectiformes, Corinthia R. Black Jan 2014

Geometric Morphometric Analysis Of Skeletal Shape Variation Across The Pleuronectiformes, Corinthia R. Black

Dissertations and Theses @ UNI

Pleuronectiformes, commonly called flatfishes, is a large order of highly specialized fishes that display two eyes on one side of the head. Comprised of approximately 716 species, flatfishes share many similar characteristics. However, the complex history of the classification of the group reveals the diversity of shape across the order. This study focused on the diversity of shape across the order by examining skeletal elements. Landmark-based geometric morphometrics was used to visualize shape variation across the order of Pleuronectiformes. A total of 457 specimens were radiographed from collections at the University of Kansas Natural History Museum and the Smithsonian National …

Do Offenders' Life Goals Reflect Locus Of Control And Personality Traits?, Luci L. Dumas Jan 2014

Do Offenders' Life Goals Reflect Locus Of Control And Personality Traits?, Luci L. Dumas

Dissertations and Theses @ UNI

According to the Good Lives Model (Ward, 2002) it is imperative that offenders in rehabilitation recognize which life goals are important to them and how they can achieve a ‘good life.’ Including the evaluation of life goals in treatment can be beneficial not only for the individuals being treated but for the community into which they are transitioning. Seventy-six male, residential offenders were assessed on type and perception of life goals during semi-structured interviews. They also completed a personality inventory, locus of control scale, and self-esteem scale. Hierarchical multiple regression analyses for types of goals and perception of goals were …

The Supreme Court And The Rehabilitative Ideal, Chad W. Flanders Jan 2014

The Supreme Court And The Rehabilitative Ideal, Chad W. Flanders

All Faculty Scholarship

Graham v. Florida was a watershed decision, not least because of the centrality of the so-called “rehabilitativeideal” to its holding that life in prison for juveniles convicted of nonhomicide crimes was cruel and unusual. The Court’s emphasis on rehabilitation was surprising both in terms of the Court’s previous decisions on punishment, in which rehabilitation was barely included as a “purpose of punishment,” but also in terms of the history of academic and legislative skepticism if not hostility toward the idea of rehabilitation (which includes two recently decided sentencing cases, Tapia and Pepper). Courts and commentators have struggled to make sense …

Beyond Instructions To Disregard: When Objections Backfire And Interruptions Distract, Molly J. Walker Wilson, Barbara A. Spellman, Rachel York Jan 2014

Beyond Instructions To Disregard: When Objections Backfire And Interruptions Distract, Molly J. Walker Wilson, Barbara A. Spellman, Rachel York

All Faculty Scholarship

Researchers have proposed many explanations for the replicated finding that jurors often fail to disregard evidence when instructed by a judge to do so. We propose a novel explanation: that the act of objecting may cause the effect because an objection (a) draws attention to the testimony and (b) heightens the perceived importance of the testimony (because of the implication that the objecting party wants to prevent jurors from using it). In previous studies, the act of objecting has always been confounded with the presence of the critical (objected-to) testimony. We devised two new experimental conditions that unconfound these factors. …

When Is A Change Going To Come?: Separate And Unequal Treatment In Health Care Fifty Years After Title Vi Of The Civil Rights Act Of 1964, Ruqaiijah A. Yearby

All Faculty Scholarship

ON June 19, 1963, when the Civil Rights Act was first introduced, President John F. Kennedy said in a message to Congress:

Events of recent weeks have again underlined how deeply our Negro citizens resent the injustice of being arbitrarily denied equal access to those facilities and accommodations, which are otherwise open to the general public. That is a daily insult, which has no place in a country proud of its heritage-- the heritage of the melting pot, of equal rights, of one nation and one people. No one has been barred on account of his race from fighting or …

The New Jim Crow? Recovering The Progressive Origins Of Mass Incarceration, Anders Walker Jan 2014

The New Jim Crow? Recovering The Progressive Origins Of Mass Incarceration, Anders Walker

All Faculty Scholarship

This article revisits the claim that mass incarceration constitutes a new form of racial segregation, or JimCrow. Drawing from historical sources, it demonstrates that proponents of the analogy miss an important commonality between the two phenomena, namely the debt that each owe to progressive and/or liberal politics. Though generally associated with repression and discrimination, both Jim Crow and massincarceration owe their existence in part to enlightened reforms aimed at promoting black interests; albeit with perverse results. Recognizing the aspirational origins of systematic discrimination marks an important facet of comprehending the persistence of racial inequality in the United States.

