Visual Merchandising Strategies For Small Businesses, Karen Henry

Apparel Design and Hospitality Management

The sole purpose of this research was to focus specifically on visual merchandising strategies for small apparel stores since little research had been done on these types of stores. Visual merchandising literature to-date left small apparel retailers with little guidelines in deciding which visual merchandising strategies are more appropriate for their operations. This study addressed how participants responded favorably to six visual merchandising strategies (store layout/design, color, lighting, music, fixtures, and window displays) and how applying these strategies may benefit small apparel stores. The results suggest that these six visual merchandising strategies were instrumental with increased purchase intentions, traffic, loyalty, …

Much Obliged: Analyzing The Importance And Impact Of Acknowledgements In Scholarly Communication, Joshua Finnell

Library Philosophy and Practice (e-journal)

Author rights, peer review, open access, and the role of institutional repositories have all come under scrutiny by scholars, librarians, and legal experts in the last decade. Much of the conversation is centered on liberating information from the confinements of legal, financial, and hierarchical restraints. The relevancy of traditional citation analysis too, understood within the framework of an h-Index and Eigen factor, is under scrutiny with the rise of altmetrics. Collectively, these issues form the core of the scholarly communication process, from creation to dissemination to impact. However, an overlooked facet of the scholarly communication process is the acknowledgement. …

The notable American resistance to educated professionalism is explored and placed in its historic, multinational framework. Throughout, the limitations of various theoretical approaches to analyzing professionalism are addressed and more realistic methods of defining professionalism in context are offered. The field of school librarianship is examined as a domain where professionalism and appropriate LIS education are sustained to some degree in law and regulation but face challenges at the system and building level. Expressed preferences of …

Diplomacy And Its Others: The Case Of Comfort Women, Monica E. Eppinger, Karen Knop, Annelise Riles Jan 2014

Diplomacy And Its Others: The Case Of Comfort Women, Monica E. Eppinger, Karen Knop, Annelise Riles

All Faculty Scholarship

The “Comfort Women incident,” now at least several decades old, troubles the familiar view of law as a funnel for politics. Viewed as a funnel, the wide range of legal, political, cultural, and diplomatic efforts to seek or resist redress for the system of sexual slavery institutionalized by the Japanese military during the Second World War would be assessed as ultimately pushing in the same direction: toward vindicating human rights. We see in the Comfort Women incident a far more chaotic interaction of law and politics. As critical legal feminist, we are concerned with finding a truthful and ethical way …

The Supreme Court And The Rehabilitative Ideal, Chad W. Flanders Jan 2014

The Supreme Court And The Rehabilitative Ideal, Chad W. Flanders

All Faculty Scholarship

Graham v. Florida was a watershed decision, not least because of the centrality of the so-called “rehabilitativeideal” to its holding that life in prison for juveniles convicted of nonhomicide crimes was cruel and unusual. The Court’s emphasis on rehabilitation was surprising both in terms of the Court’s previous decisions on punishment, in which rehabilitation was barely included as a “purpose of punishment,” but also in terms of the history of academic and legislative skepticism if not hostility toward the idea of rehabilitation (which includes two recently decided sentencing cases, Tapia and Pepper). Courts and commentators have struggled to make sense …

To Count And Be Counted: A Response To Professor Levinson, Marcia L. Mccormick Jan 2014

To Count And Be Counted: A Response To Professor Levinson, Marcia L. Mccormick

All Faculty Scholarship

This Essay deepens the discussion Professor Levinson began in his lecture for the Richard J. Childress Memorial Lecture at SLU Law, Who Counts?. Professor Levinson explored the question of who counts as a member of the US community, and who gets to decide who counts. Inevitably, given our history of exclusion on the basis of race and sex, questions about belonging and race and sex form a central part of the current debate. Labeling a person with a race and sex presupposes the questions of what makes a person a certain race or sex? This essay explores what identity …

Fictions Of Omniscience, Karen Petroski Jan 2014

Fictions Of Omniscience, Karen Petroski

All Faculty Scholarship

Recent studies of the legislative process have questioned the rationales for many principles of statutory interpretation. One of those traditional rationales is the so-called fiction of legislative omniscience, understood to underpin many judicial approaches to statutory decisions. This Article presents the first comprehensive analysis of judicial assertions about legislative awareness and proposes a new way to understand them. The proposed perspective compares fictions of legislative omniscience with similar but more widely accepted imputations of knowledge in other areas of law; it also draws on recent findings from other disciplines regarding how we use and respond to statements about fictional states …

Ending The Higher Education Sucker Sale: Toward An Expanded Theory Of Tort Liability For Recruitment Deception, Aaron N. Taylor Jan 2014

Ending The Higher Education Sucker Sale: Toward An Expanded Theory Of Tort Liability For Recruitment Deception, Aaron N. Taylor

All Faculty Scholarship

Admissions officers live a dual, often conflicted, existence. In one sense, they are counselors responsible foradvising prospective students. In another sense, they are salespeople with obligations to meet enrollment goals. The pressures fostered by these roles sometimes prompt unscrupulous individuals to use misrepresentations and other forms of deception to induce students to enroll. Unfortunately, students who are induced to enroll based on recruitment deception are afforded few options for redress. The purpose ofthis article is to conceptualize a tort-based solution to this utter inequity. The article proposes a broadening ofnegligent misrepresentation to encompass a new tort-negligent educational recruitment. This tort …

Corporate Social Responsibility And The Multinational Enterprise, Constance Z. Wagner

In this book review, the author critiques Levi’s Children: Coming to Terms with Human Rights in the Global Marketplace by Karl Schoenberger. Schoenberger depicts the struggle by Levi Strauss & Co. to abide by its principles regarding workers’ rights after its decision to relocate some manufacturing operations abroad, an effort that he concludes was ultimately unsuccessful. In exploring this topic, he discusses the human rights issues confronting Levi Strauss & Co. and other U.S. multinationals and the increasing pressure exerted by the public for such companies to operate in a socially responsible manner. Schoenberger’s primary contribution to the growing literature …

Beyond Instructions To Disregard: When Objections Backfire And Interruptions Distract, Molly J. Walker Wilson, Barbara A. Spellman, Rachel York

Researchers have proposed many explanations for the replicated finding that jurors often fail to disregard evidence when instructed by a judge to do so. We propose a novel explanation: that the act of objecting may cause the effect because an objection (a) draws attention to the testimony and (b) heightens the perceived importance of the testimony (because of the implication that the objecting party wants to prevent jurors from using it). In previous studies, the act of objecting has always been confounded with the presence of the critical (objected-to) testimony. We devised two new experimental conditions that unconfound these factors. …
