Beyond One Voice, David H. Moore
Beyond One Voice, David H. Moore
Faculty Scholarship
The one-voice doctrine, a mainstay of U.S. foreign relations jurisprudence, maintains that in its external relations the United States must be able to speak with one voice. The doctrine has been used to answer critical questions about the foreign affairs powers of the President, Congress, the courts, and U.S. states. Notwithstanding its prominence, the one-voice doctrine has received relatively little sustained attention. This Article offers the first comprehensive assessment of the doctrine. The assessment proves fatal.
Despite broad use and value in certain contexts, the one-voice doctrine is fundamentally flawed. The doctrine not only is used to address divergent questions …

A National Investigation Of Pre-Activity Health Screening Procedures In Fitness Facilities: Perspectives From American College Of Sports Medicine Certified Health Fitness Specialists, Aaron C. Craig
USF Tampa Graduate Theses and Dissertations
It is well established in the literature that the morbidity and mortality rates due to chronic diseases such as cardiovascular disease, cancer, hypertension, and diabetes in the U.S are alarmingly high. Likewise, there is ample data which demonstrates that participating in physical activity can help prevent and control many types of chronic diseases. Though the benefits outweigh the risks of participation in physical activity, the risks must be acknowledged.
Published standards and guidelines in the health fitness field have been established to address operational practices of fitness facilities, increase safety of participants and mitigate these risks. The present study was …
Human - Animal Interaction And The Benefits To Mental Health: A Phenomenological Study, Jasmin Jau
Human - Animal Interaction And The Benefits To Mental Health: A Phenomenological Study, Jasmin Jau
Theses : Honours
The prevalence of mental illness is a major concern in Australia and worldwide. It is one of the leading causes of disability in Australia and it is estimated that globally one in four people will experience a mental illness at some point in their life. One of the lesser known therapies and activities in the mental health field are animal assisted interventions that incorporate animals as part of the therapeutic or ameliorative process. Although emerging research literature shows that interaction with animals has positive effects on mental health and wellbeing, it is not clearly understood how and why there are …

Theses : Honours
Elliott Carter’s Eight Pieces for Four Timpani have become integral works in the solo timpani repertoire. They continue to offer technical and musical challenges to both developing and professional players and have influenced the development of the solo timpani genre to date. These pieces contain metric and temporal modulation – musical processes which alter certain performance parameters concerning pulse and subdivision tempi.
This dissertation investigates Carter’s use of metric and temporal modulation in his Eight Pieces for Four Timpani and examines the effects click track application has on the performance of these works. A brief biography of Carter and his …
Explorations In Double-Stops: Three New Pieces For Expanding The Role Of The Double Bass In The Jazz Ensemble, Ashley De Neef
Explorations In Double-Stops: Three New Pieces For Expanding The Role Of The Double Bass In The Jazz Ensemble, Ashley De Neef
Theses : Honours
This dissertation investigates the potential for using double-stops - the sounding of two or more simultaneous notes - as a means for extending the traditional role of the double bass, within compositions for a small jazz ensemble. It is the contention of this dissertation that it is possible to use double-stops to perform a more advanced function within the jazz ensemble, without compromising the double bass’ primary harmonic and rhythmic duties.
A historical overview of the history of the double bass within western classical and jazz music will be provided, as to outline and define what the double bass’ role …

Investigating The Role Of Dachshund Homolog 1 (Dach1) And Mir-200b In Group 4 Medulloblastoma Pathogenesis, Courtney George
Theses : Honours
Medulloblastoma is the most common malignant childhood brain tumour, and the most significant cause of childhood cancer-related mortality. Recently four core molecular medulloblastoma sub-groups have been identified, with distinct pathogenesis and responses to therapies. Current therapies, do not account for this molecular variation, and many patients may receive inappropriate treatment. To address this, targeted therapies for each molecular sub-group would be ideal. Unfortunately, for the more aggressive Group 3 and Group 4 subgroups, the underlying mechanisms of pathogenesis remain poorly understood. The current challenge is to identify the key tumour suppressors or oncogenes involved in Group 3 and Group 4 …

Sex Offenses Under Military Law: Will The Recent Changes In The Uniform Code Of Military Justice (Ucmj) Re-Traumatize Sexual Assault Survivors In The Courtroom?, Lisa M. Schenck
GW Law Faculty Publications & Other Works
In 2013, the President, Secretary of Defense, and members of Congress responded with shock and outrage to perceptions of increased sex assaults committed by military personnel upon other military personnel. Politicians are considering a variety of changes to substantive and procedural criminal law to make prosecution of such offenses more effective. This Article evaluates substantive military criminal law, UCMJ art. 120, 10 U.S.C. § 920, and Military Rules of Evidence 404(a) and 405(c). Drawing on lessons learned from state and federal laws, the Article then makes recommendations regarding statutory changes in military criminal sexual assault and procedural statutes. Specifically, the …
Probate Law Meets The Digital Age, Naomi R. Cahn
Probate Law Meets The Digital Age, Naomi R. Cahn
GW Law Faculty Publications & Other Works
This Article explores the impact of federal law on a state fiduciary’s management of digital assets. It focuses on the lessons from the Stored Communications Act (“SCA”), initially enacted in 1986 as one part of the Electronic Communications Privacy Act. Although Congress designed the SCA to respond to concerns that Internet privacy posed new dilemmas with respect to application of the Fourth Amendment’s privacy protections, the drafters did not explicitly consider how the SCA might affect property management and distribution. The resulting uncertainty affects anyone with an email account.
While existing trusts and estates laws could legitimately be interpreted to …