Immaculate Defamation: The Case Of The Alton Telegraph, Alan M. Weinberger Jan 2014

Immaculate Defamation: The Case Of The Alton Telegraph, Alan M. Weinberger

All Faculty Scholarship

At the confluence of three major rivers, Madison County, Illinois, was also the intersection of the nation’s struggle for a free press and the right of access to appellate review in the historic case of the Alton Telegraph. The newspaper, which helps perpetuate the memory of Elijah Lovejoy, the first martyr to the cause of a free press, found itself on the losing side of the largest judgment for defamation in U.S. history as a result of a story that was never published in the paper—a case of immaculate defamation. Because it could not afford to post an appeal bond …

Rethinking Trademark Functionality As A Question Of Fact, Yvette Joy Liebesman Jan 2014

Rethinking Trademark Functionality As A Question Of Fact, Yvette Joy Liebesman

All Faculty Scholarship

Trade dress functionality stands for a reasonable premise: features which are essential to the use or purpose of an article, which affect the cost or quality of the article, or whose exclusive use would put competitors at a significant non-reputation-related disadvantage, are not protectable as signifiers of source or sponsorship. Functionality has broad implications, as a product’s shape can be its most identifiable feature.

The problems plaguing the functionality doctrine have been examined from a substantive point of view; however until the standard by which functionality is determined is changed, these problems are likely to continue to persist. When adjudicating …

Galifianakis: "First question. In 2013, you pardoned a turkey. What do you have planned for 2014?"

Obama: "We'll probably pardon another turkey". 1

First, let me express my gratitude to the incisive comments of Zach Hoskins and Cara Drinan. I have long been a fan of Hoskins' s work, and his forthcoming book on the collateral consequences of punishment promises to be pathbreaking.2 The influence of Drinan's scholarship on the pardoning power3 is evident in my original essay4 and her newer work on the Graham case has again inspired me in new directions in my research.5 …

Department of Neurology Faculty Papers

Light is a potent stimulus for regulating circadian, hormonal, and behavioral systems. In addition, light therapy is effective for certain affective disorders, sleep problems, and circadian rhythm disruption. These biological and behavioral effects of light are influenced by a distinct photoreceptor in the eye, melanopsin-containing intrinsically photosensitive retinal ganglion cells (ipRGCs), in addition to conventional rods and cones. We summarize the neurophysiology of this newly described sensory pathway and consider implications for the measurement, production, and application of light. A new light-measurement strategy taking account of the complex photoreceptive inputs to these non-visual responses is proposed for use by researchers, …

The Courts And National Security: The Ordeal Of The State Secrets Privilege, David Rudenstine Jan 2014

The Courts And National Security: The Ordeal Of The State Secrets Privilege, David Rudenstine

Articles

The state secrets privilege, originally established in United States v. Reynolds, has evolved into a powerful tool for the Executive to shield actions from judicial scrutiny, undermining the rule of law and constitutional checks and balances. This expansion, driven by judicial deference and circuit court interpretations, now prioritizes national security over accountability, threatening core legal principles. The article argues for reform to balance national security concerns with judicial oversight and individual rights.

A Proposal To Withhold Divorce Decrees On Grounds Of Equity, J. David Bleich Jan 2014

A Proposal To Withhold Divorce Decrees On Grounds Of Equity, J. David Bleich

Articles

Throughout the medieval period, marriage was acknowledged by temporal rulers to be a religious matter governed by the ecclesiastic law of the Church which, to be sure, incorporated many principles of Roman law. Subsequent to the Reformation, the rulers of many European countries became disposed to regard marriage as a civil act, to withdraw marriage from the control of the church and to entrust it entirely to the state. The Napoleonic Code was the first example of a legal system that treated marriage as a purely civil act. The Napoleonic Code did not deny the religious element present in marriage …

Premis-Lite, A Preservation Metadata Generator., Todd P. Swanson

Library Philosophy and Practice (e-journal)

Digital preservation is without question an important, if not essential, facet of our now digital society. Implementing a digital preservation strategy is crucial to ensuring the longevity and sustained usability of digital content. The importance of digital preservation is not limited to large-scale institutions and organizations, but also extends to private individuals and small-scale businesses.

PREMIS is currently the international preservation metadata standard. The objective of PREMIS was to identify and create a wide ranging and implementable set of "core" preservation metadata elements while following the recommendations of the Open Archival Information System (OAIS) reference model. This project seeks to explore and observe differences in RDFa and microdata and their ability to retain proper schematization and syntax when converted back to RDF/XML. Online conversion tools were used to transpose existing RDF/XML files from online data dumps to RDFa and microdata, and then back to RDF/XML, offering some insights into RDFa and microdata’s capabilities, as well as a taste of what may happen in the future if major search engines decide to move away from microdata and developers need to convert to a different semantic markup language. Multiple online converters were employed in the conversion process in …

Immutability And Innateness Arguments About Lesbian, Gay, And Bisexual Rights, Edward Stein Jan 2014

Immutability And Innateness Arguments About Lesbian, Gay, And Bisexual Rights, Edward Stein

Articles

A popular and intuitively plausible argument for the rights of lesbians, gay men and bisexuals (LGB people) focuses on the claim that sexual orientations are inborn and/or unchangeable. This argument draws on three sources: ethical, scientific, and legal. The scientific source is the widely held observation that people generally (and LGB people particularly) do not choose their sexual orientation. This observation is buttressed by claims about the causes and character of human sexuality. The ethical source is the general intuition that people should not be punished for something that they did not choose. Together, these ethical and scientific beliefs lead …