Why Who Does What Matters: Governmental Design, Agency Performance, The Cfpb And Ppaca, William E. Kovacic

How should the federal government be organized – and who (i.e., which departments, agencies, bureaus, and commissions) should do what? The issue is not new: President James Madison addressedgovernmental organization in his 1812 State of the Union Address, and in the last century, it is the rare President that does not propose to reorganize some part of the federal government. Indeed, on numerous occasions during the past century, virtually every part of the federal government has been repeatedly reorganized and reconfigured. In previous work, we examined the dynamics that influencethe assignment of regulatory duties to an agency, how those dynamics …
Musical Work Copyright For The Era Of Digital Sound Technology: Looking Beyond Composition And Performance, Robert Brauneis
Musical Work Copyright For The Era Of Digital Sound Technology: Looking Beyond Composition And Performance, Robert Brauneis
GW Law Faculty Publications & Other Works
For over 150 years, federal copyright law in the United States reflected and reinforced the model ofmusic as a two-stage art of composition and performance. Copyright protected scores, the stable, visually perceptible result of the deliberative activity of composition. It did not protect performances, theevanescent, unrepeatable, purely aural realizations of scores. Even as protection was extended tomusical sound recordings, copyright law has maintained a strong distinction between composition andperformance. In the last several decades, however, developments in sound technologies and their uses by musicians and listeners have substantially undermined that distinction. Written notation often no longer figures in any stage …
Merger Control Procedures And Institutions: A Comparison Of The Eu And Us Practice, William E. Kovacic
Merger Control Procedures And Institutions: A Comparison Of The Eu And Us Practice, William E. Kovacic
GW Law Faculty Publications & Other Works
The objective of this paper is to discuss and compare the role that different constituencies play in US andEU procedures for merger control. We describe the main constituencies (both internal and external) involved in merger control in both jurisdictions and discuss how a typical merger case would be handled under these procedures. At each stage, we consider how the procedure unfolds, which parties are involved, and how they can affect the procedure. Our discussion reveals a very different ecology. EU andUS procedures differ in terms of their basic design and in terms of the procedures that are naturally associated with …

This essay reviews the Obama Administration’s civil rights record during its first Administration, with a particular focus on theCivil Rights Division of the Department of Justice and the Equal Employment Opportunity Commission (“EEOC”). The review finds that although the Obama Administration has generally been supportive of progressive causes, particularly in the Supreme Court and among issues relating to gay men and lesbians, its enforcement activities have generally been quite limited. On a quantitative basis, the Obama Administration’s civil rights enforcement typically fall at the same or below levels of the prior BushAdministration, and with a few exceptions (mortgage discrimination and …

The European Procurement Directives And The Transatlantic Trade & Investment Partnership (T-Tip): Advancing U.S. - European Trade And Cooperation In Procurement, Christopher R. Yukins
GW Law Faculty Publications & Other Works
Regulatory efforts on both sides of the Atlantic, in anti-corruption and procurement, are become more interdependent, as the two systems, U.S. and European, evolve in parallel. That convergence continued as the European Union finalized its new directives on procurement, and the United States and Europe moved forward in negotiating a comprehensive free trade agreement, the Transatlantic Trade and Investment Partnership (T-TIP), which would (among other things) address barriers to trade in procurement. This piece reviews the T-TIP agreement’s potential impact on procurement, in the near and long term. The European T-TIP negotiators are likely to demand greater access to sub-central …

Over the past few decades, the liberal Justices on the Supreme Court have made their most notable extrajudicial communications about the Constitution in academic venues discussing academic issues. This has limited their appeal to broader audiences. In this Essay -- written for a symposium at Yale Law School on Justice Sotomayor's first five years on the Court -- David Fontana explores the distinctive path that Justice Sotomayor has pursued. Justice Sotomayor has spoken to academic audiences, as past liberal Justices have. What is most notable about JusticeSotomayor, though, is that she has also appeared in locations and addressed issues that …

This article examines a case, United States v. Richards, 719 F.3d 746 (7th Cir. 2013), to illustrate how a prosecutor succeeded in having other act evidence admitted, obtained a conviction, and lost it on appeal. The appellate court ruled that the prosecutor erred in making a propensity argument in violation of Federal Rule of Evidence 404(b).
